BY OLIVER MATHENGE THE Jubilee coalition wants to privately prosecute Kethi Kilonzo for claiming that she was legally registered to vote. And yesterday former assistant minister Agnes Ndetei gave notice to appeal the decision by the High Court that allowed Wiper Democratic Movement to field Mutula Kilonzo Jnr for the Makueni senate by-election after Kethi was disqualified. Ndetei successfully challenged the nomination of Juniors sister Kethi in the IEBC tribunal saying she was not properly registered as a voter. Yesterday, Ndetei said she was dissatisfied with the decision of the three-judge bench comprising Justice Mumbi Ngugi, Justice Richard Mwongo and Justice Weldon Korir. Yesterday Jubilee Coalition lawyers released a legal opinion recommending Kethis prosecution. The lawyers led by Jasper Mbiuki said that Kethi committed an electoral malpractice and should not be let off the hook. We also recommend that Jubilee does not stand idly by and let Ms Kilonzo continue to mock the justice system and practice impunity. Jubilee should explore a private prosecution of Ms Kilonzo; if the Director of Public Prosecutions is unwilling to take on a political bigwig who thinks she is above the law, the

BY OLIVER MATHENGE THE Independent Electoral and Boundaries Commission has dismissed claims that there was a conspiracy to support President Uhuru Kenyattas candidature in the March 4 general election. Chief Executive Officer James Oswago yesterday said IEBC is an independent body and it did not take sides during the polls. There was no conspiracy to support any candidate. I can swear that I was not party to any such plans if at all they existed, Oswago said. He said Kenyans should bear in mind the magnitude of the elections conducted by the commission. The CEO said it is very discouraging to see the country fail to appreciate the work done by IEBC during the election. It was no mean feat to conduct such a historic poll and IEBC needs a pat on the back for conducting six elections in a day, Oswago said. He said the technical failures of the electronic voter identification kits will be rectified before the next polls. The BVR kits were 100 per cent efficient. What failed in some areas were the electronic voter identification kits. I am not saying there were no mistakes. Yes, errors were made but we are working on addressing them before the next election, he said. Oswago said IEBC has cooperated with the Ethics and Anti-Corruption Commission and the Public Procurement Oversight Authority in their investigations on the procurement of the election kits. He was speaking during a breakfast meeting with the media over Fridays Makueni Senate by-election. The commissions vice chairperson Lilian Mahiri-
Zaja said they are working on regaining public trust and confidence again as their image was tainted after the general election. She said the commission will conduct Fridays poll well and show Kenyans that it can be trusted. Commissioner Albert Bwire who is charged with overseeing the by-election said the ballot papers have been printed and they will be in Makueni before Fri-
day. Bwire also assured Makueni residents that the long queues witnessed during the March 4 general election will not reoccur as the commission has put in measures to ensure the voter kits work The kits batteries need to be charged for a long time. They are already in Makueni and we have made sure they will be charged by Friday, he said.
BY CAROLE MAINA THE Kenya National Union of Teachers and its top officials were yesterday fined Sh6 million by the Industrial court for contempt of court. Knut chairman Wilson Sossion and secretary general Mudzo Nzili were ordered by judge Linet Ndolo to each pay a fine of Sh500,000 or face a 30-dayjail term for disobeying an order requiring them to call off the teachers strike. Ndolo ruled that the union should pay a Sh5 million fine which will be recovered by the Teachers Service Commission and paid to the court within 30 days. Sossion and Nzili who had

The judge said court orders must be obeyed to safeguard the rule of law. She said the union officials disobeyed the orders issued on July 1 asking teachers to end the strike and negotiate with TSC. Court orders must be complied with. To see it any other way will open door for chaos and anarchy. Defiance is not an option, Ndolo said. The legal battle began after Knut asked its members to down their tools on June 25 and demand that the government imple-
ments legal notice 534 of 1997 . TSC went to court seeking orders to restrain Knut from continuing with the strike. Despite being served with the suit papers Knut did not appear in court . After hearing TSCs submissions, the judge ordered both parties to enter into negotiations and teachers to go back to work The strike was not called off and TSC filed contempt proceedings seeking orders to commit the two to jail for six months. During the hearing, the officials said they were not in contempt and it was Knuts national executive council that had powers to end the strike. However Ndolo said it was obvious they called for the strike.

It said it was not aware about the exact amount of money in the container which was stolen while on transit. The company said the bank under the contract ought to have given a written notice in 15 days to inform about the lost cash which it didnt do. The bank blames the company for failing to use armed police escort. It said the loss was suspicious because the employees of the company did not call the bank or their own bosses in Nairobi to report the robbery. Instead, they reported the matter to the police.
BY SAM KIPLAGAT AN accountant yesterday accused his former employer of tax evasion as he fights for compensation after he was sacked four years ago. Giving his testimony before Industrial Court judge James Rika, David Muhoro said two employees of Ol Pejeta Ranching Ltd were hired as consultants but an audit later revealed that they were employees of the company. In the report, which he tabled in court, Muhoro said although the company was commended for high tax compliance, there were instances where
it evaded tax. The audit, which was done by KPMG in June 2007, revealed that two white managers had not paid tax amounting to Sh8.9 million. Muhoro told Justice Rika that although the two managers were hired as consultants, they received taxable allowances such as house, bonuses, leave and motor vehicle allowances. He said that the sole reason for hiring the two white managers as consultants was to evade tax. The company in reply, wants the court to dismiss the case arguing that Muhoro was paid all his dues. The case was adjourned to September 27.

BY HENRY KIBIRA THE Medical Practitioners and Dentists Board has said it will not hesitate to take punitive measures on errant medics in its bid to safeguard the profession and patients against malpractice. The boards chairman, George Magoha, said his team will strive to be fair in hearing complaints raised about its members negligence. He was speaking yesterday at the opening session of the four-day complaints hearings being conducted at the University of Nairobis School of Medicine board room. We have taken the Hippocratic Oath. We shall jealously protect the confidentiality of the parties involved in the matters before this tribunal, Magoha said. Three hearings were scheduled for yesterdays session. They involved medics from Nairobi, Kitui district and Victoria Hospital in Kisumu. Two cases were filed by two parents on behalf of their daughters while another was filed by a sibling on behalf of his sister. I appeal to all parties to avoid unnecessary adjournments or legal technicalities. This will enable the board to hear and conclude the matters quickly, Magoha said. The proceedings were held in camera, in line with boards rules and procedures. This ensures that the privacy of all parties involved is upheld. The respondents are allowed to have their lawyers present. The full board sits as a quasi-judicial tribunal. When aggrieved patients, citizens or practitioners lodge complaints of alleged medical malpractice, the board writes to the accused and a comprehensive report of the allegations is written. Upon receipt of the complaint note, a review committee deliberates on the contents, and eventually the case goes to the full tribunal hearing.

