GENERAL POWER OF ATTORNEY

KNOW ALL MEN BY THESE PRESENTS THAT I, [NAME], son of [NAME], aged about [AGE] years and residing at [ADDRESS], being of sound mind and legal capacity, DO HEREBY APPOINT AS MY TRUE AND LAWFUL ATTORNEY

TO ACT FOR ME IN MY NAME AND ON MY BEHALF, TO DO AND PERFORM THE ACTS AS MENTIONED IN THIS GENERAL POWER OF ATTORNEY:

WHEREAS, I am leaving to the [FOREIGN COUNTRY NAME] in order to pursue my higher studies, and

WHEREAS, I own a lot of movable property in India includes shares, deposits, bonds, securities, balances in bank accounts and investment in government securities, besides investment in businesses in India, and WHEREAS, during my absence in India all the above movable properties have to be taken care of and attended to, and WHEREAS, with the intention of ensuring that all activities relating to my properties be carried out without interruption, I have this day appointed as my Lawful Attorney, [RELATIONSHIP IF ANY], [NAME], and he shall be authorized and empowered to do all or any of the acts or things as mentioned below:

My Attorney shall demand, collect and receive in my name and on my behalf, all debts, loans and advances and other claims due to me. He is empowered to take lawful proceedings and means to recover and receive the said loans and advances. He is further empowered to prosecute and defend all lawful actions, suits and claims and refer the matter to arbitration, file the suit, compromise the suit and execute such instruments as he deems proper and necessary.

My Attorney is empowered to invest my monies in any manner as he deems fit and expedient.

My Attorney is empowered to deposit the monies collected on my behalf, into my bank account. He is authorized to operate my bank accounts, close them and open new bank accounts, if necessary. He is authorized to draw, accept, endorse, negotiate, retire and pay any Bill of Exchange, Promissory Note, Cheque and other Negotiable Instruments, as he thinks proper and expedient in my interest.

My Attorney is authorized to invest my monies in Government Securities, Bonds, Shares or other modes of investments of Public Sector and Private Sector Undertakings or any other deposit or investment that he may deem necessary, in my interest. He is also authorized to operate my D-Mat account and empowered to authorize any transfers in and out of the said account.

My Attorney is authorized to sign all documents relating to statutory, municipal, quasijudicial and local authorities and he is also empowered to represent me before any or all such authorities.

My Attorney shall appoint and retain any Advocate or Chartered Accountant or any other Professional for the purpose of appearing before Government, statutory, quasi-judicial, local and other similar authorities and for any other purpose deemed fit.

My Attorney is empowered to defend, institute of prosecute all legal proceedings on my behalf and to my benefit and advantage, in matters in which I am or may hereafter be interested or concerned.

My Attorney is authorized and empowered to purchase any movable or immovable property for my benefit and as he deems fit.

My Attorney is authorized to sell, endorse, transfer, invest, close, or assign all or part of my assets, stocks, shares debentures, deposits and the like which stand in my name or shall stand in my name and give valid receipts for the same.

My Attorney is authorized to represent me in respect of the businesses of which I am the sole proprietor and in which I am a partner and all deeds done by him shall be construed as done by me in my capacity as proprietor / partner of the businesses.

My Attorney is authorized to enter into partnership arrangement with other parties, on my behalf, for the purpose of carrying on any lawful business and all acts and deeds done by him shall be construed as done by me. He shall be empowered to sign the Partnership Deed on my behalf and all other documents that are necessary for the commencement and subsequent functioning of the partnership business.

My Attorney is authorized to sign applications, contracts, agreements, receipts, forms or other documents for giving effect to any or all of the above mentioned acts, deeds or things.

I further declare that all acts, deeds and other things done by my Attorney shall be construed as acts, deeds and things done by me and I hereby ratify and confirm all and what-so-ever my Attorney shall lawfully do, or cause to be done, for me, by virtue of the powers hereby given to my Attorney.

This General Power of Attorney shall remain in effect in the event that I should become or be declared disabled, incapacitated or incompetent.

This General Power of Attorney shall be valid for a period of five years from this date, unless it is revoked by me, in writing, before the expiry of that period.
