to its Board of Directors
The success of BAR Services is not just down to the hard work of the management team and its strong
team of staff but also the support of an experienced Board of Directors.

This is why BAR Services is now delighted to welcome
Brian Maidman of Maidmans Removals to its Board
knowing that Brians knowledge of the removals
industry and of the BAR will help the company
continue to grow and develop.
Brian began his career in the removals industry
purely by chance. In his home town of Poole, a friend
was in need of a pair of hands to help move a 3-piece
suite. Brian was that friend and from there grew a
passion and an idea that became Maidmans
Removals. One of the founding partners in 1979, the
company has grown, diversied and achieved an
excellent reputation in the industry. In 2008,
Maidmans became the rst company to achieve three
BSI standards in domestic removals, commercial
relocations and storage services.
Brian is without a doubt an incredibly busy person
and actively involved in the BAR. He has served as BAR
Area Secretary, Vice Chairman and Chairman and has
worked with The Movers Institute. He has been closely
involved and is still instrumental in the development
of standards as a Commercial Moving Group
Councillor, and more recently, has been a Director
of the BAR board.

So why has Brian decided to be further involved in the
running of the company that is BAR Services? Brian is
already an incredibly loyal BAR Services customer
currently buying 100% of his packaging products
through BAR Services. Brian also thoroughly enjoyed
his role as a Directly Elected Director on the BAR Board
of Directors and although this was originally a two-
year contract Brian stayed in the position for four
years. Looking for a similar role, Brian saw the
opportunity to join the BAR Services Board as ideal.
As with most of Brians previous roles and as with all
of the existing BAR Services Directors, he will kindly be
giving his time voluntarily. Brian sees two signicant
and key contributions to his role on the board. Firstly,
he feels with his 30 years of experience he will be able
to shape and inuence policy for BAR Services that will
have a signicant benet to members in terms of
pricing and standards. Secondly, Brian wants to
understand the company and how it works; this way he
feels he will be better able to inuence and encourage
all Members to buy through BAR Services. This is
clearly something Brian is passionate about. I have
been a long and loyal customer of BAR Services and
this is because after years in the industry, I dont
believe Members can buy products of the same quality
any cheaper elsewhere, he says. As a cooperative,
BAR Services is the Members company and we should
be buying together. The more we buy together the
lower the prices and we all benet and it is my
intention to encourage members to this effect.
BAR Services feels it has a very bright future and that
with experienced, supportive and proactive directors
like Brian helping to nurture the company it can only
grow and expand. His experience in the eld is
undeniable and Miranda Hyder and Alison Cowie of
BAR Services hope Brian will spend many years
supporting them through his input on the Board.

Register in time for Ecotaxe!
BAR Afliate DKV Euro Service, a leading service provider to the transport and logistics industry, reminds

This new environmental Truck Tax, which will start
throughout France from 1 October 2013, applies to vehicles
over 3.5 tons, which represents between 200,000 and
250,000 non-French vehicles. These vehicles will be charged
on approximately 15,000km of motorways and national
roads. All companies working in the Removals and Storage
industry and regularly transporting through and within
France need to register before 1 October for a new On Board
Unit to maintain efcient and protable business
operations.
All vehicles affected by the new French laws that apply for
Ecotaxe have to be equipped with a certied satellite-based
On Board Unit. DKV Euro Service provides its customers with
a new DKV Box in order to adhere to this. This DKV Box will
handle post-payments for both toll systems in France (TIS
PL and Ecotaxe).
The nes of using the national roads from 1 October
without a certied Ecotaxe box are as follows: a ne of 750
will apply for the rst time, if it happens again a ne of
1,500 will be imposed. No other means such as cash or
cards can be used to pay for the Ecotaxe.
Since ordering and installing new On Board Units will
require planning, DKV Euro Service is urging transport and
logistics companies to register as soon as possible at one of
the Certied Tax Collectors appointed by Ecomouv, such as
DKV Euro Service, to ensure timely delivery of the new On
Board Units.
Advantages of registering with one of the ve Certied Tax
Collectors such as DKV Euro Service is that companies will
be able to apply for the post-pay scheme and that discounts
of approximately 10% will be provided on the applied levy.
Registering at DKV, which supports the industry, among
others, in cost management, compliance and operational
excellence, also offers all the benets of extensive reports
and services that DKV has to offer as well as all nancial
data within one invoice, so there are no additional
administrative tasks to perform.

