Common Law Admission Test (CLAT)
CLAT 2008
Introduction
The greatest contribution of National Law Schools has been to transform legal
education into a professional education in its real sense of the term and to make it
attractive to Indian intelligentsia. The success of National Law School of India
University, Bangalore, has inspired many States to set up similar institutions in
their respective territories and at present, there are eleven Law Schools in different
parts of the country. These institutions are national in the sense that substantial
number of seats in all these institutions are filled up by students from all over India
and the academic staff are also recruited on all India basis. All of them conduct
admission tests in different centres spread all over the country and thousands of
students after their ten plus two examinations take these admission tests.

As the things stand now, each Law School conducts its own admission test and
admits students as per its regulations. As a result, students aspiring for good legal
education have to write a number of admission tests; and this multiplicity of
admission tests has been causing tremendous hardship both physically and financially
to the candidates taking these tests. This issue was raised from time to time by
several people, but it drew national attention as a result of a Writ Petition filed by
Mr. Varun Bhagat against the Union of India and various National Law Schools in
the Supreme Court of India in 2006. In the course of hearing, the Honourable
Chief Justice of India directed the Union of India to consult the National Law
Schools with a view to evolving a scheme for common admission test. It may be
noted that the Bar Council of India strongly supported this move towards common
admission test.

Since all National Law Schools owe their existence to their respective State
Legislation, there is no central agency to coordinate their activities. Therefore, a
move such as common admission test requires the consensus of all National Law
Schools participating in such a process. To facilitate such a consensus, the Ministry
of Human Resources Development, the Government of India and the University
Grants Commission of India convened the meeting of the Vice-Chancellors of seven
National Law Schools namely NLSIU, NALSAR, NLIU, NUJS, NLU, HNLU and GNLU.
The Chairman, Bar Council of India actively participated at these meetings. It may
be noted that these seven Law Schools have been functioning for quite some time
unlike other newly-established National Law Schools. After a couple of such meetings,
these seven National Law Schools signed a Memorandum of Understanding (MoU)
on 23rd November, 2007 committing themselves to hold the common admission test.
It is quite in order to acknowledge the significant role played by Mr. Sunil Kumar,

3
Joint Secretary, Ministry of Human Resources Development and Prof. Mool Chand
Sharma, Vice-Chairman, University Grants Commission in this entire exercise.

According to this MoU, the Common Law Admission Test would be conducted
hereafter every year by each of National Law Schools on rotation as per the

CLAT 2008
criterion of seniority. The NLSIU, Bangalore, the oldest of the National Law Schools
will set the process in motion by undertaking to conduct the admission test for the
academic year 2008-09.

It is expected that other National Law Schools (i.e., the Law Schools established
by State enactments) would join these seven Law Schools in due course.

It has been our experience that larger the catchment area, better will be the
quality of students; and it would be better for the institutions and the society. This
should be the first step to improve the quality of our educational institutions, so
that they may measure upto the international standards. This is imperative, if we
have to successfully meet the challenges of globalization.

The following National Law Universities will be making use of Common Law
Admission Test scores for their respective admissions for the academic year

National Law Schools
CLAT 2008
It is somewhat paradoxical that the legal education had not received the adequate
attention from our policy makers in the early years of our Independence despite
the fact that most of them were eminent lawyers. Naturally there was heavy
emphasis on technical education in view of the need for industrializing our economy.
But the important role assigned to law and the judiciary in our system of constitutional
governance required sound legal education as well. The relative negligence of legal
education took a heavy toll on the system; and the concept of national law school
was a response to meet the challenges posed by the deteriorating standards.

The Bar Council of India, representing the organized legal profession at all India
level, took initiative in establishing the first National Law School of the country.
This bold experiment required statutorily-guaranteed autonomy from the
conventional university system. Hence there was a need for the establishment
of a full-fledged law university. The Government of Karnataka, under the
visionary leadership of the then Chief Minister, Sri. Ramakrishna Hegde,
responded to the request of Bar Council of India by passing the National Law
School of India Act, 1986. The State Government also provided the land and the
substantial financial assistance in the initial stages. The Law School became
functional in 1988. From the very beginning, it admitted students on the basis
of all India admission test.

