this

represents
Mr.
Ben
Murray
where
he
has
been
charged
with
two
counts:
(1)
intent
to
distribute
a
Class
D
drug
and
(2)
possession
of
Class
C
drug.
As
discussed,
our
clients
position
is
that
he
is
categorically
and
unequivocally
innocent
of
the
charges.
Since
our
client
is
innocent
it
is
imperative
that
his
rights
be
protected
by
all
investigating
officers.
In
that
regard
we
respectfully
request

preservation
of
the
following

and
(2.)
request
an
opportunity
to
view
and
copy
these
materials
at
the
very
earliest
possible
convenience:
(1.) All
video/camera
footage
from
the
following
locations:
a. from
police
cruisers,
especially
from
Sgt.
Desserts
cruiser
(Sgt.
Dessert
informed
Mr.
Murray
that
all
interactions
were
being
recorded);
and,
b. from
Sturbridge
Police
Department,
specifically
the
booking
video.
(2.) All
audio
recordings
of
communications
between
dispatch
and
police
and
officers.
(3.) All
audio
recordings
of
any
statements
made
by
Mr.
Murray.
(4.) All
photographs
taken.
(5.) All
handwritten
notes
of
any
investigative
officers
involved.
(6.) All
interdepartmental
memorandum
and
training
documents
regarding
marijuana
possession
law
and
medical
marijuana
law.

(7.) All
training
documents
and
materials
regarding
Sgt.
Desserts
knowledge
of
marijuana
law,
and
related
departmental
polices
and
procedures.
(8.) All
lab
reports
and
analysis,
together
with
the
chain
of
custody
reports,
of
the
testing
done
on
the
hashish,
establishing
that
the
concentration
of
delta-9
tetrahydrocannabinol
in
said
marihuana
exceeds
two
and
one-half
per
cent.
A
similar
letter
regarding
the
records
request
and
preservation
is
being
simultaneously
sent
to
the
three
above-listed
Officers
and
the
Records
Department.
Also,
I
am

to
how

will
be

in
