Chairman's Foreword

Sewerage Undertakers in the UK are responsible for over


300,000 kilometres of sewers. Mathematical modelling of sewer
systems to investigate their hydraulic performance is now a
key tool for the management of the network. Verification of
these models from accurate field data is an essential part of
this.

The Model Contract Document for Sewer Condition Inspection was


first published in 1987 as the model contract document for non
man entry sewer inspection and the model contract document for
man entry sewer inspection. Since the publication of the first
editions there have been developments in equipment technology,
site procedures and contract administration. They have been
combined in this document in order to rationalise the number
of documents whilst at the same time taking the opportunity to
incorporate recent developments.
This new document is part of a family of three model contract
documents which also comprise model contract documents for
manhole location surveys and short term sewer flow surveys.
Large parts of the Conditions of Contract, Specifications and
Preamble to the Bill of Quantities have been amended to
provide a common thread which will run through all three
documents. Term Contracts are also now provided for in the
document.

The work on updating the document has been carried out by WRc
in close co-operation with the Engineering and Operations
Committee's Sewerage Working Group under the Chairmanship of
Mr W G Sheldon of North West Water. I acknowledge the input of
the Working Group in the work and I expect that this will
ensure that the document continues to be a success in the
future.

1. INSTRUCTIONS TO TENDERERS

GENERAL

1.1Tenderer to inform himself

The Tenderer shall obtain at his own


expense all information necessary for
making a Tender and entering into a
Contract and shall examine and consider
all matters referred to in the documents
and accompanying plans. Particular
attention is drawn to the requirements
contained in the Information and
Instruction Schedule (Section 6).

The Tenderer shall be deemed to have


satisfied himself before submitting his
tender as to the correctness and
sufficiency of the rates and prices
stated by him in the priced Bill of
Quantities which shall (except insofar as
it is otherwise provided in the Contract)
cover all his obligations under the
Contract.

2.1Definitions

2.1.1 Employer is as defined in Clause

2.2Engineer's Representative

2.2.1 The functions of the Engineer's

2.4Contract documents

2.6Acceptance, commencement, programme and

2.9Public relations

2.18.5 The Employer shall be entitled to withhold payment


if the Contractor has been unable to submit Survey results

2.18.6 The Employer shall be entitled to deduct from any
payment due to the Contractor penalties paid by the
Employer under provisions contained in the New Roads and
Street Works Act 1991 as a result of actions taken by the
Contractor.

2.19Forfeiture

2.19.1 If the Contractor shall become bankrupt or have a


receiving order made against him or shall present his
petition in bankruptcy or shall make an arrangement with
or assignment in favour of his creditors or shall agree to
carry out the Contract under a committee of inspection of
his creditors or (being a corporation) shall go into
liquidation (other than a voluntary liquidation for the
purposes of amalgamation or reconstruction) or if the
Contractor shall assign the Contract without the consent
in writing of the Employer first obtained or shall have an
execution levied on his goods or if the Engineer shall
certify in writing to the Employer that in his opinion the
Contractor:
(a)has abandoned the Contract, or

(b)without reasonable excuse has failed to


commence the Survey in accordance with Clause 2.6 or
has suspended the progress of the works for 14 days
after receiving from the Engineer written notice to
proceed, or

(c)despite previous warning by the Engineer in


writing is failing to proceed with the Survey with due
diligence or is otherwise persistently or fundamentally
in breach of his obligations under the Contract, or

(d)has, in defiance of the Engineer's instruction


to the contrary, sublet any part of the Contract,

then the Employer may after giving 7 days' notice in
writing to the Contractor enter upon the site of the
Survey and expel the Contractor therefrom without thereby
avoiding the Contract or releasing the Contractor from any
of his obligations or liabilities under the Contract or
affecting the rights and powers conferred on the Employer
or the Engineer by the Contract and may himself complete
the Survey or may employ any other Contractor to complete
the Survey and the Employer or such other Contractor may
use for such completion so much of the Survey materials
and data which have been deemed to become the property of
the Employer. By the said notice or by further notice in
writing within 14 days of the date thereof the Engineer
may require the Contractor to assign to the Employer and
if so required the Contractor shall forthwith assign to
the Employer the benefit of any agreement for the supply
of any survey materials and data and/or for the execution
of any work for the purpose of this Contract which the
Contractor may have entered into.

