Amending Ordinance #13-007 relating to petty cash funds in various City Departments by eliminating such fund for the Clerk of Council. WHEREAS, the purpose of this Ordinance is to eliminate the petty cash fund for the Clerk of Council as represented in Ordinance #13-007. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF MANSFIELD, STATE OF OHIO: SECTION 1. Authorizing the City to accept a donation of One Hundred Dollars ($100.00) from Michele Matteson for use by the Mansfield Fire Department for Fire Prevention Education Materials. WHEREAS, Michele Matteson has graciously offered to donate One Hundred Dollars ($100.00) to be used for fire prevention education materials, and WHEREAS, this Council for itself and on behalf of the City of Mansfield gratefully appreciates the generosity and public interest reflected by her kind offer. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF MANSFIELD, STATE OF OHIO: SECTION 1. That the Safety-Service Director on behalf of the City of Mansfield be, and she is hereby, authorized to accept a donation from Michele Matteson in the amount of One Hundred Dollars ($100.00) to be used by for the Mansfield Fire Department for fire prevention education materials. SECTION 2. That the donated funds accepted in Section 1 hereof shall be deposited in the Safety Services Fund (#214) and the sum of One Hundred Dollars ($100.00) be, and the same is hereby, appropriated from the unappropriated balance in the Safety Services Fund, Fire (214.16.01) to the Supplies and Material Classification therein. SECTION 36.37 FLSA EXEMPT POSITIONS. Positions marked with an A+@ are exempt from the minimum wage and overtime provisions of the Fair Labor Standards Act (FLSA), and as such are paid a salary. Incumbents of such positions are not entitled to receive overtime, compensatory time, call-in pay, stand-by pay, or any other type of premium pay for working more than the maximum hours in a work week or work period. Incumbents are also not covered by the rules concerning the following compensation or benefits: Holiday pay, wage continuation, bereavement leave pay, civil leave pay, disaster leave pay, examination leave pay, shift-differential, or personal days. Incumbents shall not receive a reduction in pay for absences of less than one day. Such employees shall follow the procedures for the deduction of vacation and sick leave of one day or more from the appropriate balances. BILL #13-068 BY: ALL MEMBERS OF COUNCIL Honoring Chief John Harsch upon his retirement from the Mansfield Fire Department. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF MANSFIELD, STATE OF OHIO: SECTION 1. That this Council, on behalf of the government and the citizens of the Mansfield community, is privileged to honor and pay tribute to John Harsch upon his retirement, effective February 8, 2013, after more than twenty-seven (27) years of service with the Mansfield Fire Department. John Harsch has been employed with the Mansfield Fire Department since April 26, 1985. During his twenty-seven (27) years of service, he attended additional classes as his responsibilities grew and he obtained numerous certifications, including EMT - Basic, Firefighter II, and Fire Safety Instructor. He was also the leader of the Mansfield Fire Department HazMat team, and he received the Local 266 Presidents Award in 1991. During his tenure with the Fire Department, John Harsch was promoted to Captain on May 6, 1993, to Assistant Chief on July 2, 2001 where he was assigned to A Crew, and to Fire Chief on February 6, 2009, the position he filled until his retirement on February 8, 2013. As Chief, he replaced three broken down rescue squad vehicles with new ones, secured a 2.1 million dollar grant for hiring firefighters and received an FBI Award for participation in the Weapons of Mass Destruction Program. He was a very dedicated professional and will be missed by all who served alongside of him. Chief Harschs retirement represents a great loss to the Mansfield Fire Department. He has our congratulations and heartfelt thanks for his many years of loyal service and we wish him good health and happiness in the future. RESOLUTION # ____________________

