24 be conveyed via the possessionof firearms at a ganshow for the following reasons:

25 a. Possessionof a gun at a gun show supportsmy belief that the "right to keep and

26 bear arms" - as that right is interpretedby the National Rifle Association - is

27 essentialfor the preservationofall rights.

b. For a practicalexampleof why gunsneedto be presentto conductgun salesat a
8 gun show,considerthe following:
9 i. A licensedfirearmsdealer,andthe buyerfor that matter,must
10 verify both the existenceandintegrity of serialnumberson the
1l firearm being sold.

t2 ii. This cannot be done without the gun actually present.

l3 iii. There is no way to verify that apicture of a serial number, which

t4 would necessarilyhave to be a close-up, is the actual number on


15 the gun that is shown for sale in a different photograph. Buying a

I6 gun with the incorrect, or obliterated serial number is a crime.

I7 iv. The federal and state forms for purchasing a firearm require a

l8 serial number entry before the form is processed.

t9 V. In other words, the sale cannot take place under federaror state
20 law without the object of the sale available for inspection and
2I identification.
22 vl. Becauseof California's waiting period and background check,

23 most gun sales/transactions(excepting antique frrearms,curio and

24 relic firearms older than 50 years) involve at least a l0 day delay

25 in the delivery of the firearm. And for those salesconductedat

26 gun shows, that delivery usually takes place at the next gun show

27 or at the dealer'sretail store. But the lO-day waiting can only start

2 brokered by a licensedfirearms dealer) are not true sales,they are

J more truthfully describedas contracts for inspection and an

4 invitation to make an offer after the inspection. Only then can the

5 parties start the processof turning that into a sale.


l 6 vlll. Perhapswith good cause,gun control activists have fought hard,

7 and politicians have passedlaws to strictly regulate firearm salesin

8 California. Nobody wants felons and violent people acquiring

I 9 weapons.But for the County of Alameda to come along and say:

t2 conductingthesale." is an invitation to fraudulentand
13 unscrupulous(andpossiblycriminal) firearmtransactions.
t4 ix. Beforeany "sale" of gun canlegally takeplaceunderfederaland
15 statelaw in California:(1) the firearmserialnumbermustbe
t6 verified, (2) thebuyermustfill out federaland stateforms
t7 veriôringhis/hereligibility to acquirefirearms,(3) the form must
18 identifr the fireannby rnake,modeland serialnumber,and(4)
L9 lastly the buyerandsellermustsign theseformsunderpenaltvof
20 perjurythat the informationis basedon their personalknowledge

22 c. For anotherpracticalreasonfirearmsneedto be presentto conducta reasonable
23 andsafesaleof a firearm,consider:
24 i. CaliforniaPenalCodeg 12071(bX8)et seq.Setsfor the
25 requirementsregarding safety training and the demonstrationof

26 safe handling of firearms as a necessary(legally mandatory)part

27 of any firearms delivery.

5 33. have all the required permits and certificates for lawfully conducting gun shows in

6 California under the Gun Show EnforcementAct of 2000. were never permitted to

7 operatea gun show at the Alameda County Fairgrounds under the provision of that act,

8 becausegun sho\¡/shave been bannedfrom that venue since November 1999.

9 34. We strive and succeedin complying with all federal and state laws for conducting a gun

10 shows.We also host gun shows in Nevada where the laws are quite different. For

1l example:

t2 a. IV'ehave personally witnesseda surge in gun show attendancein Nevada since

t3 the year 2000. That can only be accountedfor by the growth of population in

t4 Nevada or by people traveling from out of stateto those shows. IV'ehave walked

15 through the parking lot at the venueswhere the Nevada shows take place, it is

t6 easyto seethat California licenseplates make up great percentageof the patrons

17 attending the Nevada Shows.

18 b. There is no Nevada state Law counterpartto the california Gun show

t9 EnforcementAct of 2000.

20 There is no background check or waiting period for purchasing long guns (rifles

2I and shotguns)at a Nevada gun show.

22 d. The much touted "gun show loophole" is alive and well in Nevada. (i.e., private

23 party salesare uffegulated.)

