Missing Documents
Various Document Requests Made to the Director of Central Intelligence

We need to discuss the status of following items ~ what if any additional documents need
to be produced, and if there are none, what assurances you can give us that your search
has been sufficient and the production complete.

• Items 1 through 6, DCI Document Request #1. If such documents do not exist,
please be prepared to have the DCI certify that this fact.

- No documents have been provided for Items(^(ljJ, 17, 20, 30 and 36.

- Item 14 of this request - the National Intelligence Priorities Framework -


was determined to be "out of scope" by the DCI in his response to the
Commission. We disagree and have raised this concern with the Attorney
General's Office several months ago.

- Item 16, DCI Directives, is incomplete. DCIDs for Warning, the


Counterterrorism Center, and Counterterrorism coordination within the
Intelligence Community are missing.

- Item 19, guidance related to the DCI's declaration of war against al-
Qa'ida. A list of documents was provided, however we require the actual
documents.

- Item 22, documents of the National Intelligence Collection Board related


to UBL or al Qa'ida. No documents have been provided for the period of
September 2000 to September 2001.

- Item 24, documents of the National Intelligence Production Board related


to UBL, al Qa'ida or other foreign terrorist threats. Documents reflect
only two meetings over the three year period requested and that the CT
portion of the meetings had no backup materials.

- Item 29, "The Plan," only PowerPoint slides provided. Please provide any
written documents that memorialize this "Plan."

- Item 34, Spot Reports. The Commission staff put this on hold. We now
need this item fulfilled.

- Item 37, analytic products of the CTC. We are willing to limit this to
analytic products "disseminated to policy officials" related to UBL, al
Qa'ida, or other foreign terrorist organizations from January 1, 1998 to
September 20, 2001.

• Item 3, DCI Document Request #10, FBIS documents regarding priorities and
collection strategies. In particular, there are pages missing on Yemen FY 99-03
and Arabian Peninsula (besides Saudi Arabia) for FY 1998. Some countries are
missing altogether.

Dear Mr. Marcus:

I am responding to The National Commission on Terrorist


Attacks Upon the United States' (the Commission) request for an
update on the status of the Central Intelligence Agency's (CIA)
response to Item Nos. 1, 2, 3, 4, 5, 6, 8, and 18 of DCI
Document Request No. 8. In your memorandum of 26 August 2003,
you identify these items as the >vmost important categories of
documents requested by the Commission." Below is our report on
these items:

1. Item Nos. 1 (Presidential Daily Briefs [PDBs]), 2 (PDB


Feedback), 3 (Briefing Packages for Principals and Deputies
MeetingsJ of PR #8. As regards Item No. 1, we have been
informed that the Commission will receive a briefing on PDBs on
Tuesday, 14 October 2003. We understand that the Executive
Branch focal point, Mr. Daniel Levin, is responsible for working
with the Commission staff to resolve Item Nos. 2 and 3 of
Request No. 8. We are in the final stages of reviewing many of
the briefing packages for the Principals and Deputies meetings
and expect to begin making these documents available to the
Commission on a rolling basis beginning on 17 October 2003.

2. Item No. 4, PR #8 (DCI Presentations to President of


the United States and Vice President of the United States). We
understand that the Executive Branch focal point, Mr. Daniel
Levin, is responsible for working with the Commission Staff to
resolve Item No. 4 of Request No. 8, and we have been informed
that he will establish procedures with the Commission for

providing access to information responsive to this request. In


addition, we have recently identified additional materials
responsive to Item No. 4, and the production of these materials
will also be coordinated through Mr. Levin.

3. Item No. 5, PR #8 (Preparatory Materials for DCI's


Meetings with NSC, Secretary of Defense [SecDef], Secretary of
State [SoS], and Director/Federal Bureau of Investigation
[D/FBI]). We have identified responsive documents pertaining to
the DCI's meetings with the SecDef, SoS, and D/FBI, and, by
prior agreement, these documents have been retained by the
Agency and are available for your inspection at CIA
headquarters. We understand that the Executive Branch focal
point, Mr. Daniel Levin, is responsible for working with the
Commission Staff to resolve that part of Item No, 5 of
Request No. 8 pertaining to the DCI's meetings with the National
Security Advisor. We expect to make this latter category of
documents available to the Commission by 17 October 2003.

4. Item No. 6, PR #8 (Reports of DCI7s Meeting with Senior


Foreign Officials). We have identified responsive documents
pertaining to the DCI's meetings with senior foreign officials,
and, by prior agreement, these documents have been retained by
the Agency and are available 'for your inspection at CIA
headquarters. We again note that CIA does not systematically
store and maintain summaries for the numerous meetings and
conversations that the DCI has with senior foreign officials.
The Commission therefore should not consider CIA's production of
documents responsive to Item No. 6 to reflect the universe of
the DCI's meetings with senior foreign officials.
5. Item No. 8, PR #8 (Lessons Learned from Prior Terrorist
Attacks). In addition to materials previously produced to the
Commission for Item No. 8, we have recently identified several
CIA "lessons learned" documents responsive to this request and
expect to produce them to the Commission by 17 October 2003.

6. Item No. 18, PR #8 (Agenda and Counterterrorism


Materials from DCI's Meeting with SecDef). We have previously
produced responsive documents pertaining to the DCI's meetings
with the Secretary of Defense. We have not located any new
documents that are responsive to this request.

Kevin: As I mentioned in my e-mail—much of the information that's being pulled together


by CFO's office is having to be pulled by literally searching through chronological
electronic files to see if there's anything responsive, very tedious stuff. They estimate at
this point it'll take them at least 2 weeks to complete their search for all items they might
have that would be responsive--but what we can do is give you what we come up with as
we come up with it.

With respect to the stuff CMS holds. I don't have an estimate from them yet, John

Even if we could pull it all together today however, we still have to have OMB
concurrence, which is still in the works.

Steve: thanks & happy friday. We'll certainly work to set this up as soon as
possible and get back to you w/ details. Only issue I foresee is w/ the
"CIA-prepared chronology of events relating to the evolution of AQ"--as I've
discussed with Philip & mentioned to Doug when he was here, this.document is very
densely populated with special programs material, its impossible given its size to
excise it. I had actually been talking with Philip about trying to schedule a
session with his "small group" to go over the chrono to be preceded by a briefing
on the special programs material—I've floated that idea to Adam, he wanted to
discuss with the WH first & I await his decision on that--if this briefing will be
for folks not in the "small group".... the chrono might be the only thing on this
list that wouldn't be available for everyone who might attend this briefing..doug
as a member of the small group is certainly welcome to see it, we would however
like to try to have the briefing for the entire small group on the programs before
introducing the staff to the chrono. DRG & OTA are still working on pulling
together the papers for the bibliography, I just spoke to them about that to get a
status, give a call if you need further info, more later, g/n closed by statute
