METHOD OF MEASUREMENT (APPLICABLE TO ALL WORKS)

GENERAL A. Schedule of Rates and Bills of Quantities 1. The Schedule of rates and Bills of Quantities, including the pages for Contractor's additions and omissions, represent the entire work to be carried out in accordance with the Tendering Procedure, Conditions of Contract and Technical Specifications. Tendering Procedure, Conditions of Contract and Technical Conditions are complementary, explanatory, cumulative, additive and not alternative and for this reason descriptions contained in the Schedule of Rates and Bills of Quantities are in outline only to ensure reference is properly made to other Tender Documents for full information for pricing and tendering. Where appropriate, items are cross-referenced to the Drawing and Specifications and other Tender Documents. The Schedule of Rates and Bills of Quantities define the items which are measurable and the units of measurement under this Contract. They are supplemented by Measurement Rules which follow in this section. Quantities given in the Bills are based upon measurement from the Tender Drawing and Specifications. The Contractor's attention is drawn to the Measurement Rules which give details of certain items not measured in the Schedule of Rates and Bills of Quantities which, nevertheless, the Contractor must satisfy himself are included within his Tender Sum. The Contractor shall be deemed to have satisfied himself as to the accuracy of the quantities and to have made any necessary adjustments on the pages provided. Any alterations the Contractor may wish to make when bidding must be made solely on the Adjustment Schedule provided and similar continuation sheets if necessary. No alteration whatsoever may be made to the text and quantities of the Schedule of Rates and Bills of Quantities by the Contractor unless such alteration is authorized in writing by the Employer. Any such alteration being made without such authorization will be disregarded when tenders are scrutinized. The Unit Rate inserted by the Tenderer against each items shall include all costs, expenses and obligations, overheads and profit under the Contract in supplying, executing, completing and maintaining the Works. The Unit Rate shall include full compensation labour equipment, plant, tools and incidentals necessary to complete the item as described. Specified and/or shown on drawing.

7. Price Analysis: The Tenderer is required to submit with his Tender an analysis of all his unit rates in the following manner: a. Materials: The cost of materials delivered to site, including transportation, loading, unloading, insurance and in the case of imported materials, port, customs and landing charges and any other expenses thereon. Labour: The cost of labour, in accordance with the Kuwaiti Labour Law.

Plant and Equipment: The cost of plant and equipment including installation, maintenance, dismantling, fuel and operators. Sub-Contractors (if any) and Contractor's Overheads and Profit: Document III-5: Price Analysis. Refer to

Builder's Work in Connection with Sub-Contractors: Builder's work in connection with sub-contractors is deemed to be included in the rates unless specifically mentioned within the Bills of Quantities. No claims will be considered for cost of cutting away work already built in consequence of any neglect on part of the Contractor to obtain sufficient particulars beforehand.

Pricing Schedule of Rates and Bills of Quantities 1. The Contractor is to note that he must price all items in the Schedule of Rates and Bills of Quantities. If no costs are involved for any particular item, the words "included in tender" shall be written opposite to the item. Unless otherwise stated in the Schedule of Rates and Bills of Quantities (e.g. by separate measurement of associated items or method of measurement), all measured items are for work fixed in place and complete in all respects and the Contractor's prices are to include for everything necessary to comply with the Drawing, Specifications and other Contract Documents relating to the item measured. The Contractor must satisfy himself that the tender figure arrived at by a combination of measured rates and sums within the Documents accurately represents the full and final cost of carrying out the whole of the Works. No claim for misguidance or misrepresentation will be admitted under any circumstances. In submitting a tender the Contractor will be deemed to accept the method of measurement and descriptions. Rates inserted in the Schedule of Rates and Bills of Quantities shall be applicable for the whole period of the Contract including any extended period thereof. All entries in the Schedule of Rates and Bill of Quantities and Summary are to be made in ink and suitable for reproduction.

Measurements and Descriptions 1. This method of measurement shall prevail throughout the Contract notwithstanding any trade, local or general custom and shall be used in the adjustment of all measured variations or further measurement or re-measurement. All works shall be measured net as fixed and finished with no allowance made for waste. Measured items shall include for all jointing, fixing, and sundry labours, including cutting and fining, notching, forming or cutting holes, chasing, angles, ends, short lengths, circular work, etc., as shown on the Drawing or required by the Specifications or the Works, unless specifically measured elsewhere. Work is measured net as fixed in position, each measurement is taken to the nearest centimetre. Fractions of a centimeter less than half are disregarded and all other fractions are regarded as a whole centimetre. Where the unit of billing is the metre, quantities are billed to the nearest whole unit.

Fractions of a unit less than half are disregarded and all other fractions shall be regarded as whole units. 4. 5. In cases where the total quantity measured is less than half of one unit of measurement this shall be regarded as one whole unit. The measurement is by Sections following generally the trade pattern insofar as is practicable. The final responsibility as to which Section provides material to be incorporated in the Works rests with the Contractor and he shall ensure that the cost of all items is included in his Rates and prices whether occurring in the Section responsible for carrying them out or in another. Where minimum deductions of voids are dealt with they refer only to openings or voids which are wholly within the boundaries of measured areas. Openings or voids which are at the boundaries of measured areas are always the subject of deductions irrespective of size. Junctions between straight, raking or curved work are in all cases included with the work in which they occur.

Definitions 1. Where items in the Bills of Quantities contain the phrase "as specified" the Contractor shall refer to the Specifications, the Conditions of Contract, the Drawing and other Contract Documents for the full description. The Contractor shall include in his rates for complying with this clause whether the phrase "as specified" appears in the text or not. The term "Site" means the whole site area as defined on the Drawing plus allocated to temporary offices, work areas and connecting paths, roads, etc., as defined in the particular specifications - Document II. The terms "including", "is included", "include for" and similar words and phrases are used to indicate that the items in question are not measurable as separate items, are not specifically mentioned in descriptions but the costs of which are included in the measured items. The word "Ditto" means the repetition of all or part of the preceding items as applicable to complete the sense of the item. The words "Extra over" or "Extra for" mean the additional cost of the item of work in question over and above the cost of work already measured. The words "Deliver" or "Store" means materials to be delivered to the store(s) against the receipt to be issued by the Employer. The description contained in the Schedule of Rates and Bills of Quantities are not comprehensive and are for convenience only and the Contractor is to note that all relevant requirements of the Specifications, Drawing, General Conditions and other Contract Documents are to be taken into account in the measured items.

TENDERER'S ADJUSTMENT SCHEDULE OMISSION/ADDITION 1. All quantities and prices inserted in the adjustment schedule are subject to the same conditions as the items to which they relate and are referenced to.
