FYI and action. The documents he refers to are the supporting documents to the /

administrative record designating certain groups as FTOs. (DOS request 1, /
#6). This is the first thing that they have made available (we have received /
nothing else yet) . •——/
FYI, Treasury was making similar noises about this in our meeting this morning.
I am happy to respond to this but need more information about the status of the
third party rule. Please advise. Thank you.

John: Sorry to be taking some time with this. I understand that the
records you identified for copying include a fair number of intelligence
community documents. It looks like we will process through our system for
release those docs which are ours, but we will probably have to refer you to
CIA to obtain their docs that are part of our records. FYI at this point.

Karl hasn't got back to me, but what I will propose to him is a dedicated
reading room where we can go and review the documents according to our
timetable. The difficulty is that they are using these documents to prepare
renewals, so each set may be available off and on. Additionally, I would
like to review and release the documents as soon as we can, so we are not
tying up documents for months at a time. Obviously, administrative
convenience will take a back seat to our investigative needs, but to the
extent we can move documents through the process, I think we should.

11. If not covered in earlier requests, memoranda, reports and summaries received by the
Secretary, Deputy Secretary, any Under Secretary, the Assistant Secretary of Economic
and Business Affairs, the Assistant Secretary of International Narcotics and Law
Enforcement, or the Coordinator for Counterterrorism of the Department relating to
U.N. Security Council resolutions 1373, 1390, and 1455 and preparation of the U.S.
report (and any follow-up thereto) to the Counter-Terrorism Committee required by
UNSCR 1373.
12. Memoranda, reports and summaries used in preparing the discussion of terrorist
financing in the annual Patterns of Global Terrorism for the years 1998 - 2002.
The Commission requests that the documents requested above be provided as soon as
they are available, even though all requested documents may not be provided at the
same time, through means of a "rolling" production.
If any requested documents are withheld from production, even temporarily, based on
an alleged claim of privilege or for any other reason, the Commission requests that the
respondent, as soon as possible and in no event later than the productipn date, identify
and describe each such document or class of documents, as well as llfte1 alleged basis for
not producing it, with sufficient specificity to allow a meaningful challenge to any such
withholding.
If the respondent does not have possession, custody or control of any requested
documents but has information about where such documents may be located, the
Commission requests that the respondent provide such information as soon as possible
and in no event later than the production date.
If the respondent has any questions or concerns about the interpretation or scope of
these document requests, the Commission requests that any such questions or concerns
be raised with the Commission as soon as possible so that any such issues can be
addressed and resolved prior to the production date.

The National Commission on Terrorist Attacks Upon the United States (the "Commission")
requests that the Department of State ("respondent") provide the Commission no later than July , 2003
(the "production date") with copies of the following documents:
1) the administrative records (including classified information) underlying the designation and, if
applicable, redesignation(s) by the Secretary of State of the following organizations as "foreign
terrorist organizations" (FTOs) pursuant to 8 U.S.C. 1189: Abu Sayyaf Group (ASG); 'Asbat al Ansar;
Al-Gama'a al-Islamiyya (Islamic Group, IG); Harakat ul-Mujahidin (HUM); Islamic Movement of
Uzbekistan (IMU); Jaish-e-Mohammed (JEM); Jemaah Islamiya (JI); Al-Jihad (Egyptian Islamic
Jihad); Lashkar-e-Tayyiba (LT); Lashkar I Jhangvi (LJ); Al-Qaida; and Salafist Group for Call and
Combat (GSPC); and
2) any other documents that refer to Osama bin Laden or Al-Qaida that are contained within the
administrative records underlying the designation or redesignation(s) by the Secretary of State of other
foreign terrorist organizations (FTOs) pursuant to 8 U.S.C. 1189.