The decade of nineties was the era of globalization and it opened up vast
opportunities for young law graduates. As a result, the products of National Law
School have been very much in demand everywhere. This phenomenon inspired
other State Governments to set up similar law schools in their own States. As a
result, a number of National Law Schools have come up in different parts of the
country. Statutory basis provided by the State Legislature concerned and intake on
all India basis are the common characteristics of all these Law Schools. Of course,
all of these Law Schools had close links with the higher judiciary. Invariably, either
the Chief Justice of India or the Chief Justice of the respective High Court happens
to be the Chancellor of these Law Schools.

Broadly speaking, the objectives of all these National Law Schools may be
summarized as follows:

to achieve excellence in legal education and in this process, benchmark

themselves against the international standards.
to impart comprehensive legal education relevant to the requirements
of our country.

5
to advance knowledge by promoting inter-disciplinary research in all
branches of law.
to inculcate noble professional and ethical values so as to realize the
objectives enshrined in our Constitution.

CLAT 2008
In keeping with the present trend, all National Law Schools are expected to be
self-financing, and therefore, they charge relatively higher tuition fees. But it has
been the common objective of all of them that no student is compelled to
discontinue the study on account of financial constraints. Hence, all of them
provide liberal means cum merit scholarships.

All National Law Schools are residential and the students are expected to be in the
campus so that the teaching and learning would be a continuous process.

With these words of introduction, the Common Law Admission Committee welcomes
the young students from all over India and abroad to come and study in National
Law Schools. In order to facilitate the selection, brief sketches of the academic
programmes offered by each of the Law Schools are provided herewith. For further
details, one may access the website of the Law School concerned or go through
the bulletins of the individual law schools.

B.AA., LL .B. (Hons.): FFiv
LL.B. ive Year Integrated Course
ive
National Law School of India University, (NLSIU) Bangalore is the first Indian Law
University established by a statute passed by Karnataka Legislature in 1986. It
became functional in 1988. It is the only Law School sponsored by the Bar Council
of India with a view to raising the standard of legal education in India. Leading
lawyers, judges and academicians have been associating with the Law School from
the very beginning and in this way, the NLSIU represents the unique partnership
among the Bar, the Bench and the Academia.

NLSIU, Bangalore offers five year B.A., LL.B.(Hons.) programme whereunder four
social science subjects, namely, History, Economics, Political Science and Sociology
are integrated with legal studies. The social science subjects are taught in the
first two years along with law subjects. All the subjects are compulsory in the first
four years; and in the fifth year, optional seminar courses are offered along with a
few compulsory courses.

The NLSIU follows a trimester system whereunder the academic year is divided
into three parts and four subjects are taught in each trimester. As a result, a
student would have studied sixty subjects when he/she completes the five year
term. The wide spread of subjects helps a student to acquire extensive and intensive
knowledge of the legal system.

The optional seminar courses offered in the fifth year provide opportunities to
specialize in certain areas. For example, a student who wishes to pursue career in
corporate law may choose seminar courses on accountancy, securities, mergers and
acquisitions, etc. The NLSIU encourages the involvement of outside expertise in
offering optional seminar courses. In the recent times, the seminar courses have
been offered in subjects such as International Taxation, Accountancy and Financial
Management, Information Technology Law, Telecommunication Law, European
Community Law, Competition Law, Anti-Dumping Law, Negotiation Skills, Law of
Elections, Refugee & Humanitarians Laws, Affirmative Action, Women and the
Law, Displaced and the Law etc.

Another significant method of involving scholars from outside is by way of one

credit courses. These courses comprise of nearly eighteen lecture hours normally

7
spread over a week. The school invites experts, national and international, to
come and stay within the campus for a week to deliver these lectures. Any interested
student can sign up for these courses provided he/she possesses some basic
understanding of the subject. Some of the one credit courses offered in recent
times are: Shipping Laws, Law and Literature, South African Constitutional Law,

CLAT 2008
the U.S. Patent Laws, Genetic Resources Policy etc.

The NLSIU is a fully residential University with a number of halls of residence for
men and women. Men and women have separate mess facilities. Shri. Narayana
Rao Melgiri National Law Library, well-equipped with books, journals and electronic
data bases is the heart of the campus both in literal and metaphorical sense of the
term. The academic block, hostels and the Library are provided with wireless
connectivity so that the students may access internet facilities through their laptops.