Nyachae said Kinangop MP Stephen Mburu called him a stooge of former Prime Minister Raila Odinga who makes decisions on Railas instructions. He said the incident happened at the close of a meeting between the CIC and the Budget and Appropriation Committee last Thursday. Nyachae said he found the statements offensive, absurd and almost insane. He said the statement is both false and insulting to him and to the CIC. Nyachae told Muturi that he believes the statement is aimed at bullying and intimidating him and the commission. My colleagues and I will continue to discharge our constitutional and statutory responsibilities in accordance with the commissions mandate and our oath of office, he said. by DOMNIC WABALA THE Citi Hoppa bus management has denied reports that they have resisted advice by police to use metal detectors to screen passengers as alleged by Nairobi county police boss Benson Kibue. In a statement sent to newsrooms yesterday, Citi Hoppa bus operations manager Githaiga Weru said the company has posted security officials at all stages and has been using metal detectors for a year and half to screen passengers. He urged the police to do their work and reduce carjackings of Public Service Vehicles instead of apportioning blame. It is disturbing that the police have singled out Citi Hoppa buses as a scapegoat for the carjackings in Nairobi. We ask the police to get their facts right and use all machinery to end the carjackings which are affecting our business, Weru said. Kibues warning comes after a Citi Hoppa bus was carjacked by armed gangsters on Jogoo road and driven to Githogoro slums where passengers were robbed and assaulted last Thursday.

On the political front; we recommend that the coalition aggressively highlight the hypocrisy displayed by Cord both before the tribunal and before the High Court. Cord likes to depict itself as a champion of the rule-of-law but it is now clear that Cord means the laws that favour it, the lawyers say. Last week the High Court upheld the decision of the IEBC Tribunal to disqualify Kethi but allowed Wiper to nominate another candidate. Wiper has now nominated Mutula Kilonzo Junior who will face-off with Harun Mwau, Philip Kaloki and Jane Kitundu on Friday. The seat was left vacant by the death of former Education Minister Mutula Kilonzo, Kethis and Juniors father.

By ALBERT NYAKUNDI Police in Kasarani have recovered a motorcycle belonging to a boda boda taxi operator who was murdered last Thursday at Kiamumbi village and his body dumped in a coffee plantation. The motorcycle was recovered yesterday at Maakiou coffee estate by workers a few metres from where the operators body was found. Police said the motorcycle was in good condition and had fuel in the tank. A worker at the farm was killed by the gang when he tried to rescue the rider during the 9.30pm incident. Police have said it is unlikely the robbery was the motive of the attack. Property worth millions of shillings was destroyed after the Ministry of Transport and Infrastructure flattened structures on land reserved for the bypass at the weekend The ministry has defended the demolitions saying the structures are in the way of bypass whose construction is underway. In a letter delivered to State House yesterday, Sonko protested that the structures were far from the bypass and that there was no court order or an eviction notice issued before the demolitions. The senator attached to the letter copies of correspondence and title deeds from the Ministry of Roads, the City Council of Nairobi confirming the approvals of development of the struc-
tures. The demolitions do not augur well for the Jubilee administration and the constitution. They are giving your government a negative image thereby giving our political opponents an opportunity to discredit your good leadership, the letter reads. Sonko urged the president to take up the matter with the Transport and Infrastructure secretary Michael Kamau because the demolitions are being conducted without any notice, court order or compensation. Should the government find it necessary to carry on with the demolitions then I plead for compensation to the affected persons as the case was with other by passes, he said. Sonko took a swipe at Secretary Kamau, accusing him of arrogance and working with the enemies of Jubilee to paint the government black. Sonko wrote to the President after pleas from the affected families.

Magistrate quits case Kibera man in court for defiling his niece
By ANNETTE WAMBULWA A 39-year-old man yesterday denied defiling his 14-year-old niece. The Kibera court heard that Samuel Ndungu Waithaka allegedly defiled the girl between January 2012 and June 8, 2013 at Karinda Village in Karen. The magistrate, Juma Osoro, released him on a Sh200,000 bond with a surety of a similar amount.The girl was taken to the Kibera childrens rescue centre where she is staying until the case is heard and determined. The hearing was set for August 21.
A criminal case against a couple has been re-assigned to another court after the trial magistrate disqualified herself from the case. Senior principal magistrate Lucy Mbugua said she quit the case against Salvacao Cipriano Fernanders and his wife Gladys Rose Fernanders for personal reasons. The two, who are former directors of Advanced Catering Ltd, are accused of stealing more than Sh4.3 million from the company. The case will be mentioned on July 31.

Elders to sue Kenya Army
isiolo Lebarua residents will go to court to bar the Kenya Army from evicting them from their ancestral land. The more than 5,000 locals and their elders have been raising funds to sue the army. Elder Peter ole karumba said the soldiers are harassing them and destroying their crops in a bid to evict them from the land. Karumba asked the county government to move the army barracks from the town to pave way for a proposed resort city.
BY KURGAT MARINDANY ATHI River police station officers do not know who to report to as two bosses fight over office. The stations OCS James Njiiri was promoted and transferred to Kakamega Central Division on July 16 but has refused to leave, defying orders from police headquarters. Njiiri was expected to take over as deputy OCPD in Kakamega Central while his colleague from Maseno, Gerald Gitau, was to replace him as the new Athi River OCS. Gitau reported to Athi
River but Njiiri told him he had not been properly consulted before the decision to transfer him was made. Speaking to the Star on the phone yesterday Njiiri said he is not aware of his transfer. However the new Athi River OCPD, Beatrice Kiraguri said Njiiri has been transferred. If we establish that the officer has refused to report to his new station, we have a way of disciplining him. Police rules are clear. I am aware that Gitau has reported to this station, but so far nobody has made
complaints about Njiiri. I have only been here for a week, Kiraguri said. Officers serving under the OCS do not know who to take orders from. The junior police officers yesterday said Njiiri has refused to hand over to Gitau who is operating from the stations report office. They said he has turned a vehicle assigned to the office into his personal car. What we are asking is; where does he get the powers to disregard the Inspector General of Police? an officer said.
The officers said Njiiri had previously served at the station for five years until 2004 when he was transferred. He was brought back as OCS in 2009. Sources said Njiiri owns wine and spirits shops in Mavoko and he fears if he leaves the station his wife will lack his protection in the business that is run before and after hours. But close associates of Njiiri within the station said he will not be going anywhere because he has protection from a senior officer at Vigilance House in Nairobi.
ISIOLO Deputy governor Mohamed Gulled has called for tough penalties on poachers and cattle rustlers. Gulled said cattle rustling and poaching will only be stamped out if the government is hard on suspects. He said courts only fine bandits and poachers for the crimes. Gulled was speaking to county executives, county boards members and the interim transitional team at Sarova Hotel on Saturday. He asked Parliament to come up with laws to deal with the cattle rustling.

