1. GENERAL This order lays down specific provisions about Ultralight Aircraft/ Vehicle (hereinafter called ULA/ULV) and prescribes rules governing the airworthiness requirements of Ultralight Aircrafts/Vehicle in Bangladesh.

2. DEFINITIONS: For the purpose of this Order, the definitions as mentioned under the Rule 2, 183 and 234 of the Civil Aviation Rules, 1984 shall apply. Where a particular definition is not given under the rules, the under mentioned group wise definitions shall apply:

a) "Aircraft appliances/components" means a major assembly of a complete Aircraft, engine or propeller and includes for example wings, flight control surfaces, landing gears, generators, fuel pumps, actuators, avionic components etc.

b) "Aircraft parts" means, a sub-assembly of an Aircraft component and standard items including fasteners, rivets, nuts, bolts, rigging cable and electrical wire.

c) Certification compliance book (check list) means the book compiled by the respective manufacturer(s) to show means of compliance with the applicable Design Standard of the Aircraft. d) Certificate of type approval in respect of an Aircraft means, the action taken by the Chairman, as an alternative to issuing CAABs own Type Certificate (TC), in accepting a Type Certificate including the Type Approval Data Sheet (TADS) issued by any other contracting State which meets the design standard of the CAAB as specified in this Order. e) "Country of origin" means, the country having airworthiness responsibility for the design approval; usually this is the country in which the aeronautical product is manufactured or assembled. f) EASA CS means European Aviation Safety Agency Certification Specification as determined by the aviation safety agency formed by the member states of European Union. g) FARs means aviation regulations issued by Federal Aviation Administration (FAA) of USA. h) "Type of Aircraft" means, a design and make of Aircraft and refers to group of essentially similar Aircraft, which although possibly existing in different models, stem from a common basic design (e.g. Boeing 747 Aircraft). i) Special certificate of registration means a Certificate of Registration issued to an aircraft which does not meet the requirements of an applicable comprehensive and detailed airworthiness code as required for standard category aircraft. It is the Certificate of Registration only for Microlight Aircrafts. j) Special Certificate of Airworthiness means a Certificate of Airworthiness issued to an aircraft which does not meet the requirements of an applicable comprehensive and detailed airworthiness code as required for standard category aircraft. k) Commercial Operations- shall mean any operation of an aircraft, in return for remuneration or other valuable consideration, which is available to the public or, when not made available to the public, which is performed under a contract between an operator and a customer, where the latter has no control over the operator l) Private Operations-shall mean any operation other than Commercial operation. 3. APPLICABILITY: Group A Ultralight Aircraft , is an Aircraft having no more than two seats, Vso not exceeding 35 knots (65 KM/h) CAS, and a maximum take-off mass of no more than:Issue 0

300 kg for a landplane, single seater; or 450 kg for a landplane, two-seater; or 330 kg for an amphibian or floatplane, single seater; or 495 kg for an amphibian or floatplane, two-seater, provided that a Microlight

capable of operating as both a floatplane and a landplane falls below both MTOM limits, as appropriate. Note: Foot-launched Aircraft are excluded from this definition. Class 1 Powered Para Glider: An Ultralight Aircraft that sustains paramotor with flexible wing, parachute type. It meets the following technical conditions: - maximum continuous power less than or equal to 45 kW for single seater and 60 kW for two seaters - the maximum take-off mass is less than or equal to 300 kg for single seater and 450 kg for two seaters . Class 2 Weightshift: is an Aircraft which sustains a rigid wing under which is usually hung a motorized trolley. An Ultralight is a single-engine Aircraft which sustains a flexible blade which is usually hung over a motorized carriage. It meets the following technical conditions: the maximum power is less than or equal to 45 kW for a single seat and 60 kW for a two-seater; maximum mass not exceeding 300 kg for single and 450 kg for two seaters, these masses may be increased by 5% in the case where the ULA is equipped with a parachute, or 10% in the case of an Ultralight float. The parachute and installation meet technical requirements set by the Chairman of Civil Aviation Authority of Bangladesh ; the stall speed or the minimum steady flight speed in the landing configuration (Vs0) does not exceed 65 km / h in conventional speed (Vc).

