APPLICATION: Temporary Protected Status
The respondent, a native and citizen of Honduras, appeals the Immigration Judge's
November 9, 2011, decision fnding her ineligible fr Temporary Protected Stats ("TPS") and
ordering her removed. See section 244(c) of the Immigation and Nationality Act, 8 U.S.C.
1254(c); 8 C.F.R. 244.2. The record will be remanded.
The Boad reviews an Immigation Judge's fndings of fct, including credibility
determinations ad (under the law of the Circuit with jurisdiction over this case) the likelihood of
fture events, under a "clearly eroneous" standard. 8 C.F.R. 1003. l(d)(3)(i); see Turkon
v. Holder, 667 F.3d 523, 530 (4th Cir. 2012). We review all other issues, including questions
of law, judgent, or discretion, under a de novo standad. 8 C.F.R. 1003. l (d)(3)(ii). The
respondent's application was fled befre May 11, 2005, ad therefre is govered by the
provisions of the RAL ID Act. Mater ofS-B-, 24 I&N Dec. 42 (BIA 2006).
The Immigation Judge did not prepare a separate oral or written decision in this matter
setting out the reasons fr the decision. A explanation of the reasons in the trascript is not
sufcient. Accordingly, the record will be retued to the Immigration Judge fr preparation of a
fll decision. See Mater of A-P-, 22 l&N Dec. 468 (BIA 1999). In doing so, the Immigation
Judge should make an explicit fnding concering the respondent's competence fr purposes
of immigtion proceedings, given that record evidence ad the respondent's testimony contain
indicia of incompetency (see Tr. at 17-27; Exh. 2, Tab H; Respondent's Br. at 2-3, 6-7). See
Mater of M-A-M-, 25 I&N Dec. 474 (BIA 2011). As appropriate, the Imigration Judge may
conduct additional proceedings and receive evidence relating to the respondent's competence
and ay saeguards that may be necessary to ensure that te proceedings comport with the
respondent's due process rights.

Because the Immigation Judge made no fndings of fct, the record befre us is not
sufciently developed to perit us to rule on the respondent's appellate agument that she is
entitled to equitable tolling of the July 5, 1999, deadline fr the TPS initial registation period on
account of her mental incompetence and physical illness (Respondent's Br. at 3). See AV
WAC 06 007 70270, 2007 WL 5337538 (INS 2007) (accepting untimely TPS fling deadline
because Los Angeles Ofce of Depatment of Homelad Security failed to frard complete,
timely fled TPS application to processing center). On remand, the Immigration Judge should
enter appropriate fndings of fact and conclusions of law concering the respondent's aguments
that her late-fled TPS application should be adjudicated on its merits.
ORDER: The record is remanded to the Immigration Judge fr frther proceedings
consistent with this order ad fr the enty of a new decision.
