The respondent has fled a motion seeking to have te Boad terinate these proceedings. See
United States v. Chapa-Garza, 243 F.3d 921 (5th Cir. 2001) (flony driving while intoxicated
ofense is not an aggavated flony crime of violence under the immigation law); see also Matter
of Olivares, 23 I&N Dec. 148 (BIA 2001 ). The Deparent of Homeland Security (the "DHS") ha
not responded to the motion. I light of the decision in United States v. Chapa-Gara, supra, the
motion is ganted and tese removal proceedings are terinated. See Matter of J-J-, 21 I&N Dec.
976 (BIA 1997); 8 C.F.R. 1003.2(a).