Having realized the importance of computers in education, the NLSIU expects

every student to prossess a laptop. Those who cannot make down payments to buy
laptops may go for bank-loans and the Law School stands guarantee for the
repayment of such loans.

The NLSIU is proud of its vibrant student community which has excelled in curricular,
co-curricular and extra-curricular activities. The Law School has a well-equipped
moot-court hall named after Honourable Justice Hidayatullah. The students have
done very well in national and international moot court competitions. The moot
and debating competitions hosted by NLSIU have attracted participants from all
over India and from neighbouring countries such as Pakistan, Bangladesh, Nepal,
Malaysia, etc. The Law School students have in the recent times organized sports
and theatre festivals and national and international teams have participated in
those events.

There is a rigorous internship programme which every student of NLSIU has to

undergo as part of the curriculum and it starts from III year onwards. During these
internships, a student has to compulsorily work with lawyers doing trial work and
appellate work. The students who do very well can expect to work as law clerks
with the Judges of the Supreme Court and High Courts.

The NLSIU has well-developed research centres in areas such as Juvenile Justice,
Intellectual Property Rights and Environmental Law. The interested students can
associate themselves with these centres.

The Law School also has a well-equipped International Training Centre wherein
seminars and workshops are conducted on a regular basis.

B.A., LL.B. (Hons.), B.Sc., LL.B.(Hons.) Programme
The West Bengal National University of Juridical Sciences (NUJS) was established
under the WBNUJS Act 1999 (West Bengal Act IX of 1999). It is a university within
the meaning of subsection (f) of Section 2 and approved under Section 12 B for
receiving grants under the UGC Act 1956. It has been granted permanent affiliation
of the Bar Council of India. The Hon’ble Chief Justice of India is the Chancellor of
NUJS and is also the Chairman of its highest governing body, the General Council.

NUJS strives to pursue holistic legal education in order to prepare its graduates for
the diverse worlds of litigation, corporate legal practices, academia and legal
research. Due emphasis is given to clinical legal education in order to equip the
students with knowledge, skill and values to promote the ends of justice through
the instrument of law.

NUJS offers five-year integrated B.A. / B.Sc. LL.B (Hons.) and two-year LL.M
programmes besides M.Phil, Ph.D and LL.D programmes in law. It follows semester
system and its students are exposed to a carefully articulated blend of law and
social science courses. It adopts Socratic Method of teaching of well-structured
and regularly updated curricula with a host of optional courses to cater to the
needs of appropriate specialization. In addition to writing end-semester
examinations, each student has to compulsorily prepare project papers on select
topics pertaining to each subject of study. A very rigorous system of evaluation is
in place. Grading is done on an eight-point scale.

NUJS has an excellent faculty, a good balance of the experienced and the young.
They work with the self-belief that NUJS is poised to become the premier law
school in this part of the globe and their pupil are among the best in the world of
legal education. To augment their efforts, NUJS has entered into memorandum of
agreements with a number of premier institutions of international repute to gain
academic inputs of outstanding teachers as guest faculty on a sustainable basis.

The University is located on a prime land at the Salt Lake City of Kolkata, overseeing
the Eastern Metropolitan Bypass. The campus has an academic and three residential
blocks, two seven storied halls of residence for women and men each and a two-

26
storied staff accommodation cum Guest House. The academic block, named after
Dr. B.R. Ambedkar, is a four-storied majestic edifice in stone, having 105 rooms in
all. It is an inward looking building, octagonal in shape, and rounded by wide-
spread verandas that open up to a vast central lush green courtyard. It has everything
a modern university ought to have - a host of class rooms, seminar halls, conference
CLAT 2008
rooms, a well-stocked air-conditioned library open from 8 A.M. through 10 P.M.
with services of internet, printing and photocopying. Physical infrastructure of
NUJS also includes on campus Bank, a canteen, state-of-the-art kitchens at the
hostels, health care and sports and recreational facilities. Students of NUJS have
adapted themselves to computer aided education in a big way and LAN service is
extended to most of the rooms in the hostels. Construction of a modern auditorium
and complete networking of the entire campus is now underway.

