ANACTPROVIDINGFORSTRONGERDETERRENCEANDSPECIALPROTECTION AGAINST CHILD ABUSE, EXPLOITATION AND DISCRIMINATION, PROVIDING PENALTIESFORITSVIOLATION,ANDFOROTHERPURPOSES Be it enacted by the Senate and House of Representatives of the Philippines in Congressassembled: ARTICLE1 Title,Policy,PrinciplesandDefinitionofTerms SECTION1.Title.Thisactshallbeknownasthe"SpecialProtectionofChildren AgainstChildAbuse,ExploitationandDiscriminationAct." SEC.2.DeclarationofStatePolicyandPrinciples.Itisherebydeclaredtobe thepolicyoftheStatetoProvidespecialprotectiontochildrenfromallformsofabuse, neglect, cruelty, exploitation and discrimination, and other conditions prejudicial to theirdevelopment;providesanctionsfortheircommissionandcarryoutaprogramfor prevention and deterrence of and crisis intervention in situations of child abuse, exploitationanddiscrimination.TheStateshallinterveneonbehalfofthechildwhen theparent,guardian,teacherorpersonhavingcareorcustodyofthechildfailsoris unabletoprotectthechildagainstabuse,exploitationanddiscriminationorwhensuch actsagainstthechildarecommittedbythesaidparent,guardian,teacherorperson havingcareandcustodyofthesame. It shall be the policy of the State to protect and rehabilitate children gravely threatenedorendangeredbycircumstanceswhichaffectorwillaffecttheirsurvivaland normaldevelopmentandoverwhichtheyhavenocontrol. Thebestinterestsofchildrenshallbetheparamountconsiderationinallactions concerningthem,whetherundertakenbypublicorprivatesocialwelfareinstitutions, courts of law, administrative authorities, and legislative bodies, consistent with the principleofFirstCallforChildrenasenunciatedintheUnitedNationsConventionon theRightsoftheChild.Everyeffortshallbeexertedtopromotethewelfareofchildren andenhancetheiropportunitiesforausefulandhappylife. SEC.3.DefinitionofTerms.

(a) "Children"referstopersonsbeloweighteen(18)yearsofageorthoseoverbut areunabletofullytakecareofthemselvesorprotectthemselvesfromabuse, neglect, cruelty, exploitation or discrimination because of a physical mental disabilityorcondition; (b)"ChildAbuse"referstothemaltreatment,whetherhabitualornot,ofthechild whichincludesanyofthefollowing: 1. Psychological and physical abuse, neglect, cruelty, sexual abuse and emotional maltreatment; 2. Any act by deeds or words which debases, degrades or demeans the intrinsic worth and dignity of a child as a human being; 3. Unreasonable deprivation of his basic needs for survival such as food and shelter; or 4. Failure to immediately give medical treatment to an injured child resulting in serious impairment of his growth and development or in his permanent incapacity or death. (c) "Circumstances which gravely threaten or endanger the survival and normal developmentofchildren"include,butarenotlimitedto,thefollowing: 1. Being in a community where there is armed conflict or being affected by armed conflict-related activities; 2. Working under conditions hazardous to life, safety and morals which unduly interfere with their normal development; 3. Living in or fending for themselves in the streets of urban or rural areas without the care of parents or a guardian or any adult supervision needed for their welfare; 4. Being a member of an indigenous cultural community and/or living under conditions of extreme poverty or in an area which is undeveloped and/or lack or has inadequate access to basic services needed for a good quality of life; 5. Being a victim of a man-made or natural disaster calamity; or 6. Circumstances analogous to those above stated which endanger life, safety or normal development of children. (d)"Comprehensiveprogramagainstchildexploitationanddiscrimination "refersto thecoordinatedprogramofservicesandfacilitiestoprotectchildrenagainst: 1. 2. 3. 4. 5. Child prostitution and other sexual abuse; Child trafficking; Obscene publications and indecent shows; Other acts of abuse; and Circumstances which threaten or endanger the survival and normal development of children. ARTICLEII ProgramonChildAbuse,ExploitationandDiscrimination SEC.4.FormulationoftheProgram.Thereshallbeacomprehensiveprogramto be formulated by the Department of Justice and Department of Social Welfare and Development in coordination with other government agencies and private sector concerned,withinone(1)yearfromtheeffectivityofthisAct,toprotectchildrenagainst childprostitutionandothersexualabuse;childtrafficking,obscenepublicationsand indecentshows;otheractsofabuse;andcircumstanceswhichendangersurvivaland normaldevelopment. ARTICLEIII ChildProstitutionandOtherSexualAbuse