2.20Collusion and corruption

2.20.1 The Employer shall be entitled to terminate the


Contract and to recover from the Contractor the amount of
any loss resulting from any such termination if the
Contractor shall have practised collusion in tendering for
the Contract or shall have employed any corrupt or illegal
practice in the obtaining or execution of the Contract.
2.20.2 The Contractor shall not employ any of the
Employer's employees.

2.21Settlement of disputes - arbitration

2.21.1 Any dispute between the Employer and the


Contractor arising from the Contract shall be referred to
the Engineer in writing for decision. If a decision is not
given within one calendar month or if either party is
dissatisfied with this decision the dispute may be
referred to arbitration by either party.
2.21.2 Arbitration shall be conducted in accordance with
the Short Procedure detailed in Part F of the "Institution
of Civil Engineers Arbitration Procedure, (1983)",
published by Thomas Telford Ltd., ISBN 0727705210.

2.22Tax matters

2.22.1 If the cost to the Contractor of performing his


obligations under the Contract shall be increased or
reduced by reason of the making or amendment after the
date of Tender of any law or of any order, regulation, or

expense) to make copies of any
photographs or other data collected as
part of the Contract. Such copies will
become the property of the Contractor.
Copyright will remain with the Employer.

2.24.3 If the Contractor wishes to use


such copies for promotional or tender
purposes he shall obtain the prior
written consent of the Employer, and such
consent shall not be unreasonably
withheld or delayed. The Employer may,
however, request that the source of such
photographs or data remains anonymous.

3.16.4 In case (c) the Contractor shall,

starting to survey a sewer length, the
survey has to be abandoned due to
blockage, heavy siltation or high water
level then the Contractor should advise

3.18Forced Ventilation

3.18.1 The use of forced ventilation for


man-entry sewer surveys is covered in
Clause 6.24 of the Schedule.

3.19CCTV Camera position

3.19.1 Wherever possible the CCTV camera


shall be positioned to reduce the risk of
picture distortion. In the case of
circular or regular shaped sewers, the
camera lens shall be positioned centrally
within the sewer. In the case of egg
shaped sewers, the camera lens shall be
positioned vertically above the invert at
a height two thirds of the vertical
dimension of the sewer. In all instances
the camera lens shall be positioned
looking along the axis of the sewer. A
positioning tolerance of +10% of the
vertical sewer dimension will be
permitted.

3.20Photographic camera position - Man entry
surveys

3.20.1 In a circular shaped sewer the


camera shall be positioned so that the
long side of the photograph is
horizontal.

3.20.2 In all other shapes of sewer the


camera shall be positioned so that the
long side of the photograph is in the
same plane as the longest vertical or
horizontal dimension of the sewer.

3.20.3 When a photograph is taken to


illustrate a specific defect it may be
necessary to relax the specification in
Clauses 3.20.1, and 3.20.2. Where a
photograph is taken to illustrate a
specific defect it shall occupy the
central part of the photograph and be
clearly in focus and accurately show the
defect. If necessary a second photograph
shall be taken at the location to put the
defect depicted in the specific
photograph into perspective in the
overall context of the sewer.
3.20.4 When a photograph is taken to
illustrate a degree of mortar loss, size
of a crack/fracture, size of a void or
any other quantifiable defect a suitable
metric scale shall be included in the
photograph, clearly visible and in focus
within the photograph. When a photograph
is taken to illustrate mortar loss, the
scale should be inserted in the joint
between the bricks. The scale should be
clearly visible and in focus within the
photograph at all times.

3.21CCTV Camera speed

3.21.1 The speed of the camera in the


sewer shall be limited to 0.1m/s for
sewers of diameter less than 200mm,
0.15m/s for diameters exceeding 200mm but
not exceeding 310mm and 0.20m/s for
diameters exceeding 310mm, or such
other speed as agreed by the Engineer to
enable all details to be extracted from
the video tape recording.

3.21.2 The camera shall be "stopped"
whenever defects are being noted on the
coding sheet.

3.22Linear measurement

3.22.1 In non man entry surveys the CCTV


monitor display shall incorporate an
automatically updated record in metres
and tenths of a metre of the distance of
the camera position from the cable
calibration point.

