e the historical, cultural, spiritual and statehood he itage of the Macedonian people and their struggle o"e #ent! ies for national and social freedom as well as fo the # eation of thei o$n state, and pa ti#!%a %& the traditions of statehood and %ega%it& of the Krushevo Republic and the histo i# de#isions of the Anti'Fas#ist Asse()%& of the Peop%e*s Li)e ation of Macedonia, together with the constitutional and legal #ontin!it& of the Macedonian state as a so"e eign ep!)%i# within Federal Yugoslavia and the f ee%& (anifested $i%% of the citizens of the Republic of Macedonia in the efe end!( of September 8th, !! , as well as the historical fact that Macedonia is esta)%ished as a nationa% state of the Macedonian people, in which f!%% e+!a%it& as #iti,ens and pe (anent #o'e-isten#e with the Macedonian people is p o"ided fo "lbanians, Tur#s, $lachs, Romanies and othe nationa%ities living in the Republic of Macedonia, and intent on% & the establishment of the Republic of Macedonia as a sovereign and independent state, as $e%% as a civil and democratic one' & the esta)%ish(ent and #onso%idation of the !%e of %a$ as a f!nda(enta% s&ste( of go"e n(ent' & the g!a anteeing of human rights, citizens, freedoms and ethnic e(ualit)' & the p o"ision of peace and a #o((on ho(e for the Macedonian people with the nationalities living in the Republic of Macedonia' and on & the provision of social *ustice, economic $e%%)eing and p ospe it& in the %ife of the indi"id!a% and the #o((!nit&, the "ssembl) of the Republic of Macedonia adopts T+, -./ST0T1T0./ .F T+, R,21340- .F M"-,5./0"

CONSTITUTION OF THE REPUBLIC OF MACEDONIA I. BASIC PRO/ISIONS "rticle The Republic of Macedonia is a so"e eign, independent, democratic and so#ia% state6 The sovereignt) of the Republic of Macedonia is indi"isi)%e, ina%iena)%e and nont ansfe a)%e6 "rticle 7 Sovereignt) in the Republic of Macedonia de i"es f o( the citizens and )e%ongs to the citizens6The citizens of the Republic of Macedonia e-e #ise thei a!tho it& th o!gh de(o# ati#a%%& e%e#ted Rep esentati"es, through referendum and through othe fo (s of di e#t e-p ession6 "rticle 8 The territor) of the Republic of Macedonia is indivisible and inalienable6 The e-isting )o de s od the Republic of Macedonia are in"io%a)%e6The borders od the Republic of Macedonia (a& )e #hanged onl) in a##o dan#e with the -onstitution6 "rticle 9

II. BASIC FREEDOMS AND RI2HTS OF THE INDI/IDUAL AND CITI3EN 4. Ci"i% and po%iti#a% f eedo(s and ights "rticle !

"rticle < The freedom and #onfidentia%it& of #o esponden#e and other fo (s of #o((!ni#ation is guaranteed6 .nl) a #o! t de#ision (a& a!tho i,e non'app%i#ation of the p in#ip%e of the in"io%a)i%it& of the confidentialit) of correspondence and other forms of communication, in #ases $he e it is indispensa)%e to a # i(ina% in"estigation or e+!i ed in the inte ests of the defence of the Republic6 "rticle 8 The se#! it& and #onfidentia%it& of pe sona% info (ation are g!a anteed6 Citi,ens a e g!a anteed protection from an) "io%ation of their pe sona% integ it& deriving from the regist ation of pe sona% info (ation th o!gh data p o#essing6 "rticle ! The freedom of e%igio!s #onfession is guaranteed6 The right to e>press one*s faith f ee%& and p!)%i#%&, individuall) or with others is guaranteed6 The Ma#edonian O thodo- Ch! #h and other e%igio!s #o((!nities and groups are sepa ate f o( the state and e+!a% )efo e the %a$6 The Macedonian .rthodo> -hurch and other religious communities and groups are f ee to esta)%ish schools and other social and #ha ita)%e instit!tions, )& $a& of a p o#ed! e regulated b) law6 "rticle 7= -itizens are guaranteed freedom of asso#iation to e-e #ise and p ote#t their political, economic, social, cultural and other rights and #on"i#tions6 -itizens ma) freel) establish asso#iations of #iti,ens and po%iti#a% pa ties, 0oin the( o esign f o( the(6The p og a((es and a#ti"ities of political parties and other associations of citizens (a& not )e di e#ted at the "io%ent dest !