I, Armand Brits, hearby state under oath in English.

(1) I am D/Inspector in the South African Police Service stationed at Krugersdorp, Detective Branch. Telephone (011) 951-1053. (2) On 2007 06 29 I reported for duty at 07:00 in civilian clothing. At approximately 15:45 I met Snr Supt Rammagwa and was informed by him about a case in which police officers were allegedly involved. The alleged victim, Felicia, was with him at the time, and informed me that she was able to identify both the above mentioned police officers. (3) D/Inspector (F) Brits, myself and the alleged victim then entered the state vehicle and proceeded east of Commissioner street. As we arrived at the Municipal Building the alleged victim without hesitation identified the two suspects as they were sitting on the wooden fence. One suspect attemted to escape, but both suspects were apprehended minutes later. (4) The suspects were known to me as ex-constable Motswere and R/Constable Molebatsi. During this, Inspector Wolmarrans arrived and assisted us. The victim and one of the suspects, R/Constable Molebatse accompanied Inspector Wolmarrans and exconstable Motswere accompanied me in my vehicle to the Detective Branch. Detective Inspector (F) Brits proceeded to her office with R/Constable Molebatsi and I proceeded to my office with ex-constable Motswere. (5) At this stage Inspector Wolmarrans left to attend to another complaint and therefore did not enter either my office or the office of D/Inspector (F) Brits. I and D/Inspector (F) Brits formally arrested and charged the two suspects. During this time I never referred to any officer or made any racist reference or remark about any member of the police force.

(6) During the interview, ex-constable Motswere told me that if I could arrange for bail, he would give me Supt Rommotovolas head on a silver platter. I informed him that I would only be able to discuss bail with the prosecutor on Monday, and would attempt to arrange bail of R500.00. When asked what he implied by his reference to Supt Rommotovola his uninfluenced response was that Snr Supt Rommotovola was involved in copper theft. He alleged that aforementioned Supt uses the state bakkie to transport the copper from Randfontein to a scrap metal depot in Krugersdorp. The latest transaction was apparently to the value of R60 000.00. When asked to give a written statement to this effect, he refused. Therefore, I was unable to take any further action in this regard. (7) After all the necessary paper work had been completed, I took the two suspects to the Krugersdorp cells for detention. At this stage I considered I had done my work to the best of my ability. I did not expect any problems. (8) On 2007 07 02 I took my case docket to the court and placed it on the Court Roll. Bail was discussed with the prosecutor and set at R1000.00. It was explained to me that a lesser bail was not permissible. I then left the case docket with the prosecutor. (9) At approximately 07:30 on 2007 07 04 I received a telephone call informed me that Director Baithnayh wished to see mee in his office immediately. When I arrived at his office I discovered that Inspector Wolmarans was also waiting to see the Director. When called into the office, apart from the Director, Snr Supt Molagai, Sen Supt Nyambi, Supt Rommotovola and my Commander Snr Supt R/Insp Molotsi, Mr Motswere, R/Const Molebatsi, R/Const Mnguni, R/Const Mhoba and R/Const Segwagwe were present. I was shocked at this unexpected development and unaware of the implications. The Director then declared that there was a problem and ceded the floor to Snr Supt Molagai.

(10) Snr Supt Molagia then accused Insp Wolmarans and myself of insulting him by calling him a thief. He stated that he had brought along the suspects arrested by us the previous Friday to testify to the above. Mr Motwere then alleged that I and Insp Wolmarans had called Sen Supt Molagi a SKELM and had said we wanted JOU KAFFIR BOETIES heads on a silver platter. I then rose and informed the Director that I was not prepared to continue to lised to this. I stated that I would report to him personally as I had noticed that Snr Sup Molagi was recording the so-called hearing. When ordered to sit down by the Director, I complied. (11) The allegations continued, with R/Const Molebatsi concurring with Mr Motweres version of the terms we had supposedly used. At this point Insp Wolmarans, frustrated by the proceedingsd, threw his state phone and car keys on the table and started to leave the door. R/Inspec Molagi shouted YOU WHITE BASTARD. Snr Supt Molagi addeds BLIKSEM HOMM! to which I responded in kind. The Director requested everyone to calm down. (12) I remained behind. Mr Motwere then said that I had told him that Supt Rommotovola was involved in copper theft, using the state bakkie to transport the copper from Randfontein to Krugersdorp. Mr Motwere was apparently going to somehow infiltrateSupt Rommotovolas copper transactions and deliver Supt Rommotovolas to me on a silver platter. He claimed the information he had provided was fabricated by me. Feeling frustrated and overwhelmed I then rose, stating once again to the Director that I was leaving and would respond directly to him on the events after listening to the recording by Snr Supt Molagi. Although Sen Supt concurred, the Director insisted that I remained. I agreed, on condition that all Reservists leave the room.

(13) After the Reservists left, those remaining included myself, the Director, Sen Supt Molagi, Supt Nyambi, Supt Rommatovola and my Commander, Sen Supt Rammagwa. I was confused as to what followed, having to defend myself against high-ranking officedrs. Supt Rammagwa was supportive of me, but said little during the hearing. (14) At one stage Sen Supt Molagi became very aggressive towards me and the Director, shouting you in civilian clothing, come and arrest me I want you to arrest me and you must open a case docket against me. Sen Supt Molagi also threatened me personally, stating I have already seen my attorney and he is going to sue you and open a criminal docket against you. (15) I informed Snr Supt Molagi that I had no information against him of any alleged criminal activities. If there had been a docket I would have come and spoken to him about it. Therefore the allegations of these suspects were false. I told Supt Rommotovula that in actual fact mr Motwere was the one who informed that he would make a deal and deliver his (Supt Rommotovulas) head to me on a silver platter. I explained that Mr Motwere told me that Supt Rommotovula was involved in copper theft, using the state bakkie to transport the copper from Randfontein to Mr Motwere, the latest transaction was worth R60 000.00. I went on to explain that as Mr Motwere was unwilling to give a sworn statement to that effect, I was unable to take further action. (16) This wrangling with high-ranking officers continued for approximately two hours until finally I had reached my limit. The Director then ended the so-called meeting/hearing. In the secretaries office as I walked out, a crowd of plice officers were present, glaring at me. As I mentioned before, Sen Supt Molagi recorded the proceedings. I had no prior knowledge of the recording. I am unable to remember all that what was said, but I do remember how I felt and how I still feel.

(17) During this experience I could not believe what was happening. I have never heard of this before. I feel I am being victimized for doing my work and for doing what I felt was expected of me. (18) That is all that I can state at this stage. I know and understand the content of the above statement. I do not have any objection to taking the prescribed oath. I consider the prescribed oath as binding on my conscience.