SEC.5.ChildProstitutionandOtherSexualAbuse.Children,whethermaleor female, who for money, profit, or any other consideration or due to the coercion or influenceofanyadult,syndicateorgroup,indulgeinsexualintercourseorlascivious conduct,aredeemedtobechildrenexploitedinprostitutionandothersexualabuse. Thepenaltyofreclusiontemporalinitsmediumperiodtoreclusionperpetuashallbe imposeduponthefollowing: (a) Thosewhoengageinorpromote,facilitiesorinducechildprostitutionwhich include,butarenotlimitedto,thefollowing: 1. Acting as a procurer of a child prostitute; 2. Inducing a person to b e a client of a child prostitute by means of written or oral advertisements or other similar means; 3. Taking advantage of influence or relationship to procure a child as a prostitute; 4. Threatening or using violence towards a child to engage him as a prostitute; or 5. Giving monetary consideration, goods or other pecuniary benefit to a child with the intent to engage such child in prostitution. (b) Thosewhocommittheactofsexualintercourseorlasciviousconduct with a child exploited in prostitution or subjected to other sexual abuse: Provided, That when the victim is under twelve (12) years of age, the perpetratorsshallbeprosecutedunderArticle335,paragraph3,forrapeand Article336ofActNo.3815,asamended,theRevisedPenalCode,forrapeor lasciviousconduct,asthecasemaybe: Provided,Thatthepenaltyforlascivious conduct when the victim is under twelve (12) years of age shall be reclusion temporalinitsmediumperiod;and (c)Thosewhoderiveprofitoradvantagetherefrom,whetherasmanagerorownerof the establishmentwhere theprostitution takesplace, orof thesauna, disco, bar,resort,placeofentertainmentorestablishmentservingasacoverorwhich engagesinprostitutioninadditiontotheactivityforwhichthelicensehasbeen issuedtosaidestablishment. SEC.6. AttempttoCommitProstitution.Thereisanattempttocommitchild prostitutionunderSection5,paragraph(a)hereofwhenanypersonwho,notbeinga relativeofachild,isfoundalonewiththesaidchildinsidetheroomorcubicleofa house,aninn,hotel,motel,pensionhouse,apartelleorothersimilarestablishments, vessels,vehicleoranyotherhiddenorsecludedareaundercircumstanceswhichwould leadareasonablepersontobelievethatthechildisabouttobeexploitedinprostitution andothersexualabuse. There is also an attempt to commit child prostitution, under paragraph (b) of Section5hereofwhenanypersonisreceivingservicesfromachildinasaunaparloror bath,massageclinic,healthclubandothersimilarestablishments.Apenaltylowerby two(2)degreesthanthatprescribedfortheconsummatedfelonyunderSection5hereof shall be imposed upon the principals of the attempt to commit the crime of child prostitutionunderthisActor,inthepropercase,undertheRevisedPenalCode. ARTICLEIV. ChildTrafficking