3.22.2 For non-man entry surveys the


Contractor shall use a suitable metering
device which enables the cable length to
be accurately measured. In man entry
surveys a means of accurately locating
the photographic camera chainage and any
recorded defect, along the sewer shall be
provided. In both cases this shall be
accurate to +1% or 0.3m whichever is the
greater.
3.22.3 The Contractor shall demonstrate
that the tolerance in Clause 3.22.2 is
being complied with. For CCTV one or both
of the following methods shall be used in
conjunction with a linear measurement
audit form which shall be completed each
day during the Survey:

� use of a cable calibration device;

� tape measurement of the surface


between manholes.
For man-entry surveys the device used
by the Contractor to measure the chainage
along the sewer will be compared with a
standard tape measure.

If the Contractor fails to meet the


required standard of accuracy the
Engineer shall instruct the Contractor to
provide a new device to measure the
chainage. The Engineer may at his
discretion instruct, in writing, the
Contractor to resurvey those lengths of
sewer first inspected with the original
measuring device.

3.23CCTV Data display, video recording and


start of survey

3.23.1 At the start of each sewer length
being surveyed, the length of sewer from
zero chainage up to the cable calibration
point shall be recorded and reported in
order to obtain a full record of the
sewer length (see diagram No.2).

The meter reading entered on to the


data display at the cable calibration
point must allow for the distance from
the start of the Survey to the cable
calibration point such that the metreage
at the start of the survey is zero.

In the case of surveying through a


manhole where a new header sheet is
required, the metreage shall be set at
zero with the camera focused on the
outgoing pipe entrance.
The Team Leader shall ensure that the
metreage counter starts to register
immediately the camera moves.

3.23.2 At the start of each manhole


length a data generator shall
electronically generate and clearly
display on the viewing monitor and video
recording a record of data in
alphanumeric form containing the
following minimum information:

� Automatic update of the camera's


metreage position in the sewer line
from adjusted zero (see Clause
3.23.1).
� Sewer dimensions.

� Manhole/pipe length reference


numbers.

� Date of survey.
� Road name/location.

� Direction of Survey.

� Time of start of Survey.


� Sewer Use.

The size and position of the data


display shall be such as not to interfere
with the main subject of the picture.
3.23.3 Once the survey of the manhole
length is under way, the following
minimum information shall be continually
displayed:

� Automatic update of the camera's
metreage position in the sewer line
from adjusted zero (see Clause
3.23.1).

� Sewer dimension.

� Manhole/pipe length reference


number.
� Direction of Survey.

3.24CCTV Picture quality - camera, video tape


recorder and monitor

3.24.1 The test device(s) shall be


provided on site at all times to enable
practical demonstration of compliance
with the requirements of this section.
Test devices for the camera shall utilise
the Marconi Resolution Chart No. 1 or its
derivatives, or such device as may be
approved by the Engineer (see Clauses
3.32.1 and 3.33.1). Test devices for the
video tape recorder and monitor shall be
as submitted under Clause 1.15.

3.24.2 Correct adjustment of the


recording apparatus and monitor shall be
demonstrated by use of the test tape or
other device approved by the Engineer.
Satisfactory performance of the camera
shall then be demonstrated by the
recording of the appropriate test device
at the commencement of each day for a
minimum period of 30 seconds (see Clauses
1.14, 1.15, 3.32 and 3.33).

3.24.3 All video cassette tapes shall be


supplied by the Contractor and shall be
best quality high grade (HG) new and
unused prior to recording and shall be of
a Video Home Systems (VHS) format.

3.25Photographic camera picture quality, man


entry surveys

3.25.1 The photographic camera and


illumination system shall be capable of
providing a clear, accurate and in focus
record of the sewer's internal condition.

3.25.2 The adjustment of focus/aperture


shall give a focal range from near
objects to infinity

3.25.3 The illumination described in
Clause 3.25.1 shall be capable of
allowing the camera to operate in all
sewers at an iris setting providing an
adequate depth of field for the size of
sewer being surveyed.

3.26Survey reporting

3.26.1 The report shall be computer


validated and machine printed and
presented in accordance with the format
laid down in the WAA/WRc "Manual of Sewer
Condition Classification" Third Edition,
published 1993 (see Clause 6.31 for
Survey Report details).
3.26.2 The Contractor shall supply the
required number of copies and types of
report for each item listed, within the
time period stated in Clause 6.7 or
Clause 6.8 and before submission of the
Contractor's final account.