BY ALPHONCE MUNGAHU GARISSA Governor Nathif Jama Adam has asked the High Court in Nairobi to dismiss a poll petition seeking to nullify his election. Through his lawyers Peter Muchoki and Dennis Muriithi, Nathif says he was duly elected by Garissa residents. IEBC lawyer Daniel Muganda told the court that the March 4 election was credible, transparent, free and fair. He said there was a 97 per cent turnout in Garissa. The IEBC lawyer said Nathif won the polls with a 1,594 votes margin contrary to allegations made by the petitioners that the difference was 221 votes. Muganda said the votes being disputed by the petitioners have no significant impact to alter the election results. Meanwhile, the court has admitted evidence on a video clip showing the petitioner, Abdikarim Osman Moham-

By BRIAN OTIENO The fight against crime in Mombasa county received a big boost yesterday with the unveiling of four new police patrol cars . The county becomes the first in the country to acquire vehicles for the police. The cars are expected to go into service right away. Governor Hassan Joho said the cars are to help improve the security of Mombasa residents and visitors. His sentiments were echoed by county commissioner Nelson Marwa and Coast regional representative Aggrey Adoli. The security officers however warned that security will only improve if there is continuous flow of information from residents to the police. The vehicles cost about Sh2.6 million each with an additional Sh500,000 for the acquisition and installation of the security systems per car. Wambui, through her lawyer Cecil Miller, yesterday opposed the application by petitioner Peter Kingara who wants her to produce certified copies of her O-level and postsecondary school certificates and diplomas. In the petition, Kingara said Wambui testified two weeks ago that she has an O-level certificate from the British Council. We want to know whether she had all the qualifications required to vie for a parliamentary seat, Kingaras lawyer Kyalo Mbobu said. Miller said the application has no basis and only seeks to have the court act in vain. He said the law did not have a provision for edu-
cational qualifications to vie for a parliamentary seat in the March 4 general election. Wambui opposed the application by the petitioner for a scrutiny and recount of votes cast in Othaya. There are no sufficient reasons and evidence for the court to warrant the scrutiny at this time, Miller said. We are only left with submissions and judgment. A recount will not effectively determine the petition. Kingara had applied for a scrutiny and recount of votes cast arguing that more than 90 out of the 112 polling stations had anomalies and 4,600 votes were missing. More than 500 to be Senate may add county evicted in allocations, says Kembi Kiambu
BY JESSE MWANGI A Senator has asked governors to prove to Kenyans that they deserve the funds they are demanding. Speaking to the press at Tuthu Catholic Church in Kangema, Muranga county on Sunday, Senate Deputy Speaker Kembi Gitura said governors must have realistic, and not luxurious, budgets before the House considers allocating them more money. Kembi said they will consider increasing county budgets but governors must prove they need the extra funds. While responding to a resolution by governors who had recently converged in Mombasa to push for more funding among other issues, the senator said counties already have more than the constitution has recommended. He said counties got 34 per cent of the national budget translating to Sh210 billion per county yet they are supposed to get a minimum of 15 per cent according to the constitution. Kembi, who is also the Muranga Senator, said governors have a right to ask for more money for development. The recommendation to have more money is subject to scrutiny by the Senate, he said. The Senate will look into the matter to find out if a minimum of 40 per cent is adequate and if the counties have the capability and capacities to use it. Kembi said they may raise it to 45 per cent in the future depending on the needs and capability of the counties. The houses are owned by the National Housing Corporation but Kiambu Municipal Council collects the rent. They have now been transferred to the county government. In a notice issued by interim county secretary Wilson Maroa yesterday, the tenants have been ordered to vacate by July 31. Speaking in the town yesterday, Kiambu County Tenants Welfare Association secretary Peter Kuria said the reasons given to vacate them are baseless since there is a plot to sell the houses to individuals.

Palestinian rocket hits Israel
JERUSALEM Palestinian militants in the Gaza Strip fired a rocket at southern Israel that exploded without causing damage or injuries, an Israeli police spokesman told AFP on Monday.
It exploded near a kibbutz in the Eshkol region shortly before midnight on Sunday, said Micky Rosenfeld, adding police were still searching for the remains of what he said was a Qassam rocket.

Zambia allows company to restart dam project
LUSAKA Zambia has allowed First Quantum Minerals to restart construction of its Sentinel copper project that had been halted this year on environmental concerns, according to a document obtained by Reuters. Zambia in May ordered Vancouver-based First Quantum to stop construction of the dam, a vital source of water for the $2 billion Sentinel project expected to produce as much as 300,000 tonnes of copper per year. The environmental ministry will allow First Quantum to proceed building the dam although it will continue to study the impact of the construction, it said in a document dated July 18. First Quantum spokesman John Gladston said the company would no longer need to shed 500 jobs, as it had planned when forced to stop building in May. It will would double the work rate to ensure the copper mine was completed by the companys stipulated deadline of 2014, he said. Sentinel Mine is the first of the three potential mines at the new largescale project in northwest Zambia where the company already operates.