SEC.7. ChildTrafficking.Anypersonwhoshallengageintradinganddealing withchildrenincluding,butnotlimitedto,theactofbuyingandsellingofachildfor money,orforanyotherconsideration,orbarter,shallsufferthepenaltyof reclusion temporal to reclusionperpetua. Thepenaltyshallbeimposedinitsmaximumperiod whenthevictimisundertwelve(12)yearsofage. SEC.8. AttempttoCommitChildTrafficking.Thereis anattempttocommit childtraffickingunderSection7ofthisAct: (a) When a child travels alone to a foreign country without valid reason thereforandwithoutclearanceissuedbytheDepartmentofSocialWelfareand Developmentorwrittenpermitorjurisdictionfromthechild'sparentsorlegal guardian; (b) Whenapregnantmotherexecutesanaffidavitofconsentforadoptionfor aconsideration; (c)When a person, agency, establishment or childcaring institution recruits womenorcouplestobearchildrenforthepurposeofchildtrafficking; (d) When a doctor, hospital or clinic official or employee, nurse, midwife, localcivilregistraroranyotherpersonsimulatesbirthforthepurposeofchild trafficking;or (e)When a person engages in the act of finding children among lowincome families, hospitals, clinics, nurseries, daycare centers, or other childcaring institutionswhocanbeofferedforthepurposeofchildtrafficking. Apenaltylowerbytwo(2)degreesthanthatprescribedfortheconsummatedfelony underSection7hereofshallbeimposedupontheprincipalsoftheattempttocommit childtraffickingunderthisAct. ARTICLEV. ObscenePublicationandIndecentShows SEC.9.ObscenePublicationsandIndecentShows.Anypersonwhoshallhire, employ,use,persuade,induceorcoerceachildtoperforminobsceneexhibitionsand indecent shows,whether liveor invideo, pose,or modelin obscenepublications or pornographicmaterialsortosellordistributethesaidmaterialsshallsufferthepenalty ofprisonmayorinitsmediumperiod. Ifthechildusedasaperformer,subjectorseller/distributorisbelowtwelve(12) yearsofage,thepenaltyshallbeimposedinitsmaximumperiod. Anyascendant,guardianorpersonentrustedinanycapacitywiththecareofa childwhoshallcauseand/orallowsuchchildtobeemployedortoparticipateinan obsceneplayscene,act,movieorshoworinanyotheractscoveredbythissectionshall sufferthepenaltyofprisonmayorinitsmediumperiod. ARTICLEVI. OtherActsofAbuse

SEC. 10. Other Acts of Neglect, Abuse, Cruelty or Exploitation and Other ConditionsPrejudicialtotheChild'sDevelopment. (a) Anypersonwhoshallcommitanyotheractsofchildabuse,crueltyor exploitation or be responsible for other conditions prejudicial to the child's developmentincludingthosecoveredbyArticle59ofthePresidentialDecreeNo. 603,asamended,butnotcoveredoftheRevisedPenalCode,asamended,but notcoveredbytheRevisedPenalCode,asamended,shallsufferthepenaltyof prisonmayorinitsminimumperiod. (b) Anypersonwhoshallkeeporhaveinhiscompanyaminor,twelve(12) yearsor underorwhoisten(10)yearsormorehisjuniorinanypublicor private place, hotel, motel, beer joint, discotheque, cabaret, pension house, saunaormassageparlor,beachand/orothertouristresortorsimilarplaces shallsufferthepenaltyofprisonmayorinitsmaximumperiodandafineofnot lessthanfiftythousandpesos(P50,000.00):Provided,Thatthisprovisionshall notapplytoanypersonwhoisrelatedwithinthefourthdegreeofconsanguinity oraffinityoranybondrecognizedbylaw,localcustomandtradition,oractsin theperformanceofasocial,moralorlegalduty. (c)Anypersonwhoshallinduce,deliverorofferaminortoanyoneprohibitedby thisActtokeeporhaveinhiscompanyaminorasprovidedinthepreceding paragraphshallsufferthepenaltyof prison mayor initsmediumperiodanda fineofnotlessthanfortythousandpesos(P40,000): Provided, however, That shouldtheperpetratorbeanascendant,stepparentorguardianoftheminor; thepenaltytobeimposedshallbeaprisonmayorinitsmaximumperiod,afine ofnotlessthanfiftythousandpesos(P50,000)andthelossofparentalauthority overtheminor. (d) Anyperson,owner,manageroroneentrustedwiththeoperationofany publicorprivateplaceofaccommodation,whetherforoccupancy,food,drinkor otherwise,includingresidentialplaces,whoallowsanypersontotakealongwith himtosuchplaceorplacesanyminorhereindescribedshallimposedapenalty ofPrisonMayorinitsmediumperiodandafineofnotlessthanfiftythousand pesos(P50,000),andthelossoflicensetooperatesuchaplaceofestablishment. (e)Anypersonwhoshalluse,coerce,forceorintimidateastreetchildoranyother childto: (1) Beg or use begging as a means of living; (2) Acts as conduit or middlemen in drug trafficking or pushing; or (3) Conduct any illegal activities, shall suffer the penalty of prison correccional in its medium period to reclusion perpetua. ForpurposesofthisActthepenaltyforthecommissionofactspunishableunder Articles248,249,262,paragraph2,and263,forthecrimesofmurder,homicide,other intentionalmutilation,andaseriousphysicalinjuries,respectively,shallbereclusion perpetua when the victim is under twelve (12) years of age. The penalty for the commissionofActspunishableunderArticle337,339,340and341ofActNo.3815,as amended, the Revised Penal Code, for the crimes of qualified seduction, acts of lasciviousnesswiththeconsentoftheoffendedparty,corruptionofminors,andwhite