3.26.3 The Engineer may require


different sections of the Survey to be
carried out using different survey
methods in which case different Survey
Reports will be required. If the Engineer
requires separate Survey Reports for any
section of the Survey or requires some or
all of the section to be grouped together
in a single Survey Report, this shall be
noted in Clause 6.31.

3.26.4 The Engineer may request that


some of the items of the Survey Report
shall be supplied to the Engineer as the
Survey proceeds. This will normally be
made clear at the time of tendering in
the Information and Instruction Schedule
but not withstanding this the Contractor
shall comply with reasonable requests
from the Engineer to supply the
information on some of the items listed
in Clauses 6.31, 6.32 and 6.33 whilst the
Survey is in progress.

3.27Site coding sheets

3.27.1 Site coding sheets shall be


completed as specified in Clauses 3.26.1
and 6.31 and shall be completed by an
operative at the time of the Survey.
Quality control procedures are specified
in Clauses 3.36, 3.37, 3.38, 3.39 and
3.40.

3.27.2 Each sewer length shall be
recorded in the format laid down in the
WAA/WRc "Manual of Sewer Condition
Classification" Third Edition published
1993. Any changes shall be noted in
Clause 6.31. Where a length of sewer
between consecutive manholes is surveyed
from each end (due to an obstruction) two
coding sheets should be used.

3.27.3 For the purposes of this clause


direct entry on-site into a computer
recording system using the coding method
specified in the "Manual of Sewer
Condition Classification" 3rd edition
1993, shall be equivalent to the
completion of site sheets.

3.27.4 The operator in the employment of


the Contractor who undertakes to prepare
the site coding sheets (Clause 3.27.1) at
the time of the survey shall be fully
conversant with picture interpretation,
defect coding and classification and
shall hold current certificate(s) of

qualification for sewer survey and fault
classification as issued by Water
Training or other equivalent body for the
type(s) of sewer being inspected. Copies
of these certificates shall be deposited
with the Engineer before commencement of
the Survey.

3.28Drawings

3.28.1 One clean set of drawings showing


manhole numbers which coincide with the
coding sheets and tapes shall be returned
to the Engineer on completion of the
Survey and shall be clearly annotated to
show any significant errors noted in the
course of the Survey. Such errors shall
be brought to the attention of the
Engineer during the Survey.

3.29CCTV Photographs (off screen colour)

3.29.1 The Contractor shall provide


colour photographs using colour negative
film, i.e. a colour print and negative.
3.29.2 Photographs, shall be durable and
approximately 89mm x 125mm (enprint
equivalent) unless otherwise specified
(Clause 6.32(v)).

3.29.3 Photographs shall be taken of the


internal condition of the sewers at such
places as specified in Clause 6.32 and
such other places as the Engineer shall
direct. Where defects exist at adjacent
points, photographs should not be taken
at intervals of less than 2m unless
absolutely necessary to show the second
defect.
Where photographs are not otherwise
required, a general condition photograph
shall be taken not more than 10m after
the previous photograph in pipe sewers
and not more than 5m after the previous

photograph in brick sewers.

3.29.4 Photographs must clearly and


accurately show what is displayed on the
monitor which shall be in proper
adjustment.

3.29.5 Photographs shall be clearly


identified in relation to the location
(minimum requirement manhole start and
finish numbers or pipe length reference
numbers) survey direction, chainage,
photograph number, and date when the
photograph was taken. The annotation
shall be clearly visible and in contrast
to its background, shall have a figure
size no greater than 5mm, and be type
printed. The annotation shall be so
positioned so as not to interfere with
the subject of the photograph.
3.29.6 Unless otherwise stated in Clause
6.32(v), the photographs shall be
supplied in suitable A4 sized plastic
holders and bound in ring binders or
lever arch files. The photographs shall
be presented in chronological order and
each file shall contain a contents page
providing clear cross referencing to the
report. The minimum requirements of the
contents page shall be locations (town
and street name), photograph numbers and
dates when photographs were taken.