population has access to electricity. Wood, charcoal, dung and crop residue supply 76 per cent of Kenyas domestic energy needs. There is a strong correlation between exposure to biomass fuel and respiratory infections in children. A report published by the Ministry of Health in 2004 revealed that acute respiratory infections contribute to 70 per cent of mortality in children less than five years of age. A report by Uwezo, an education advocacy group, revealed that among Standard Three pupils only 28 per cent from the poorest households had achieved expected numeracy and literacy, compared to 48 per cent in the richest households. Twenty-five per cent of the more than 800,000 children who finished primary school in 2102 will not transition to high school. The path to gaining skills and competing in a knowledge economy does not exist for a majority of our children. According to the 2009 census, only two million of 14.5 million Kenyans in employment have stable jobs, which pay a living wage. Some 12.5 million Kenyans are employed
in sectors that are highly vulnerable and do not pay enough to lift our fellow citizens out of poverty. Inequality is staggering; the richest 10 per cent of households spent on average 14.3 times more than the poorest 10 per cent of households in 2011. The impressive growth of the last decade has not trickled down. Kenyas overriding preoccupation with economic growth makes no sense without recognising that sustained gains in human welfare depend on how that wealth is created and distributed. Our economy, which is largely driven by services, has the least potential to generate a broad based shared GDP growth for a population dominated by unskilled school dropouts and struggling smallholder and pastoralists. In a sense, Kenyas growth path is highly defective and exacerbates inequality. This path of inequitable growth will have serious implications for political and socioeconomic development, undermining the tenuous foundations of our young democracy. The GDP growth without investment in human
development is unsustainable and unethical. What is the purpose of a growth path that produces a handful of billionaires, luxury shopping malls and superhighways rather than access to water and sanitation, high quality education for our children, better nutrition and security for millions of Kenyans? We must learn from China, where massive investment in expansion of education and healthcare in the 1970s is paying off and has proved critical to undergirding sustained economic growth. Without comparable investments in laying such a foundation, Kenyas economic growth will remain modest and vulnerable. We must make public investments which will give the vast majority of our fellow citizens a toehold on the first rung of the ladder out of poverty. These include support to smallholder farmers and pastoralists, affordable public transport, affordable mixed income housing in urban areas and vocational training and work for recent graduates. What holds Kenya back is not the quality of our air or soils or water but successive governments, which lack clearheaded, long-term policies and the political will to follow through. We must ask and demand more of our government and ourselves. Most of all, our collective conscience must be stirred because when our conscience quickens political action will follow. The priority of Mijikenda political leaders should be to protect, restore and reinstate the kayas as cultural museums
lines of descent. These elders meet formally to decide policy and to adjudicate disputes. In progressing from boys to elders, men pass through several stages, each marked by a ceremonial dance, the mwanza, mungaro, nyere, kirao, sayo and finally kambi, which is the body politic. Kirao is the most important because it is in this ceremony that customary knowledge and rituals are passed on to the incoming elders. The Kambi is the Kayas decision-making body. It meets regularly at meetings called the moro, to among other matters, adjudicate community disputes and conduct annual ceremonies praying for the rains during droughts. Culturally, the Kayas are significant among the Mijikenda and this is why we should question the emerging trend in which the Kayas are rapidly losing their originally intended purposes and being turned into cocoons for individual political gain. How many of the politicians anointed by the Kaya elders have undergone the requisite cultural rigours to deserve being installed elders and spokespersons of the
community? What criteria do the elders use to instal politicians as Kaya elders and spokespersons? Let me not be misunderstood. As institutions, Kayas have every right to bestow recognition upon individuals and institutions that have made significant contributions to humankindin this case, the conservation and preservation of the Kayas themselves and the Mijikenda communitys political, economic and social advancement. However, the problem with the elders is that some of them have fallen victim to political manipulation. This has led to internal bickering interfering with the elders fundamental role as custodians of the Kaya shrines and the Mijikenda culture. The priority of the Mijikenda political leaders should be to protect, restore and reinstate the Kayas as cultural museums of the communities. Installing leaders to higher political positions should not be the priority. Such installations have made the Kaya elders lose credibility and reduced the once revered Kaya shrines to avenues for political opportunism. In the history of the Kaya shrines, only two cases of
installations have stood out as genuinethose of the late Ronald Ngala and the late Karisa Maitha. Ronald Ngala was not just a politician; he was a leader of the now defunct Kenya African Democratic Party, was at the forefront of the independence struggle and the voice of the coastal people, as well as the interests of other minority groups in Kenya. No one then and since has raised a question about his installation. When Ngala died in 1972, the Mijikenda literally went leaderless until the emergence of the late Hurricane Karisa Maitha who won the admiration of the majority of the community when he introduced a parliamentary motion legalising the tapping and drinking of Mnazi palm wine, a key income earner among Coastal communities. Miraa is to Meru what Mnazi is to the Mijikenda; or better still, what coffee and tea are to the people of Central. Over the years, Maitha became the political voice of the Mijikenda, articulating the communitys political, economic and social concerns. For this, Maitha was made a Kaya elder. These two cases should provide our current crop of Mijikenda and Coast political leaders with a few lessons. First, leadership is earned not imposed. Second, it takes years to become a respected Kaya elder. Any action to consciously instal undeserving individuals as elders amounts to blasphemy. Ripples International, a nongovernmental organisation, brought this petition on behalf of the rest of the petitioners who were allegedly victims of defilement and other forms of sexual violence and child abuse. The victims are alleged to have made various reports in various police stations within Meru county. The police officers however neglected, omitted, refused and or otherwise failed to conduct prompt, effective, proper and professional investigation into the petitioners complaints or record the petitioners complaints, visit the crime scenes, interview the witnesses or collect and preserve evidence, take any other steps or put in motion such other processes of the law as would have brought the perpetrators of the violence to book. The petitioners hence moved the court arguing that due to the neglect, commission, refusal and/ or failure on the part of the police to act on their complaints, they (the petitioners) suffered grave unspeakable and immeasurable physical and physiological trauma and that the perpetrators of the aforesaid unlawful acts still roamed large and free hence threatening the physical and psychological wellbeing of the petitioners. They thus sought, among other orders, a declaration to the effect that the neglect, omission, refusal and/or failure of the police to conduct prompt, effective, proper and professional investigations into their complaints violated the their fundamental rights and freedoms under; (a) the Constitution of Kenya, 2010, (b) Articles 1 to 8(inclusive) and 10 of the Universal Declaration of Human Rights, (c) Articles 2, 4, 19, 34 and 39 of the United Nations Convention on the Rights of the Child; (d) Articles 1, 3, 4, 16 and 27 of the African Charter on the Rights and Welfare of the Child, and
Constitutional mandate: The Kenya police crime scene unit in action at Mombasa. contrary to the express and implied provisions of Article 27 and 244 of the constitution. The police failure to effectively enforce Section 8 of the Sexual Offences Act, 2006 infringed on the petitioners right to equal protection and benefit of the law contrary to Article 27(1) of the Constitution of Kenya, 2010 and further by failing to enforce existing defilement laws the police contributed to development of a culture of tolerance for pervasive sexual violence against girl children and impunity. Police play a critical role and its abdication from that role inevitably deprived the claimants access to courts and led to miscarriage of justice or denied them justice altogether. Their demand for payments as preconditions for assistance, whether for fuel or P3 forms or whatever the case might have been, violated the petitioners right to access to justice and right to have disputes that could be resolved by the application of law decided in a fair and in public hearing before a court of law in accordance with Article 50(1) of the constitution . The police failure to act on the petitioners complaints of defilement violated their rights under Article 53 of the Constitution of Kenya, 2010. The constitutional requirement to protect the best interests of the child requires not only the establishment of relevant laws but also requires their proper enforcement by state agencies and any failure to implement laws aimed at protecting children amounts to infringement and/or violation of their constitutional rights. A declaration issued to the effect that the neglect, omission, refusal and/or failure of the police to conduct prompt, effective, proper and professional investigations into the petitioners (victims) complaints of defilement violated the petitioners fundamental rights and freedoms(a) to special protection as members of a vulnerable group, (b) to equal protection and benefit of the law, (c) not to be discriminated against, (d) to inherent dignity and the right to have the dignity protected; (e) to security of the person, (f) not to be subjected to any form of violence either from public or private sources or torture or cruel or degrading treatment; and (g) to access to justice as respectively set out in Articles 21(1), 21(3), 27, 28, 29, 48, 50(1) and 53(1) (c) of the Constitution of Kenya. 2. Uhuru should be committed to fight graft
The first 100 days in office for the Uhuru Kenyatta government has not been easy. President Uhurus admibistration has made many positive strides but also many negative ones. The government is unable to fight corruption. The state should organise a national open forum to get ideas from its citizens on how to combat graft. As a digital government, it should make the forum online but also have meetings with Kenyans in town halls to get sound proposals. In the 2013-14 budget, the state did not allocate enough money to the government auditor to fight corruption. The national audit office is cash-strapped and cannot execute its mandate effectively. he Media Council of Kenya should be left to regulate the media. It is shocking when the Information and Communication ministry reveals that it is preparing the Media Bill 2013 and that the section that guarantees self-regulation of the press has been struck off. Previously, the control and regulation of the media has been done by MCK. The council has been effective and deserve a thumbs up. I am still trying to rationalise why the executive is trying to interfere with this yet President Uhuru promised that
his government will be ready to assist the media and ensure its freedom is upheld. Why should another body be introduced to regulate the press yet the Media Council has shown its commitment in regulating journalists? During the election campaigns and the March 4 poll, MCK was effective in regulating the media. There were no cases of reckless reporting because the Media Council was on the lookout for journalists inciting people. I do not want to see the media silenced and journalists crippled by a
government intolerant of criticism. In this generation we need a press that is free and impartial. Only with this will good governance be realised because citizens are able to observe the conduct of their leaders. The government should be just in addressing this issue. It should not promote opposing factions. I urge the government to reconsider and include the self-regulation section because media freedom is paramount for any society to thrive and advance. fter being a maize farmer for three decades, 57-year-old Francis Ngure realised his harvests were dwindling every year. My farm output started dropping significantly, Ngure said at his Manera farm in Gilgil. He was frustrated and did not know what to do. Africa is facing a shortage of quality seeds. Poor seed combined with climate change is worsening the already critical food shortages in Sub-Saharan Africa. Ngure says he used to harvest an average of 30 bags per acre but in the recent past, this has dropped to less than 10 bags. The lethal necrosis disease ravaged maize farms in the North and South Rift. As many farmers decided not to grow maize this season, Ngure soldiered on. Despite the high cost of inputs coupled with the low yields, Ngure continued considering that maize is the only crop known to do well in Gilgil area. However, following a visit by extension officers from the Ministry of Agriculture to his village, Ngure says he was encouraged to try alternative crops. I was told to grow sweet potatoes... I was hesitant at first but I am now very happy, he says. He was given some money to start off and officers from the Kenya Agricultural Research Institute visited his farm to see how he was doing. He was also introduced to some new varieties in the market. I am happy Ngure and other farmers have adopted our new varieties, says Dr Joyce Malinga, a seed breeder with Kari. We have come up with new varieties and I am happy farmers are making money and getting food. She attributes this success to the Alliance for Green Revolution which supports scientists from Africa to come up with new seed varieties to fight food shortages. New varieties developed by Malinga and her colleague, Dr Laura Karanja, are already in the market. The two hope it will be used by more farmers in the country. Available varieties are Kenspot 1, 3 and 5 which are high yielding and fast maturing. Agra President Jane Karuku says many farmers in Kenya dont have quality seeds. This prompted her organisation to work with local scientists to come up with improved seed varieties. Many farmers use unreliable seeds. They often use what they harvested in the previous season to plant, Karuku said. Agra says millions of African farmers and their families are trapped in poverty because they lack good seeds, their soil is depleted, and they farm without reliable water supply or ready market. Agras strategy focuses on smallholder farmers while working for change that strengthens the entire agricultural system and focuses on high-potential breadbasket areas and countries. Everything that farmers in the developed world depend upon, Africas smallholder farmers have done without, says Karuku, we have to help these farmers. If we are talking of improving the countrys food security, let us start from getting the best, reliable and high-yielding seeds to our farmers and that is what Agra is doing. Felician Mugo, the chief of Kasambara location in Gilgil, concurs with Karuku, saying many farmers use seeds from the previous harvest. Many farmers here select their best crop and use them as seeds. They cannot afford to buy quality maize seeds and this has threatened food security in the area. Most farmers cannot produce more than 10 bags per acre owing to the poor seeds, she said. Mugo adds that many farmers in her location have shifted from maize to sweet potato production. Kari has a breeding farm in Njoro where the vines are sold to farmers for Sh2.50 per three-centimetre vine. We have Kespot series which can do well in Njoro, Lare, Eldama Ravine and Kakamega regions, said Malinga. They are high-yielding and take six to seven months to mature. It can produce up to 23 tonnes per hectare. Malinga says she decided to breed sweet potatoes because many people have not taken it seriously. Most farmers grow it just as a garden crop and not for its commercial value, she adds. At her station in Njoro, Kari officers are busy preparing chapati from sweet potato flour. She says recent studies have proven the capacity of sweet potatoes to raise Vitamin A levels in blood. This is good for young children, she adds. Agra is also working with other seed producers and stockists in Eastern and Western regions of Kenya. In Machakos, Agra partners with Dry Land Seed Company to produce seeds that are suitable for the area which receives low rainfall. Seeds produced are fast maturing KH500, KDV2 and KDV4 varieties. Agra has partnered with Moi University to train students for their masters in seed breeding. One such successful student is Rose Wangari who is working on a new variety of cow peas in Machakos. Wangari, who is a researcher with Kari, is at an advanced stage in developing a variety that is resistant to striga weed. We are funding a breeding research programme to deliver quality seeds to 400,000 local farmers, in a drive to get farmers to switch from retained seeds, says Karuku.
This has always led to low yields since smallholder farmers tend to use retained seeds because of their availability and the low cost of acquiring them compared to hybrid seeds. A 2008 study by the African Journal of Agricultural Research shows that retained seeds tend to have low disease resistance and score poorly on yield. Three quarters of smallholders are currently using retained seeds. But the $150 million Programme for African Seed Systems initiative, targeting 13 African countries, is now focused on all the popular staples consumed in Africa, including maize, beans cassava, sorghum, rice and sweet potatoes. In the 13 countries, Kenya included, the demand for quality seeds stands at 0.5 million tonnes, yet only 0.2 million tonnes are supplied, The Programme for African Seed Systems (Pass) provides the higher-yielding seeds farmers need to not only avoid such a crisis but also better their own lives and those of their children. Seed companies require investment capital but commercial banks are unwilling to shoulder the risk associated with young seed enterprises. To fill the financing gap, Karuku says, Pass created two stand-alone venture capital funds to make debt and equity investments in small and medium-sized seed companies. Another company Pass supports is the giant Western Seed Company based in Kitale. Saleem Esmail, the Western Seed CEO, says seed production in Kenya is an expensive venture. While local seed companies face many hurdles from government bureaucracy, he says multinationals are given safe passage to introduce their new varieties to the market at their expense. We are grateful to Agra but what remains difficult here in Kenya is bringing new seed variety to the market, says Saleem. We wait for about five years for the Kenya Plant Health Inspectorate Services to okay our varieties. I think the period should be reduced. The company produces various seed varieties packed in two kilogram bags which Saleem says has benefited smallscale farmers. Dr Ephraim Mukisira, the Kari director, said proper seed development is the key to farming in Kenya. We want seeds that are tolerant to crop pests and diseases. Farmers need fast maturity seeds and we thank Agra for partnering with us. Agriculture Cabinet Secretary Felix Koskei says his ministry is exploring ways of minimising the loss that farmers have incurred for the last two years by turning to new maize seed varieties. As a way of prioritising farming and guaranteeing food security in the country, we have asked the Kenya Agricultural Research Institute to carry out research and come up with maize varieties that are resistant to the viral disease and already they have identified three varieties, Koskei says. This is good news for farmers like Ngure.