slavetrade,respectivelyshallbeone(1)degreehigherthanthatimposedbylawwhen thevictimisundertwelve(12)yearsofage. Thevictimoftheactscommittedunderthissectionshallbeentrustedtothecareof theDepartmentofSocialWelfareandDevelopment. ARTICLEVII. SanctionsforEstablishmentsorEnterprises Section11.SanctionsforEstablishmentsorEnterpriseswhichPromote,Facilitate, orConductActivitiesConstitutingChildProstitution andOtherSexualAbuse,Child Trafficking,ObscenePublicationsand IndecentShows,andOtherActsofAbuse.All establishmentsandenterpriseswhichpromoteorfacilitatechildprostitutionandother sexual abuse, child trafficking, obscene publications and indecent shows, and other acts of abuse shall be immediately closed and their authority or license to operate cancelledwithoutprejudicetotheownerormanagerthereofbeingprosecutedunder thisActand/ortheRevisedPenalCode,asamended,orspeciallaws.Asignwiththe words "off limits" shall be conspicuously displayed outside the establishments or enterprisesbytheDepartmentofSocialWelfareandDevelopmentforsuchperiodwhich shallnotbelessthanone(1)year,asthedepartmentmaydetermine.Theunauthorized removalofsuchsignshallbepunishablebyprisoncorrectional. Anestablishmentshallbedeemedtopromoteorfacilitatechildprostitutionand other sexual abuse, child trafficking, obscene publications and indecent shows, and other acts of abuse if the acts constituting the same occur in the premises of said establishmentunderthisActorinviolationoftheRevisedPenalCode,asamended.An enterprisesuchasasauna,travelagency,orrecruitmentagencywhich:promotethe aforementionedactaspartofatourforforeigntouristsexhibitschildreninalewdor indecentshows;provideschildmasseursforadultsofthesameoroppositesexand saidservicesincludeanylasciviousconductwiththecustomer;orsolicitschildrenfor activitiesconstitutingtheaforementionedactsshallbedeemedtohavecommittedthe actspenalizedherein. ARTICLEVIII WorkingChildren Section 12. Employment of Children. Children below fifteen (15) years of age maybeemployed:Provided,Thatthefollowingminimumrequirementsarepresent; (a) The employer shall secure for the child a work permit from the DepartmentofLaborandEmployment; (b) Theemployershallensuretheprotection,health,safety,andmoralsof thechild; (c)Theemployershallinstitutemeasurestopreventexploitationordiscriminationtakinginto accountthesystemandlevelofremuneration,andthedurationandarrangementofworking time;and (d)Theemployershallformulateandimplementacontinuousprogramfortraining andskillacquisitionofthechild.