Europe consults on Driver CPC changes
The European Commission has opened a
consultation about Driver CPC, ten years since the
original legislation was introduced by the EC in
July 2003. The Commission says that it wants to
assess how effectively the Directive has met its
objectives and what specic action and measures
may need to be adopted to improve its effectiveness.
The EC needs to prepare for possible follow-up
action and needs to assess what next steps,
including a possible revision of the Directive, ought
to be taken. The Freight Transport Association
(FTA) stated that it felt it was the right time for the
review, adding that based on the experience of its
members, improving Driver CPC legislation would
be a positive step at this stage for the freight
industry, helping ensure the continuous
professional development of drivers. Nevertheless,
James Firth, FTAs Head of Road Freight and
Enforcement Policy, warned: We do need to be
careful, however, not to fall into the trap of looking
to the Commission to solve problems through
regulation, and thus constraining the exibilities
of responsible operators who are already using
Driver CPC to good effect.
In fact, the Road Haulage Association (RHA) in
the UK has launched its own review of Driver CPC.
In the medium term, the UK has an opportunity
to help lead the debate about how the EU Directive
can be improved so that it is better suited to the
industry and uses modern training technology,
the RHA said.
The RHAs review will highlight examples of
progressive implementation by hauliers; and how
UK regulators can help hauliers and trainers to
take a exible, targeted approach to Driver CPC
training. The RHA is also considering strong calls
from members for new regulation around the idea
of requiring annual training something the RHA
pressed for unsuccessfully when the new rules were
introduced and to stop drivers doing the same
course up to ve times, as a tick-box exercise.

New guide to
French lorry tax
If you want to know more about the French
Truck Tax (see article above), Frances road
transport association, the FNTR, has published
a useful guide in English to the French Truck
Tax, or TPL (taxe poids lourds) which begins on
1 October 2013.
The guide for operators and drivers is

The spectrum of products and services of the trade
fair covers all areas of furniture logistics and moving,
including vehicle technology and accessories for
transportation and logistics as well as IT, software
and services in the areas of nance, security,
marketing and company management.
One of the highlights of this year will be the
traditional Fair Party on the 19 September, with free
food and drinks for all guests!
Another much anticipated part of MLo, is the
Innovation Awards Show. Outstanding new products
and services will be in the running for the Innovation

Hungarian warning
FEDEMAC has received information that there are
quality issues with On-Board-Units (OBUs) which
are currently being offered to hauliers to pay the
Hungarian toll which entered into force on 1 July
this year.
In particular, there is apparently no interface
between the OBU and the central system of the
Hungarian Motorway Authority and it is not
possible to programme key data such as the
number of axles, which are necessary to pay the
toll.
FEDEMAC is recommending that removers
exercise caution when buying OBUs and work
only with the so-called pre-purchased ad-hoc
tickets. The toll tariff for all vehicles liable to pay
toll charges is based on the distance travelled,
vehicle type, emission class and number of axles.

Catalonia
plans truck tax
from 2014
The regional government of Catalonia in Spain
has said it plans to introduce a Eurovignette
road tax for vehicles over 12 tonnes in the
second half of 2014.
The tax will apply to the C-25, also known as
the Eje Transversal or Eix Transversal in
Catalan, which is one of the main routes from
Spain to France. According to the Catalan
government, between 2,500 and 3,000 lorries
use the recently widened motorway each day, or
up to 25% of total trafc.
The level of road tax payable has not yet
been determined. The Catalan authorities may
also extend the tax to other roads later.
Coming hard on the heels of proposals for
new tolls in the Basque Country, Spanish road
transport association Astic criticised the
measure and said it would contribute to the
fragmentation of the Spanish market. The
transport sector needs a scal and regulatory
framework that avoids distortions and new
taxes, Astic said.
Spains national government in Madrid has
said it has no plans to introduce a Eurovignette
tax.

The fuel rebate system, announced by Minister
Michael Noonan in the December 2012 Budget,
commenced on 1 July 2013. However, FTA said that a
system for registering with the Revenue has yet to be
implemented and is unlikely to be in place for some
months yet, with the expected rst payment to freight
and bus operators not being made before January
2014.
The association is encouraging its members to
implement processes now, making sure that they have
the correct paperwork, systems and processes in place,
so that they are able to take advantage of the rebate
as efciently as possible.
FTA Ireland also understands that the commercial
diesel rebate is only applicable to those who possess
an Operators Licence.
These operators are being encouraged to accurately
record fuel usage for each vehicle from 1 July 2013,
and to make sure that they have in their possession
legitimate proof of purchase. Claims may only be
made in respect of auto-diesel that is purchased in
the country by the qualifying road transport operator,
either in bulk or by means of a fuel card approved for
that purpose by Revenue.
Irish fuel rebate
With the commercial diesel rebate now in operation within the
Republic of Ireland, Freight Transport Association (FTA) Ireland is
encouraging freight and bus operators to have their plans,
administration systems and process in place to help them to reap
the rewards of the system.