WHEREAS, under authority of Section 3, Article XVIII of the Ohio Constitution and '' 715.26, 715.261, 3737.14 and 3737.28 of the Ohio Revised Code, the City has enacted Chapter 1335 of the Mansfield Codified Ordinances, 1997, relating to the removal and repair of buildings and structures for the purpose of safeguarding life and property and for the promotion of the peace, health, safety and welfare of the City of Mansfield and its inhabitants, and WHEREAS, the Bureau of Buildings, Inspections, Licenses and Permits has, pursuant to Chapter 1335 of the Mansfield Codified Ordinances, 1997, made its inspection and issued its notice and order as pertains to the remains of the building and structure hereinafter described, and WHEREAS, the owner or occupant has failed to comply with the order issued by the Bureau, and WHEREAS, Council is fully advised in this matter by reason of the reports and proceedings of the Bureau. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF MANSFIELD, STATE OF OHIO: SECTION 1. That it is hereby determined and declared that the one and a half (1) story single family dwelling located on the premises described in Section 2 hereinafter has been extensively damaged by fire and is insecure, unsafe, structurally defective and unsafe to life and other property by reason of its hazardous and unsound condition, unsound and unsafe walls, floors, foundation and ceilings, and by reason of want of repair, age and dilapidation; and it is hereby further determined and declared that by reason thereof said building or structure is beyond repair and is a nuisance. WHEREAS, the codified Ordinances of the City of Cleveland (Cleveland), authorize Cleveland to enter into an agreement with another municipal corporation to act as the agent of the other municipal corporation, provide a central collection facility for the collection of income tax, and do all things allowed by law to accomplish such purpose, and WHEREAS, this Council finds it to be in the best interest of the City of Mansfield to enter into an agreement with Cleveland to allow Cleveland to act as an agent for administration of the income tax laws of the City of Mansfield and collection of income tax due and owing to the City of Mansfield; and WHEREAS, such administration and collection shall be restricted to delinquency issues referred to Cleveland by the City of Mansfield, including collection of outstanding balances and pursuit of non-filed tax returns and other delinquency programs as agreed to by Cleveland and the City of Mansfield. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF MANSFIELD, STATE OF OHIO: SECTION 1. That the Finance Director is hereby authorized and directed to enter into an Agreement for the Central Collection of Municipal Income Tax, available on file in the Finance Department, with the City of Cleveland (Cleveland) on behalf of the City of Mansfield, to allow Cleveland to act as an agent for the purpose of administering income tax laws of the City of Mansfield and collecting income tax due and owing to the City of Mansfield. SECTION 2. That by reason of the importance of collecting municipal income taxes efficiently and expediently, this measure is determined to be an emergency ordinance for the immediate preservation of the public peace, health, safety and welfare of the City of Mansfield and its inhabitants and providing it receives the affirmative vote of twothirds of all members elected to Council, it shall take effect be in force immediately upon its adoption, otherwise from and after the earliest time allowed by law, after its passage and approval by the Mayor. Authorizing the Safety-Service Director to execute and deliver an amendment to the Sales Tax Sharing Agreement with the County of Richland, Ohio, and declaring an emergency. WHEREAS, the Board and the City previously entered into the Sales Tax Sharing Agreement dated April 27, 1988 (the Original Agreement) to provide for the County to share with the City a portion of any excess proceeds from the Countys levy of certain sales and use taxes, and WHEREAS, Ohio statutory law permits the County funds to be expended on City streets only in limited circumstances in accordance with certain procedural requirements. See, for example, Ohio Revised Code Chapter 5557 relating to city streets forming a continuous road improvement with county or state roads and to boundary streets between a city and unincorporated territory, and WHEREAS, subsequent to the execution and delivery of the Original Agreement, the County and the City entered into the Agreement for Housing Prisoners dated as of September 20, 2006 (the Jail Agreement) pursuant to which the County agreed to construct a new county jail in reliance upon the Citys agreement to (i) contribute a portion of the costs of the construction of the new county jail, (ii) close its city jail and house prisoners at the county jail, and (iii) pay amounts for (a) the right to house such prisoners in the new county jail and (b) the costs of housing such prisoners, and WHEREAS, the City has been declared to be in fiscal emergency by the Auditor of the State of Ohio, and WHEREAS, the City may, from time to time, desire to seek a waiver of a portion of its payments due to the County pursuant to the Jail Contract, and WHEREAS, any waiver of such payments would require additional expenditures from the Countys general fund to pay debt service on the Countys bonds issued to pay costs of constructing the jail and to pay the costs of housing prisoners to compensate for any waiver granted by the Board of payments due from the City pursuant to the Jail Contract, and WHEREAS, the County and the City desire to enter into an amendment of the Original Agreement to provide that should the City request, and should the County grant, a waiver of any payment due from the City to the County pursuant to the Jail Contract, the amount of sales and use tax proceeds to be shared with the City pursuant to the Original Agreement would be reduced by the amount of any waiver granted by the County and, thus, leaving amounts available in the County general fund to pay costs of the construction and operations of the county jail.

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF MANSFIELD, STATE OF OHIO: SECTION 1. The Amendment of Sales Tax Sharing Agreement by and between the Board and the City (the Amendment) in the form now on file with this Council is approved, and the Mayor and the Safety-Service Director are authorized to sign and deliver, on behalf of the City, the Amendment with such changes that are not materially adverse to the interests of the City and are approved by the Mayor and the Safety-Service Director.

To the extent permitted by law, the signing and delivery of the Amendment by the Mayor and the Safety-Service Director shall be evidence that any changes therein are not materially adverse to the interests of the City and have been approved by the Mayor and the Safety-Service Director. SECTION 2. This Council finds and determines that all formal actions of this Council concerning and relating to the passage of this ordinance, and that all deliberations of this Council and of any of its committees that resulted in those formal actions, were taken in meetings open to the public in accordance with the law. SECTION 3. That by reason of the immediate necessity for amending the Sales Tax Sharing Agreement and to thereby promote and continue fiscal recovery efforts for the City of Mansfield, this measure is determined to be an emergency ordinance for the immediate preservation of the public peace, health, safety and welfare of the City of Mansfield and its inhabitants and providing it receives the affirmative vote of two-thirds of all members elected to Council, it shall take effect be in force immediately upon its adoption, otherwise from and after the earliest time allowed by law, after its passage and approval by the Mayor.