TheDepartmentofLaborandEmploymentshallpromulgaterulesandregulations necessaryfortheeffectiveimplementationofthissection. SEC. 13. Nonformal Education for Working Children. The Department of Education,CultureandSportsshallpromulgateacoursedesignunderitsnonformal educationprogramaimedatpromotingtheintellectual,moralandvocationalefficiency of working children who have not undergone or finished elementary or secondary education. Such course design shall integrate the learning process deemed most effectiveundergivencircumstances. SEC. 14. Prohibition on the Employment of Children in Certain Advertisements. No person shall employ child model in all commercials or advertisements promoting alcoholic beverages, intoxicating drinks, tobacco, and its byproducts,andviolence. SEC.15.DutyofEmployer.Everyemployershallcomplywiththedutiesprovided forinArticles108and109ofPresidentialDecreeNo.603. SEC.16.Penalties.AnypersonwhoshallviolateanyprovisionofthisArticleshall sufferthepenaltyofafineofnotlessthanOnethousandpesos(P1,000)butnotmore thanTenthousandpesos(P10,000)orimprisonmentofnotlessthanthree(3)months butnotmorethanthree(3)years,orbothatthediscretionofthecourt: Provided,That incaseofrepeatedviolationoftheprovisionofthisArticle,theoffender'slicenseto operateshallberevoked. ARTICLEIX ChildrenofIndigenousCulturalCommunities SEC. 17. Survival, Protection and Development. In addition to the rights guaranteedtochildrenunderthisActandotherexistinglaws,childrenofindigenous communitiesshallbeentitledtoprotection,survivalanddevelopmentconsistentwith thecustomsandtraditionsoftheirrespectivecommunities. SEC.18. SystemofandAccesstoEducation.TheDepartmentofEducation, CultureandSportsshalldevelopandinstituteanalternativesystemofeducationfor childrenofindigenousculturalcommunitieswhichisculturespecificandrelevantto the needs and the existing situation in their communities. The Department of Education, Culture and Sports shall also accredit and support nonformal but functionalindigenouseducationalconductedbynongovernmentalorganizationinsaid communities. SEC.19.HealthandNutrition.Thedeliveryofbasicsocialservicesinhealthand nutritiontochildrenofindigenousculturalcommunitiesshallbegivenprioritybyall governmentagenciesconcerned. Hospitalsandotherhealthinstitutionsshallensure that children of indigenous cultural communities are given equal attention. In the provision of health and nutrition services to children of indigenous cultural communities,indigenoushealthpracticesshallberespectedandrecognized. SEC.20. Discrimination.Childrenofindigenousculturalcommunitiesshallnot besubjectedtoanyandallformsofdiscrimination.

Anypersonwhodiscriminatesagainstchildrenofindigenousculturalcommunities shallsufferapenaltyofarrestomayorinitsmaximumperiodandafineofnotlessthan Fivethousandpesos(P5,000)normorethanTenthousandpesos(P10,000). SEC. 21. Participation. Indigenous cultural communities, through their duly designatedorappointedrepresentativesshallbeinvolveinplanning,decisionmaking, implementation, and evaluation of all government programs affecting children of indigenousculturalcommunities.Indigenousinstitutionsshallalsoberecognizedand respected. ARTICLEX ChildreninSituationsofArmedConflict SEC.22.ChildrenasZonesofPeace.ChildrenareherebydeclaredasZonesof Peace. ItshallbetheresponsibilityoftheStateandallothersectorsconcernedto resolvearmedconflictinordertopromotethegoalofchildrenaszonesofpeace.To attainthisobjective,thefollowingpoliciesshallbeobserved: (a)Childrenshallnotbetheobjectofattackandshallbeentitledtospecialrespect. Theyshallbeprotectedfromanyformofthreat,assault,tortureorothercruel, inhumaneordegradingtreatment; (b)ChildrenshallnotberecruitedtobecomemembersoftheArmedForcesofthe Philippinesoritscivilianunitsorotherarmedgroups,norbeallowedtotake partinthefighting,orusedasguides,couriers,orspies; (c) Delivery of basic social services such as education, primary health and emergencyreliefservicesshallbekeptunhampered; (d)Thesafetyandprotectionofthosewhoprovideservicesincludingthoseinvolved infactfindingmissionsfrombothgovernmentandnongovernmentinstitutions shall be ensured. They shall not be subjected to undue harassment in the performanceoftheirwork; (e)Publicinfrastructuresuchasschools,hospitalsandruralhealthunitsshallnot be utilized for military purposes such as command posts, barracks, detachments,andsupplydepots;and (f) All appropriate steps shall be taken to facilitate the reunion of families temporarilyseparatedduetoarmedconflict. SEC. 23. Evacuation of Children During Armed Conflict. Children shall be given priority during evacuation as a result of armed conflict. Existing community organizationsshallbetappedtolookafterthesafetyandwellbeingofchildrenduring evacuationoperations.Measuresshallbetakentoensurethatchildrenevacuatedare accompaniedbypersonsresponsiblefortheirsafetyandwellbeing. SEC.24. FamilyLifeandTemporaryShelter.Wheneverpossible,membersof the same family shall be housed in the same premises and given separate accommodationfromotherevacueesandprovidedwithfacilitiestoleadanormalfamily life.Inplacesoftemporaryshelter,expectantandnursingmothersandchildrenshall

