Literary Magazine Contract

This contract is to be used by authors and literary magazines in conjunction with the National Writers Union Guidelines for Literary Magazines. 1. RIGHTS. a. In return for compensation as specified in Paragraph 2, below, the Author grants the Publisher first North American print rights to ______________________________________________ (title of Work). All other rights (such as electronic or anthology) are retained by the Author unless expressly negotiated. b. The Publisher agrees to forward to the Author in a timely fashion all requests for reprint rights to the work named in Paragraph la, above. 2. COMPENSATION. a. The Publisher agrees to pay the Author a fee of $ __________ for use of the Work, payable within 30 days of the signing of this agreement or upon receipt of the final version of the Work, whichever comes later, OR, b. In lieu of cash payment, the Publisher agrees to compensate the Author in copies, _________(number of copies), to be delivered to the Author within 15 days of publication. 3. TIMELY PUBLICATION. Publisher agrees to publish Work by ___________________ (date). If publication is postponed, Publisher agrees to notify Author by __________________ (date). The Author has the option of withdrawing Work without refunding any payment if publication is postponed twice. 4. EDITORIAL CHANGES; ELECTRONIC SUBMISSION; PRE -PUBLICATION REVIEW. a. The Publisher agrees to make no editorial changes to the Work without the express agreement of the Author. b. The Publisher agrees that the Author shall have the option of submitting the final version of the Work on disk or via electronic mail. c. The Publisher agrees to provide the Author with galleys of Work for proofreading prior to publication. 5. ADDITIONAL COPIES OF PUBLICATION. Publisher agrees that additional copies of the publication containing the Work will be made available to the Author at trade discount or better.

GUIDELINES FOR LITERARY MAGAZINES

These guidelines are to be used by editorial boards of literary magazines in conjunction with the National Writers Union Literary Magazine Contract. The purpose of these guidelines is to clarify the mutual rights and responsibilities in the relationship between authors and literary magazines. It is assumed that this relationship is characterized by limited financial resources, a high value placed on timeliness, and the joint desire of author and UAW Local 1981/AFL-CIO publisher to produce the completed magazine.

1. TIMELY RESPONSE TO SUBMISSIONS. The magazine should respond to all submissions within 30 days of
receipt of the submission.

2. ACCEPTANCE OR REJECTION OF SUBMISSIONS. The magazine should notify authors of acceptance or rejection of a submission within 90 days of receipt of submission. Submissions accompanied by an SASE should be returned. 3. SOLICITED SUBMISSIONS. If the magazine requests a work of an author, the magazine may specify that this work
not be submitted elsewhere for consideration. The magazine will respond with acceptance or rejection of a solicited work within 30 days of submission.

4. MULTIPLE SUBMISSIONS. The magazine should consider unsolicited manuscripts where the author is submitting to
more than one publisher at a time, with the proviso that authors will notify the magazine in a timely manner of acceptance elsewhere.

5. CONTRACTS FOR WORK When the magazine decides to publish a work, it should secure the necessary rights to the
work by signing a contract with the author (see National Writers Union Literary Magazine Contract, over). This contract should clearly state the nature of the rights purchased, the consideration (whether in cash or copies) to be received by the author, a timeline for cash payment, along with other responsibilities of the author and publisher regarding publication dates, availability of extra copies, etc.

5. PUBLICATION RIGHTS. The magazine should expect to purchase only first North American print rights. All other
rights (such as the right to include a work in an anthology or the right to publish it electronically) must be negotiated with the author and memorialized in writing.

6. COMPENSATION. If compensation is in money rather than copies, payment should be made within 30 days of signing the
contract. If payment is in copies, they should be delivered to the author within 15 days of publication. All authors, regardless of other compensation, should receive two complimentary copies of the magazine in which their work appears. In addition, they should have the option of purchasing additional copies at the magazine's standard trade discount or better. Authors should be notified in a timely manner if excess copies of the number containing their work are to be disposed of, so that they may purchase them if they so choose.

7. REVISIONS. The magazine should make no revisions to a work without express agreement of author. If the magazine
believes that the work is not acceptable without significant revisions, no contract should be signed until those revisions have been made. If the author withdraws a work because unacceptable revisions have been requested, but after a contract has been signed, he or she has the right to keep the fee due him or her in the contract. The magazine should make every effort to provide the author with page proofs in a timely manner in order to allow the author to check for typographical or other errors.

8. PUBLICATION DATE. The magazine should commit to a publication date at the time of the signing of the contract,
and must notify the author promptly of any changes in publication date. The magazine may change the date of publication one time without consequences to rights or author's compensation. If publication is postponed a second time, the author may withdraw the work without returning the fee.