3.29.7 Unless otherwise stated in Clause


6.33 the photographic negatives shall be
supplied in suitable plastic negative
holders and bound in a negative file.
Each plastic negative holder sheet shall
be clearly cross referenced to the
photograph files and the report.
3.30Control sample photographs and/or video
tapes

3.30.1 The Engineer may at his


discretion issue a written instruction to

the Contractor to provide a sample of the photographs
and/or CCTV tapes taken during the contract period. The
Contractor shall provide the information within 5 working
days of receiving the written instruction.

3.31Type and extent of survey

3.31.1 The Engineer will specify the type and extent of


the Survey in Clause 6.23.
3.31.2 The Engineer will specify the extent and type of
CCTV Survey (black and white and/or colour) in Clause
6.23.

3.32Monochrome CCTV

3.32.1 An approved test device shall be provided and be


available on site throughout the Contract, enabling the
tests specified in this clause to be checked.
The test card shall be the Marconi Resolution Chart
No. 1 or its derivatives and the camera shall be
positioned centrally and at right angles to the test card
at a distance where the full test card just fills the
rasters of an under scanned monitor screen ensuring that
the edges of the test chart castellations coincide with
the edges of the horizontal and vertical scan (raster).

Other test devices may be used, subject to approval by


the Engineer.

At the start of each and every working shift the


approved test device shall be used, and the tests
specified in accordance with Clause 3.32.2 recorded for
subsequent use by the Engineer. Recordings shall last for
a minimum of 30 seconds. The type of camera used is to be
identified on the test recording. The recording must show
the camera being introduced into the test device and
reaching its stop position.

3.32.2 The electronic systems, television camera and


monitor shall be of such quality as to enable the
following to be achieved:
Shades of grey

The grey scale shall show equal changes in brightness


ranging from black to white with a minimum of five clearly
recognisable stages.
Linearity
The background grid shall show squares of equal size,
without convergence/divergence over the whole of the
picture. The centre circle should appear round and have
the correct height/width relationships (+5%).

Resolution

The live picture must be clearly visible with no


interference and capable of registering a minimum number
of TV lines/picture height lines. In the case of a tube
camera 400 lines and in the case of a CCD type camera 300
lines.

3.33Colour CCTV

3.33.1 An approved test device shall be provided and be


available on site throughout the Contract, enabling the
tests specified in this clause to be checked.

The test card shall be the Marconi Resolution Chart


No. 1 or its derivatives with a colour bar, clearly
differentiating between colours with no tinting to show
the following:

� White
� Yellow

� Cyan

� Green
� Magenta

� Red

� Blue
� Black.

At the start of each and every working shift, the


camera shall be positioned centrally and at right angles
to the test card at a distance where the full test card
just fills the monitor screen, ensuring that the edges of
the test card castellations coincide with the edges of the
horizontal and vertical scan (raster). The card shall be
illuminated evenly and uniformly without any reflection.
The illumination shall be to the same colour temperature
as the colour temperature of the lighting that will be
used on the CCTV camera in the sewer. The test specified
in Clause 3.33.2 shall be recorded for subsequent use by
the Engineer, the recording time to be at least 30
seconds. The type of camera used is to be identified on
the test recording. The recording must show the camera
being introduced into the test device and reaching its
stop position.

Other test devices may be used subject to approval by


the Engineer.
3.33.2 The electronic systems, television camera and

monitor shall be of such quality as to enable the
following to be achieved:

Shades of grey

ranging from black to white with a minimum of five clearly
recognisable stages.
Colour

With the monitor control adjusted for correct


saturation, the six colours plus black and white shall be
clearly resolved with the primary and complementary
colours in order of decreasing luminance. The grey scale
shall appear in contrasting shades of grey with no tint.

Linearity
The background grid shall show squares of equal size,
without convergence/divergence over the whole of the
picture. The centre circle shall appear round and have the
correct height/width relationship (+5%).

Resolution

The live picture must be clearly visible with no


interference and capable of registering a minimum number
of TV lines/picture height lines. The resolution shall be
checked with the monitor colour turned down. In the case
of tube cameras this shall be 400 lines and in the case of
CCD type cameras 300 lines.
Colour constancy

To ensure the camera shall provide similar results


when used with its own illumination source, the lighting
shall be fixed in intensity prior to commencing the
Survey. In order to ensure colour constancy, generally no
variation in illumination shall take place during the
Survey.