begivenadditionalfoodinproportiontotheirphysiologicalneeds.Wheneverfeasible, childrenshallbegivenopportunitiesforphysicalexercise,sportsandoutdoorgames. SEC.25.RightsofChildrenArrestedforReasonsRelatedtoArmedConflict . Any child who has been arrested for reasons related to armed conflict, either as combatant,courier,guideorspyisentitledtothefollowingrights: (a) Separatedetentionfromadultsexceptwherefamiliesareaccommodated asfamilyunits; (b) Immediatefreelegalassistance;

(c)Immediatenoticeofsucharresttotheparentsorguardianofthechild;and (d) Release of the child on recognizance within twentyfour (24) hours to the custody of the Department of Social Welfare and Development or any responsiblememberofthecommunityasdeterminedbythecourt. Ifafterhearingtheevidenceintheproperproceedings,thecourtshouldfindthat the aforesaid child has committed the acts charged against him, the court shall determinetheimposablepenalty,includinganycivilliabilitychargeableagainsthim. However,insteadofpronouncingjudgementofconviction,thecourtshallsuspendall further proceedings and shall commit such child to the custody or care of the DepartmentofSocialWelfareandDevelopmentortoanytraininginstitutionoperated bytheGovernment,ordulylicensedagenciesoranyotherresponsibleperson,untilhe hashadreachedeighteen(18)yearsofageorforashorterperiodasthecourtmay deemproper,afterconsideringthereportsandtherecommendationsoftheDepartment ofSocialWelfareandDevelopmentortheagencyorresponsibleindividualunderwhose carehehasbeencommitted. Theaforesaidchildshallbesubjecttovisitationandsupervisionbyarepresentative oftheDepartmentofSocialWelfareandDevelopmentoranydulylicensedagencyor such other officer as the court may designate subject to such condition as it may prescribe. Theaforesaidchildwhosesentenceissuspendedcanappealfromtheorderofthe courtinthesamemannerasappealsincriminalcases. SEC. 26. Monitoring and Reporting of Children in Situations of Armed Conflict.Thechairmanofthebarangayaffectedbythearmedconflictshallsubmitthe names of children residing in said barangay to the municipal social welfare and development officer within twentyfour (24) hours from the occurrence of the armed conflict. ARTICLEXI RemedialProcedures SEC. 27. Who May File a Complaint. Complaints on cases of unlawful acts committedagainstchildrenasenumeratedhereinmaybefiledthefollowing: (a) Offendedparty;

(b)

Parentsorguardians;

