    DearSenators, IwantedtoreachoutandsharethereasonswhyIvotedtonotletRep.GayGrant'sLR2488aka'the phthalatesbill'intothesecondsession. Isuspecttherewillbealotofconversationaboutthisbillandwantedtomakesureyouheardfromme. Asyoucanimagine,thisvotewasanextremelydifficultvote.Ihavespentalotoftimelearningmore abouttheissue,understandingthishistory,meetingwithadvocates,anddeliberatingaboutmychoice. TofullyunderstandhowIgothere,onemustappreciatethehistoryofthekidssafeproductact (KSPA).Andletmebecleartherearebetterhistoriansofthisbillthenme. TheKSPAwasinitiatedinthe123rdlegislaturebyMajorityLeaderHannahPingreeoftheHouse.In thatsession,thelegislaturedevelopedasystembywhichtoxicchemicalswerelisted,howtheywould becomeprioritychemicals,andthestepsofeliminatingthosechemicalsfromconsumerproducts(by findingalternatives).Thelistcontained49chemicalsandduringGovernorBaldacci'sfinalterm,inthe 124thlegislature,helistedtwochemicalsfortheprioritylist(BPAbeingthemajorone). WhenGovernorLePagetookoffice,heattemptedtoweakentheKSPAanddeprioritizethetwo chemicalsthatwerelistedbythelegislatureinthe124thlegislature.

    ThankfullyevenwhileDemocrats wereintheminority,thelegislaturerejectedbothattempts.The125thlegislaturedidreformtheKSPA inabipartisanmanner.But,afterlosingbothattempts,theLepageadministrationignoredKSPAand hasnotlistedanynewprioritychemicals.Ithasbeenthreeyearsofnoactivity. Thisbringsustothe126thandtoday.OfcourseyouallrememberSethGoodall'sbilltoimprovethe KSPAthatwaspassed,vetoedbyGovernorLePageandnotoverturned. RepresentativeGrant'sbillwasattemptingtoinitiatetheprioritychemicalprocessbypickingafew chemicalsfromthe49chemicalslisted.Rep.GrantworkingwiththeEnvironmentalCoalitionidentifieda fewveryharmfulchemicalsonthelist:phthalatesbeingthemajorone.Rep.Grant'sbillmadealotof sensebecausetheadministrationhadtakennoactionforthreeyears. Thisweek,IlearnedthattheLePageadministrationhasmovedfourchemicals(Formaldehyde,Arsenic, Mercury,andCadmium)intotheprioritylist.Nextweektheprioritychemicalswillpublishedandmove intorulemaking.WhileIdon'tagreewiththesechemicals,whileIwishmorechemicalswerebeing listedbyLePageadministrationandI'dhopedthatthechemicalstheGovernorchosealignedwithRep. Grant,IcouldnotignorethattheGovernorismovingforwardunderthelawandsystemcreatedbythe legislature.

    SoIvotedagainstthebilltodaybecauseit'simportantthatwekeeptheintegrityoftheKSPAforthe longrun.BeforetheKSPA,chemicalswerecherrypickedindividuallyandtherewasnorhymeor reason.Idon'twanttogobacktothatsystem. Finally,asmayknow,thisbillisapoliticallightingrod(youallrememberSeth'sbill)andgiventheshort sessionandhowmuchbipartisanworkisaheadofus,Ivotedtokeepthisbilloutofthemix. IhopethatthisemailgivesyouabriefsenseofmyvoteandIwouldbehappytodiscussthisfurther withanyoneinthecaucusXXXXXXX. Best, Justin
