A proposed genealogical descent of Francisca Ponce de Len, wife of Juan Bautista Lomas y Colmenares, lord of Nieves

A lineal ancestor of Victor Ernesto Bermdez

Within the many illustrious ancestral lines of Victor Ernesto Bermdez and Agnes Louisa Lacayo are to be found numerous individuals about whom little is known but whose names tantalizingly suggest that further research might yield new and interesting discoveries about them or the families to which they belonged. Two such persons, ancestors of Victor Ernesto, bear the family name Ponce de Len (see chart, figure 1), suggestive of possible connections to the Ponce de Len who were the counts of Arcos in Cdiz, descendants of much of the royalty and nobility of the High and Late Middle Ages. Any clues as to the filiation of Mara de Aviar Ponce de Len, a maternal great-grandmother (more specifically, the bisabuela materna materna) of Pedro Chamorro de Sotomayor, have thus far eluded this writer. Circumstantial evidence pertaining to Francisca Ponce de Len, a great-great-great-grandmother of Pedro Chamorros wife, Mara Josefa de Murga, however, is sufficiently compelling for one to infer that she most probably was of the family of the early sixteenth-century counts of Bailn in Jan, descendants of the second count of Arcos. Corroboration or disproof of this hypothesis of course depends on the future discovery of pertinent documents. Before commencing to postulate the ancestry of Francisca Ponce de Len, we shall establish the lineal descent from her of Victor Ernesto Bermdez. The latters descent from Pedro Chamorro de Sotomayor y Garca Ponce de Len, corregidor of Seville, Jan, and Bedmar, and Mara Josefa de Murga y Nez de Villavicencio has already been established in Keesee (2009).1 They and those of the succeeding two generations, namely, Diego Chamorro and Rafaela OConor and Jos Ignacio Argullo and Mara Josefa Chamorro, are corroborated in Aparicio (1968),2 who further informs us that the abovementioned Mara Josefa de Murga was the daughter of the Sevillians Francisco Isidro de Murga (b. 1691) and Ins Nez de Villavicencio (b. 1690),3 and granddaughter maternally of Martn Nez de Villavicencio and Mara Josefa de Villavicencio y Sandin [sic] [recte Sandier], the latter the daughter of the admiral Pedro Nez de Villavicencio (1603-1654) and Mara de Sandin [Sandier] (b. 1619).4 In the proof of blood purity (limpieza de sangre) presented by her grandnephew for admission into the Order of Calatrava,

Mara Josefa de Villavicencio is named as one of five children of Pedro Nez de Villvicencio and Mara de Sandier, and as a granddaughter paternally of Nuo Nez de Villavicencio (d. 1607) and Mara Enrquez de Colmenares, and maternally of Francisco Sandier and Ana Lasana.5 The grandparents of Pedro Nez, as we see, for instance, in proofs offered by him and his relatives for admission into the knightly orders, were Pedro Nez de Villavicencio and Catalina Nez de Prado on the paternal side, and on the maternal side Juan Bautista de Lomas y Colmenares and Francisca Ponce de Len.6 The Nez de Villavicencio were a distinguished family originating in Jerez de la Frontera near Seville. Nuo Nez de Villavicencio matriculated as a lawyer (licenciado) from the University of Salamanca in 1577, and for nearly thirty years thereafter held posts in the Spanish judiciary: he was a judge (oidor) of the audiencia of New Galicia, a justice (oidor; juez oficial) of the

Casa de Contratacin in Seville (also called the Casa y Audiencia de Indias), an inspector ( visitador) and interim president of the audiencia of Santa Fe de Bogot (1603), a position which gave him executive authority over the province of New Granada; and ultimately he was appointed president of the audiencia of Charcas (a province occupying approximately the area of modernday Bolivia), but he died from food poisoning in early 1607 at sea en route to taking up his post.7 His unlawful marriage in 1588 to Mara Enrquez de Colmenares, the daughter of a magnate of New Galicia (discussed below, pp. 4-7), brought about what Fray Tello calls the little war of Guadalajara and the dismissal of the viceroy of New Spain, while Nez himself was somehow allowed to retain both his wife and his position as oidor.8

