WHY I BURNED THE MEXICAN FLAG


My name is Roy Warden. For seven years now the Tucson Media have referred to me as a Racist a White Supremacist, and as Warden, the Notorious Mexican Flag Burner, for my confrontational stand against local vested interests and local government, whom I believe are complicit in creating the contentious border issues which divide this country. My origins are left wing. I am a natural product of the University of California at Berkeley and the radical politics of the sixties. At that time and place it was real easy for me to tell the difference between the good guys and the bad guys. The good guys marched for civil rights and against the war, wore long hair, hated the oppressors, got stoned, distrusted The Establishment (with justification), loathed Republican Fat Cats (with more justification), and always voted Democratic. The bad guys hated civil rights marchers, hated war protestors, and long-hairs, had short hair (though government agents who infiltrated radical political groups had long hair and got stoned), were the oppressors, and (of course) were Republican Fat Cats who always voted for themselves. That simplistic viewpoint worked well enough for me, at least in the sixties. In 1972, as a consequence of my work as an unlicensed private investigator, the details of which are not significant here, I went to Morocco, immersed myself in another culture, wore a turban on my head and rode camels to Timbuctu.1

In 1975 I returned to resume my work as an investigator, employed by several high profile San Francisco attorneys, to investigate political cases; including some minor work on the Patty Hearst case I did for noted San Francisco attorney Vincent Hallinan. I started an Import-Export business, fathered my daughter and eventually enrolled at the San Francisco School of Law, down near Haight and Van Ness. After six months I dropped out and returned to Morocco. Things had changed for me. Over time I had became alienated from the sixties culture but I still hated The Establishment; found both cultures to be full of liars, cheats and thieves, rip-off and bull-shit artists, etc. So I rejected all expectations and norms; instead I traveled Yahoo-like between three cultures, straight, non straight and Arab, never fully at home. Im truly multi-cultural. Maybe thats why when it comes to the contentious border issues which divide this country I see things a little differently. In Tucson theres no longer any good guys or bad guys. There is just The Establishment. Here in Tucson, behind the Green Door, behind the curtain where the Wizard still pulls the levers of power, both sides, the former good guys and bad guys have joined together to become one. For the past several decades, both sides have aided and abetted, enticed and invited, and otherwise encouraged the illegal entry of poor Mexican citizens for economic and political exploitation2. The Mexican Government has learned how to spin straw into gold; by encouraging the export of their poor and weak, they have turned their own people into a commodity. Presently, the

Mexican economy earns 24 billion dollars every year3, in remittance money sent home by Mexican citizens working in the states, often for less than minimum wage. Thats why Ive always hollered Viva Zapata! Long Live the Mexican Revolution whenever Ive burned a Mexican Flag in protest of the exclusionary policies of the Mexican government. The Tucson Establishment has accepted Mexicos gift of the poor and exploitable, and created what I call The Industry of Mexican Poor. By so doing theyve provided the all the substance necessary to fuel Americas cheap labor, law enforcement and prison industries. Prosecutors have informed me; since the poor Mexicans status is illegal they are reluctant witnesses, more vulnerable to predators, and four times more likely to be victims of violent crime. Public Defenders have told me: Roy, if every poor Mexican went home tomorrow, half the Tucson lawyers, and judges, would be unemployed within six months. The local right wing Fat-Cats wanted cheap labor so they could create inexpensive luxurious country club environments for baby-boomers to retire in; local government wanted the consequent increased tax revenue. Until the economic collapse in 2008, the Fat-Cats and local government, got what they wanted; in 2006 Arizona joined Nevada as the fastest growing state.4 Now the economy (except for law enforcement and prisons) is in collapse. In the process, the blood, sweat and tears of poor Mexicans has nurtured Arizonas soil, and replaced water in the mortar and brick foundation of Arizonas economy5. The left wing so called humanitarian groups, (most of them established and operated by left wing lawyers), wanted a Raza

Revolution and the creation of the Nation of Aztlan. To succeed they needed ever increasing numbers of poor Mexicans whose children could be easily radicalized in the local schools. The left wing humanitarian groups havent (yet) achieved their dream of Aztlan, but in the process theyve gotten something else: Theyve created a vast network of non-profit foundations, created revenue streams, solicited contributions worldwide to help poor Mexicans, whose very presence, illegal status and need for help the left wing helped instigate, generating millions of dollars yearly in untaxed revenue, which has paid a whole lot of salaries for a whole lot of Directors of the non-profits. They also got enormous media coverage and political leverage. In Tucson, both sides of The Establishment got everything they wanted. Everyone got jobs, businessmen got rich, and the humanitarians felt very smug about all the good they were doing for the poor Mexicans. So what? Thats what they call the American Dream, right? Work hard, lie, cheat and steal, and maybe you can always get what you want, anything you want, even a Raza Revolution. Yeah, but while both wings of The Establishment were getting everything they wanted, what happened to the poor Mexicans? Ill tell you what happened: they got ground up. They got shit. They got their backs broken. The ones who survived to get here (around 175 die in the desert each year), got and continue to get, screwed. Coyotes kidnap them for ransom, rob and rape them coming here6, make them carry 40 pound bags of mota, coke, meth, etc. Not so cool, why? Im in the federal court building twice a week, mostly to observe proceedings, use the library, etc.

