SPECIAL CONDITIONS OF CONTRACT The entire work including all field investigations and laboratory testing shall be conducted under the direct supervision of an approved competent engineer specially trained in Soil Mechanics with adequate pervious experience. !"S#"$s representative reserves the right of entry to the site at any time during the execution of work with and without prior intimation to the Tenderer. The Tenderer shall submit progress report about the progress of the contract work to !"S#" every week. 'uring the execution of work at site( the instructions given in !"S#" shall be final and binding on the Tenderer and shall be observed in full with respect to Technical Specifications( drawings methods of conducting work and other measures necessary as well as all problems concerning the relevant priorities of various parts of the work. The Tenderer shall obtain necessary permission from the appropriate *uthority + !"S#" so that the T#,'#-#- can move to the site to start the contract work. The field work shall be inspected and passed by !"S#" representative from time to time at site. The Tenderer shall provide all facilities for such inspection free of cost. ,otwithstanding any inspection of the site( !"S#" shall have the right to re.ect any work not conforming to the Technical Specification without being liable for any explanation or compensation. The Tenderer shall ensure satisfactory completion of the contract work. 'uring the execution of work( if any problem arises which is not covered by the Technical Specification( the Tenderer shall seek necessary clarification and instruction from !"S#" such instruction shall be binding on the Tenderer and shall be observed in full. The Tenderer shall not off2load the 3ontract or part thereof to any sub2 contractor without written permission of the !"S#"$s representative. 4n the event sub2letting of contract or any part thereof is permitted( the fact that such permission has been accorded shall not establish any contractual relationship between the approved sub2contractor and !"S#" of any of his liabilities and obligations under the contract.

* complete list of execution + deviation from the tenderer$s scope of work shall be clearly indicated. Similarly( if any departure( commission of substitution from stipulated specifications is made( this fact should be clearly indiated in the offer with reasons. 6owever( !"S#" shall have the absolute discretion to summarily re.ect such offers. The Tenderer shall make his own arrangement for all labour( construction equipment( tools and tackles and construction materials( office accommodation. !ater and #lectricity for construction purpose if supplied by !"S#" the charge shall be borne by the Tenderer at the rate specified by the !"S#". The Tenderer cannot claim any compensation for any failure in such supply caused due to any reason whatsoever. The Tenderer shall strictly follow the construction safely rules( regulations and instructions issued from time to time. 4n absence of any particular reference the Tenderer shall refer to relevant 4ndian Standard and also the State 7overnment rules and regulations. *ll necessary precautions shall be taken by the Tenderer as not to cause damage to any property of the !"S#" or other personnel working in the same premises or in any ad.oining property. Similar precautions shall also be exercised so as to not hinder the progress work in the area or the ad.oining area. The Tenderer shall co2ordinate his work with others working in the area for smooth and trouble free work. !"S#"$s representative may during the progress of work( order for re2 execution of part or whole of the work executed( found not in accordance with the approved drawings + specifications + instructions. ,o extra claims shall be entertained for re2execution or altering of such work.
