A Bill to amend the Boilers and Pressure Vessels Ordinance 2002. P, -./l +, -hereas it is e.#edient to amend the Boilers and Pressure /essels 0rdinance 2 %1223 of 2 2& for #ur#oses hereinafter a##earing4 3t is enacted as follows)* 2

1. S0o,1 1"1l -23 4o.. 24 . 21+, %!& This Act may be cited as the Punjab Boilers and Pressure /essels %Amendment& Act 2 !"+ %2& 3t shall come into force at once+ 2. A. 23. 21# "2 10 O,3"2-24 C55I o* 2002 +, 3n the Boilers and Pressure /essels 0rdinance 2 2 %1223 of 2 2&, hereinafter referred to as the said 0rdinance, %a& for the words 5Federal 6overnment7, wherever occur, the word 56overnment7 shall be substituted4 and %b& for the words 5Provincial 6overnment7, wherever occur, the word 56overnment7 shall be substituted+ 3. A. 23. 21 "2 # 41"o2 1 o* 10 O,3"2-24 C55I o* 2002+, 3n the said 0rdinance, in section !, in sub*section %2&, for the word 5Pa8istan7, the words 5the Punjab7 shall be substituted+ 6. A. 23. 21 "2 # 41"o2 2 o* 10 O,3"2-24 C55I o* 2002+, 3n the said 0rdinance, in section 2, in sub*section %!&, %a& in clause %c&, for the word 5Federal7, the word 5Punjab7 shall be substituted4 %b& for clause %f&, the following shall be substituted) 5%f& 59e#artment7 means the 3ndustries 9e#artment of the 6overnment charged with the enforcement of this 0rdinance474 and %c& after clause %h&, the following clause %hh& shall be inserted) 5%hh& 56overnment7 means 6overnment of the Punjab47+ %. A. 23. 21 "2 # 41"o2 3 o* 10 O,3"2-24 C55I o* 2002 +, 3n the said 0rdinance, for section ", the following shall be substituted)* 53. L"."1-1"o2 o* -77l"4-1"o2 o* 10"# O,3"2-24 +, %!& :othing in this 0rdinance shall a##ly to, %a& any boiler in any steamshi# or in any mechanically #ro#elled vessel4 %b& any boiler a##ertaining to a sterili;er or disinfector and the li8e used in hos#itals, hotels, laboratories and other industries etc, if it does not e.ceed ninety one liters in ca#acity4 %c& any boiler used in relation to the nuclear energy4 and %d& any boiler or steam*#i#e, belonging to or under the control of railway+ %2& The 6overnment may, by notification in the official 6a;ette and for reasons to be recorded in writing, declare that #rovisions of this 0rdinance shall not a##ly in the case of any s#ecified class of boilers or steam*#i#es+7

A. 23. 21 "2 # 41"o2 6 o* 10 O,3"2-24 C55I o* 2002+, 3n the said 0rdinance, in section 6, for clause %b&, the following shall be substituted) 5%b& in case of any boiler which has been transferred from another Province or territory until it is registered under this 0rdinance47 ). A. 23. 21 "2 # 41"o2 10 o* 10 O,3"2-24 C55I o* 2002 +, 3n the said 0rdinance, in section ! , in sub*section %2&, for the words 5a Federal emergency7, the words 5an emergency7 shall be substituted+ 8. A. 23. 21 "2 # 41"o2 2% o* 10 O,3"2-24 C55I o* 2002 +, 3n the said 0rdinance, for section 2<, the following shall be substituted)* 52%. Pu29-/ Bo"l , -23 P, ##u, V ## l# S-* 1y Bo-,3 +,%!& The 6overnment shall constitute a Board to be called the Provincial Boilers and Pressure /essels =afety Board for the #ur#oses of this 0rdinance which shall consist of the following members)* %a& 9irector 3ndustries of the 6overnment who shall be the 1hair#erson of the Board4 %b& an officer not below the ran8 of 9e#uty =ecretary of the 9e#artment4 %c& 1hief 3ns#ector and two 9e#uty 1hief 3ns#ectors nominated by the 6overnment4 1hief 3ns#ector shall be the =ecretary of the Board4 %d& one member to be nominated by the >ahore 1hamber of 1ommerce and 3ndustry4 %e& two members from the manufacturers of boilers and #ressure vessels to be nominated by the 6overnment4 %f& two members from users of boilers and #ressure vessels to be nominated by the 6overnment4 and %g& one member from the insurance com#anies to be nominated by the 6overnment+ %2& The Board may regulate its own #rocedure and the conduct of business to be transacted by it, the constitution of committees and sub*committees of members and the delegation to them of any of the #owers and functions of the Board+7 (. A3 0o4 T 402"4-l Co.."11 +,%!& The 6overnment shall constitute a committee to be called the Ad hoc Technical 1ommittee to e.ecute assignments advised by the Board+ %2& The Ad hoc Technical 1ommittee shall consist of the following members)* %a& 1hair#erson to be nominated by the 6overnment on the advice of the Board4 %b& one 9e#uty 9irector from the 9irectorate of 3ndustries of the 6overnment4 %c& one member to be nominated by the >ahore 1hamber of 1ommerce and 3ndustry4 %d& one member from the manufacturers of boilers and #ressure vessels to be nominated by the 6overnment4 %e& one member from insurance com#anies to be nominated by the Board4 %f& one member from users of boiler and #ressure vessels to be nominated by the 6overnment4 and %g& 1hief 3ns#ector who shall be the =ecretary of the 1ommittee+7 10. A. 23. 21 "2 # 41"o2 2) o* 10 O,3"2-24 C55I o* 2002 +, 3n the said 0rdinance, for section 2(, the following shall be substituted)* 52). F"ll"2! o* :-4-24" #+,The 6overnment shall, as soon as #ossible, fill any vacancy occurring in the Board or Ad hoc Technical 1ommittee in accordance with the #rovisions of section 2< or section 26+7 11. A77l"4-1"o2 o* 10 O,3"2-24 1o 10 ;o: ,2. 21# +, =ave as otherwise e.#ressly #rovided, this 0rdinance shall be a##licable to boilers and #ressure vessels belonging to the 6overnment, Federal 6overnment, local government or any other Provincial 6overnment+7 STATEMENT OF OBJECTS AN+ REASONS The subject of boilers was s#ecifically mentioned at serial :o+ 2$ of the re#ealed 1oncurrent >egislative >ist+ After the omission of this subject from the Fourth =chedule of the 1onstitution, the Boilers and Pressure /essels 0rdinance 2 2 has devolved on the Provinces by virtue of the 1onstitution %@ighteenth Amendment& Act 2 ! + The 0rdinance is reAuired to be ada#ted by the

Provincial Assembly of the Punjab in terms of Article 2( AA%6& read with Article !?2%c& of the 1onstitution+ Boilers being used in the generation of nuclear energy have been s#ecifically #ro#osed to be e.cluded from the a##lication of this 0rdinance as the same are covered under the Federal >egislative >ist+ Bence, this Bill+
