OPINION
La Asamblea Nacional tiene un plazo según la
Constitución Política vigente hasta el 14 de
Octubre de 2009 para aprobar varias leyes
pendientes, para lo cual ha creado comisiones
especiales a fin de cumplir con el mandato
constitucional, lo que significa que en los
próximos meses tendremos en nuestra
sección de novedad legislativa varias leyes
aprobadas recientemente que analizar y
oportunamente revisaremos su contenido y
las consecuencias por el correr contra reloj de
la Asamblea Nacional.
En esta edición de LEX ECUADOR
presentamos un artículo sobre la
responsabilidad legal de tener un blog en la
web, el cual a través de principios básicos nos
recomienda lo que debemos evitar para ser
sujetos de responsabilidad legal por el
contenido de nuestro blog personal.
Adicionalmente y con el objeto de dar
continuidad del artículo publicado por la Ab.
Verónica Regalado perteneciente a nuestra
firma de abogados, presentamos el artículo
denominado “La Protección al Consumidor”, el
cual ha recibido varios reconocimientos por su
utilidad.
La jurisprudencia de esta edición también
refleja un fallo de triple reiteración que se
convierte en ley, y que precisamente por tal
motivo refleja su importancia en el ámbito
laboral, recomendamos su lectura la cual
estamos seguros será muy ilustrativa y útil
para nuestros suscriptores.
Finalmente en nuestras secciones de novedad
legislativa, presentamos la Ley Orgánica del
Consejo de Participación Ciudadana y Control
Social, así como el análisis del Título V de la
Constitución Política vigente relativo a la

OPINION
According to the Political Constitution in force,
October 14th of 2009 is the deadline the
National Assembly has to approve several
pending laws, for which it has created special
commissions in order to comply with the
constitutional mandate, which means that in
the next months we will have to analyze in our
section of legislative news several laws
recently passed and at the appropriate time
we will review their content and the
consequences of the National Assembly
running against the clock.
In this edition of LEX ECUADOR we present
an article on the legal responsibility of having
a blog in the web, which through basic
principles recommends us what we should
avoid to be subjects of legal responsibility
given the content of our personal blog.
Additionally, and with the purpose of giving
continuity to the article published by Veronica
Regalado, Attorney-at-law who is part of our
law firm, we present the article called
"Consumer Protection ", which has received
various recognitions for its usefulness.
The jurisprudence of this issue also shows a
triple reiteration ruling that becomes law, and
that exactly for such reason reflects its
importance in the labour environment; we
recommend its reading, which we are sure will
be very illustrative and useful for our
subscribers.
Finally in our sections of legislative news, we
present the Basic Law of the Civic
Participation and Social Control Counsel, as
well as the analysis of Title V of the Political
Constitution in force relating to the territorial
organization, rescuing its main changes and

Muchas personas alrededor del mundo usan
los blogs para expresarse, nuestro país no es
la excepción, sin embargo se deberían tomar
en cuenta algunas recomendaciones legales
para no extralimitarnos en nuestras
expresiones y cometer algún delito o
infracción.
Many people worldwide use blogs to express
themselves, our country is not the exception,
nevertheless some legal recommendations
should be taken into account for not exceeding
ourselves in our expressions and commit
some crime or infraction.

INTRODUCCIÓN.- INTRODUCTION.-

Actualmente la gran vitrina para la libertad de
expresión e intercambio de información es el
Internet, el cual ha ayudado a desarrollar en
gran medida una sociedad de la información
global, que comparte y difunde todo tipo de
conocimientos, algunos verdaderos y otros
falsos, algunos beneficiosos y otros
perjudiciales.
Currently, the great showcase for freedom of
speech and exchange of information is the
Internet, which has helped in great measure to
develop a global information society, that
shares and diffuses all kinds of know-how,
some true and other false, some beneficial
and other damaging.

Una de las herramientas que se ha
desarrollado con mayor velocidad en los
últimos años es el blog, el cual sirve para
expresar ideas, comentarios, opiniones, etc.
Si bien el Internet brinda a los autores de
estos blogs un grado de secretismo con
respecto a su identidad, esto no tiene que ser
interpretado como libertinaje para poder hacer
un mal uso de esta herramienta y expresar
opiniones o ideas contrarios a la moral y a las
leyes, o peor aún en contra de determinada
persona o grupo de personas.

offers the authors of these blogs a degree of
excessive secrecy with regard to their identity,
this does not have to be interpreted as
licentiousness to be able to use this tool

contrary to the moral and the laws, or even
worse against determined person or group of
people.