24 e. California prohibits the sale of firearm magazinesthat hold more than l0 rounds

25 of ammunition. There is no law in Nevada regulating the sale of hi-cap mags. It

26 is not illegal to buy them in Nevada. It is only illegal to bring them back to

27 California. But with the extinction of gun shows in Northern California, and the

J f. California has its own Assault Weapon laws, which prohibits the sale of Assault

4 Weaponsin California, in addition to prohibiting their importation. Nevadahas

5 no statelaw counterpart,and the Federal Assault Weapon Ban expired in

6 Septemberof 2005. It is now legal to buy assaultrifles in Nevada. Bringing

7 them to California is a potential felony, but many people are not aware of

8 California's stricter laws. By banning the larger gun shows in Northern

9 California, the Alameda Ordinance (along with the copy cat ordinancesin other

., l0 counties) has the unintended consequenceof pushing the gun buying public into

1t the relatively unregulatedgun market ofNevada.

J d. And yes, we used to run a commercially successfi.rlgun show at the Alameda (and

4 other) Fairgrounds for a number of years. V/e have watched that profit margin

5 shrink as gun shows were bannedin county after county in Northern California.

6 We had to declarebankruptcy after the Alameda Shows were banned,as that

7 show generatedalmost35Yoof our revenueper year. The Santa Clarashows are

8 down to half of their ususal attendance. 'We have been banned from the

9 fairgrounds in sonoma, san Mateo and Marin counties.

10 37' Finally, this caseis a good example of how prejudice and ignorance can drive bad public

11 policy.

2 Fair to commit crimes that are feroniesunder state law.

5 place on county property, only they must be gun-less gun shows

t. Then, after we filed this suit, the Defendantsamendedtheir ordinance grant
to
8 exceptionsfor the expressiveuse of firearms in motion pictures, television,
video,
9 theatrical and danceproductions. Knowing that gun shows were
suing them
10 under a freedom of expressiontheory, and refusing to include gun
shows in the
1l category of exceptionsfor the expressiveuse of firearms is pretty
strong evidence
l2 that the banning of gun shows was not collateral damage,
but in fact was the

Alt NAAS membersmust agreeto enforcethe mandatoryshowproducer rules


without limit at everyshowproducedby the membei. In addition,the
recommendedrules shouldbe appliedby the memberfor safetyand other reasons
whereverpossible.

MandatoryShowproducerRules

1. NAAS Member shows shall require a signed contract from each and
every exhibitor which includes requiring compliance with all applicable
federal, state, and local laws.

2. NAAS Member shows shall make available to all exhibitors any


information provided by ATF or state or local law enforcement agencies
relating to applicable laws, including ATF "Notice to nealers" anã ¿.tn
guidelines.

3. No loaded firearms or loaded magazines oÈ clips will be permitted in


any NAAS Member show at any time by anyone other than law
enforcement personnel.

4. AII cartridge firearms brought to the NAAS Show by members of the


public shall be checked, cleared and tied in an inoperable position prior
to being brought into the show.

5. No loose ammunition will be allowed at any NAAS Member Show. All


ammunition must be in an original box, sealedcontainer, or under cover
(i.e. Iidded showcase). Collector cartridges may be exempted by show
safety personnel.

6. All cartridge firearms, other than those which are disassembled,must


be checked, cleared and secured with a cable tie by the dealer before
placing them on display at the show.

Recommended
ShowProducerRules

1. No black powder will be permitted in the show.

2. No one under 18 years of age will be admitted to the show unless


accompaniedby a supervising and responsibleadult.

3. Show management reseryes the right to check all bags, purses, and
containers at the entrance to ensure that no firearms or prohibited materials
are being brought to the show by members of the public. A sign should be
posted at the show entry: "All bags are subject to search."

4. No camerasor recording devicesare permitted in the show without specific


atthorization of show management.

5. Show managementis strongly encouragedto ensurethat there are no books


displayed or offered for sale at the show which describe the fabrication of
devices which, if the device described were possessed by an individual,
would constitute a felony under the laws of the United States or under the
laws of the state or municipality where the show is being held. This
prohibition includes racial, ethnic, sexist, and any hate-mongering material of
any type, or any other material which are objected to by show management.

6. No explosive ordinance, destructive devices,parts designed specifically to


convert a semi-automatic firearm to fully automatic frre, or anti-personnel
sprays shall be permitted to be displayed or offered for sale at the show.

7. Since gun shows are advertised to the public as family events, no


pornographic materials or items with obscenelanguage or graphics, including
T-shirts, magazines, videos, bumper stickers or other items which could be
considered to be offensive to families or which are objectionable to show
management,are permitted.

8. All show rules (including ATF guidelines)applicableto the public should


be posted at the show entrance.