#tion of the #onstit!tiona% o de of the Republic, or at en#o! age(ent o in#ite(ent to (i%ita & agg ession or ethnic, racial or e%igio!s hat ed or into%e an#e6 Mi%ita & or pa a(i%ita & associations which do not )e%ong to the A (ed Fo #es of the Rep!)%i# of Macedonia are p ohi)ited6 "rticle 7 -itizens have the right to asse()%e pea#ef!%%& and to e-p ess p!)%i# p otest without prior announcement or a spe#ia% %i#ense6The e>ercise of this right (a& )e est i#ted onl) during a state of e(e gen#& o $a 6 "rticle 77 ,ver) #iti,en on ea#hing 4: &ea s of age acquires the right to vote6 The right to vote is e(ual, universal and direct, and is e-e #ised at f ee e%e#tions )& se# et )a%%ot6 2ersons dep i"ed of the ight to p a#ti#e thei p ofession by a court verdict do not have the ight to "ote6 "rticle 78 ,ver) citizen has the right to take pa t in the pe fo (an#e of p!)%i# offi#e6 "rticle 79 ,ver) citizen has a right to petition state and othe p!)%i# )odies, as well as to e#ei"e an ans$e 6 " citizen #annot )e #a%%ed to a##o!nt or s!ffe ad"e se #onse+!en#es for attit!des e-p essed in petitions, !n%ess the) entai% the #o((itting of a # i(ina% offen#e6

"rticle 7: ,ach citizen is guaranteed the espe#t and p ote#tion of the p i"a#& of his?her pe sona% and fa(i%& %ife and of his?her dignit& and ep!te6 "rticle 7; The in"io%a)i%it& of the home is guaranteed6 The right to the inviolabilit) of the home (a& )e est i#ted onl) b) a court decision in #ases of the dete#tion o p e"ention of # i(ina% offen#es or the p ote#tion of peop%e1s hea%th6 "rticle 7< ,ver) citizen of the Republic of Macedonia has the ight of f ee (o"e(ent on the te ito & of the Republic and f ee%& to #hose his9he p%a#e of esiden#e6 ,ver) citizen has the right to %ea"e the te ito & of the Republic and to et! n to the Republic6 The e>ercise of these rights (a& )e est i#ted )& %a$ onl) in #ases $he e it is ne#essa & for the p ote#tion of the se#! it& of the Republic, # i(ina% in"estigation or protection of people,s health6 "rticle 78 The defen#e of the Republic of Macedonia is the ight and d!t& of e"e & #iti,en6 The e-e #ise of this ight and dut) of citizen is eg!%ated )& %a$6 "rticle 7! Fo eign s!)0e#ts en0o& f eedo(s and ights guaranteed b) the -onstitution in the Republic of Macedonia, !nde #onditions regulated b) law and inte nationa% ag ee(ents6 The Republic guarantees the ight of as&%!( to foreign sub*ects and state%ess pe sons e-pe%%ed )e#a!se of de(o# ati# po%iti#a% #on"i#tions and a#ti"ities 6 E-t adition of a foreign sub*ect can be #a ied o!t onl) on the )asis of a atified inte nationa% ag ee(ent and on the p in#ip%e of e#ip o#it&6 " foreign sub*ect cannot be e>tradited for po%iti#a% # i(ina% offen#es6 A#ts of te o is( are not ega ded as political criminal offences6 5. E#ono(i#1 so#ia% and #!%t! a% ights "rticle 8= The ight to o$ne ship of p ope t) and the right of inhe itan#e are guaranteed6 .wnership of propert) # eates ights and duties and sho!%d se "e the $e%%)eing of )oth the individual and the communit)6 No pe son (a& )e dep i"ed of his?her propert) or of the ights de i"ing f o( it, e-#ept in #ases #on#e ning the p!)%i# inte est determined b) law6 0f propert) is e-p op iated or est i#ted, ightf!% #o(pensation not %o$e than its (a ket "a%!e is guaranteed6 "rticle 8 Foreign sub*ects in the Republic of Macedonia (a& a#+!i e the ight of o$ne ship of p ope t& !nde #onditions dete (ined b) law6 "rticle 87 E"e &one has the right to wor#, to f ee #hoi#e of e(p%o&(ent, p ote#tion at $o k and (ate ia% assistan#e d! ing te(po a & !ne(p%o&(ent6 E"e & 0o) is open to all !nde e+!a% #onditions6 ,ver) e(p%o&ee has a right to app op iate e(!ne ation6 ,ver) emplo)ee has the right to paid dai%&1 $eek%& and ann!a% %ea"e6 ,mplo)ees #annot $ai"e