The Contractor shall note that the Engineer may


periodically check both the live and video picture colour
consistency against the colour bar. Any differences will
necessitate resurvey of any length affected at the
Contractor's expense.

3.34Focus/iris/illumination

3.34.1 The adjustment of focus and iris shall allow


optimum picture quality to be achieved and be remotely
operated. The adjustment of focus and iris shall provide a
focal range from 150mm in front of the camera's lens to
infinity. The distance along the sewer in focus from the
initial point of observation shall be a minimum of twice
the vertical height of the sewer. The illumination must be
such as to allow an even distribution of the light around
the sewer perimeter without the loss of contrast, flare
out of picture or shadowing.

3.35Video playback

3.35.1 Video playback shall be capable of a resolution of


a minimum of 250 lines recorded at standard VHS speed.

3.36Contractor's quality control procedure

3.36.1 The Contractor shall operate a quality control


system, to be approved by the Engineer prior to the
commencement of the Survey. The system will effectively
gauge the accuracy and consistency of the survey report
produced by the operator from the monitor picture.
The system shall be such that the accuracy of
reporting should be a function particularly of:

� the number of faults not recorded (omissions),

� the correctness of the coding and classification of


each fault recorded.
The minimum levels of accuracy to be attained under
the various survey headings are given in Clause 6.25.

3.36.2 The Engineer shall be entitled to audit


periodically the control system and be present when
assessments are being computed.

When requested by the Engineer in writing the


Contractor shall forward to the Engineer sufficient
details and information for this audit assessment.
3.36.3 Should any Survey report fail to achieve the
specified percentages for a particular sewer length, the
Engineer shall require the Contractor to re-code and
re-submit the report. If the accuracy check fails, the
Contractor shall repeat the full quality control check on
10 surveys, 5 surveys either side of the survey which has
failed. If any further failures are found to be outside
the tolerances laid down in Clause 6.25 within these
additional checks, the process will be repeated until an
acceptable standard is reached. Any reports that have
failed will be re-coded by another qualified surveyor and
submitted to the Engineer to replace those in his
possession.
3.37Random selection

3.37.1 Quality selection is achieved by using two


parameters:
� Survey size - the anticipated number of surveys

carried out by one surveyor over a
period of time (normally 1 year).

� Sample size - the number of


surveys required to be checked to
satisfy the quality control validity.

3.37.2 The sample surveys for quality


control are to be selected by the use of
computer generated random numbers (ERNI)
or other such equivalent method and shall
be 5% of the total population. Each
surveyor shall have a different set of
random numbers, which have been sorted
into chronological order, and are renewed
once the population size has been
reached. The random numbers shall not be
disclosed to the surveyor until they have
been used up.

3.38Survey extraction

3.38.1 On site the surveyor shall log


certain information on each length of
sewer being surveyed and in the order in
which they are surveyed.

The "in office" staff shall count


through the sewer lengths surveyed and
copy those reports that coincide with the
random numbers.
In CCTV surveys a copy of the
relevant section of video tape should
also be made.

Information on the new tape and its


contents are entered on a survey
selection log.

3.39Checking

3.39.1 All header information shall be


checked to ensure that left and right
justified entries are correctly entered,
alpha or numeric symbols are correctly
used and all compulsory boxes filled in.
The percentage of accurate entries shall
be ascertained and any that fall below
the value stated in Clause 6.25 shall be
rejected. All decimal percentage points
shall be rounded down to the nearest
whole number.

3.39.2 Each error/omission of detailed


information should be treated on an equal
basis whether or not it is a minor or
major error or omission. During the

checking each error/omission should be
highlighted on the report from which the
following totals are calculated for each
survey report:

� the number of actual entries that


should have been made.

� the number of actual


errors/omissions made.
These totals should be entered on the
right of the survey report being checked.
Individual column totals should also be
calculated and entered on to the survey
accuracy log.

3.39.3 The accuracy of each survey is


arrived at by taking the number of actual
errors/omissions away from the number of
actual entries that should have been made
and dividing the result by the number of
actual entries that should have been made

4. PREAMBLE TO THE BILL OF QUANTITIES
GENERAL

4.1Documents mutually compatible

4.1.1 The Conditions of Contract, the Specification, the

Drawings and the Information and Instruction Schedule
shall be read in conjunction with the Bill of Quantities.
The work or materials covered by items in the Bill of
Quantities are as detailed in the Specification.