The new president Gilda Odera takes over from Mbogo Muthui. The event was emceed by Gichu Wahome while the chief guest was Rotary International trustee Sam Owori from Uganda. A presentation by Jane Mberia and Prince Seyi Lufadeju (Rotary Club of Abuja Metro) outlined the clubs achievements including construction of low-cost housing units at Cura community in Kikuyu, in conjunction with RC Orlando and donating solar ovens to Mukuru Kwa Njenga community. Among the guests were Rotary Club of Muthaigas Jane Mungoma with Reza Kazemian, Steve Wernar, Mayling Simpson and Paul Hebert travelling all the way from Colorado, US to take part in the celebrations. This comes in the backdrop of the Human Rights Watch (HRW) report on Somali refugees torture allegations. The HRW recently released a 68page report on how Somali refugees rights are violated by Kenyan security forces in the pretext of fighting terror. Refugees told us how hundreds of Kenyan police unleashed 10 weeks of hell on communities close to the heart of Nairobi (Eastleigh), torturing, abusing, and stealing from some of the countrys poorest and most vulnerable people, said Gerry Simpson, senior refugee researcher and author of the report titled You are all Terrorists: Kenyan Police Abuse of Refugees in Nairobi. The report was released in May. International law requires Kenya to ensure that officers who tortured refugees who raped women and beat children and men into unconsciousness while branding them terrorists are investigated and held to account, Simpson said. Ismail says despite the grave revelations by the global rights body, this is just among many other challenges faced by refugees worldwide in foreign lands. Citing a threat to national security following grenade and gun attacks which claimed many lives especially in the predominantly Somali-inhabited Eastleigh and in North Eastern Kenya, the government gave a directive that all refugees and asylum seekers residing in urban centres be returned to Dadaab and Kakuma refugee camps. The Department of Refugee Affairs, after what it called unbearable and uncontrollable threat to national security, asked the humanitarian agencies to stop their humanitarian services in urban centres and instead confine them to camps, a move the acting head of the department, Badu Katelo, said is meant to bring the gory attacks under control. The government of Kenya has decided to stop reception, registration and close down of all registrations centres in urban areas with immediate effect, the statement said. We are looking for durable solution to the refugee crises in the country including their safe return to their homeland. Kenya at this juncture is working with the Somali government and UN refugee agency to establish modalities of repatriating refugees, Katelo further said during the World Refugee Day marked on June 20 in Dadaab. He, however, said the process will be voluntary. I wish to clarify that repatriation will be voluntary. The United Nations High Commission for Refugees is also opposed to the repatriation and the confinement of refugees in the camps, terming it as hurried and insensitive to the rights and plight of refugees. We feel that the decision reached by the government was rushed, we are still negotiating with them to take steps that will ensure security but also protect the rights of refugees, Emmanuel Nyabera, the UNHCR spokesman said. In April during a courtesy visit to President Uhuru Kenyatta, the Somali president, Hassan Sheikh Mohammud, said his government is ready to receive the refugees, indicating that the country is now more secure after the militants who have wrecked havoc the Eastern Africa country for decades were largely neutralised by foreign forces under Amisom. There is need for Somali refugees in Kenya to return to Somalia as soon as the time is right and preparations have been properly made, President Mohammud said. Kenya has for many years been lobbying for global support for the speedy return and resettlement of the more than half a million Somali refugees mainly in Dadaab, the crowded and probably the largest refugee camp in the world covering 50 square kilometres. Today, Somalis are spread across the globe and can be traced to major cities in the United Kingdom, Canada, Africa, Scandinavia, the Middle East and United States. But for the hundreds of thousands refugees in Kenya, going back to Somalia isnt on the table ... not just yet.