Class 3

Multiaxes : is an Aircraft which sustains a fixed wing. Multiaxes meet the following technical requirements: maximum continuous power less than or equal to 45 kW (60.34 hp) for single seater and 60 kW (80.46 hp) for two seaters the maximum take-off is less than or equal 300 kg to 450 kg for single seater and two seaters, these masses may be increased by 5% in the case where the ULA is equipped with a parachute or floats the stall speed (Vso) is less or equal to 65 km / h, or wing loading at the maximum weight is less than 30 kg/m2.

maximum continuous power less than or equal to 60 kW for single seater and 80 kW for two seaters the maximum mass not exceeding 300 kg for single seater and 450 kg for two seaters the rotor load to maximum mass between 4.5 and 12 kg per m2.

Lightweight balloon: A lightweight balloon meets the following technical requirements: maximum continuous power less than or equal to 60 kW for single seater and 80 kW for two seaters the volume of the helium envelope is less than or equal to 900 m3, the volume of the layer of hot air is less than or equal to 2000 m3.

Group B

Ultralight Vehicle, is a Vehicle that: (a) (b) (c) (d) I. Is used or intended to be used for manned operation in the air by a single occupant; Is used or intended to be used for recreation or sport purposes only; If unpowered, weighs less than 155 pounds; or If powered: Weighs less than 254 pounds empty weight, excluding floats and safety devices which are intended for deployment in a potentially catastrophic situation; Has a fuel capacity not exceeding 5 U.S. gallons; Is not capable of more than 55 knots calibrated airspeed at full power in level flight; and Has a power-off stall speed which does not exceed 24 knots calibrated airspeed.

For any other new Microlight Aircraft/ Vehicles Civil Aviation Authority of Bangladesh will decide its Group and Class according to technical documents associated to it.

4. DESIGN STANDARDS AND ISSUE OF CERTIFICATE OF TYPE APPROVAL OF MICROLIGHT AIRCRAFT/VEHICLE 4.1 Primary design standards - Microlight Aircraft/Vehicle, powerplant and propellers. 4.1.1 Unless otherwise specified by the Chairman, the primary airworthiness design standards in respect of Microlight Aircraft, powerplant and propellers are followed by FAA (American Society for Testing and Material (ASTM) standards associated with Light Sport Aircraft), EASA or National Aviation Authority of Country of Origin/ Country of manufacturer . The design standard used as the basis of certification for the importation of a complete Microlight Aircraft or for assembly of a complete Microlight Aircraft or complete powerplant or propeller shall be recorded with the respective airworthiness or engineering documents and notified to the CAAB, and that standard shall thereafter be used as the basis of approval for all modifications and repairs to that Microlight Aircraft or powerplant or propeller. For Aircraft or engine or propellers having more than one basis of certification, the standard adopted by the country of Manufacture shall apply, provided it conforms to the requirements of the section 3 of this Order. At the time of issue of Special Certificate of Airworthiness by the CAAB, applicable design standard of an Aircraft as mentioned in the section 3 of this Order shall also be mentioned in the Group & Class block of the Special Certificate of Airworthinessof the particular Aircraft.

4.2 Primary design standards aeronautical products 4.2.1 Unless otherwise specified, the primary airworthiness design standard for aeronautical products i.e. Microlight Aircraft materials, part, processes and appliances are: a) Technical standard order (TSO) issued by FAA of the USA; or b) European Technical Standard Orders (CS- ETSO) issued by EASA; or c) American Society for Testing and Material (ASTM) standards associated with Light Sport Aircraft , or d) Other standard that may be acceptable to the Chairman.

4.3 Certificate of type approval 4.3.1 Either the holder of the original Type Certificate (TC) or the prospective operator for the Microlight Aircraft type may apply to the Chairman for issue of a Certificate of Type Approval (CTA) in respect of a type Certificated Aircraft, which meets the design standard mentioned in the section 3 provided Certificate of Type Approval has not been issued earlier by the Chairman in respect of that type of Microlight Aircraft or model of the Microlight Aircraft. The Certificate of

