ENVIRONMENTAL QUALITY ACT 1974 (ACT 127)


The Environmental Quality Act, 1974 was enacted to prevent, abate, control pollution and enhance the quality of environment. The Department of Environment administer and enforce the EQA 1974, and Section IV of the Economic Exclusive Zone Act 1984.

PRINCIPLE ADOPTED IN THE FORMULATION OF EQA


i. Pollution should be controlled at source ii. Polluters must pay or bear the cost of their pollution control iii. Standards sets may be contravened in certain circumstances provided that it does not adversely affect the environment iv. Variable standards may be specified if the uniform standards is inadequate to protect the environment

RATIONALE FOR EQA 1974 (AMENDMENT 2012)

ISSUES Pollution issues yet to be fully addressed In 2011: 39 Polluted rivers 3,177 Open burning cases 12 Movement/ Illegal disposal of scheduled waste

SOURCES -Pollution from siltation caused by earthwork activities -Pollution from sewage and industrial effluent -Illegal dumping of hazardous waste -Open burning

CONSTRAINTS -Difficulties in proving that the pollution has occurred -Absence of legal provisions to stop work order issue (activities subject to EIA) -Absence of legal provisions to arrest environmental offenders

EIA is essentially a planning tool for preventing environmental problems due to development

CONTROL OF POLLUTION FROM WET MARKET


Generate large quantity of sullage from slaughtering activity, fish cleaning and general washing. Poor segregation & collection of solid wastes. BOD & AN levels are very high, comparable to raw sewage.

Facts: There are more than 605 wet markets in Malaysia owned by the Local Authorities & 42% are still doing slaughtering and discharge the wastewater directly into the rivers.

CONTROL OF POLLUTION FROM RESTAURANTS/FOOD COURTS


Facts: Even more polluting than household sullage - due to highly concentrated organic wastes. Soluble BOD comprises 78% of total BOD meaning that most BOD is dissolved in the sullage & therefore can pass through the O&G interceptors. Currently not channelled & treated in the STP but directly discharged into the drain/rivers. Only 65% out of 150 Local Authorities enforce the installation of FOG Trap in restaurants.