The International Organisation for Migration, a humanitarian body that oversees the orderly migration of refugees around the globe, said the conditions for return must be adequate, accommodative. The IOM communication officer, Lilian Matama, cast doubt on how the refugees will be integrated into Somalia after their lives were ruined by the two-decade war. She, however, said much will be discussed in the August Conference on Somali repatriation. But our stand has been to advocate for humane, orderly and safe process before repatriation, she said. Medecins Sans Frontieres, the main medical provider in Dagahley refugee camp, one of the four camps in Dadaab, terms the Kenya governments move premature, since the security conditions in Somalia is still not conducive. According to the MSF head of mission, Elena Velilla, humanitarian agencies continue to have problems reaching some of the refugees in the camps due to heightened insecurity which greatly hinder service delivery. The humanitarian agency said there is no forced return to Somalia so far, but some people returned due to unfavourable conditions at the refugee camps. Shelter, water and sanitation conditions in the camps are substandard and this has led to some refugees opting to go back home since the camps are no longer a safe haven, Velilla told the Star. Kanye West gets into a physical altercation with paparazzi in Los Angeles Rapper Kanye West (pictured) got into an altercation with a photographer shortly after landing at Los Angeles International Airport on Friday. A section of the business leaders yesterday said they welcome the VAT Bill in as far as it simplifies the compliance process. However they maintained the poor should be cushioned from the impact of the high prices of commodities that will come with the passage of the bill that seeks to tax goods that were previously exempted. The leaders, from the Kenya Private Sector Alliance and the Kenya Association of Manufacturers were responding to assertions by the Kenya Revenue Authority that the VAT Bill was not formulated to help the government raise revenues but to ease compliance with the tax in Kenya and thus improve the countrys investment climate. Its true. It has fundamentally simplified the VAT administration, said KAM chief executive Betty Maina. It was/is very complex. In its argument, KRA said because of the difficult and bureucratic tax payment processes, Kenya has remained a less attractive investment destination. According to a 2013 global World Bank and PWC report on paying taxes, Kenya is ranked 164 out of 185, a worse position compared to 153 in 2011 and 154 last year. Countries like Mauritius rank at number 12, Rwanda at 25, South Africa 32 while Uganda is 70 places ahead of Kenya.