(c)Ascendantorcollateralrelativewithinthethirddegreeofconsanguinity; (d) Officer, social worker or representative of a licensed childcaring institution; (e)OfficerorsocialworkeroftheDepartmentofSocialWelfareandDevelopment; (f) Barangaychairman;or (g)Atleastthree(3)concerned,responsiblecitizenswheretheviolationoccurred. SEC. 28. Protective Custody of the Child. The offended party shall be immediatelyplacedundertheproductivecustodyoftheDepartmentofSocialWelfare andDevelopmentpursuanttoExecutiveOrderNo.56,seriesof1986.Intheregular performance of this function, the officer of the Department of Social Welfare and Developmentshallbefreefromanyadministrative,civilorcriminalliability.Custody proceedingsshallbeinaccordancewiththeprovisionsofPresidentialDecreeNo.603. SEC.29.Confidentiality.Attheinstanceoftheoffendedparty,hisnamemaybe witheldfromthepublic,untilthecourtacquiresjurisdictionoverthecase. Itshallbeunlawfulforanyeditor,publisher,andreporterorcolumnistincaseof printedmaterials,announcerorproducerincaseoftelevisionandradiobroadcasting, produceranddirectorofthefilmincaseofthemovieindustry,tocauseundueand sensationalizedpublicityofanycaseofviolationofthisActwhichresultsinthemoral degradationandsufferingoftheoffendedparty. SEC.30.SpecialCourtProceedings.CasesinvolvingviolationsofthisActshall beheardinthechambersofthejudgeoftheRegionalTrialCourtdulydesignatedas JuvenileandDomesticRelationsCourt. Anyprovisionofexistinglawtothecontrarynotwithstandingandwiththeexception of habeascorpus,electioncases,andcasesinvolvingdetentionprisonersandpersons coveredbyRepublicActNo.4908,allcourtsshallgivepreferencetothehearingor dispositionofcasesinvolvingviolationsofthisAct. ARTICLEXII CommonPenalProvisions SEC.31.CommonPenalProvisions. (a) The penal provided under this Act shall be imposed in its maximum periodiftheoffenderhasbeenpreviouslyconvictedunderthisAct; (b) Whentheoffenderisacorporation,partnershiporassociation,theofficer oremployeethereofwhoisresponsiblefortheviolationofthisActshallsuffer thepenaltyimposedinitsmaximumperiod; (c)Thepenaltyprovidedhereinshallbeimposedinitsmaximumperiodwhenthe perpetratorisanascendant,parent,guardian,stepparentorcollateralrelative withintheseconddegreeofconsanguinityoraffinity,oramanagerorownerof anestablishmentwhichhasnolicensetooperateoritslicensehasexpiredor hasbeenrevoked;

(d) Whentheoffenderisaforeigner,heshallbedeportedimmediatelyafter serviceofsentenceandforeverbarredfromentrytothecountry; (e)ThepenaltyprovidedforinthisActshallbeimposedinitsmaximumperiodif the offender is a public officer or employee: Provided, however, That if the penaltyimposedisreclusionperpetuaorreclusiontemporal,thenthepenaltyof the perpetual or temporary absolute disqualification shall also be imposed: Provided, finally, That if the penalty imposed is prison correctional or arresto mayor,thepenaltyofsuspensionshallalsobeimposed;and (f) Afinetobedeterminedbythecourtshallbeimposedandadministeredasa cashfundbytheDepartmentofSocialWelfareandDevelopmentanddisbursed for the rehabilitation of each child victim, or any immediate member of his familyifthelatteristheperpetratoroftheoffense. ARTICLEXIII FinalProvisions SEC. 32. Rules and Regulations. Unless otherwise provided in this Act, the Department of Justice, in coordination with the Department of Social Welfare and Development,shallpromulgaterulesandregulationsfortheeffectiveimplementationof thisAct. Such rules and regulations shall take effect upon their publication in two (2) nationalnewspapersofgeneralcirculations. SEC.33. Appropriations.Theamountnecessarytocarryouttheprovisionsof thisActisherebyauthorizedtobeappropriatedintheGeneralAppropriationsActof theyearfollowingitsenactmentintolawandthereafter. SEC.34. SeparabilityClause.IfanyprovisionofthisActisdeclaredinvalidor unconstitutional,theremainingprovisionsnotaffectedtherebyshallcontinueinfull forceandeffort. SEC. 35. Repealing Clause. All laws, decrees, or rules inconsistent with the provisionofthisActareherebyrepealedormodifiedaccordingly. SEC. 36. Effectivity Clause. This Act shall take effect upon completion of its publicationinatleast(2)nationalnewspapersofgeneralcirculation.