DEFINICIÓN.-
“Un blog, o en español también una bitácora,
es un sitio web periódicamente actualizado
que recopila cronológicamente textos o

conserva siempre la libertad de dejar
publicado lo que crea pertinente. El nombre
bitácora está basado en los cuadernos de
bitácora. Cuadernos de viaje que se utilizaban
en los barcos para relatar el desarrollo del
viaje y que se guardaban en la bitácora.
Aunque el nombre se ha popularizado en los
últimos años a raíz de su utilización en
diferentes ámbitos, el cuaderno de trabajo o
bitácora ha sido utilizado desde siempre.
Este término inglés blog o weblog proviene de
las palabras web y log ('log' en inglés = diario).
El término bitácora, en referencia a los
antiguos cuadernos de bitácora de los barcos,
se utiliza preferentemente cuando el autor
escribe sobre su vida propia como si fuese un
diario, pero publicado en la web (en línea)”.
El blog al ser un espacio de difusión de ideas
e información, se relaciona directamente con
varios conceptos como:
Sociedad de la información.- Ciertamente el
intercambiar ideas, conocimientos, opiniones,
etc, mediante un medio de acceso global
como lo es el Internet, genera que las
personas según sus preferencias y gustos
vayan creando pequeñas o grandes
sociedades de la información.
Propiedad intelectual.- Al ser el blog un
espacio para expresar nuestras ideas o
conocimientos, las mismas por su naturaleza,
al ser un proceso creativo del intelecto
humano, están protegidas por las leyes de
Derechos de Autor, siempre y cuando dichas
ideas sean propias, caso contrario debería
realizarse la respectiva cita.
Libertad de expresión.- Las leyes de la
mayoría de países del mundo
concuerdan en que la libertad de expresión
es un derecho fundamental del ser humano,
sin embargo dicha libertad de expresión

DEFINITION.-
"A blog, or in Spanish also a binnacle, is a
periodically updated website that compiles in
chronological order texts or articles of one or
various authors, appearing first the most
recent one, where the author conserves
always the liberty of leaving published what he
believes pertinent. The name binnacle is
based on logbooks. Logbooks were used in
the ships to relate the development of the trip
and were kept in the binnacle. Although the
name has been popularized in recent years
because of its use in different environments,
the logbook or binnacle has always been
used.
This English term blog or weblog comes from
the words web and log ('log' in English =
diary). The term binnacle, in reference to the
old logbooks of the ships, is utilized preferably
when the author writes over his own life as if it
were a diary, but published in the web (on
line)".
The blog, being a space of diffusion of ideas
and information, is directly related with various
concepts as:
Information society.- Certainly to exchange
ideas, know-how, opinions, etc, through a
means of global access as it is the
Internet, generates that people create
small or large information societies
according to their preferences and
inclinations.
Intellectual Property.- Being the blog a space
to express our ideas or know-how, the
same ones that given their nature,
being a creative process of the human
intellect, are protected by copyright laws,
provided that such ideas are of our own,
otherwise the respective quote should be
made.
Freedom of speech.- The laws of the
majority of countries of the world
agree that freedom of speech is a
fundamental right of the human
being, nevertheless such freedom of speech

opiniones que por ejemplo denigren a una
persona o grupo de personas o que atenten
contra el buen nombre o reputación de
alguien.
EL EDITOR
PUNTOS MÍNIMOS LEGALES.-
Hace algunos días atrás se celebró en todo el
mundo el BlogDay, así que pensando en un
aporte para ese día, he tratado de recopilar
algunos “PMLs” (Puntos Mínimos Legales).
1. El principio básico de la blogosfera y de
la Sociedad de la Información es el
compartir. En este compartir el blog es de los
mecanismos más idóneos. Recuerda que este
compartir está signado por la libertad de
información y de expresión, y también por el
irrestricto respeto por los derechos de otros
(los mismos que se encuentran en la
Declaración Universal de Derechos
Humanos).
2. En el diálogo se encuentra la verdad, y
tienes que ser claro al dar los marcos para
dicho diálogo, en especial en los comentarios
a tus “posts”. Si bien son hechos por terceros,
si tú tienes administración de los mismos,
tienes conocimiento y posiblemente
responsabilidad sobre ellos. Si no los
controlas, debes tener mecanismos de
eliminación en caso de afectación de
derechos de terceros.
3. Tu blog es tuyo, en todo sentido. Los
contenidos que produces son de tu autoría,
aun cuando puedas tener fuentes (las que
debes citar o referenciar). La responsabilidad
de los post es tuya. También son tuyos los
contenidos, así que si no indicas
explícitamente que pueden ser referenciados
o utilizados por terceros, la protección de
derechos de autor los resguarda. Haz una
declaración en algún sitio de tu blog si quieres
que tus contenidos sean o no sean utilizados
por otros, y como quieres que los referencien.

example defame a person or group of people
or that attempt on the good name or reputation
of someone cannot seek protection in the
freedom of speech.
THE EDITOR
MINIMUM LEGAL POINTS.-
Some days ago the BlogDay was celebrated
worldwide; so thinking about a contribution for
that day, I have tried to compile some "PMLs"
(Minimum Legal Points).
1. The basic principle of the blogsphere
and of the Information Society is to share.
In this sharing, the blog is one of the most
suitable mechanisms. Remember that this
sharing is signed by the liberty of information
and expression, and also by the unrestricted
respect of the rights of others (the latter are
found in the Universal Declaration of Human
Rights).
2. The truth is found in the dialogue, and
you have to be clear upon giving the
frameworks for the said dialogue, especially in
the comments to your "posts". Although they
are made by third parties, if you have their
administration, you have the knowledge and
possibly responsibility on them. If you do not
control them, you should have elimination
mechanisms in case they affect third party’s
rights.
3. Your blog is yours, in every sense. The
contents that you produce are of your
authorship, even if you have sources (the
ones that you should quote or refer to). The
responsibility of the post is yours. Also the
contents are yours, so if you do not explicitly
indicate that they can be referred or used by
third parties, they are protected by copyrights.
Make a statement in some place of your blog if
you want your contents to be or not used by
others, and how you want them to quote
them.

