(2nd speaker: GBJM) In a Realistically speaking divorce is absurd, simply because its failure on grounds on legality/ constitutionality, religion,

society, psychology and economy of the Philippines and all its subjects Expert Insight Some experts want to strengthen laws-making divorce more difficult to obtain a divorce in order to protect women, the American Sociological Review states. From a sociological standpoint, The Law and Economics of Marriage and Divorce agrees, impossibility of divorce laws could shield women from the disadvantages of divorce and could improve the quality of both mens and womens lives over the long term. When marriage seems more permanent, people feel more willing to invest in relationships and to cooperate in reaching long-term goals. Filipino Quotes: Ang kasal ay hindi mainit na kanin na kapag inisubo / isinubo mo na iluluwa mo nalang pag napaso ka! Holy matrimony should remain holy. This is not just a plain contract sign off when you feel like things are going out of its way, you can at any time terminate it. The more that it is not just like dining into a restaurant, if you dont like the menu, you can at any time go and find another place. Definitely, theres no perfect relationship in this world but it does not excuse us for being irresponsible of whatever decision we make. This differs marriage with other commitments, simply because marriage is not just a contract that is legally binding, but a God-bonded commitment as well -CONSTITUTIONALITY/LEGALITY: Paper presented to the Committee on Revisions of Laws by atty. Jo Aurealmbong of the EDUCHILD foundation, an association of parents committed to defending the families strongly provided opposition on divorce. Section 2 of the Article XV of the Constitution clea rly states that Marriage, as an inviolable (unbreakable) social institution, is the foundation of the family and shall be protected by the state. Section 12 of the same Article further states that the states recognizes sanctity of family life and shall protect and strengthen the family as basic autonomous social institution. The words of Constitution are unmistakable: marriage is an inviolable social institution. Any attempt to allow divorce to exist will run counter to this noble declaration of the constitution. This attempt will violate the spirit of the constitution. Divorce is therefore unconstitutional and it obviously violates the section 1-3, Article XV of the 1987 Constitution of the Philippines. Adoption of divorce would

require amendment of certain provisions of our constitution. Constitutional amendments entail a lot of expenses. Millions of pesos are needed to undertake such political exercise. According to former Archbishop Oscar Cruz, it questions the morality of both party and it violates the Philippine Law (Saludo, 2011) Upon pursuance there will be more relationships that would be more attracted to engage to utilize this remedy that would destroy the significance of the family. That is under the Article 14 of the Family Code, the family being the foundation of the nation, is a basic social institution which public policy cherishes and protects. Consequently, family relations are governed by law and no custom, practice or agreement destructive of the family shall be recognized or given effect. (According to Article 63,a) section 2 of the Divorce bill to be introduced in the Philippines) The absolute community of the conjugal partnership shall be dissolved and liquidated. There will be a continuation of irresponsible parenthood. It violates Family Code Title 3 under article 68, on the Rights and Obligations between Husband and Wife, the husband and wife are obliged to live together, observe mutual love, respect and fidelity, and render mutual support and help. -RELIGION: To the married I give this command: a wife must not separate from her husband. But if she does, she must remain unmarried or else be reconciled to her husband. And a husband must not divorce his wife that is according to I Corinthians 7:10-11 And I say to you, whoever divorce his wife and marries another commits adultery; and whoever marries her who is divorced commits adultery Matthew 19:9 The bible recognizes the legal aspects of marriage; it presents a higher view of marriage as a relationship based upon respect, trust, love and commitment. God intended marriage to be a lifetime covenant between one man and one woman. As stated in the bible, there are many reasons for failure in a relationship and to resort to divorce as a way out is not in keeping Gods purpose. Therefore divorce is a sin, and not a pardonable sin.

Theology professor Mr. James Marthue said, he says that divorce is divorce, and God hates it. It was only men who wants it, not God. It never help ease the trauma caused by divorce, but it marked the wickedness of the right to remarry which violates the natural law, under the Catechism of the Catholic Church. 2384, divorce is a grave offense against the natural law. It claims to break the contract, to which the spouses freely consented, to live with each other till death. Divorce does injury to the covenant of salvation, of which sacramental marriage is the sign. Contracting a new union, even if it is recognized by civil law, adds to the gravity of the rupture: the remarried spouse is then in a situation of public and permanent adultery.

If a husband, separated his wife, approaches another woman, he is an adulterer because he makes that woman commit adultery; and the woman who lives with him is an adulteress, because she has drawn anothers husband to herself. 2385, divorce is immoral also because it introduces disorder into the family and into society. This disorder brings grave harm to the deserted spouse, to children traumatized by the separation of their parents and often torn between them, and because of its contagious effect which makes it truly a plague on society.

-ECONOMY: Research by the Marriage and Religion Research Institute found that marriage is a key contributor to human capital, or the ability a person has to contribute to economic value. Since Human capital is a contributor to economic growth, the research found a positive link between marriage and a healthy economy. Marriage causes economic growth, Henry Potrykus, MARRI senior f ellow and co-author of the study, said. Married men experience greater rates of income increase than single men, and the rate of income increase for a newly divorced man drops almost to that of his always-single counterparts through the divorce. Because of this, the explosion of divorce in this country has resulted in a loss in productivity growth. The divorce revolution has undermined growth in the United States Economy. The research also found that when divorce rates increased in recent decades, productivity and wage gains in men decreased. This, in turn, led the researchers to conclude that divorce hurt economic growth, particularly in men. [Men are Happier at Work Than Women, Survey Finds] Not only is divorce bad for the economy, but previous researc h finds its bad for the earth, too. According to Livescience report that was based on research by the

Proceedings of the National Academy of Science, rising divorce rates in recent decades has resulted in a rise in the number of households with fewer people around the world. Places with strict religious policies regarding divorce, are having more divorced households, said co-author Jianguo Liu of Michigan State University. We have a high divorce rate here. Its bad for the society from an economic point of view. When you divorce, each family now needs two apartments and two cards, she said. A woman often encounters financial distress after divorce, because she loses her husbands salary as a source of income. A divorced woman is likely to end up in the bottom quartile of income distribution, explains the Centre for Economic Performance. An article published in the American Sociological Review concurs, concluding that the average divorced woman has less money than the average married woman, even when accounting for certain variables. The authors state that all women face significant economic vulnerability outside of marriage. Because divorce often hinders and harms women in several ways, the rise in divorce has also created a greater taxpayer burden, notes The Law and Economics of Marriage and Divorce. Government welfare for single mothers and their children has continually increased in the United States. In the last 50 years, the percentage of single-mother households has risen from 8 percent to more than a quarter of the U.S. population, notes the Network on the Family and the Economy. Women account for 90 percent of those single parents. The government has also spent more money offering mental health services, since divorce increases psychological problems among women.