Auditors slam
modal shift
programmes
The EUs Marco Polo programmes, aimed
at shifting freight away from the roads,
have been ineffective and should be
discontinued, according to a damning new
report from the European Court of Auditors
(ECA).
To put it simply, the programmes were
ineffective as they did not meet the targets,
little impact was achieved in shifting
freight off the roads and there were no data
to assess the achievement of the policy
objectives, said Ville Itl, the ECA
member responsible for the report.
Since 2003, the Marco Polo I and II
programmes have nanced transport
service projects designed to shift freight
transport from road to rail, inland
waterways and short sea shipping.

TUPE or not TUPE...
The Government on 17 January 2013 issued a
consultation on a number of proposed changes to
the 2006 Regulations.
Amongst the most signicant changes was the
proposal to repeal the regulations relating to a
service provision change which deals with the
transfer of a contract which is performed by one party
and is then brought in-house or awarded to another
contractor.
This may happen where the Council or Housing
Authority end a contract with one removal company
and provide that work to a new contractor. In this
instance it could be argued that a service provision
change has occurred and any affected employees will
transfer to the new contractor.
The consultation concluded in April 2013 and it was
expected that the Government would publish details
of the proposed changes by 5 July 2013.
Unfortunately the employment minister has
delayed the release of this information until
September, casting doubt on whether the changes
will be implemented by October 2013 as previously
proposed.
The proposed changes are likely to include the
following:

The 2006 Regulations introduced a second strand to
the denition of a TUPE transfer which intended to
bring most service provision changes within the scope
of TUPE. However these changes have been criticised
for going above and beyond the rights imposed by
European legislation as well as creating extensive
litigation.
The proposed changes will remove service provision
changes from the regulations.
Within the consultation the Government sought
views on whether any provisions of the earlier case
law on TUPE 1981 should be reversed. It is therefore
unclear what provisions will apply when the
Government introduce these changes.
The changes are likely to cause confusion for
businesses that have or may now be entering into
contracts with the assumption that TUPE may well
apply. In these circumstances companies could nd
themselves with the increased burden of unexpected
redundancy costs. However the Government proposes
that the changes will have a long lead-in period which
may provide added protection.

Currently, the outgoing contractor/business (the
transferor) is required to supply the new contractor/
business (the transferee) with employee liability
information not less than 14 days before the transfer.
Such information includes all details relating to the
employees terms and conditions of employment along
with any disciplinary, grievances or claims that may
have been invoked by the employee. Failure to provide
this information would allow the transferee to present
a claim against the transferor with the employment
tribunal having the power to award compensation for
a sum not less than 500 per employee.
The proposed changes will repeal these requirements
whilst making it clear that a transferor should disclose

information to the transferee where it is necessary for
both parties to meet their obligations to inform and
consult the affected employees. In removing the need to
supply certain information within a required time scale
the process and ow of information between the two
parties has the potential to be a lot smoother.
However it is yet to be seen whether punishments
will be put in place for failing to provide adequate
employee information which prevents the transferee
fullling its obligations to consult the affected
employees.

The current provisions under the 2006 Regulations
make it unlawful for a transferor to change an
employees terms and conditions unless the changes
are an economic, technical or organisational reason
entailing changes in the workforce.
In response to the consultation, parties have
requested a provision to be put in place to allow for the
harmonisation of terms and conditions of employment,
to place a transferring employee on the same terms and
conditions as current employees and prevent a two-
tier workforce.
The Government has indicated that such changes
would be incompatible with European legislation.
The proposed changes will introduce new legislation
restricting the changes if they are by reason of the
transfer as well as introducing specic legislation giving
the right of the transferor and the transferring employee
to vary the terms and conditions of employment by
agreement.

Other changes will include further protection against
dismissal for a transferring employees, conrmation
that entailing changes in the workforce will include
changes to the workforces location and enabling the
transferee to consult with the transferring employees on
collective redundancies prior to the transfer.

Whilst we still await full details on the proposed changes
to TUPE, the Government hopes to provide a simple and
clear process for businesses that may be affected by the
regulations. These regulations are unlikely to have any
impact on the one-off contracts usually associated with
the removals industry. However those companies who
have contracts with businesses, councils or housing
authorities to provide work on a regular basis may be
affected by TUPE and will need to aware of these
changes. It is essential for businesses entering into a
contract between now and October, or until further
information is published by the Government, to clarify
the implication of TUPE.
Those businesses will also be affected by the lead in
periods that the Government seek to impose in
repealing the service provision changes and therefore
advice should be sought at an early stage in the
event that a business is concerned about the effect
of TUPE.