4. El Blog de otros es de ellos, así como tus
contenidos son tuyos, los contenidos,
imágenes, videos, marcas, signos, etc, de
otros blogs es de ellos. Muchos indican cómo
utilizar sus contenidos, si debes o no debes
pedir permiso. En caso que no veas una
indicación sobre el mismo escríbele al autor,
pero siempre avísale o referencia de donde
obtuviste una información.
5. Se consciente que aún colocando un
contenido en un país X, si tu contenido
termina afectando a alguien en un país Y, y en
ese país Y las normas jurídicas refieren algo
sobre el tema, puedes verte afectado. La ley
también sirve para protegerse en caso que
otros busquen censurarte.
6. Los datos personales de los que hacen
comentarios debes resguardarlos, no
utilizarlos para spam o para fines diversos que
los de haberse referenciado para hacer un
comentario.
7. Si tu blog es institucional, recuerda que
la responsabilidad es de la institución. Si
es de un negocio recuerda que las reglas de
competencia también le aplican y también las
reglas sobre defensa al consumidor. Sé veraz
en tus posts, que las reglas de defensa al
consumidor y de competencia se te aplican.
8. La Xenofobia, La Discriminación, el
Racismo y la Apología del Terrorismo,
están penados en la mayoría de países, ten
cuidado de que tus comentarios no puedan
ser tomados como tales, puesto que estarías
incurriendo en un delito.
9. Hay usuarios de la red que son menores
de edad, para lo cual te recomendamos que
sigas las pautas del Memorandum sobre la
protección de datos personales y la vida
privada en las redes sociales en Internet, en
particular de niños, niñas y adolescentes.
10. Trata, en la medida de lo posible, de
tener una nota sobre las reglas de tu blog,
de modo tal que todo usuario que lea o haga
comentarios sepa claramente las reglas de
juego del mismo. Esto los protege y te protege
en caso de responsabilidad.

4. The Blog of others is theirs, as well as
your contents are yours, the contents, images,
videos, marks, signs, etc, of other blogs are
theirs. Many indicate how to use their
contents, if you should or should not ask for
permission. In case you do not see an
indication on this, write to the author, but
always notify him or quote from where you
obtained the information.
5. Be conscious that even placing a content
in an X country, if your content ends up
affecting someone in a Y country, and in that
Y country the legal norms refer something to
the theme, you may be affected. The law is
also used as protection in case others seek to
censure you.
6. You should protect the personal data of
the people that make comments, do not use
them for spam or for diverse ends than the
ones of being quoted to make a
comment.
7. If your blog is institutional, remember
that the responsibility is of the institution.
If it is of a business remember that competition
rules also apply to it and also the defence of
the consumer rules. Be truthful in your post
that the rules of defence to the consumer and
of competition apply to you.
8. Xenophobia, Discrimination, Racism
and the Praise of Terrorism are
punished in the majority of countries, be
careful that your comments cannot be taken
as such, since you would be committing a
crime.
9. There are under age network users for
which we recommend you to follow the
guidelines of the Memorandum on the
protection of personal data and private life in
the Net, particularly of children and
adolescents.
10. Try, as possible, to have a note on the
rules of your blog, in such way that every
user that reads or makes comments knows
clearly the rules of the game for it. This
protects them and protects you in case of
responsibility.

11. El Internet no es un espacio sin Ley, le
son aplicables la mayoría de la legislación que
se encuentra en el “mundo físico”. Si bien
antes los jueces tenían resistencia a enfrentar
estos problemas, nuevas generaciones de
jueces, fiscales y abogados, están
demostrando que no son dos mundos
separados sino que le Internet no es más que
un reflejo del mundo no digital.
LOS ACUERDOS DE INTEGRACION
REGIONAL

BREVE HITORIA:
El ALCA es una idea que nace a finales de
1994, con un objetivo claro de reducir o
eliminar las barreras arancelarias que se
habían generado entre todos los países de
América, excepto Cuba; sin embargo, la
inestabilidad de los regímenes de gobierno,
especialmente en Sudamérica, complico las
negociaciones, lo que llevo a que los países,
tomen iniciativas distintas y quizá con no tan
altas expectativas, lo que incluso llevo a los
Estados Unidos, tiempo más adelante, a
iniciar negociaciones con países de manera
individual con la finalidad de firmar un Tratado
de Libre Comercio, de forma bilateral, lo cual,
llevó al rechazo de varios países por
considerarlo un tratado que respondía a las
necesidades de los Estados Unidos, pero que
llevaría a la crisis a los países en desarrollo.
INTRODUCCION: En este artículo,
apreciaremos como el ALCA poco a poco fue
siendo desplazado por los TLC bilaterales o
multilaterales; así como, otro tipo de
alternativas de alianzas económicas han ido
surgiendo en Latinoamérica como el ALBA.
ARGUMENTO:
En noviembre del 2003 en Miami, se
lleva a cabo la reunión preparatoria a la
Cumbre Ministerial, en la cual, “se
hicieron más claras las divergencias
entre las posturas de Brasil y Estados
Unidos”. Principalmente estas divergencias,
tenían mucho que ver por un lado con el tema
del subsidio agrícola que Estados Unidos