If we really want to improve Kenyas competitiveness, we have to address the fundamental problems that make VAT so onerous to comply with and therefore a threat to Kenyas investment climate competitiveness, KRA commissioner general John Njiraini said last week. Kepsa chairman and Bidco chief executive Vimah Shah said there is general consensus that compliance with the tax should be made simpler but touching on the basic items for the masses poses a serious challenge. As manufacturers, the more compliant, the better, said Shah but on cost (of food) that is a different issue all together. Shah argued that removing the previously zero-rated items will only work to make the entire cost of doing business more expensive. Last week, Kenya Airways managing director Titus Naikuni said if the bill is passed, it will affect the expansion plans by the company. The company plans to increase its fleet to 103 aircrafts from the current 41 in the next 10 years. The proposal to tax purchase and lease of aircrafts and spares, which are currently zero-rated, will have a negative impact on the companys cash flow, Naikuni said. Naikuni said the estimated VAT on purchase and lease of aircrafts in the coming years will be approximately Sh108 billion. Yesterday, Consumer Federation of Kenya boss Stephen Mutoro said a balance should be found between the positive attributes of the Bill and its negatives. We are not saying it is not good, but there has to be some balance, Mutoro said.

GSKs emerging markets president Abbas Hussain met recently with officials from Chinas ministry of public security, or police, a ministry statement said, without giving the date of the meeting. The GSK head office should face up to its duties and responsibilities, fulfill the commitments in its apology statement and fully cooperate with the investigation by Chinas police, the statement said. A police official has previously claimed GSK staff funnelled nearly $500 million in suspected bribes through travel agencies and consultants since 2007. Police have held four top executives of GSK China and prevented another, the firms British finance director, from leaving the country, though he has not been formally detained. GSK executives also took kickbacks from travel agencies in return for organising conferences, some of which did not exist, police say.