4.2Stated quantities

4.2.1 The quantities set out in the Bill of Quantities


are provisional and are the estimated quantities of the
work.

4.3Errors in the Bill of Quantities

4.3.1 Any error in description in the Bill of Quantities


or omission therefrom shall not release the Contractor
from the execution of the whole or any part of the Survey
according to the Specification or from any of his
obligations or liabilities under the Contract. Any such
error or omission shall be corrected by the Engineer and
the value of the work actually carried out shall be
ascertained in accordance with the Contract, provided that
there shall be no rectification of any errors, omissions
or wrong estimates in the descriptions, rates and prices
inserted by the Contractor in the Bill of Quantities. In
the event of a discrepancy between the quantity, the Bill
rate and the extended amount, the Bill rate as written
shall be taken as correct.

4.4Rates to include

4.4.1 Rates shall be deemed to include for complying


with the whole of the Contractor's obligations under the
Contract.

4.4.2 Rates shall be deemed to include the costs of


provision and operation of all necessary equipment and
compliance with the Contract.

4.4.3 The Contractor shall allow in his rates and prices


for dealing with flow by temporary stoppering for limited
periods (see Clause 3.10). All costs incurred in carrying
out the Engineer's instructions for dealing with flows
other than by stoppering for limited periods will be
reimbursable to the Contractor.
4.4.4 The Contractor will be responsible for making his
own arrangements and paying all charges for the supply of
electricity including the provision of mobile generators
where necessary.

4.4.5 An item is included for travelling to the initial


site and return to depot on completion of the Contract.
All other travelling shall be included in bill rates
(Clause 4.4.1).

4.5Unpriced items

4.5.1 Any items left unpriced should have the word
"Inc." inserted in the Tender, but in any event unpriced
items will be held to have had their costs included in the
prices for other items of work. Items shall not be
bracketed together.

4.5.2 With the exception of Dayworks items which are


covered in Clause 4.10, where a NIL quantity has been
entered or left blank against a bill item, no tender rate
is required and no contract work is intended. Should
subsequent events indicate a need for such works a
variation may be ordered in accordance with Clause 2.17.

4.6Preliminary item

4.6.1 A preliminary item is provided for pricing the


requirements of any clause or clauses of the Conditions of
Contract or Specification to cover all the Contractor's
obligations of every kind which are not covered by the
Contract Rates for measured items.

4.7Non circular sewers

4.7.1 For the purposes of pricing and payment non


circular sewers shall be assumed to be circular with a
diameter equal to the major dimension of the sewer,
whether horizontal or vertical.

4.8Method of measurement

4.8.1 The rates for surveying sewers have been divided


into various items in consideration of the nature of the
survey operation and other conditions.

4.8.2 The Bill of Quantities has been prepared on the


basis that manholes are situated within the curtilage of
the public highway (i.e. in public roads, footpaths or
verges). Where the Contractor has to undertake surveys
which are not within the curtilage of the highway,
separate items have been included in the Bill of
Quantities to enable the Contractor to claim additional
payment in respect of any additional costs of access
and/or liaising with land owners or tenants.

4.8.3 Where the Engineer authorises resurvey works, the


Contractor shall be entitled to payment in full for the
resurvey, only if it can be shown that the Contractor or
his work was not initially at fault. Payment will be in
accordance with the rates entered in the Bill of
Quantities, if resurveyed within the Contract period;

outside the Contract period, it shall be on a dayworks
basis.

4.8.4 The Bill of Quantities is prepared on the basis


that manholes are accessible by means of conventional two
wheel drive vehicles. Where this is not the case a Bill
item has been provided to allow the Contractor additional
payment in respect of the additional costs of access.

4.8.5 A Bill item is provided for the provision of


traffic lights and associated signs. This item may only be
expended on the written instructions of the Engineer and
payment will be made for each week or part week with a
minimum of one week for any separate period of provision.

4.9Working hours

4.9.1 Daytime working is defined as 0800 to 1800 hours.


No work shall be carried out at any other time including a
Saturday, Sunday or bank holiday, without the permission
in writing of the Engineer except when the work is
unavoidable or absolutely necessary for the saving of
life, property or for the safety of the Works in which
case the Contractor shall immediately notify the Engineer.