REGIONAL INTEGRATION
AGREEMENTS

BRIEF HISTORY:
The FTAA is an idea that is born at the end of
1994, with a clear objective of reducing or
eliminating trade barriers that had been
generated among all the countries of America,
except Cuba; nevertheless, the instability of
the legal systems of the government,
especially in South America, complicated the
negotiations, which led the countries to take
different initiatives and perhaps with not so
high expectations, even the United States,
time ahead, initiate negotiations with countries
in an individual way with the purpose of
signing a bilateral Free Trade Agreement,
which produced the refusal of various
countries for considering it a treaty that
responded to the needs of the United States,
but that would carry the developing countries
to the crisis.
INTRODUCTION:
In this article, we will appreciate how the FTAA
was gradually displaced by the bilateral or
multilateral FTA; as well as other alternatives
of economic alliances have arose in Latin
America, like the ALBA.
POINT OF VIEW:
In November 2003, the preliminary meeting to
the Ministerial Summit is held in Miami, in
which "the divergences between the positions
of Brazil and the United States were made
clear". These divergences had a lot to do,
mainly, with the theme of the agricultural
subsidy that the United Status

esto tendría al competir libremente en un
mercado con precios desiguales, pues, los
países Latinoamericanos, no tendrían la
misma capacidad de subsidiar a sus
productos; y por otro lado, con un propuesta
clara sobre la creación de una legislación que
defienda los intereses comerciales de los
países en vías de desarrollo, esto incluye
aranceles, derechos de compensación y
legislación antidumping.
Estados Unidos, paralelamente había firmado
Tratados de Libre Comercio con países como
Canadá y México; así como, con países
Centroamericanos como Honduras,
Guatemala, Costa Rica entre otros; lo que
obligaba a países que estaban quedando
fuera de este tipo de acuerdos comerciales, a
fomentar nuevas negociaciones que
garanticen el cumplimiento de los derechos de
mercado.
Este tipo de tratados de libre comercio fueron
uno de los motivos por los que el ALCA llegó
al fracaso, pues parecía, que América se
dividía y mientras unos países por medio de
TLC realizaban integración comercial en el
norte, otros países como Venezuela, Bolivia y
Brasil trataban de alinearse al MERCOSUR;
puesto que, Brasil que lideraba el
MERCOSUR anunciaba que estaba dispuesto
a negociar temas como los servicios,
propiedad intelectual o compras
gubernamentales, que eran temas, que los
Estados Unidos no incluían en las
negociaciones de los TLC.
Propiamente, “Un Tratado de Libre Comercio
(TLC), es un acuerdo mediante el cual dos o
más países establecen reglas y two or more countries establish rules

productos, servicios e inversiones.”. Estos
tratados otorgan un nuevo papel al
Estado con respecto a la economía, así como,
nuevos marcos legales, sobre todo en
materia de propiedad intelectual; pero, en
un determinado momento, Brasil planteó
una alternativa para negociar un TLC
con Estados Unidos, la cual consistía
en que los países de América del Sur
negocien en bloque y no individualmente
el acuerdo; sin embargo,

offered to their industry and the effects
that this would have upon competing freely in
a market with uneven prices, since, the Latin-
American countries would not have the same
capacity of subsidizing their products; and, on
the other hand, with a clear proposal on the
creation of a legislation that defends the
commercial interests of the developing
countries, this includes tariffs, rights of
compensation and antidumping
legislation.
The United States, in parallel, had
signed Free Trade Agreements with
countries as Canada and Mexico; as well as
with Central American countries like
Honduras, Guatemala, Costa Rica
among others; which obliged the countries that
were staying out of this type of trade
agreements, to promote new negotiations that
guarantee the accomplishment of the market
rights.
This type of free trade agreements were one
of the motives for which the FTAA failed, since
it seemed that America was divided and while
some countries through FTA carried out
commercial integration in the north, other
countries as Venezuela, Bolivia and Brazil
tried to be aligned to the MERCOSUR; since,
Brazil that headed the MERCOSUR
announced that it was willing to negotiate
subjects like services, intellectual property or
government procurement, that were themes
that the United States did not include in the
negotiations of the FTA.
Accurately, "A Free Trade Agreement (FTA),
is an agreement by means of which
and norms for the free exchange of
products, services and investments".
These treaties offer a new role to the
State with regard to the economy, as
well as new legal frameworks, above all in
the field of intellectual property; but, in
a determined moment, Brazil presented
an alternative to negotiate a FTA with