Facing a fragile recovery and the threat of a new economic slowdown, the G20 this weekend agreed to prioritise boosting growth and jobs and for now to pay less attention to reducing swollen budget deficits. At a meeting in Moscow in an exhibition hall just outside the Kremlin walls, the finance chiefs from the top 20 advanced and emerging economies in the world showed an unusual unanimity over the risks and priorities for the economy. The economic recovery is fragile and uneven, the finance ministers and central bank chiefs said in their final statement, while unemployment was deemed excessively high in some countries. While the US and Japan show signs of sustainable recoveries, growth in the eurozone remains sluggish and even Asian powerhouse China is now showing a decline in its output growth. The debate between growth and austerity seems to have come to an end,
as captured in the G20s strong statement on growth and jobs, said one senior US treasury official. The official argued that the G20 had accepted that fiscal positions could only be corrected once growth and demand are put on a sustainable path. To place the global economy on a stronger, more sustainable and more balanced growth path, we will intensify our policy actions, the final statement said, calling for an action plan to be agreed at the Saint Petersburg G20 summit in September which will be the culmination of Russias presidency of the group. Lofty reckons that this years Kenya Airways Safari Classic Rally slated to run around the scenic East African region will be an adventure like no other to him and many of his contemporary crews who have seen rally technology morph through different guises. I still enjoy life. Its an adventure before dementia and gives me the vigour and morale to keep returning here in Kenya time and time again, remarked the 1973 winning navigator with Shekhar Mehta. A chat with Lofty during the 2011 Safari Classic epitomised just how vintage cars heightened his pulse rate and that of his followers when events covered mammoth distances of up to 5,000km. For one, the legendary navigator is excited with the change in technology of rally cars from the 2WD normally aspirated to the present day turbo charged contraptions. Lofty will be navigating three-time former Kenya National Rally champion and Arusha based industrialist, Jayant Shah, who has entered a Porsche 911.
I worked and raced with Young in 1973 with the Datsun Debe (1200) in the East African Challenge and seeing him come back to the Safari reminds me of so many things. They are so many and you only realise its one big family when you see them all in diverse facets, said Lofty. As years go by, you got to accept change and this is a fact in life. But its all from 2WD to 4WD and life goes on and on. The Safari is a challenge with some fantastic countryside and people. I would love to win again but then its a very cautious approach. To finish is also a great achievement considering its a world renowned event and people hold it in all, said Loftyan Australia-based mechanical engineer. Drews describes himself as a gentleman farmer with cows, horses, pigs and chicken. He was born in Tanga and is looking forward to spending the last night of the rally there, having not visited for over 25 years. Lofty has had an unmatched rallying career, having won the Safari with Shekhar Mehta (1973) and finished second on five occasions with Sandro Munari (1975) and Rauno Aaltonen (1977, 1980, 1981 and 1984).

Leading wicket taker Waqas Aslam took 5-35 to help bowl out Cutchi Leva for 167 inside 37 overs after national U-19 opener Gurdeep Singh and Maninder Singh had made 70 and 67 runs to steer Sikh Union to 261 for 7. To be honest, it was a very convincing win against one of the unpredictable sides in the league, said Gurdeep, who was also impressive with figures of 2 for 56. Aslam got the wickets of Mahendra Siyani (4), Mukesh Rabadia (32), Jay Ragwani (2), Vishwal Borgwami (4) and Manoj Kerai (8) to register another impressive performance in the league. Gurmajot Singh and Zaid Abbas added on 32 and 37 runs for the visitors despite 3 for 39 from Ragwani. BY STAR REPORTER Mbuvi Ngunze is the winner of the 2013 Citibank Corporate Golf Day. Ngunze, who is the Kenya Airways chief operating officer and a member of Karen Country Club, posted 38 points to shake off a strong field of 160 golfers. Ngunze started his flight to victory on a shaky note, finding turbulence on the short par-four first, where he stalled and dropped two shots. On the second and third holes, Ngunze hit cruising altitude, making two easy pars. Now cruising on auto-pilot, Ngunze lost focus, posting 3-bogeys and 3-doubles, landing on 18-points through 9-holes. The champion posted 20-points on the back nine, greatly boosted by a birdie on the par-4 12th. Dipan Thakka and Isaac Awuondo both posted 37 points to finish first and second runner up respectively while Epimach Maritim was fourth on 36 points. The contest among the Citibank staff members was fierce with the top contenders being Moses Kiboi, MaryAnne Mwaura, Dan Connelly, Michael Mutiga and Nick Kamere. Mwaura threw in the towel early, opting to watch the duel from the sidelines. Mutiga struggled with his putting managing a descent score of 31-points while Kamere was on point with 38-points a winning score on most days. The 2012 Citibank staff winner, Dan Connelly posted a strong 39 points, marred only by a double bogey on the tough par-4 17th and triple on the par-5 18th. However, it was Moses Kiboi who found rhythm in his swing, posting a massive 40-points to win the staff prize. Kibois winning score was also the best score of the day. In the team competition Moses Kiboi, Mbuvi Ngunze, Steve Okello and Nick Kamere posted a massive 116 points to win the top team prize. BY WILLIAM NJUGUNA ZUKU have signed a Sh250 million sponsorship deal to the Kenya Rugby Union for the next five years. The deal translates to Sh50m investment per season for exclusive broadcasts rights production of Kenya Rugby Union matches from the 2013 2014 season and allocation of airtime of Zuku channels to promote the game, its partners and events. Under the agreement, Zuku will have the rights to televise several rugby events including Safaricom Sevens, Bamburi Rugby Super series and the Elgon Cup. It will also cover the Kenya Cup, Eric Shirley Shield, Mombasa International Sevens as well as the national Sevens circuit. Speaking during the signing ceremony, Wananchi Group chief operating officer, Richard Aldeen, acknowledged the tremendous growth rugby has made and underscored the Zuku excitement to partner with KRU in bringing the game directly to the viewers. We are pleased to pioneer high definition in the production of the local rugby matches which means Kenyans will now watch the their local rugby teams in the quality that they watch international rugby matches, he said. Zuku said if Kenya qualifies for the Rugby World Cup in 2015, the team will get Sh8.5 million as bonus. Kenya Rugby Union (KRU) chairman, Mwangi Muthee, thanked Zuku for coming on board. We are starting on clean slate. Our deal with SuperSport ended in March and now we have new partner. Muthee warned that clubs who have their television rights deals must get clearance from the union. Ministry of Sports to carry out an investigation on doping claims amongst Kenyan athletes. Last year, a section of international media reported that doping was rife in Kenya, prompting the WADA president to tour Kenya over the issue. Speaking yesterday at Iten, where he officially opened the Team Kenya Marathon camp at Keelu Resort, Kiplagat said the agency needs the report in the next three months. I have received a report from WADA that Kenya risk being blacklisted if the report on doping will not be out by November, said Kiplagat. According to the letter, Kiplagat said, WADA is supposed to meet in South Africa in November and they have demanded the report on whether doping is real or not in Kenya. He said the ministry should speed up the investigations and hand over to the anti-doping agency to save the country from being blacklisted. This is a serious matter considering Kenya is the worlds epicentre of athletics. The ministry should present the report as soon as possible, he said. However, Kiplagat said the allegations of blood boosters being rampant among Kenyas athletes is a misconception. He added that some few individuals are out to taint the good image of the athletes. Our athletes have been running clean all this years. That German journalist has really cause a irreparable damage to this country, Kiplagat noted. He said blood centre will be opened soon in Eldoret to cater for Ethiopians and Kenyan athletes.
