Dear Sir, This is a complaint against Mr Uday Kumar Varma, Ex Secretary I&B for using sponsored public forum to lobby for pay broadcasters and mislead the media as well as the public at large about developments taking place in the industry. He is trying to influence the Regulator and the Government making biased statements.

He has stated that 10+2 mints Ad Cap is an outdated regulation and is Arbitrary. It is surprising that why his observations are coming now in a Broadcaster Sponsored Event . These Regulatios are there since 2006, but never implemented during his tenure.

Please refer to the recent news items published in the Times of India dated 24 Sep titled Former I&B secy raises doubts on TRAIs ad cap and report titled Former I&B Secy proposes fresh study into ad cap dated 21 Sep 2013 published in Indiantelevision.com, an industry portal based on Mr Varmas address and interview in an award function EMVIES organized by Indiantelevision.com and sponsored by Times Broadcastings pay channel Romedy in Mumbai. Mr Varma is no more with the Ministry but since he was the main proponent of total digitalization policy in cable television who planned and executed it for the benefit of only a few large pay TV broadcasters and their supported companies, his statements made in these interviews only a few months after his retirement from the concerned Ministry and published by national news papers (Who are a Pay TV broadcaster too) may be construed as an interference in the work of the Ministry and the Regulator TRAI who are working hard to clear the mess created by the warped policies framed under the helmsmanship of Mr Varma . Some of these policies have been declared Bad in Law by TDSAT and some of them are still under revision. He was also shown black flags by operators during BES Expo in Feb 2013. As long as Mr Varma was in the Ministry, he worked only for the large Broadcasters and their aligned MSOs and DTH and still maintains his loyalty towards them. He has done immense damage to CableTV Industry and Cable Operators in particular. He never spoke for REVIEW of Revenue Share for LMOs. He shunned all those who apprised him of the reality. He is very VINDICTIVE and ANTI-CONSUMER . He wants CONSUMERS to PAY SUBSCRIPTION a also WATCH LENGTHY ADVT. It appears he is working as an agent for BROADCASTERS to help them earn double. He is trying to help some broadcast media groups and their vertically/ horizontally integrated MSOs and DTH companies at the cost of CONSUMERS and Cable Operators. His CONDUCT after retirement should be investigated by agencies like CVC, CAG, CBI, Vigilance and other such investigating Agencies and his post retirement benefits should be forfeited for unbecoming conduct. We request that the DAS policies may please be reviewed and Mr Varma may be directed to abstain from making such remarks in public that support or criticize any policy. Ministry needs to investigate the matter seriously and take necessary action in public interest.