“b) Fomentar las relaciones de amistad entre
las naciones basadas en el principio de la
igualdad de derechos y en la libre
determinación de los pueblos”.
En el caso mexicano, “El TLCAN ha
beneficiado a unos pocos sectores (como el
de telecomunicaciones) los que se han
enriquecido, mientras que la mayoría de
indígenas, campesinos, trabajadores,
artesanos, etc. se han empobrecido.”
Finalmente no podemos negar la importancia
que el mercado norteamericano tiene para
nuestros países, el problema es el costo que
estos países estén dispuestos a pagar por
acceder a este mercado.
Ahora bien, Venezuela y Bolivia son los
principales países sudamericanos que no
comparten la idea de involucrarse en un TLC
por las políticas con las que Estados Unidos
desea imponerse por sobre los demás países
en vías de desarrollo; adicionalmente, la idea
inicial del ALCA de no contar con Cuba para
el acuerdo de integración llevó a Venezuela a
impulsar la Alternativa Bolivariana para
Latinoamérica y el Caribe (ALBA), el cual es
un acuerdo de integración en materia
económica y de comercio pero que tiene
como objetivo primordial, impulsar el
desarrollo y la integración de los países
pobres en América Latina y el Caribe, siempre
tomando en cuenta, los tintes de izquierda
que tienen los gobiernos que actualmente han
decidido ser parte del ALBA, entre ellos,
Venezuela, Cuba, Ecuador, Honduras, entre
otros.

and respond with certain autonomy to the

This idea seeks to accomplish a clear
objective, that is to compare the conditions of
the countries that participate of a possible
FTA, which at the same time, and perhaps
without giving greater importance, have left
sideways one of the fundamental purposes of
the Charter of the United Nations, which is:
"b) To develop friendly relations among
nations based on respect for the principle of
equal rights and self-determination of
peoples ".
In the Mexican case, "The NAFTA
has benefited a few sectors (as
that of telecommunications) which has
enriched, while the majority of natives,
country persons, workers, artisans, etc.
have impoverished." Finally we cannot
deny the importance that the North
American market has for our countries; the
problem is the cost that these countries are
willing to pay to access to this
market.
Now, Venezuela and Bolivia are the main
South American countries that do not
share the idea to be involved in a FTA
given the policies that the United States
desire to impose on other developing
countries; additionally, the initial idea
of the FTAA of not including Cuba for the
integration agreement led Venezuela to
prompt the Bolivarian Alternative for
Latin America and the Caribbean (ALBA),
which is an integration agreement in economic
and trade matters but that has as a
fundamental objective, to promote the
development and the integration of the poor
countries in Latin America and the Caribbean,
always taking into account, the left-wing
tendency that the governments that at present
have decided to be part of the ALBA have,
among them, Venezuela, Cuba, Ecuador,
Honduras, among others.

El hecho de que Ecuador haya decidido ser
parte del ALBA y no firmar un TLC con
Estados Unidos nos permitiría concluir que las
condiciones sociales, políticas y económicas
de este acuerdo se condicionan de mejor
manera para la realidad ecuatoriana, para lo
cual se prevé, un mejoramiento del mercado
local así como mejores ingresos para las
arcas del Estado.
Sin duda alguna la iniciativa venezolana de
impulsar el ALBA genera también algún tipo
de integración, lo que podría ser herencia
propia del ALCA, pues tal como lo mencioné
en la introducción del presente artículo, si bien
es cierto el ALCA no se llegó a consolidar, a
partir de este se avizoraron posibles alianzas
e integraciones entre los países de
Latinoamérica; lamentablemente, estas
alianzas han sido en segmentos fragmentados
como el MERCOSUR, NAFTA, CAFTA y
finalmente el ALBA, sin conseguir aún el
propósito inicial de toda una América unida.
CONCLUSIONES:
Si bien es cierto cualquier tipo de acuerdos
comerciales a nivel internacional podría ser
positivo para los fines de desarrollo del
Ecuador, no es menos cierto, que los mismos
podrían traer consecuencias no beneficiosas
para el país y no necesariamente en materia
económica.
Independientemente de las consecuencias
que pueda tener este tipo de tratados,
“expertos aseguran que siempre será
beneficioso para el Ecuador ser parte de
acuerdos de integración como el ALBA, pues
no solo beneficiaría a la economía
ecuatoriana ya que el ALBA no es solo un
tratado económico sino que también impulsa
la integración en materias sociales como
salud, educación, cultura, etc.”
Considero que el Ecuador no se encuentra en
condiciones políticas, sociales y económicas,
lo suficientemente sólidas como para ser parte
de un TLC con Estados Unidos; pero, creo
que es acertada la decisión de ser parte del
ALBA, ya que, los países que integran esta
Alternativa Bolivariana para la América Latina

