Terms and Conditions of ZT Paishacha Paus contest

PLEASE READ THESE TERMS CAREFULLY BEFORE PARTICIPATING IN THIS CONTEST KNOWN AS ZT Paishacha Paus contest!!. BY PROCEEDING WITH PARTICIPATION ON ZT Paishacha Paus contest, YOU AGREE TO BE LEGALLY BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, PLEASE DO NOT PARTICIPATE IN the ZT Paishacha Paus contest. Mobilox is our process control partner for the contest.

TERMS, PRIZES AND WINNER SELECTION:

This Contest is hosted by Zee Entertainment Enterprises Ltd. Limited through its business division Zee Talkies Marketing (herein after referred to as ZT), and is for a limited period from 7st July,2013 to 5th August, 2013 between 6.00 pm 12.00am every day. Further details of the contest are mentioned in Annexure A This contest is valid only for those who fulfill the following criteria:

You must be above 18 years of age. You must be a citizen of India and resident of India. You must not have been either prosecuted or convicted for commission of any criminal offence. You must not be suffering from any legal disability e.g. insolvency. * The subscriber, the rightful owner of the connection, is a person in whose name the phone number is registered, or the employee, who is the user of the phone, if the phone is registered in the name of a company, provided that company issues a letter that the employee has been allotted the specific phone number. If the winner is not able to provide sufficient evidence to show that he/she is the rightful user of the number, ZT reserves the right to award the prize to the next eligible winner. The number must be subscribed to an address within the legal boundaries of India. Each participant may participate only through one channel .i.e. by giving missed calls on the given options This is a missed call based contest where participants have to give a missed call on the number mentioned against the options. Missed call has to be received during the time slot in which the question has been asked. Only people with a registered subscription who will give correct answers within the time slot shall be eligible for the contest. If either of it is wrong (answer/ format) ZT will move on to select the next eligible winner. The winner will have to submit all documents mentioned by ZT, in case if ZT asks for the same for verification process. If the participant fails to submit any document then ZT will move on to select the next eligible winner. ZT at any time may disqualify a person from participating in the contest without any reason or prior notice. All decisions made by ZT will be final and binding. Every day one Mega winner will be selected of the eligible winners by way of a selection process. That winner will be entitled to win Rs. 9999 provided he fulfills all the above mentioned conditions.

Every day other winners will be selected of the eligible winners by way of a selection process. Those winners will be entitled to win Rs. 2000 each provided they fulfill all above mentioned conditions. Once the number has been chosen as the winner- that number will be disqualified for all further selections. No same person can be a winner in this contest more than once. The prize money will be given by way of cheque which shall be couriered to the address of the winner which is registered with the mobile subscription. Proof of such address is mandatory to be produced if demanded by ZT. People failing to provide such evidence within 2 days of winner announcement list shall be disqualified and ZT shall move on to choose the next eligible winner. A Participant by participating in the Contest hereby agrees to these terms and conditions of the contest and gives his/her consent to the winner selection process as set out, and any appropriate changes that may be made to this Contest due to any legal or regulatory requirement, instructions from any judicial or a quasi-judicial body or due to any natural calamity beyond the reasonable control of ZT, its affiliates and associates. The name and detail of the winner may be published in any daily and the participant hereby consents to the same by taking part in this contest. The list of winners will be announced through a scroll on ZT and ZT website which can be accessed free of cost and shall be informed by phone. Failure to claim the prize within the aforesaid 2 days period may result in disqualification and forfeiture of the prize and/or declaration of alternate winner which is at the sole discretion of ZT. ZT shall, try to contact the winner(s). However, if the subscriber cannot be reached or the subscriber does not claim the prize as stipulated in these terms and conditions even after the above process, then ZT reserves the right to confer the price to the next eligible winner. The Winner shall be responsible to keep in safe custody the intimation letter and/or confirmations given/ issued to him by ZT. In case of loss or damage or theft of the same, ZT reserves the right to issue duplicate(s) subject to such verifications and/or on such other term/s as it may desire. All prizes must be claimed by the winners, along with the documents specified herein below if the same is demanded by ZT at any time. The documents required to be submitted along with the claim by the winner include the following (the document list is only inclusive and not exhaustive and can change as per the requirements of Law): Identity Proof Address Proof Proof of holding the telephone connection/ subscription PAN Card The contest shall be governed by and construed in accordance with the laws of India. Any disputes, differences and, or, any other matters in relation to and arising out of the contest and, or, pertaining to the rules and regulations and, or, the Terms and Conditions shall be referred to arbitration under the Arbitration & Conciliation Act, 1996. The arbitral tribunal shall be as per terms guided by ZT. The prize(s) under the Offer are neither assignable nor transferable under any circumstances. All the prizes shall be subject to such other terms and conditions as may be applicable and shall have to be duly complied with by the winner.