The audiencias were appellate courts and additionally had quasi-legislative functions. Nuo Nezs son, Pedro Nez de Villavicencio, was a knight of the Order of Calatrava,9 an admiral of the armada espaola, an alcalde mayor, and a familiar of the Holy Office (Inquisition).10 Victor Ernesto Bermdez descends from him through his daughter, Mara Josefa de Villavicencio, but we should note that one of Maras brothers, Francisco Jos Nez de Villavicencio (d. 1696), was the first count of Caete del Pinar and the viceroy of Peru,11 and another brother was the artist Pedro Nez de Villavicencio (d. 1700), a pupil of Murillo.12 The father of Mara Enrquez de Colmenares, whose marriage to Nuo Nez de Villavicencio was the cause of the contretemps alluded to above, was Juan Bautista Lomas y Colmenares, seor of Nuestra Seora de las Nieves, north of Zacatecas, in the silver-rich province of New Vizcaya,

who had built up a feudal barony encompassing the entire basin of Nieves in central Nueva Vizcaya. His properties took in whole villages, mines, vineyards, and livestock innumerable. Many persons claimed he was the wealthiest man in western New Spain. As emblematic of his exalted status, he traveled everywhere with a huge escort, made up principally of Castilians and Andalusians and including relatives, in-laws, friends, dependents, and their servants.13mmmmm

Lomas y Colmenares had well-placed family connections too: Nuo Nez de Villavicencio and Hernando Saavedra de Valderrama, oidores respectively of the audiencias of Guadalajara and Mexico City, were married to his daughters,14 and his wife, Francisca Ponce de Len, must certainly have been wellborn (see discussion below), for it was customary that a person of Lomass wealth and status should marry someone whose social station was at least equal to his own. The lord of Nieves has achieved notoriety in the annals of New Spain, however, for having used his wealth and influence (he was also a familiar of the Holy Office) to further his unsuccessful candidacy to be the first adelantado of the New Mexico territory, in the process of which he actively and maliciously endeavored to thwart the chances of two rival aspirants, Francisco de Urdiola and Juan de Oate.15 In the lengthy proposal presented in 1589 to the viceroy lvaro Manrique de Ziga, marquis of Villamanrique, Lomas asked to be granted the rank of a count or marquis, to retain the captaincy-general within his family for six generations, to have full civil and military authority, to be granted 40,000 vassals in perpetuity and a personal estate of 120,000 acres, and so forth. The viceroy astonishingly approved the application in 1590, although he thought it better to forward it to Spain for final ratification, where the Council of the Indies rejected it, considering its conditions outrageous (desaforadas), and the king did not even bother to reply to Lomas.16 The appointment of Urdiola, the favored candidate of the

new viceroy, Lus de Velasco, marquis of Salinas, was almost finalized in 1593, when the audiencia of new Galicia suddenly indicted him for the murder by poison of his wife and a servant. It is generally thought that Lomas, believing that he was still in contention for the New Mexico appointment, and his son-in-law the oidor Nuo Nez de Villavicencio conspired to frame Urdiola and thereby remove him from contention.17 Juan de Oate, Velascos next choice, was ultimately appointed to lead the entrada into New Mexico but twice during the approval process was nearly disqualified, first in 1595, when the new viceroy, Gaspar de Ziga Acevedo y Fonseca, count of Monterrey, became aware of negative appraisals of Oate that had lately been circulating, probably generated by Lomass agents in Spain and Mexico;18 and then in 1596, when the nobleman Pedro Ponce de Len, cousin of the count of Bailn, who had no experience in colonial matters, suddenly proposed himself as a candidate for governor of New Mexico. Ponce de Len was initially looked upon with favor by the kings advisors, primarily because he represented himself as far wealthier than Oate and therefore able to offset more of the expenses that otherwise would devolve to the crown. But suddenly he fell seriously ill, and then it was discovered that he in fact had been trying to mortgage his estate and recently had sought a loan from the royal government. In spite of this the Council of the Indies persisted in recommending Ponces appointment to the king, who rejected its advice and chose Oate.19 Marc Simmons, the biographer of Oate, proposes that the candidacy of Ponce de Len, who financially, physically, and by his lack of practical experience was a less than ideal prospect as a colonial adelantado, can only have originated precisely when the criticisms of Oates qualifications had begun to reach the viceroys ear and been promoted at the instigation of Juan Lomas y Colmenares, who, acting through his agents, persuaded Ponce to advance his New Mexico proposals as a means to check Oate, and had this long shot succeeded, he might have continued to use Ponce out front while pulling the strings of the New Mexico expedition in secret.20 Simmons further conjectures that if there were a family connection between Lomas and