The fact that Ecuador has decided to be part
of the ALBA and not sign a FTA with the
United States would allow us to conclude that
the economic, political, and social conditions
of this agreement are conditioned in a better
way for the Ecuadorian reality, for which it is
foreseen an improvement of the local market
as well as better incomes for the State
treasury.
Without any doubt, the Venezuelan initiative to
promote the ALBA generates also some type
of integration, which could be legacy of the
FTAA because, as I mentioned in the
introduction of the present article, though it is
certain the FTAA did not consolidate, from this
possible alliances and integrations among the
Latin America countries were foreseen;
sorrowfully, these alliances have been made
in fragmented segments as MERCOSUR,
NAFTA, CAFTA and finally the ALBA, without
obtaining still the initial purpose of a whole
united America.
CONCLUSIONS:
Although it is true that any type of trade
agreement to international level could be
positive for the development ends of Ecuador,
it is not less certain, that the same would be
able to bring non-beneficial consequences for
the country and not necessarily in economic
matter.
Independently of the consequences
that this type of treaties can have,
"experts assure that it will always be
beneficial for Ecuador to be part of integration
agreements as the ALBA, because it would
not only benefit the Ecuadorian economy,
since the ALBA is not only an economic treaty,
but it also promotes the integration in
social matters like health, education, culture,
etc."
I consider that Ecuador has not the economic,
social, and political conditions, sufficiently
solid as to be part of a FTA with the United
States; but, I believe that it is a wise decision
to be part of the ALBA, since, the countries
that integrate this Bolivarian Alternative for the
Latin America

LA PROTECCION AL CONSUMIDOR

A continuación, la segunda parte del artículo
denominado “La Protección al Consumidor”:
La obligación de “Seguridad” de los bienes
y servicios ofertados.-
Un elemento muy importante dentro de la
protección al consumidor es el tema de la
seguridad, entendiéndose que las empresas
que participan en el mercado deben ofrecer
bienes y servicios seguros, es decir que
deben ser entregados al cliente de tal forma
que en condiciones normales de uso, no
presenten ningún peligro para la salud o la
integridad física de los consumidores.
En cuanto la salud e integridad física del
consumidor, es necesario tomar en cuenta
que en el Ecuador la protección a los
consumidores no se refiere únicamente a los
intereses económicos de este, sino también a
la protección de su salud, e integridad física al
ser estos valores absolutos, “de modo que
aunque no se hubiera dispuesto su protección
en estas normas los consumidores y usuarios
estarían protegidos en la misma medida por
otras leyes dictadas sobre la materia”.1
El hecho de que se incluyan normas
protectivas a la salud e integridad física del
consumidor, se fundamentan en la realización
de una tutela preventiva de ambas, con el
objeto de disminuir los riesgos que el producto
puede causar al consumidor, y a su vez
incluyendo y determinando en la misma
legislación el derecho a la reparación del daño
que se pueda producir, y por ende haciendo
este derecho tan exigible como cualquier
derecho que pueda nacer de una afectación
económica.
En la legislación ecuatoriana el tema de la
seguridad es de suma importancia, pues
existe la obligación del proveedor de informar

CONSUMER PROTECTION

Next, the second part of the article titled
“Consumer Protection”:
Mandatory “Safety” in offered goods and
services.-
A very important element within consumer
protection is the safety matter, understanding
that the businesses that participate in the
market should offer safe goods and services,
that means the latter should be delivered to
the client in such a way that in normal
conditions of use, they would not jeopardize
the health or physical integrity of the
consumers.
As for the health and physical integrity of the
consumer, it is necessary to take into account
that consumer’s protection in Ecuador does
not refer only to their economic interests, but
also to the protection of their health and
physical integrity, since these are absolute
values, “so even if their protection was not
provided in these norms, consumers and
users would be protected in the same extent
by other laws given on the subject”2.
The fact of including norms that protect health
and physical integrity of the consumer is
based on the fulfillment of a preventive
protection of both with the purpose of
diminishing the risks that the product may
cause to the consumer; and, at the same time,
including and establishing within the same
legislation the right to recover damages that
can be produced, and therefore making this
right as accessible as any right that can arise
from an economic affectation.
In the Ecuadorian legislation, the
safety matter is extremely important, as
the suppliers are compelled to inform,

mediante instructivos, advertencias o by means of instruction manuals, warnings or
indicaciones los riesgos que podría ocasionar
el producto ofertado, mientras que para el
caso de servicios riesgosos, se ordena a los
proveedores del servicio el adoptar las
medidas que resulten necesarias para que el
servicio se preste en adecuadas condiciones
de seguridad, informando al usuario de las
medidas preventivas que deban usarse.
Condiciones de protección al consumidor
en la Legislación Ecuatoriana.-
La legislación ecuatoriana define al
Consumidor como “toda persona natural o
jurídica que como destinatario final adquiera
utilice o disfrute de bienes o servicios, o bien
reciba oferta para ello”, y en base a este
concepto regula varios puntos afines, siendo
los más importantes los relacionados con los
contratos de adhesión, especulación,
información básica comercial, oferta,
proveedores, publicidad, servicios públicos
domiciliarios, distribuidores o comerciantes,
productores o fabricantes, importadores,
prestadores, entre otras.
De acuerdo al Plan Nacional de Derechos
Humanos del Ecuador, en el país no existe
una masa de consumidores conscientes de
sus derechos, ni tampoco un sector productivo
y comercial preparado para ofrecer bienes y
servicios de calidad, y a su vez el Estado no
esta provisto de mecanismos suficientes para
controlar los desequilibrios entre ambos
sectores.
En el Ecuador la primera ley que trataba
temas de Derecho del Consumidor, fue
expedida el 12 de septiembre de 1990, sin
embargo esta se volvió inoperante e
inaplicable pues atribuía competencias para
su ejecución a diversos organismos, dando
como resultado que ninguno de ellos asuma
en la práctica las funciones de proteger los
derechos de consumidores y usuarios, en
función de lo cual fue derogada en el año
2000.
En la Constitución de 1996, se
procuró dar un paso frente a la
defensa de los derechos del consumidor,

