Seor Juez Quinto de Familia de Bogot E. S. D.

REF: Contestacin de demanda ejecutiva de Alimentos en el Proceso No 818 -02 en contra del seor HUMBERTO GOMEZ SANCHEZ.

Cordial saludo, INGRID FLORIAN PINTO, mayor de edad, y vecina de esta ciudad, identificada como aparece al pie de mi correspondiente firma, abogada en ejercicio, portadora de la tarjeta profesional nmero 159.789 del Consejo Superior de la Judicatura, obrando como apoderada judicial del seor HUMBERTO GOMEZ SANCHEZ, igualmente mayor de edad y vecino de esta ciudad, por medio del siguiente documento presento contestacin de la demanda y estando dentro del trmino legal de la siguiente manera: EN CUANTO A LOS HECHOS AL PRIMERO: Es cierto. AL SEGUNDO: Es Cierto. AL TERCERO: Es falso. La cuota alimentaria en el periodo de tiempo comprendido entre agosto de 2003 y abril de 2008 si fue pagada, como se sustenta con recibos a favor de la madre de los alimentarios, firmados por ella misma o por algunos de los hijos. AL CUARTO: Es parcialmente cierto. Si bien, el juzgado adopt la medida de descuento de la cuota alimentaria por nmina, esto no fue a causa del incumplimiento por parte de mi poderdante ya que aunque hubo unas demoras en los pagos de finales de 2007 e inicios de 2008, la cuota se cubri en su totalidad y en esa ocasin no fue verificado dicho incumplimiento por parte de la Defensora de familia.

AL QUINTO: Es cierto. AL SEXTO: Es cierto. AL SEPTIMO: Es parcialmente cierto, los mencionados pagos se realizaron pero no en la modalidad de pago parcial. AL OCTAVO: Es parcialmente cierto, los mencionados pagos se realizaron pero no en la modalidad de pago parcial. AL NOVENO: Es una manifestacin de la parte demandante, que se pruebe, adems la totalidad de los alimentarios en la actualidad son mayores de edad, toda vez que ANDREA BEYANID GOMEZ URREGO, cumpli 18 aos el da 19 de agosto de 2011. AL DECIMO: Es falso, ninguno de los mencionados ttulos contiene obligaciones exigibles. PRONUNCIAMIENTO SOBRE LAS PRETENSIONES Me opongo a todas y cada una de las pretensiones de la parte actora por carecer de sustento de hecho y derecho, adems de no ser cierto ni darse los presupuestos fcticos esbozados en la demanda, ya que como es sostenido mi poderdante ha respondido por cada una de sus obligaciones alimentarias. EXCEPCIONES Propongo para que sea resuelta en la debida oportunidad procesal la siguiente: 1- PAGO TOTAL DE LA OBLIGACION: La cual hago consistir en que cada mes mi poderdante, en la modalidad de pago quincenal realiz el respectivo aporte de cuota alimentaria a sus hijos, en algunas ocasiones aportando ms de lo acordado en las conciliaciones, de acuerdo con las necesidades especiales del momento. Los aportes se realizaron por valor de DIECIOCHO MILLONES DOSCIENTOS SESENTA Y DOS MIL PESOS M/CTE ($18.262.000.oo) excediendo en CUATRO MILLONES SETECIENTOS OCHENTA Y OCHO MIL SETECIENTOS OCHO PESOS M/CTE ($4.788.708.oo) a las

pretensiones de la demanda, anotando que en este clculo no se incluyen los TRES MILLONES DE PESOS M/CTE ($3.000.000.oo) que la seora LUZ MARINA URREGO asegura haber recibido de parte de mi poderdante. Adems de la cuota alimentaria aportada a sus hijos, mi poderdante los tena afiliados en salud y al Plan complementario de salud de la Empresa de Acueducto y Alcantarillado de Bogot. Entre los aos en cuestin tambin el seor HUMBERTO GOMEZ aport educacin para sus hijos en el colegio de la EAAB. Adicionalmente tambin aporta para sus hijos la vivienda, de la cual disfrutan tambin la seora madre de ellos y su compaero ya que la casa en que habitan y en la cual no deben pagar arriendo es de propiedad del seor HUMBERTO GOMEZ SANCHEZ, como consta en el certificado de tradicin y libertad que se anexa a este escrito. PETICIONES PRIMERO: Declarar probada la excepcin DE PAGO TOTAL DE LA OBLIGACION formulada en el presente escrito. SEGUNDO: Toda vez que no existe deuda pendiente por concepto de alimentos, solicito que los TRES MILLONES DE PESOS ($3.000.000.oo) que la seora Luz Marina declara haber recibido y que no se computan en los recibos de pago que aporto a esta demanda, se tengan como pago del vestuario que se adeuda desde el ao 2008. SEGUNDO:Como consecuencia de lo anterior solicito al seor Juez dar por terminado el presente proceso. TERCERO: Ordenar el correspondiente levantamiento de la medida de embargo que pesa sobre el salario de mi poderdante. CUARTO: Condenar en costas y agencias en derecho a la parte actora. Recibos de las cuotas alimentarias a favor de la seora Luz Marina Urrego Orozco, madre de los alimentarios, Julieth Paola Gmez Urrego y Javier Leonardo Gmez Urrego en su calidad de hijos, por valor de DIECIOCHO MILLONES DOSCIENTOS SESENTA Y DOS MIL PESOS M/CTE ($18.262.000.oo). Certificado de tradicin y libertad de la vivienda ubicada en la Calle 139 No 128 A 07, en la cual habitan los hijos de mi poderdante. Comunicado de la Empresa de Acueducto y Alcantarillado de Bogot en donde se hace la suspensin del servicio de ANDREA BEYANID GOMEZ URREGO, por no aportar documentacin que certifique la dependencia econmica a los padres.