Students of NUJS are a promising lot and are carefully nurtured for all round
excellence. They have enviable track-records in the field of mooting and debating,
have regular publications in peer-reviewed journals of international repute and are
known for their outreach community services and legal aid activities. They have
the unique distinction of publishing regularly two journals, one quarterly and other
annual, featuring contemporary legal thought. It is no wonder that each one of all
three passed-out batches has been satisfactorily placed in the profession and is
able to make a mark in her/his respective vocation.

Despite being able to achieve a high level of academic ambience, the NUJS has
maintained a relatively modest fee structure. It further seeks to ensure that no
student is forced to discontinue studies on account of financial constraints. With
generous donations of individuals and institutions, the University has built up
Scholarship Fund, proceeds of which are disbursed to students every year on need
basis. The alumni of the NUJS have also instituted a scholarship from this year.
Arrangements are in place for students of NUJS to secure educational loans from
any Bank of their choice on mutually agreeable terms. The Indian Bank has
announced special package for the NUJS students to facilitate speedy sanction of
loan at softer rate of interest without any collateral.

NUJS perceives legal education as an efficient instrument of improved social order

contributing to national development. Globalised environment has thrown new
challenges and is opening up newer issues of concern. It expects the students to
adequately arm themselves to combat these challenges in a mission mode. The
standards set in NUJS are already very high. Those who join NUJS are expected
not only to sustain, but also to improve upon these standards. NUJS promises best
return of their dedication, hard-labour and committed efforts.

B.A. LL.B.(Hons.) Programme
Hidayatullah National Law University (HNLU) has been established by the Government
of Chhattisgarh under the Hidayatullah National Law University of Chhattisgarh
Act, 2003. The University became functional immediately thereafter. From its
modest beginning, the HNLU has been making rapid strides to become Unus
Unorum and a Centre of Excellence in Legal Education.

The new campus of HNLU is located at Village Uperwara off National Highway
connecting Raipur and Vishakhapatnam and is about 22 kms. from the city campus.
The new campus is constructed with huge investment of about 50.00 Crores
sprawling over 65 acres of land abutting a beautiful lake. It consists of the academic
and administration block, halls of residence for men/women, halls of residence for
girls, separate Dining Halls attached to the hostels, Faculty Quarters, Guest House,
Gymnasium, Sports Complex and a proposed training centre. The entire campus is
located in a serene and pollution-free environment, surrounded by natural resources.
Plenty of open space makes the campus a refreshing one. The academic block
consists of three-storied library with air-conditioned reading hall and a fully air-
conditioned internet centre housing about 150 computers. The academic block
also houses the State-of-the-art Moot Court Halls carefully designed to match the
standards of the Hon’ble Supreme Court of India and the High Courts. HNLU is the
only National Law University in India having a hi-tech Language Lab to equip
students with writing skills and communication skills required for a promising
career in law. The Language Lab is having computers fully loaded with interactive
language learning programs. The entire campus is Wi-Fi enabled. All classrooms
are air-conditioned with Hi-Tech gadgets having DLP projectors, interactive boards
etc. The campus also consists of the State-of-the-art Conference Hall, which can
accommodate about 450 persons. The academic block also has an aesthetically
designed amphitheatre to cater to the needs of the students. The library is the
hub of all academic activities established to accomplish the research and academic
activities of the University. Our library is also a depository of rare books donated
by Justice M. Hidayatullah, which constitutes an important section for us and is
rather enviable for other law libraries. HNLU periodically publishes “Journal of Law
and Social Policy” and “Student Law Journal”.

The Honours Paper System

The Honours course of the University is its distinguishing feature from other
National Law Schools of the country as it offers the student to specialize in two
subject areas of his/her choice. The Honours course differentiates itself from the
Honours paper system, wherein a student opting for a stream, is enriched with
intensive knowledge through three exhaustive papers. The teaching in honours
paper is highly interactive due to choice-based study of the subject. The course is
designed with a near resemblance to a postgraduate course in a particular subject.
Coupled with the compulsory papers as prescribed by the University, the Honours
course provides a comprehensive five-paper study in the chosen subject, on
completion of the exercise.