this ight6 The e>ercise of the rights of emplo)ees and their position are regulated b) law and #o%%e#ti"e ag ee(ents6 "rticle 88 ,ver)one is o)%iged to pa& ta- and other p!)%i# #ont i)!tions, as well as to sha e in the dis#ha ge of p!)%i# e-pendit! e in a manner determined b) law6 "rticle 89 -itizens have a right to so#ia% se#! it& and so#ia% ins! an#e, determined b) law and collective agreement6 "rticle 8: The Republic p o"ides fo the so#ia% p ote#tion and social securit) of citizens in a##o dan#e $ith the p in#ip%e of so#ia% 0!sti#e6The Republic guarantees the ight of assistan#e to citizens who are infi ( o !nfit fo $o k6The Republic provides pa ti#!%a p ote#tion for in"a%id pe sons, as well as #onditions for their in"o%"e(ent in the %ife of the so#iet&6 "rticle 8; The Republic guarantees pa ti#!%a so#ia% se#! it& ights to "ete ans of the Anti'Fas#ist ;a and of all Ma#edonian nationa% %i)e ation $a s, to $a in"a%ids, to those e-pe%%ed and i(p isoned fo the ideas of the sepa ate identit& of the Macedonian people and of Macedonian statehood, as well as to (e()e s of thei fa(i%ies $itho!t (eans of (ate ia% and so#ia% s!)sisten#e6 The pa ti#!%a ights are regulated b) law6 "rticle 8< 0n order to e>ercise their economic and social rights, citizens have the right to esta)%ish t ade !nions6 Trade unions #an #onstit!te #onfede ations and )e#o(e (e()e s of inte nationa% t ade !nion o gani,ations6 The law (a& est i#t the conditions for the e>ercise of the right to trade union organization in the a (ed fo #es, the police and ad(inist ati"e )odies6 "rticle 88 The right to st ike is guaranteed6 The law ma) restrict the conditions for the e>ercise of the right to stri#e in the armed forces, the police and administrative bodies6 "rticle 8! ,ver) citizen is guaranteed the ight to hea%th #a e6 -itizens have the right and dut) to p ote#t and p o(ote thei o$n hea%th and the hea%th of othe s6 "rticle 9= The Republic provides pa ti#!%a #a e and p ote#tion for the fa(i%&6 The lega% e%ations in (a iage, the famil) and #oha)itation are regulated b) law6 2arents have the right and dut) to p o"ide fo the n! t! ing and ed!#ation of their children6 -hildren are esponsi)%e fo the #a e of their o%d and infi ( pa ents6 The Republic provides particular protection for pa ent%ess #hi%d en and #hi%d en $itho!t pa enta% #a e6 "rticle 9

0t is a human right f ee%& to de#ide on the p o# eation of #hi%d en6 The Republic #ond!#ts a h!(ane pop!%ation po%i#& in order to p o"ide )a%an#ed e#ono(i# and so#ia% de"e%op(ent6 "rticle 97 The Republic particularl) protects mothers, children and (ino s6 " pe son !nde 4< &ea s of age cannot be emplo)ed6 Minors and mothers have the right to particular p ote#tion at $o k6 Minors (a& not )e e(p%o&ed in wor# which is det i(enta% to their health or (o a%it&6 "rticle 98 ,ver)one has the right to a hea%th& en"i on(ent to %i"e in6 ,ver)one is o)%iged to p o(ote and p ote#t the environment6 The Republic provides conditions for the e>ercise of the right of citizens to a health) environment6 "rticle 99 ,ver)one has a right to ed!#ation6 ,ducation is a##essi)%e to e"e &one !nde e+!a% #onditions6 p i(a & ed!#ation is #o(p!%so & and f ee6 "rticle 9: -itizens have a right to esta)%ish p i"ate at s#hoo%s at a%% %e"e%s of ed!#ation, $ith the e-#eption of primar) education, under conditions determined b) law6 "rticle 9; The a!tono(& of !ni"e sities is guaranteed6 The conditions of esta)%ish(ent1 pe fo (an#e and te (ination of the activities of a universit) are regulated b) law6 "rticle 9< The freedom of s#ho%a %&1 a tisti# and othe fo (s of # eati"e $o k is guaranteed6 Rights deriving from scholarl), artistic or other inte%%e#t!a% # eati"e $o k are guaranteed6 The Republic sti(!%ates1 assists and p ote#ts the de"e%op(ent of s#ho%a ship1 the a ts and #!%t! e6 The Republic stimulates and assists s#ientifi# and te#hno%ogi#a% de"e%op(ent6 The Republic stimulates and assists te#hni#a% ed!