I cant tell you how many times have I seen Mexican wives and mothers, grandmothers and children, walking the marble halls of justice, crying their hearts out, because papa got caught bringing in someone elses load, got 5-15 years laid on him from some stinking, asshole Republican Judge, who, after sentencing maybe 10 a day, drives home every night to a luxurious country club home that, without cheap Mexican labor, he never could have afforded. He and his fellow judges play golf on exquisitely manicured greens, maintained by cheap Mexican labor. He and his brethren have lifetime jobs because the courts have a never ending series of drug and immigration cases. Judges and Lawyers, (most of them even less than mediocre) now have a lifetimes work of adjudications, prosecutions and court appointments to represent the indigent, especially indigent Mexicans. Thousands of parasites handling hundred of thousands of cases each year, here in Arizona alone. A symbiotic relationship: the legal class feeding on poor Mexicans who need their services, a need created by an evil industry which invited them in, for profit. Moreover: before the market collapsed, the humanitarian nonprofits7 got federal subsidies from HUD for helping to convince poor Mexicans, by the tens of thousands, to sign up for a loan to buy a house, at 1-2% interest, a house they couldnt afford. Poor Mexicans, with the advice and assistance from radical groups like Chicanos por la Causa, bought a lot of houses in Tucson, between 1998 and 2004, until the freaking banks jacked-up the interest to 5-6%, which the poor Mexicans couldnt afford. It may have been Good Business8 for the Fat Cats, nonprofits and the legal community, but the consequences have been sheer living hell for poor Mexicans.

This is particularly true for Chicanos Por La Causa which had offices across the street from HUD.

Then, in 2004 the sharks moved in. The banks foreclosed, starting a process which led to the Great Mortgage Collapse of 2008. Subsequently; Fat Cat bankers formed real estate investment trusts and got the houses back at bargain basement prices. Theyve begun selling these very same houses all over again. The land of boundless opportunity; aint America great? Meanwhile; the poor Mexicans lost everything. Are you freaking kidding me? Left wing groups like Chicanos Por La Causa helping Fat-Cat Bankers rip off the poor, imagine that! Here in Tucson it was a thriving industry, until 2008. Ive been speaking out against this exploitation, this shit, ever since 2006. Naturally, the entire Establishment, especially the lawyers, the left wing non-profits, the media, etc., and other groups like the Southern Poverty Law Center and the ACLU, along with the business community, hate my guts. Thats why Ive been arrested 13 times for speaking out; thats why they have branded me a racist and hate-monger for challenging their special interests. And, now theres my federal suit, Warden v Miranda, perhaps the most outrageous series of First Amendment Retaliation claims9 ever to be filed in an American court. The truth of what Ive said above becomes very clear when you read the Statement of Facts. And there is more: Along with my federal suit against the Tucson City Police Department and Tucson City Officials, I have filed suit against the City of Tucson who, for the past 5 years, have issued

a series of non-appealable, transparently invalid10, Orders of the Tucson City Court, suspending my First Amendment rights. Not just my rights; your rights too. Right here in the Old Pueblo the government has already established all the process necessary to suspend everyones right to challenge the rectitude of official government action. The right wing believes Homeland Security has already purchased the armored personnel carriers and more than 1 billion rounds of ammunition, all to wage war on the American people. And if the First Amendment has been compromised, guess what, you right wingers who think your guns will protect you from them? You wont even know when theyre coming for you, until the flash-bang and agents come pouring through the door. The briefs have already been submitted. Oral argument will be entertained in Pima County Superior Court within the next six weeks. I hope it makes sense to you. Maybe Im just a lunatic. Maybe Im crazy to believe that people will see that my fight to protect our first amendment rights is their fight too. If rights are not protected for all of us, soon, very soon, there will be no rights left to protect for any of us. I hope people will contact me at the email address listed below. I hope they will begin to help me out, at least in some way11, But if they cant, or wont, thats OK too. Im used to public apathy. Im used to people passionately speaking out about how important our rights are, and then refusing to put any action

behind their words, or even worse: making their livings going into court to protect government officials who violate our rights12. Im tired of the sanctimonious; passionate words, without action, are meaningless. And Im fed up with people swallowing that left-wing propaganda Im a Racist, or a White Supremacist. Because Im neither. In Tucson Arizona Im re-growing my pony tail. I also grow organic vegetables and fight for what I think is right. And when it comes to The Establishment, ripping off the poor, I really dont give a rats ass which wing, left or right, they come from. I still hate Fat-Cats, especially the ones who suck the marrow from the bones of poor Mexicans; those who make their livings from an industry of exploitation and fear. I come from San Francisco. The sixties were my formative era. I never forgot, or lost, the spirit of the sixties, but over the years Ive found out that most of the sixties has left me.
