The Editor on Garcia's Counter-claim Against LULAC The Editor: Domingo Garcia filed a counter-claim against LULAC in the

lawsuit that LULAC had originally filed against Domingo Garcia to keep him from being candidate for the office of National President for national LULAC. In the counter-claim, Garcia is asking for a TRO, i.e., a temporary restraining order, that if granted maintains Garcia's viability as a candidate for office by ordering that LULAC would be prohibited from barring him as a candidate pending a second order that would come from a hearing requesting of a temporary injunction that would be asking for the same restraints being put on LULAC that prohibit LULAC from barring Garcia from being a candidate for the national LULAC office that he is seeking. The TRO, followed by a temporary injunction, usually occurring in a period of 15 days, would maintain the court ordered status until the request for a permanent injunction could be heard on its merits, sometime after the LULAC National Convention scheduled for June 17 through June 22, 2013 in Las Vegas. The request for the TRO was filed jointly with Garcia's answer to the lawsuit that LULAC filed against Garcia.

The counter-claim contains at least 10 affidavits from prominent LULAC leaders, both national and Texas, describing to the court the way that LULAC conducts business. As soon as we can obtain the entire filing, we will post the additional documents on this blog. The LULAC lawsuit against Domingo Garcia should have never been filed. It was done out of utter desperation by the National LULAC Board who support Margaret "la Bruja" Moran and who see Domingo Garcia's run for national office putting an end to their power on everything LULAC. This is the same board that expelled the Editor from LULAC for life, that removed Joey Cardenas as the Director of Texas LULAC in 2011, that removed Linda Chavez, Bea Martinez, Lourdes Galvan and Pete Anzaldua, from their respective office as Director, deputy director, deputy director for the elderly and deputy director for youth, and who in turn filed a lawsuit against Linda Chavez, Bea Martinez and Joey Cardenas because they incorporated Texas LULAC. The National LULAC Board was acting like the Mafia, like brutal dictators. In filing their lawsuit against Domingo Garcia, the National LULAC Board that follows La Bruja took on a person who knows how to fight back and win. The first victory came today when the judge in the court hearing the LULAC lawsuit rendered a decision in favor of Domingo Garcia by granting him the TRO that he was requesting. A second hearing will be held in 14 days to rule on Domingo Garcia's request for a temporary injunction. Today's ruling means that Domingo Garcia is a valid candidate for the office of National President of LULAC.