#ation and sport6 "rticle 98 Members of nationalities have a right freel) to e>press, foste and de"e%op their identit& and nationa% att i)!tes6 The Republic guarantees the protection of the ethnic, cultural, %ing!isti# and religious identit) of the nationalities6 Members of the nationalities have the right to establish instit!tions fo #!%t! e and a t, as well as s#ho%a %& and othe asso#iations for the e>pression, fostering and development of their identit)6 Members of the nationalities have the right to inst !#tion in thei %ang!age in primar) and se#onda & ed!#ation, as determined b) law6 0n schools where education is #a ied o!t in the language of a nationalit), the Macedonian %ang!age is a%so st!died6 "rticle 9! The Republic cares for the stat!s and ights of those pe sons )e%onging to the Ma#edonian peop%e in neigh)o! ing #o!nt ies, as well as Macedonian e-pat iates, assists their #!%t! a% de"e%op(ent and p o(otes %inks with them6 The Republic cares for the cultural, economic and social rights of the #iti,ens of the Rep!)%i# a) oad6

=. 2!a antees of )asi# f eedo(s and ights "rticle := ,ver) citizen (a& in"oke the protection of freedoms and rights determined b) the -onstitution )efo e the eg!%a #o! ts, as well as )efo e the Constit!tiona% Co! t of Ma#edonia, th o!gh a p o#ed! e )ased !pon the p in#ip%es of p io it& and ! gen#&6 >!di#ia% p ote#tion of the %ega%it& of indi"id!a% a#ts of state ad(inist ation, as well as of other instit!tions #a &ing o!t p!)%i# (andates, is guaranteed6 " citizen has the right to )e info (ed on h!(an ights and )asi# f eedo(s as well as a#ti"e%& to #ont i)!te, individuall) or 0oint%& $ith othe s, to their promotion and protection6 "rticle : 0n the Republic of Macedonia %a$s sha%% )e in a##o dan#e $ith the -onstitution and a%% othe eg!%ations in accordance with the -onstitution and law6 ,ver)one is o)%iged to espe#t the -onstitution and the laws6 "rticle :7 4aws and other regulations are p!)%ished )efo e the& #o(e into fo #e6 4aws and other regulations are published in ?The Offi#ia% 2a,ette of the Rep!)%i# of Ma#edonia? at (ost se"en da&s afte the da) of thei adoption6 4aws #o(e into fo #e on the eighth da& afte the da& of thei p!)%i#ation at the ea %iest, or on the da& of p!)%i#ation in e-#eptiona% #ases determined b) the "ssembl)6 4aws and other regulations (a& not ha"e a et oa#ti"e effe#t, e>cept in cases when this is (o e fa"o! a)%e fo the #iti,ens6 "rticle :8 Atto ne&ship is an a!tono(o!s and independent p!)%i# se "i#e, p o"iding %ega% assistan#e and #a &ing o!t p!)%i# (andates in accordance with the law6 "rticle :9 The freedoms and rights of the individual and citizen #an )e est i#ted on%& in #ases determined b) the -onstitution6 The freedoms and rights of the individual and citizen can be restricted d! ing states of $a o e(e gen#), in a##o dan#e $ith the p o"isions of the -onstitution6 The restriction of freedoms and rights cannot dis# i(inate on g o!nds of se>, race, colour of s#in, language, religion, national or social origin, propert) or social status6 The restriction of freedoms and rights #annot )e app%ied to the ight to %ife, the inte di#tion of to t! e, inh!(an and h!(i%iating #ond!#t and p!nish(ent, the %ega% dete (ination of p!nisha)%e offen#es and senten#es, as well as to the f eedo( of pe sona% #on"i#tion, conscience, thought and religious confession6 6. Fo!ndations fo e#ono(i# e%ations "rticle :: The freedom of the (a ket and ent ep ene! ship is guaranteed6 The Republic ens! es an e+!a% %ega% position to a%% pa ties in the mar#et6 The Republic takes (eas! es against (onopo%isti# positions and (onopo%isti# #ond!#t on the mar#et6 The freedom of the mar#et and entrepreneurship san be restricted b) law on%& fo easons of the defence of the Republic, protection of the nat! a% and %i"ing en"i on(ent or public health6 "rticle :;