For the purposes of this clause bank holidays shall be


considered to be the same as Saturdays and Sundays.
4.9.2 Night work shall be defined as the period of 1800
to 0800 hours.

4.9.3 Weekend working shall be defined as the period


from 0800 hours Saturday to 0800 hours Monday and 0800
hours on Bank Holidays to 0800 hours on the following day.

4.9.4 Work on heavily trafficked routes shall be


restricted to certain hours as directed by the Engineer.
No work will be permitted outside these hours.
4.9.5 Bill items are provided to allow the Contractor
additional payment for weekend and/or night working. These
items may only be expended on the written instructions of
the Engineer where he considers such working is necessary
by reason of traffic conditions or rates of flow which
cannot reasonably be dealt with by other means.

4.10Dayworks rates
4.10.1 Work ordered by the Engineer to be carried out on
a dayworks basis will be valued at the appropriate
Contract Rates for Dayworks in the Bill of Quantities,
which shall be inclusive of all the Contractor's costs,
including supervision, all overheads and profit.

4.10.2 The rates for dayworks shall include for all items
covered by the Bill rates.

4.10.3 Expenditure on dayworks will only be on the


instructions of the Engineer.

4.11Dayworks quantities

4.11.1 Where no quantities are entered in the dayworks


schedule, the rates for Dayworks shall be filled in but
not extended.

4.12Unproductive or standing time

4.12.1 If the Contractor is unable to proceed with the


Survey or is delayed due to unforeseen circumstances, the
rates as entered in the Dayworks Schedule shall be used as
a basis for reimbursement where payment is properly due to
the Contractor.
No payment will be made in respect of inclement
weather.

4.13Prime cost items

4.13.1 A prime cost item is provided for the supply of


water in accordance with Clause 3.5. If the Engineer
authorises the use of this item, payment will only be
certified against water company's invoices.

4.14Engineer's instructions

4.14.1 If the Engineer instructs or allows work under


either Clause 2.6.4 or Clause 3.7.6 this will be paid at
the rates specified in the Bill of Quantities.

4.15Provisional items

4.15.1 Provisional items will only be used on the written


instruction of the Engineer.

4.16Fixed price
4.16.1 The Contractor shall include in his rates entered
in the Bill of Quantities for any variation in the price
of materials, labour rates and any other costs whatsoever
except labour tax matters described in Clause 2.22 and
Value Added Tax described in Clause 2.23 which he
anticipates might take place during the term of the

Contract and it must be clearly understood that no
additional payment will be allowed in respect of any
increase in such prices, rates or other costs.

4.17Term contracts

4.17.1 Clauses 6.7 and 6.8 indicate whether the contract


is for specified Works (A Specified Works Contract), or a
term contract for work included in the schedule of rates
or ordered by the Engineer and which may be specified from
time to time (A Term Contract).
4.17.2 Where Clause 6.8 indicates that the contract is a
term contract the Bill of Quantities shall be taken to be
a schedule of rates. The quantities shall be used for
comparison of tenders only and all references in the
Contract to "Bill of Quantities" shall be taken to mean
"Schedule of Rates".

4.18Equipment set up

4.18.1 Bill items 5.1.5 to 5.1.10 allow the Contractor to


enter a fixed rate for setting up survey equipment and
preparatory work at a manhole. These rates shall include
for locating the manhole, effecting all safety
precautions, lifting and subsequently replacing the
manhole cover and for moving equipment and personnel
between sites. The Contractor shall be entitled to payment
for one set up for each total length of sewer between two
consecutive manholes irrespective of whether he sets up
his equipment for each individual length or, in the case
of CCTV surveys, can take advantage of "pulling through".
The total length of sewer shall be defined as being the
distance between the exit of the start manhole and the
entrance of the finish manhole as shown on the drawings
(also see Diagram No. 1).
Where the Contractor commences the survey of a length
of sewer, but is unable to complete the survey for any
reason from one direction, he shall survey the length of
sewer from the other end and will be entitled to payment
for both set ups and for the total length of sewer
surveyed.

Where the Contractor elects to "pull through"


manholes, he shall only be entitled to the extra over in
bill item 5.1.18 for the length between the point of limit
of survey and the first manhole on retraction.