measures as deemed necessary for the
service to be rendered in adequate safety
conditions, informing the user about the
preventive measures that should be taken.
Consumer protection conditions in the
Ecuadorian Legislation.-
The Ecuadorian legislation defines the
Consumer as “every natural or legal person
that acquires, uses or enjoys goods or
services, or receives offers for that as final
addressee”, and based on this concept it rules
several related points, being the most
important those related to adhesion contracts,
speculation, basic commercial information,
supply, suppliers, advertising, home public
services, distributors or merchants, producers
or manufacturers, importers, lenders, among
others.
According to the Ecuadorian National Plan of
Human Rights, in the country there is not a
group of consumers aware of their rights,
neither a productive and commercial sector
prepared to offer quality goods and services;
and, at the same time, the State is not
provided with enough mechanisms to control
the inequity among both sectors.
In Ecuador, the first law that dealt with
Consumer Rights matters was sent off on
September 12th, 1990; nevertheless, this
became inoperable and inapplicable because
it attributed competences for its execution to
diverse agencies, causing that in practice
none of them assume the functions to protect
consumer rights, subsequently it was
abrogated in the year 2000.
In the 1996 Constitution, they tried
to move a step forward on the
defense of the consumer rights since

calidad, el concepto de publicidad,
organización ciudadana, mecanismos de
protección, etc.
Dada la protección existente en la
Constitución de 1998, el Congreso Nacional
en Coordinación con la Defensoría del Pueblo
y la Tribuna Ecuatoriana de Consumidores y
Usuarios, promulgó la actual Ley Orgánica de
Defensa del Consumidor, la misma que fue
aprobada el 10 de Julio del año 2000 y que
como ya mencionamos abarca conceptos
importantes para promover la protección al
consumidor, además de establecer los
mecanismos para la exigibilidad de estos
derechos.
La Constitución de la República del Ecuador,
en su Art. 52, dispone que las personas tienen
derecho a disponer de bienes y servicios de
óptima calidad y a elegirlos con libertad, así
como a una información precisa y no
engañosa sobre su contenido y and not deceitful information on their
características. El inciso segundo de este
artículo dispone que la ley establecerá los
mecanismos de control de calidad y
procedimientos de defensa de los
consumidores; y las sanciones por
vulneración de estos derechos, la
reparación e indemnización por deficiencias,
daños o mala calidad de bienes y
servicios, y por la interrupción de los
servicios públicos que no fuera ocasionada
por caso fortuito o fuerza mayor.

consumer and where some fundamental rights
were established, for example, to offer an
optimum quality service, the concept of

mechanisms, etc.
Due to the protection provided in the 1998
Constitution, the National Congress, in
coordination with the Ombudsman’s Office
and the Ecuadorian Consumers and Users
Tribune, enacted the current Basic Law of
Consumer Defense, the same one that was
passed on July 10, 2000 and that, as we
already mentioned, covers important concepts
to promote consumer protection, as well as for
establishing the enforceability mechanisms for
these rights.
The Constitution of the Republic of
Ecuador foresees, in its Art. 52, that
people have the right to have optimum
quality goods and services and to select
them freely, in addition to accurate
content and characteristics. The second
paragraph of this article provides that
that the law will establish the mechanisms
of quality control and procedures of
consumers defense; and, the punishments
for violation of these rights, the recovery
and compensation of deficiencies,
damages or poor quality of goods and
services, and of interruption of public services
not caused by acts of nature or force
majeure.

medidas que resultaren necesarias

adecuadas condiciones de seguridad,

pudieren verse afectados por tales

que deban usarse.
Otro punto tratado en legislación
ecuatoriana al “Derecho de
Devolución”, como el medio que tiene
el consumidor que adquiera bienes o
servicios por teléfono, catálogo,
televisión, Internet o a domicilio, de
devolver el bien adquirido dentro de
los tres días posteriores a la recepción
del bien o servicio.

el establecimiento de Asociaciones de
Consumidores, como toda
organización constituida por personas
naturales o jurídicas, independientes
de todo interés económico, comercial,

garantizar y procurar la protección y la
defensa de los derechos e intereses
de los consumidores; así como,
promover la información, educación,
representación y el respeto de los
mismos.
A este tipo de organizaciones para
funcionar, además de las
características enumeradas
anteriormente, se les exige la
obtención de su personería jurídica en
el Ministerio de Bienestar Social;
conformarse con un número no menor
a cincuenta miembros; no incluir como
asociados a personas jurídicas que se
dediquen a actividades comerciales y
mantenerse al margen de estas; no
perseguir fines de lucro, no aceptar
anuncios de carácter comercial en sus
publicaciones y no realizar una
explotación comercial selectiva en la
información y consejos que ofrezcan
al consumidor.