"ll the nat! a% eso! #es of the Republic of Macedonia, the f%o a and fa!na, a(enities in #o((on !se, as well as the o)0e#ts and )!i%dings of pa ti#!%a #!%t! a% and histo i#a% "a%!e determined b) law, are a(enities of #o((on inte est for the Republic and en0o& pa ti#!%a p ote#tion6 The Republic guarantees the protection, promotion and enhan#e(ent of the historical and a tisti# he itage of the Macedonian people and of the nationalities and the t eas! es of $hi#h it is #o(posed ega d%ess of thei %ega% stat!s6 The law eg!%ates the (ode and #onditions under which spe#ifi# ite(s of gene a% inte est for the Republic can be #eded fo !se6 "rticle :< The Republic of Macedonia sti(!%ates e#ono(i# p og ess and p o"ides fo a (o e )a%an#ed spatia% and egiona% de"e%op(ent, as well as for the (o e apid de"e%op(ent of e#ono(i#a%%& !nde de"e%oped egions6 "rticle :8 O$ne ship and %a)o! fo ( the )asis for (anage(ent and sha ing in de#ision'(aking 6 Pa ti#ipation in management and decision&ma#ing in public instit!tions and se "i#es is regulated b) law, on the p in#ip%es of e-pe tise and #o(peten#e6 "rticle :! 6 The term of office of a *udge ceases & if he?she so re(uests' & if he?she permanentl) loses the capabilit) of carr)ing out a *udge As office, which is determined b) the Cudicial -ouncil of the Republic of Macedonia' & if he?she fulfils the conditions for retirement' & if he?she is sentenced for a criminal offence to a prison term of a minimum of si> months' & if he?she is elected or appointed to another public office, e>cept when his?her *udicial function rests under conditions determined b) law' " *udge is discharged & when he?she commits a serious disciplinar) offense which ma#es him?her unsuitable to perform a *udge As office prescribed b) law' and & he?she performs her *udicial dut) unprofessionall) and unethicall) under conditions stipulated b) law6 76 -lause of this amendment replaces paragraph 8 of "rticle !! of the -onstitution of the Republic of Macedonia6 AMENDMENT BB/II 6 " *udge shall not be held responsible for an opinion given in the process of rendering a court decision6 " *udge shall not be detained without the consent of the Cudicial -ouncil, e>cept when caught in committing a criminal act for which a prison sentence of at least five )ears is prescribed6 76 The *udicial function is incompatible with membership in a political part) or with another public function or profession determined b) law6 86 -lause of this amendment replaces paragraph 7 of "rticle == of the -onstitution of the Republic of Macedonia, and clause 7 of this amendment replaces paragraph 8 of "rticle == of the -onstitution of the Republic of Macedonia6 AMENDMENT BB/III 6 The Cudicial -ouncil of the Republic of Macedonia is an independent and autonomous institution of the *udiciar)6 The -ouncil shall ensure and guarantee the independence and the autonom) of the *udiciar)6 The Cudicial -ouncil is composed of fifteen members6 The 2resident of the Supreme -ourt of the Republic of Macedonia and the Minister of Custice are e> officio members of the Cudicial -ouncil6 ,ight members of the -ouncil are elected b) the *udges from their own ran#s6 Three of them shall belong to the communities that are not ma*orit) in the Republic of Macedonia, insuring that e(uitable representation of citizens belonging to all communities shall be observed6 Three members of the -ouncil are elected b) the "ssembl) of the Republic of Macedonia with ma*orit) votes of the total number of M2As, and with ma*orit) votes from the total number of M2As who belong to the communities that are not ma*orit) in the Republic of Macedonia6 Two members of the -ouncil are proposed b) the 2resident of the Republic of Macedonia and are elected b) the "ssembl) of the Republic of Macedonia, and one of them shall belong to the communities that are not ma*orit) in the Republic of Macedonia6 The members of the -ouncil elected b) the "ssembl) of the