On 15th Oct, 2012 Mr. Amir Emp # 2987 along with Mr. Tariq Emp # 3705, Mr. Zulfiqar Emp # 3981 and Mr. Muhammad Sabir Emp # 3985 reached the factory SMD floor and started shouting against the Management for not concluding/finalising Agreement as per their demands. They forced other employees to stop machines and shut down production process. In the meanwhile Mr. Qasim Ali of opposition denied to accept their instructions. Mr. Amir Emp # 2987 along with Mr. Tariq Emp # 3705 assaulted him and punched on his face which results to wound his lips. Security department came on site and remove them from company premises. Mr. Ram Lakhan,

It has been reported that while you were on duty in the Kitchen ( pl. name the Section/Department) on 26th August 2009,(mention the correct date) at about 3.30 p.m.(mention the correct Time), you along with some other employees, namely ( name all of them), without any reason or provocation, suddenly assaulted Mr..and thoroughly beat him up in the presence of ..(name the witnesses) inflicting upon him injuries in the face, head and other parts of his body ( name the areas where injuries were found, if any).

You even threatened him with dire consequences and harm to his life.

The other workers and Staff members present there at that time came to the rescue of the Mr and with difficulty managed to save him from further beating and physical assault

Such violent behaviour on your part in physically assaulting your co-employee and then abusing him and threatening him with harm to his life amounts to acts of Gross Misconduct as per Clause 10(a) of the Companys Standing Orders which read as under:

You are therefore hereby called upon to explain in writing within 48 hours of receiving the Letter of Charges as to why appropriate disciplinary action should not be taken against you for your above mentioned acts of gross misconduct.

Should you fail to submit your written explanation within the above stipulated time, it will be inferred that you admit the charges leveled against you and that you do not have any explanation to offer in your defence.

In such eventuality, the management will be at liberty to take necessary disciplinary action against you, as it deems proper, under the circumstances.

However, since the Charges levelled against you are extremely serious in nature and since your presence in the establishment premises are detrimental to the overall discipline of the establishment, it is deemed expedient to suspend you from your duties with immediate effect.

During the period of your suspension, you will not be allowed to enter the establishment premises. However, you shall be entitled to receive subsistence allowance as per provisions of applicable law, during the period of your suspension, from the date of your suspension.

You are also hereby advised to report at the Security Room/Gate, at 10 am daily. (this is optional and at the discretion of the management)

The above act of yours is of a serious misconduct under Section M1( c ), M1(d ), M2(11) and M2(13) of the Certified Standing Orders of the Company which reads as follows : Careless or negligent work M1(c) Laziness and inefficiency M1(d) Gross neglect of work M2(11) Willful or irresponsible action resulting in damage to an y goods or property of the Company M2(13)

Charge Sheet on Misconduct.

1. You were granted leave for ten (10) days with effect from May 01, 2002. You were required to report yourself on duty on May 11, 2002. 2. You have not reported yourself on duty upto May 22, 2002, and remained absent willfully without sanction of leave for twelve (12) days. 3. This act on your part constitutes misconduct under the West Pakistan Industrial and Commercial Employment (Standing Orders) Ordinance, 1968. 4. You are hereby directed to explain your position in writing within ten days of issuance of this charge sheet as to why action should not be taken against you under relevant provisions of the West Pakistan Industrial and Commercial Employment (Standing Orders) Ordinance, 1968. 5. In case you fail to submit your written reply within stipulated period, ex parte action shall be taken against you.

Your above action comes under the violation of rules and as such constitutes an act of Misconduct. You are hereby called for an explanation within three days on receipt of this letter as to why disciplinary action should not be taken against you. In case of failure, further action will be initiated according to law.
