(PROPOSED ORDINANCE NO. 1022)
AN ORDINANCE PROHIBITING DEFECATING AND URINATING IN PUBLIC PLACES WITHIN THE CITY OF CALOOCAN.
WHEREAS, it is the policy the State to protect and promote the right to health of the people and instill consciousness among them; WHEREAS, it has been observed that some people still defecate and urinate along the corners of the streets, bridges, overpasses and in other public places within the City; WHEREAS, these unsanitary acts not only reflect a bad impression on the quality of discipline that we have but likewise create an unhealthy surrounding that could generate, carry and transfer diseases from one person to another; WHEREAS, in line with the thrust of the City Government to make the City a livable and workable physical environment for all and to promote and safeguard the health of the people of Caloocan, the Sangguniang Panlungsod recognizes the urgent need to stop and put an end of these unhealthy practices along the streets, bridges, overpasses and in other public places within the City.
NOW THEREFORE, BE IT ORDAINED AS IT IS HEREBY ORDAINED, by the Sangguniang Panlungsod, in session duly assembled:
SECTION 1. Title. This Ordinance shall be known as AN ORDINANCE PROHIBITING DEFECATING AND URINATING IN PUBLIC PLACES WITHIN THE CITY OF CALOOCAN..
SECTION 2. Prohibited or Unlawful Acts. It shall be prohibited or unlawful for any person to defecate and urinate along the corners of the streets, bridges, overpasses and other public places within the City. SECTION 3. Definition of Public Places. Public Places as used in this Ordinance shall refer to the roads, streets, sidewalks, easements, parks and other open spaces, bridges, alleys, overpasses, rivers, creeks, canals, drainage, esteros, waterways and other bodies of water and outlets.

________________________________________________________________________ SECTION 4. Penalty. Any person who violates any of the provisions of this Ordinance shall pay the fine of THREE HUNDRED PESOS (P300.00) or render a day of community service. SECTION 5. Accrual of Fines. Fines collected from violators of this Ordinance shall accrue to the General Fund of the apprehending office provided that the latter shall issue corresponding receipt. . SECTION 6. Enforcing Office. All barangay officials, tanods and PNP are hereby directed to strictly enforce and implement this Ordinance. SECTION 7. Separability Clause. If for whatever reason any section or provision of this Ordinance is declared illegal or unconstitutional, other section/s and/or provision hereof which are not affected shall continue to be in full force and effect. .SECTION 8. Repealing Clause. All ordinances, resolutions, memoranda or executive orders not consistent with this Ordinance are hereby repealed and/or modified accordingly. SECTION 9. Effectivity Clause. This Ordinance shall take effect upon its approval. SECTION 10. Publication. This Ordinance shall be posted in conspicuous places at the North City Hall, City Hall Main and all barangay halls within the territorial jurisdiction of Caloocan City.