Type Approval shall be issued in respect of the Microlight Aircraft type itself and not the applicant. 4.3.2 The Chairman may issue a Certificate of Type Approval in respect of a Type Certificate on acceptance of original Type Certificate issued by the National Aviation Authority (NAA) of the country of manufacture, provided the TC conforms with the requirements of the section 3 of this Order. Certificate of Type Approval shall not be issued on the basis of Certificate of Validation of a TC issued by a contracting State. 4.3.3 The applicant shall submit an application on AWS (ML) - 17, as shown in Appendix-2 of this order and shall submit the preliminary technical data as mentioned in the Appendix-1 of this order. 4.3.4 If accepted, the applicant will be asked to submit further all or selected technical data in the Appendix-1 to this order for examination by the Airworthiness and Engineering Licensing Division of the CAAB. The examination will normally include: 4.3.4.1 An assessment of the adequacy of the code of design standards applied and their amendment status to ensure that no hazardous characteristics exist in the design and construction of the Aircraft; 4.3.4.2 An assessment of acceptability of any waivers or variations granted by the State of Design; 4.3.4.3 An assessment of suitability of any special conditions specified and Certified by the State of Design; and 4.3.4.4 An assessment of adequacy of type design in regard to specified requirements, operating conditions and airworthiness requirements of the CAAB. 4.3.5 The remaining further technical data/documents may be supplied later on, but invariably be submitted by the operator along with application for issue of Special Certificate of Airworthiness. The applicant (if not holder of TC) shall also submit to the Chairman an undertaking from the TC holder and must arrange for continued supply of revisions/ amendments to the chairman of the continuing airworthiness data listed in the Appendix-1 to this order. If accepted, the Chairman will issue Certificate of Type Approval through a letter stating the followings; a) Name of the regulatory authority responsible for issue of Type Certificate (TC) or equivalent and Type Approval Data sheet (TADS) or equivalent of the Microlight Aircraft. b) Name of the Type Certificate holder. c) Microlight Aircraft Type & Model. d) TADS Number, TADS Revision Number and Date.

The Chairman may refuse to issue Certificate of Type Approval if there are responsible grounds not to do so or may issue a Certificate of Type Approval with such conditions as are necessary on safety grounds.

5. IMPORT PROCEDURE OF MICROLIGHT AIRCRAFT/ VEHICLE 5.1 Import Procedure of new Microlight Aircraft/ Vehicle 5.1.1 Need to submit an application mentioning that, the applicant wants to import a Microlight Aircraft, to the Chairman, CAAB (Attention: AELD) 5.1.2 Any person operating a Microlight Aircraft under this part shall, upon request, allow the Chairman of Civil Aviation Authority of Bangladesh, or his designee, to inspect the Microlight Aircraft to determine the applicability of this part. 5.1.3 Flight Test: Flight Test must be conducted under the observation of CAAB Airworthiness and Flight Operation officials after importing the Microlight Aircraft. Flight test can be accomplished by issuing onetime Special Certificate of Airworthiness as necessity. If the Microlight Aircraft fails to prove its flight performance in flight test to designated CAAB officials, CAAB will not issue any certificate ( special certificate of registration, special certificate of registration) regarding this particular Microlight Aircraft. 5.1.4 Flight test, Type Certificate inspection and other relevant inspections depending on necessity can be conducted at a single visit. A single visit does not mean a single day. 5.1.5 As part of the import procedure, it may require a number of visits or a single visit to inspect the airworthiness by the CAABs airworthiness officials. All costs of such visits shall be borne by the applicant (who wants to import) as per rule 213 of the CARs 1984. 5.2 Import Procedure of ageing Microlight Aircraft/Vehicle. 5.2.1 Rest life time/ life cycle should be more than 50% of manufacturers mentioned life cycle or life time of a Microlight Aircraft. 5.2.2 From para 5.1.1 to 5.1.5 will be same for ageing Microlight/Vehicles.

WAIVERS.

No person may conduct operations that require a deviation from this part except under a written waiver issued by the Civil Aviation Authority of Bangladesh. 7. Special Certificate of registration: 7.1 The owner of the Microlight Aircraft/ Vehicle holds a Special Certificate of Registration. The Special Certificate of Registration of Microlight Aircraft/ Vehicle is issued by the

Chairman of civil aviation in consideration of the mere declaration of the owner to have mandatory documents listed below: a) Proof of foreign registration cancellation. b) Bill of sale or conditional sales contract. c) Insurance Certificate. d) Import permit. e) A Bangladesh customs clearance Certificate. f) Any other documentation as may be required by the Chairman.

