GUIDELINES FOR GROUP ASSIGNMENT 1. GROUP ASSIGNMENT PAPER FORMAT The group assignment constitutes 20% of the total marks for this unit. It consists of THREE (3) questions and you are required to answer all the questions. Your answer should consist of the following parts: a. Identification of Issues; (i) Identify the legal issues in the question; (ii) Be direct and relevant to the question; (iii) It provides an indication to the examiner/marker that you are on the right track; examiners make judgment of your answer by looking at the issues that you have successfully identified; and (iv) Avoid being repetitive and long winded. b. Explanation of the relevant law; (i) Explain, elaborate and discuss the law; (ii) Law consists of statutory provisions and case law; do not copy word for word from the statutes; learn to summarise but ensure that the meaning remains correct; for case law, the name and citation of the case must be provided in full; there must be facts; again, do not copy word for word from the book; extract and apply the legal rule/principle created by the judge in the case; (iii) Highlight the concern/problem you have identified in that particular area; and (iv) Proceed to explore the effect, consequence and impact of the concern/problem. You can get a rough idea from the authors of books or journal articles. c. Application of the Law; (i) You must apply the law to address the issues; (ii) Use the sections/cases or both to resolve the issue or problem; (iii) Provide sound, logical and reasoned arguments; and

(iv) Summarise the whole answer to enable the examiner/marker to understand the whole picture. d. Concluding Advice; (i) Address the issues accordingly; and (ii) The advice must match the number of issues raised. e. Use footnotes and not in-text referencing; (i) In Microsoft word, go to insert, then reference, then location, then choose footnote. (ii) Do not use in-text referencing. (iii) What should a footnote consist of? (aa) Name of a case (bb) Citation of a case. The referencing for a case is the citation and not the book from where you took the case. (cc) References must mention the particular page. (dd) Further explanation. (ee) Statutory provisions in full. The referencing for a section is the particular Act and not the book from where you have taken the section. Neither is it the publisher of the book. f. Bibliography. (i) No pages required. (ii) Should be in alphabetical order. (iii) It should not be justified. It should be indented to the left. (iv) Cases and sections should not be in the bibliography list. (v) It should not be numbered.

g. In answering the question, avoid the following: (i) Ali is advised he can sue it should be: Ali is advised that he can successfully commence/institute an action or a claim against Bill for damages for a breach of contract. (ii) In this case this is not a case but a question. (iii) It is up to the court to decide question is asking for your advice. (iv) My advice to Ali is/I advise Ali it should be: Ali is advised . (v) Do not begin the answer by saying: Ali can sue or he will sure win follow the steps mentioned above - it should be identification of issues, explanation of the law, application of the law and concluding advice. 2. DURATION You are given a duration of 5 weeks to complete and submit the group assignment. 3. LEGISLATION Legislation(s)/Statutes/Acts of Parliament and case law should be extensively used in the group assignment. Bold and underline your cases and statutes. 4. TIME Avoid leaving the group assignment to be done at the last minute, while waiting for the lecture topics to be covered or in the hope of obtaining clues/hints/pointers/tips. No clues etc. will be given as it simply defeats the very purpose of giving an assignment, assessing your work and marking your assignment. As a University student, you are required to be an independent learner assuming responsibility for your own learning. Group assignment is an open book assessment. You are given

sufficient time to look into the question; reflect on it; conduct extensive research on the relevant areas of the law and its application; select the information relevant to the work assigned; organize the information; and present it in a clear and logical sequence complying with the required format. 5. RELEVANCE Analyse each question very closely before you proceed to embark on your answer. Restrict your answer to what is relevant and important. The marks allocated to a question will influence how much of knowledge of a topic you should treat as relevant. There is little point in writing on matters that are only marginally relevant as this could consume time that could be better spent on other answers. 6. SECTION REFERENCES Where you make reference to a section in your answers attempt to rewrite the provision in your own words so as to convince the examiner of your paper that you have clearly understood the legal principles involved. Group assignment tests your ability and capability in working over long term projects; in working in a group as to whether you are a team player; whether you are able to show leadership quality in guiding and directing weak members; able to resolve academic and intra-personal conflicts; able to work independently with minimal supervision; able to explore matters beyond lecture topics and most importantly ability to provide desirable outcome and results.
