Plaintiff Versus Nafees Khan, Son of Qasim Khan, Caste Yusufzai, Resident of House No.11, Street 12, G-9/4, Islamabad Defendant SUIT FOR DISSOLUTION OF PARTNERSHIP AND RENDITION OF ACCOUNTS RESPECTFULLY SHOWETH: 1. That on 24-04-2008 plaintiff entered in to a partnership agreement with defendant to carry out business in the name of "Friends Associates. 2. That according to the terms and conditions of the agreement both the partners opened a joint account in Askari Bank, main Blue Area, Islamabad with the name of the firm and started using the account for the business. 3. That according to expressed provisions of partnership agreement no partner can carry on the business in his name or take, deliver and transfer any of assets of the firm without prior and express consent of the partner.

4. That on 10-09-2009 the plaintiff came to know that the defendant had entered in to the agreement with "Messers World Wide Business Corporation" pretending to be the sole owner of the firm. In this respect he had opened an account in "Muslim Commercial Bank" and received the amount in his own name. 5. That plaintiff approached the defendant to stop his illegal and arbitrary act but the defendant paid no attention to the grievance of the plaintiff.

6. That on 01-01-2010 plaintiff served a legal notice in this regard to the defendant but the defendant did not stop his illegal act. 7. That the cause of action arose firstly on 10-09-2009 when the defendant first violated the terms of the partnership agreement and finally on 01-01-2010 when the defendant failed to act according to the agreement. 8. That plaintiff and the defendant both reside in Islamabad so this Honorable Court has jurisdiction. 9. That the prescribed court fee has been affixed on the plaint. In the circumstances mentioned above it is most humbly prayed from this Honorable Court that the Partnership may most graciously be dissolved and appoint a receiver for the rendition of accounts of the firm may pleased be ordered. Any others relief which this Learned Court deems fit may also be granted.