Republic of Macedonia, on a proposal of the 2resident of the Republic of Macedonia shall be from among 1niversit) law professors, law)ers and other prominent *urists6 The members of the -ouncil are elected for a term of si> )ears, with the right to one re&election6 The criteria and manner of election, as well as the basis and the procedure for termination of the mandate and dismissal of a member of the -ouncil shall be determined b) law6 The office of a member of the -ouncil is incompatible with membership in political parties and with performance of other public offices and professions determined b) law6

76 This amendment replaces "rticle =9 of the -onstitution of the Republic of Macedonia6 AMENDMENT BBIB 6 The Cudicial -ouncil of the Republic of Macedonia & elects and dismisses *udges and la) *udges' & determines the termination of a *udgeAs office' & elects and dismisses 2residents of -ourts' & monitors and assesses the wor# of the *udges & decides on the disciplinar) accountabilit) of *udges' & has the right to revo#e the immunit) of *udges' & proposes two *udges for the -onstitutional -ourt of the Republic of Macedonia from among the *udges' and & performs other duties stipulated b) law6 .n the election of *udges, la) *udges and court presidents, e(uitable representation of citizens belonging the all communities shall be observed6 The -ouncil shall submit an annual report for its wor# to the "ssembl) of the Republic of Macedonia in from, content and manner determined b) law6 76 This amendment replaces "rticle =: of the -onstitution of the Republic of Macedonia and deletes line : of paragraph , "rticle ;8 of the -onstitution of the Republic of Macedonia6 AMENDMENT BBB 6 The 2ublic 2rosecutor As .ffice performs his?her duties on the basis of the -onstitution and law and the international agreements ratified in accordance with the -onstitution6 The function of the 2ublic 2rosecutorAs .ffice is performed b) the 2ublic 2rosecutor of the Republic of Macedonia and b) the public prosecutors6 The competences, establishment, termination, organization and functioning of the 2ublic 2rosecutorAs .ffice is stipulated b) law adopted b) a two&thirds ma*orit) vote of the total number of M2As6 The 2ublic 2rosecutor of the Republic of Macedonia is appointed and dismissed b) the "ssembl) of the Republic of Macedonia for a term of si> )ears with the right to re&election6 The public prosecutors are elected b) the -ouncil of 2ublic 2rosecutors and their term of office shall have no restrictions6 0n the election of public prosecutors, e(uitable representation of citizens belonging to all communities shall be observed6 The -ouncil decides on dismissal of public prosecutors6 The competences, composition and structure of the -ouncil, the term of office of its members, as well as the basis and the procedure for termination of the mandate and for the dismissal of a member of the -ouncil is stipulated b) law6 The basis and the procedure for termination of the mandate and dismissal of the 2ublic 2rosecutor of the Republic of Macedonia and .F the public prosecutors are determined b) law6 The function of the 2ublic 2rosecutor of the Republic of Macedonia and of a public prosecutor is incompatible with membership in a political part) or with performance of an) other public functions and professions stipulated b) law6 2olitical organization and activit) in the public prosecution is prohibited6 76 This amendment replaces paragraphs 7 and 8 of "rticle =; of the -onstitution of the Republic of Macedonia and deletes "rticle =< of the -onstitution of the Republic of Macedonia6 AMENDMENT BBBI 6 " candidate is elected 2resident if he?she wins a ma*orit) of the votes of those who voted, provided more than 9=H of the registered voters voted6 76 This "mendment replaces paragraph : of "rticle 8 of the -onstitution of the Republic of Macedonia6 AMENDMENT BBBII