PRESCRIPCION EXTINTIVA DEL
DERECHO DEL TRABAJADOR A
RECLAMAR SOBRE EL CAMBIO DE
OCUPACION
Existen fallos de triple reiteración respecto de
la prescripción extintiva del derecho del
trabajador a reclamar sobre el cambio de
ocupación.
Si por orden del empleador un trabajador
fuere cambiado de ocupación actual sin su
consentimiento, se tendrá esta orden como
despido intempestivo, aún cuando no implique
mengua de remuneración o categoría,
siempre que lo reclamare el trabajador dentro
de los SESENTA (60) días siguientes a la
orden del empleador. Es necesario, conforme
se ha manifestado, que frente a tal actitud
medie la reclamación en oposición del
trabajador dentro del plazo estipulado. Pues
bien, si el trabajador no realiza su reclamo
dentro del plazo antes referido, se entiende
como aceptado el cambio.
Si dentro de un proceso judicial por despido
intempestivo por cambio de ocupación o
cargo, no aparece la reclamación del
trabajador, no obstante que en la demanda y
en otras oportunidades el actor lo invoque,
pero sin precisar los términos ni la fecha en
que la misma se dio y sin probarla, se
entiende entonces que hasta ese momento se
convenía con el cambio.

EXTINCTIVE PRESCRIPTION OF
THE RIGHT OF THE WORKER TO
CLAIM A CHANGE OF
OCCUPATION
There exist triple reiteration rulings regarding
the extinctive prescription of the right of
the worker to claim a change of
occupation.
If a worker were changed by order of the
employer of his current occupation without his
consent, this order will be considered as
wrongful dismissal, even when it does not
imply decline of remuneration or category, if
this is claimed by the worker within the SIXTY
(60) days that followed the order of the
employer. It is necessary that, in agreement
to the established, before such attitude
mediates the claim in opposition of the worker
within the stipulated time limit. Therefore, if
the worker does not carry out his claim in the
before mentioned time limit, the change is
understood as accepted.
If within a judicial process of wrongful
dismissal by change of occupation or post,
there is no claim of the worker, despite that in
the lawsuit and in other opportunities the
actor invokes it, but without specifying the
terms neither the date in which it took place
and without proving it, it is understood
then that to that moment the change was
agreed.

En esta ocasión analizaremos el Título V de la

provincias y cantones tendrán facultades
legislativas en el ámbito de sus competencias
y jurisdicciones territoriales. Las juntas
parroquiales rurales tendrán facultades
reglamentarias.
3. El Estado se organiza territorialmente en
regiones, provincias, cantones y parroquias
rurales. Los regímenes especiales se pueden
constituir por razones ambientales, étnico
culturales o de población.
4. Dos o más regiones, provincias, cantones o
parroquias contiguas podrán agruparse y
formar mancomunidades, con la finalidad de
mejorar la gestión de sus competencias y
favorecer procesos de integración.

TERRITORIAL ORGANIZATION OF
THE STATE
This time, we will analyze Title V of the current
former Title XI of the 1998 Constitution,
establishes various changes of territorial
organization according to what we will see
next in this edition of our gazette; next time we
will review the competences the current
Constitution establishes for each type of
autonomous, decentralized
government:
1. Among the general principles, the
current Constitution recognizes the parish
boards, cantonal councils, metropolitan
councils, provincial counsels and regional
counsels as autonomous, decentralized
governments.
2. The autonomous, decentralized
governments of regions, metropolitan districts,
provinces and cantons will have legislative
faculties within the scope of their territorial
competences and jurisdictions. The parish
boards will have regulatory
faculties.
3. The State is geographically organized in
regions, provinces, cantons and parishes.
The special states can be constituted by
environmental, ethnic, cultural or population
grounds.
4. Two or more adjacent regions, provinces,
cantons or parishes will be able to form
groups, with the purpose of improving the
management of their competences and to
favor integration processes.

5. Dos o más provincias con continuidad
territorial, superficie regional mayor a 20.000
km2 y un número de habitantes que en
conjunto sea superior al 5% de la población
nacional, formarán regiones autónomas de
acuerdo con la ley. La iniciativa para la
conformación de una región autónoma
corresponde a los gobiernos provinciales,
quienes elaborarán un proyecto de ley y el
respectivo proyecto de estatuto de autonomía
regional para aprobación de la Asamblea
Nacional y Corte Constitucional
respectivamente. Con el dictamen favorable
de la Corte Constitucional y la aprobación del
proyecto de ley orgánica, se convocará a
consulta popular a las provincias que
formarán la región.
Si la consulta se aprueba por mayoría de
votos válidos entra en vigencia la ley y
estatuto y se convoca a elecciones regionales
en los siguientes 45 días.
6. El cantón o conjunto de cantones contiguos
en los que existan conurbaciones, con un
número de habitantes mayor al 7% de la
población nacional podrán constituir un
Distrito Metropolitano. El proceso será igual al
de las regiones.
7. La provincia de Galápagos tendrá un
gobierno de régimen especial. Su
administración estará a cargo de un Consejo
de Gobierno presidido por el representante de
la Presidencia de la República e integrado por
alcaldes de los municipios de la provincia, los
representantes de juntas parroquiales y los
demás que determine la ley.