Ponce, then the latters efforts to supplant Juan de Oate [would begin to] to make sense.21 The author perhaps is more perceptive than he is aware, for although he notes that a Diego Ponce de Len of New Spain was known to be Lomas nephew, in the course of his research he, surprisingly, never discovered that Lomas was in fact married to a Ponce de Len.22 In considering that Pedro Ponce de Lens entry into the political contest in which Juan Lomas y Colmenares was deeply involved is explicable only if a preexistent relationship between the two men is assumed, the deduction naturally follows that the uncommon family name shared by Lomass wife Francisca and Pedro, rather than being coincidental, is very likely indicative of a familial connection. This writer provisionally accepts that Francisca and Pedro were related and further speculates that there probably was a close degree of consanguinity between them, inasmuch as because of the continuing estrangement among some descendants of Juan Ponce de Len, the second count of Arcos, engendered by the lawsuits brought by several of his heirs (Juan Ponce had something like twenty-one children by various wives and mistresses, one of whom probably was Juan Ponce de Len, the first governor of Puerto Rico and discoverer of Florida23), which resulted in one case in the separation of the seorio of Bailn in Jan (in Andalusia) from the patrimony of the dukes of Arcos by a decree of 1522 of the emperor Charles V creating the countship of Bailn,24 one would expect a disinclination by members of the various branches of Ponce de Len to engage in cooperative ventures with Ponces outside their own family groups. It follows, then, that Francisca and Pedro, on the assumption that Francisca also belonged to the family of the counts of Bailn, were closely related, since the condado of Bailn originated only in 1522. Their specific relationship remains to be discovered. The information on the purity of lineage given by Juan Lomas y Colmenares in his application to become a familiar of the Holy Office in 1589 discloses that Francisca Ponce de Len, originally from Palencia, was the daughter of Juan Ponce de Len and Antonia Ramrez, neither of whom we are otherwise able to identify.25 There were of course many Ponces named Juan; and Antonias family name suggests that

she may have been a Guzmn, as there were many recent ancestors of the early counts of Bailn named Ramrez y Guzmn.26 Pedro Ponce de Len was the second son of someone also named Juan Ponce de Len, the second son of Rodrigo Ponce de Len, the second count of Bailn, and Blanca de Guzmn y Sandoval.27 Juan Ponce was the most prominent member of a large conventicle of Lutherans in Seville, most of whom, including Juan himself, were rounded up as heretics by the Inquisition in 1557, and executed in 1559 in an auto-da-f staged in the Plaza de San Francisco, Sevilles main square.28 His sentence declared that his sons, Pedro, who was nine years old at the time, Manuel, and Rodrigo, were ineligible to hold any offices or dignities in their lifetimes. Pedro for many years litigated to have his lawful share of the estate of Bailn restored to him (the verdicts of, e.g., the Council of the Indies and the Chancery of Granada were unfavorable), and at last Philip III granted him the title of Conde de Bailn upon the death of his cousin Manuel, the fourth count of Bailn (son of Juans elder brother), who died without legitimate heirs.29 Francisca Ponce de Len, Juan Lomass wife, was about the same age as Pedro, or perhaps slightly older,30 and the possibility presents itself that she was his half-sister, an illegiSu mujer: Francisca Ponce de Len, n. de Palencia. timate daughter of the martyr Juan (whose hijas legitimas by his wife, Isabel de Portocarrero, were Blanca and another Francisca who was born between 1557 and 1560 31). More likely she was a granddaughter of Juans uncle or aunt, Roldn or Isabel, the two siblings of Juans father, whose descendants this writer has not yet discovered.32 This is where she should be situated chronologically within the family tree of the counts of Bailn, if she indeed belongs there. The elite social status of Francisca Ponce de Len can be inferred by the prominence of those members of her immediate family who we have been able to identify. The name Ponce de Len was still borne only by the nobility or the immediate descendants of the same in the sixteenth century, and we can be quite confident that Juan Lomas y Colmenares, the immensely wealthy and overbearingly ambitious lord of Nieves, will have secured for himself a wife of impeccable calidad. Franciscas daughters married judges of high courts, and her grandchildren included viceroys, counts, and admirals. We have argued that a close familial relationship existed between Francisca and Pedro Ponce de Len, the fifth count of Bailn, and if this in fact be true, then Franciscas immediate ancestors ought to be sought among the descendants of Manuel Ponce de Len, the first count of Bailn, son of Juan Ponce de Len, the second count of Arcos. This connection gives her (and her descendants) lines of ascent to a multitude of medieval sovereigns over two hundred in the preceding fifteen generations spanning five centuries among the most recent being Denis of Portugal (d. 1325), Sancho IV of Castile and Len (d. 1295), James I of Aragon (d. 1276), Louis IX of France (d. 1270), Theobald I of Navarre (d. 1253), the Holy Roman Emperor and king of Jerusalem Frederick II (d. 1250), the Latin emperor of Constantinople John of Brienne (d. 1237), and Andrew II of Hungary (d. 1235) (see appended genealogical chart).33 Christopher Ingham May 25, 2013
