the United States embassy in Kuwait. Nidal Abderrahman AYYAD's
IRNAME mmigrant visa was based upon approval of a visa petition filed in his
behalf by his lawful permanent resident father. Nidal Abderrahman
YYAD was classified as the unmarried son of a permanent resident
u hder section 203(a)(2) of the INA.

Investigation has shown that Nidal Abderrahman AYYAD was part of a
JIHAD organization in the United States. According to'the report of
investigation, this JIHAD organization was an international group
"opposed to nations, governments, institutions and individuals that
did not share the groups particular radical interpretation of Islamic
law." On October 1, 1995, members of this group were convicted in
United States District Court for the Southern District of New York of
various counts pertaining to a conspiracy to commit violent acts
against both persons and structures located in the United States.
Nidal Abderrahman AYYAD was named in the indictment, number S5 93 CR
181 (MBM), as an unindicted co-conspirator.
A review of federal indictment S5 93 Cr. 180 (KTD) and the judgement
in the above referenced federal criminal case, S5 93 Cr.00180-02(KTD)
as well as indictment S5 93 Cr. 181 (MBM), all from the United States
District Court for the Southern District of New York, indicates that
it is well established that Nidal Abderrahman AYYAD's actions were
antithetical to the interests of the United States, both before and
after his naturalization. Based on the material contained in the
conviction, in the indictments and in the investigative report, there
appears to be more than ample evidence supporting civil action to
denaturalize Nidal Abderrahman AYYAD pursuant to section 340 (a) (2)
and/or sections 340 (c) and 313 (3) of the INA.
I have read the District Counsel's opinion and I strongly concur with
it. After reviewing the appended material, including the written
opinion of the District Counsel, please forward your recommendation to
my attention.

Investigation is predicated upon the fact that SUBJECT,


within five years of naturalization, became a member of an
organization, which at the time of naturalization would have
precluded SUBJECT from naturalization under section 313 (4) of
the Immigration and Nationality Act (INA). The authority for
revocation of citizenship of SUBJECT is contained in 340 (c) of
the INA.
Violation/Venue
On 2/21/91 SUBJECT was interviewed, at Newark New
Jersey, by the Immigration and Naturalization Service (INS), and
signed the affidavit portion of form N-400, Application to File
Petition for Naturalization, -in which SUBJECT attested that his
answers to the questions on form N-400 were true.
Question #44 of the N-400 asks, Do you believe in the
Constitution and form of Government of the United States?
SUBJECT responded yes to this question.
Question #45 of the N-400 asks, Are you willing to take
the full oath of allegiance to the United States? SUBJECT
responded yes to this question.
On 2/21/91, at Newark, New Jersey, SUBJECT was
administered the oath of citizenship.
On 3/07/91, the Clerk of the Court for the United
States of America, District of New Jersey, affixed the Seal of
the Court, to Certificate of Naturalization # 14809286, which is
registered to SUBJECT.

From on or about April 1992 SUBJECT and his co-
conspirators confederated, agreed and did do damage to the World
Trade Center Complex located in New York City, by use of an
improvised explosive device, causing personal injury to numerous
persons and further causing the death of six persons. The
property damage was believed to be in excess of $590 million
dollars.
The bombing of the World Trade Center by SUBJECT and
his co-conspirators was part of a larger conspiracy which was
designed to levy a war of urban terrorism against the United
States, to oppose by force the authority of the United States and
by force, prevent, hinder and delay the execution of laws of the
United States.
SUBJECT was part of a JIHAD organization in the United
States. This JIHAD organization was an international group
opposed to nations, governments, institutions and individuals
that did not share the groups particular radical interpretation
of Islamic law. This group was particularly active in the New
York City metropolitan area. A principal objective of this JIHAD
organization was to carry out and conspire to carry out and
conspire to carry out, acts of terrorism, including bombings,
murder, and taking of hostages against various governments and
government officials including the United States Government and
its officials.
On 3/4/94 SUBJECT was convicted in the Southern
district of New York for his participation in the bombing of the
World Trade Center.
SUBJECT was named as an unindicted co-conspirator in
the conspiracy to wage a war of urban terrorism against the
United States for which the defendants were convicted on
10/01/95.

Dear Requester:

Our records reflect that Nidal Abderrahman Ayyad was admitted to


the United States as a lawful permanent resident at New York, New
York on October 10, 1985.

Subject was naturalized in the United States District Court,


Newark, New Jersey on March 7, 1991.

I regret that I am unable to comply with your entire request.


The Privacy Act of 1974, Public Law 93-579, specifically
prohibits the disclosure of personal information about
individuals who are United States citizens or aliens lawfully
admitted for permanent residence without their prior written
consent; (5 U.S.C. 552a (b)). Such information is also exempt
from mandatory disclosure under the Freedom of Information Act as
it is:

a. personnel and medical files and similar files the


disclosure of which would constitute a clearly
unwarranted invasion of personal privacy; (5 U.S.C. 55?.