The prize(s) to the winner shall be given subject to compliance with all applicable statutory legislations/ processes /formalities and terms and conditions in connection with the prize(s) and on production all such documents/papers as required by ZT before accepting the delivery of the prize. Any failure on the part of the winner to comply with directions issued by ZT for claim of prize shall entitle ZT to award the prize(s) to the next eligible winner. There shall be a roll-over of prizes in case the winner/s is/are ineligible. A subscriber shall be considered ineligible if he/she does not confirm to the conditions or cannot provide the required documents as stipulated herein. The employees of ZT and Mobilox (ZTs process control partner), all the operators, and their group companies, affiliate or associate companies shall not be eligible to participate in this contest. This Offer cannot be used in conjunction with any alternative offer or promotion. This Offer is subject to force majeure circumstances i.e. Act of God or any circumstance beyond the reasonable control of ZT. ZT may stop/suspend/cancel this contest at its sole discretion without providing any specific reason to the contestants. No communication whatsoever shall be entertained by ZT regarding the contest and any display shall be at the sole discretion of ZT. ZT shall not be responsible for any claims arising out of technical failures before, during or after the completion of the Contest including but not limited to any technical failures in the telephone lines, failure of servers or the failure to provide the correct Contest score updates or any mistakes arising out of technical snags. Further, ZT shall not be responsible for any claims arising out of any failure(s) which are beyond its reasonable control. ZT shall not be liable for any loss or damage whatsoever that may be suffered, or for any personal loss or injury that may be suffered (including loss of life), to a Subscriber and/or any third party, directly or indirectly, by use or non-use of the prize. Participant hereby agrees and undertakes not to hold ZT and/or or any of its group entities or affiliates, their respective directors, officers, employees, agents, vendors, responsible for or liable for, any actions, claims, demands, losses, damages, costs, charges and expenses, either direct or remote that you may/might have suffered, sustained or incurred, or claims to suffer, sustain or incur, by way of and /or on account of the present Contest. ZT reserves the right to extend, cancel, discontinue, prematurely withdraw, change, alter or modify this offer/contest or any part thereof including the eligibility criteria, the Terms & Conditions and prizes at their sole discretion at anytime during it's validity as may be required in view of business exigencies and/or changes by regulatory authority and/or statutory changes and the same shall be binding on the participant. This Terms and Conditions shall be subject to updates and changes without any specific notice at the sole discretion of ZT and the contestants are bound to access the website to understand the changes.

ANNEXURE A: Contest will start on Sun 7th July, 2013 and will end on Sun 5th Aug, 2013. For 29 days, each day 6 questions will be asked from 6.00 pm to 12.00 am on ZT. This is a contest of skill and knowledge. All questions will be pertaining to Marathi Cinema and/ or Marathi Cinema Industry. Each question will only have 2 options. Viewers can participate in the contest by merely giving a missed call on the number mentioned against the options. Each day at the end of the contest winners will be elected from the eligible lot of participants and ZT will send the prize cheques to the winners.