7.2 The Chairman of Civil Aviation Authority of Bangladesh notify the Special Certificate of Registration identifying marks. Registration marks include the BML followed by two or three letters. The Chairman of Civil Aviation Authority of Bangladesh may conduct by persons or bodies authorized for this purpose, audits and surveillance as it deems necessary to ensure that the identified Microlight Aircraft/ Vehicle complies with the provisions of this Order. 7.3 The Special Certificate of Registration includes a descriptive part which identifies the essential characteristics of the Microlight Aircraft/ Vehicle, including characteristics of masses, and engine speed, allowing its classification of Microlight Aircraft/ Vehicle, in accordance section 3 of this Order. 7.4 When change of ownership will take place, a new Special Certificate of Registration will be reissued. 8. MARKINGS. 8.1 An Aircraft cannot operate without showing under the wing or on the structure in case of impossibility: a) The Registration marks b) The manufacturer model marks. These marks, unadorned and a minimum height of fifty centimeters must be easily readable.

9. SPECIAL CERTIFICATE OF AIRWORTHINESS: The Special certificate of Airworthiness is renewed every two years provided that the owner has declared its ability to fly Microlights and submitting the following documents or selected documents from the following as necessity.

No operation/flight is permitted without having Special Certificate of Airworthiness. 10. CHANGE OF OWNERSHIP: In the case of sale of an Ultralight, the new owner must have the following items, provided by the previous owner: 10.1 Special Certificate of Registration 10.2 Special Certificate of registration. 10.3 All manuals (Maintenance manual, Operational manual etc) 10.4 The record of use (maintenance log book etc), 10.5 Any other associated documents recommended by CAAB New Special Certificate of Registration and Special certificate of Airworthiness shall be issued by the Chairman, Civil Aviation Authority of Bangladesh or his designee in view of the old map and its associated Special Certificate of Registration. The new Special Certificate of Registration and Special Certificate of Airworthiness must be made no later than 3 (three) months after the date of sale was annotated by the former owner. 11. MANDATORY MANUAL: 11.1 For Group A category Microlight Aircraft: 11.1.1 Operation manual, Maintenance Manual, Maintenance Log Book. 11.1.2 Any other documents recommended by the Manufacturer

11.2 For Group B category Microlight Vehicle: Documents recommended by the Manufacturer. 12. DOCUMENTS TO BE CARRIED: A person operating a Microlight Aircraft is not required to carry the Flight Manual. But, the manuals/documents which the manufacturer provides with the Aircraft and recommends to carry in flight, are needed to carry on board. 13. MAINTENANCE PERSONNEL: Without any approval no personnel can perform maintenance of Microlight Aircraft/ Vehicle. Maintenance personnel shall be approved by the civil aviation Authority of Bangladesh. First means of getting approval: I. Licence without type rating (LWTR) in A or, C or, I or, E or, R II. Oral exam on Maintenance manual on the particular aircraft. OR, Second means of getting Approval: Maintenance Experience: Every Applicant should have 6 months maintenance experience on Microlight Aircraft/ Vehicle before applying to be approved as maintenance personnel. Examination System: a) Every applicant needs to appear at 50 multiple questions of every subject mentioned bellow. Pass marks will be 70%. b) Oral exam. Pass marks 70%. Subjects need to appear at the examinations: a) Human performance and Limitations b) Maintenance Manual 14. INSTRUMENTS AND EQUIPMENTS: 14.1 Life Jacket: Microlight Aircraft/Vehicle shall carry Life Jackets or equivalent floatation device for each person when flying over water. 14.2 Altimeter and speedometer must be serviceable. 14.3 If any instrument doesnt function properly, which will not hamper to fly but compromise safety, must be deferred in maintenance log book. And must be repaired within 3 days of first occurrence. 15. Limitations of Operations: 15.1 Microlight aircrafts can be used for Commercial Operations but not for Commercial Air Transport. 15.2

16. OCCURRENCE REPORTING: Any incident or accidents reporting to CAAB is mandatory. 17. DATA RECORDS: 17.1 Owner will maintain all relevant documents of maintenance and operations in microlight aircrafts / vehicles operating life. Example- maintenance log book, operation log book, incident/accident records. 17.2 All records will be preserved at least 2 years from the date of issues of records. 17.3 All records will be transferred to new owner in case of change of ownership. 18. VIOLATION OF RULES: Any violation of rules and regulations associated with microlights demands fine according to CAR84.

IMPORTANT If there is any change in the ownership of the Microlight Aircraft/ Vehicle or the Microlight Aircraft/ Vehicle is destroyed or permanently withdrawn from use, the registration and this Certificate become void, and the appropriate section hereunder shall be completed and this document returned immediately to the Chairman, Civil aviation authority, Dhaka. On change of ownership the Microlight Aircraft/Vehicle may not be flown again until such time as a new Special Certificate of Registration has been obtained.
