In questo documento forniamo una prima lettura sintetica di talune norme selezionate per rilevanza, di cui al decreto ministeriale che ha introdotto Nuovi regimi di incentivazione per gli impianti alimentati da fonti rinnovabili diverse dal fotovoltaico (D.M. 6 luglio 2012, avente ad oggetto lattuazione dellart. 24 del decreto legislativo 3 marzo 2011, n. 28, recante incentivazione della produzione di energia elettrica da impianti a fonti rinnovabili diversi dai solari, in Gazzetta Ufficiale Suppl. Ordinario n. 143 del 10 luglio 2012). With this document we aim to provide a summary reading of the main rules set forth under the new ministerial decree introducing the incentive for generation of electricity from renewable energetic source other than solar (D.M. 6 July 2012, providing for the implementation of art. 24 of legislative decree 3 March 2011 no. 28, providing for the incentives for generation of electricity from renewable energetic source other than solar photovoltaic, in Gazzetta Ufficiale Suppl. Ordinario n. 143 of 10 July 2012). 1. Qual il nuovo obiettivo di produzione di energia elettrica da fonti primarie rinnovabili? Which is the neW target of generation of electricity from reneWable energetic sources in italy? 32/35% dei consumi energetici totali del Paese al 2020. 32/35% of the total energy consumption of the country as of 2020. 2. Qual il nuovo costo indicativo cumulato annuo per tutti i regimi di incentivazione delle rinnovabili esclusi i conti energia per il fotovoltaico? When Will the neW incentive start to be granted? Dal 1 gennaio 2013. Gli impianti che erano autorizzati alla data di entrata in vigore del decreto FER e che entreranno in esercizio entro il 30 aprile 2013, tuttavia, possono optare per il regime dei certificati verdi (salvo poi transitare al nuovo regime con i meccanismi previsti per gli impianti IAFR). As from 1 January 2013. Plants that were permitted as of the date of entry into force of the FER decree and that will enter into operation by 30 April 2013 may, however, decide to be admitted to the green certificates regime (they will only in the subsequent years be converted into the new regime).

In questo ambito una specifica priorit viene data ai termovalorizzatori dei rifiuti in relazione alla frazione biodegradabile degli stessi. The aimed mix is that fostering those sources that better meet the following targets: (i) lowest possible unitary costs, (ii) highest possible upturns for the economic chain of Italy, and e (iii) minimization of the environmental impact and of the effects on electricity grids. In this context a specific priority is to be given to waste-to-energy plants using the biodegradable segment of garbage. 6. Quali sono le principali modalit di accesso alla concessione degli incentivi? hoW is the application for the granting of the incentives regulated in broad terms? A seconda della potenza dellimpianto sono previsti (i) per gli impianti maggiori una asta competitiva al ribasso sul valore degli incentivi, (ii) per gli impianti medi un sistema di prenotazione tramite iscrizione in specifici registri sulla base di criteri non direttamente competitivi e (iii) per gli impianti pi i piccoli un sistema ad accesso diretto. I rifacimenti sono esclusi dalle aste. Depending upon the capacity of the plant, different systems are provided for: (i) a competitive tender with the winning bid being the offer for the lowest possible tariff level, (ii) for mid-sized plants a system of tariff booking by means of a non-directly competitive pre-registration process, and (iii) for the smallest ones of the plants a system by way of a direct application upon commissioning. Refitting of existing plants are exempt from tendering.

7. Quali impianti accedono tramite asta competitiva? Which plants shall go through competitive tenders in order to access the tariffs? Le seguenti categorie di impianti: (i) impianti nuovi, impianti integralmente ricostruiti, impianti riattivati con potenza eccedente la soglia di gara, (ii) impianti ibridi con potenza eccedente la soglia di gara e (iii) impianti ripotenziati in cui lincremento di potenza superiore alla soglia di gara. The following categories of plants: (i) new plants, fully re-built ones, and restarted plants with capacities above the threshold triggering the tender, (ii) hybrid plants with capacities above the threshold triggering the tender, and (iii) repowered plants for which the capacity gap exceeds the threshold triggering the tender. 8. Quali la soglia di gara? Which is the threshold triggering the tender? 5 MW, salvo che per lidroelettrico per cui 10 MW e il geotermico per cui 20 MW. 5 MW, except for hydro for which it is 10 MW and geothermal for which it is 20 MW. 9. Quali sono le potenze messe a gara? Which are the tendered capacities? Quelli indicati nellAllegato 1. Those indicated in Annex 1. 10. Quali sono i ribassi ammessi? Which are the alloWed bids? Quelli compresi fra il 2% e il 30% del valore base dasta. I ribassi non dovrebbero applicarsi ai ricavi generati dalla vendita dellenergia elettrica prodotta. Minimum 2% and maximum 30% on the starting bidding offer. Bid reduction should not affect the revenues from the sale of the generated and sold electricity. 11. Quanto tempo valida laggiudicazione della gara? for hoW long time is the aWarding of the tender valid in order to obtain the tariff confirmation? Fra la data di comunicazione dellesito positivo della gara e la data di entrata in esercizio dellimpianto non possono decorre pi di (i) 28 mesi per leolico onshore, (ii) 40 mesi per leolico offshore, (iii) 40 mesi per lidroelettrico, (iv) 40 mesi per il geotermico, (v) 40 mesi per biomasse e biogas e (vi) 28 mesi per i bioliquidi sostenibili. E possibile un ritardo di 24 mesi prima di incorrere nella

decadenza dalla registrazione, che si paga con una penale sulla tariffa incentivante dello 0,5% per ogni mese di ritardo. Between the communication of the awarding and the entry into operation the maximum time gap shall be (i) 28 months for onshore wind, (ii) 40 months for offshore wind, (iii) 40 months for hydro, (iv) 40 months for geothermal, (v) 40 months for biomasses and biogas, and (vi) 28 months for sustainable biofuels. A 24 months delay is allowed before losing the registration, but a 0.5% penalty for each month of delay applies on the applicable tariff. 12. Quali impianti accedono tramite registrazione? Which plants shall go through the booking by means of preregistration? Le seguenti categorie di impianti: (i) impianti nuovi, impianti integralmente ricostruiti, impianti riattivati con potenza non eccedente la soglia di gara, (ii) impianti ibridi con potenza non eccedente la soglia di gara, (iii) impianti oggetto di rifacimento totale o parziale (con taluni limiti specificati nel decreto FER) e (iv) impianti ripotenziati in cui lincremento di potenza non superiore alla soglia di gara. The following categories of plants: (i) new plants, fully re-built ones, and restarted plants with capacities not exceeding the threshold triggering the tender, (ii) hybrid plants with capacities not exceeding the threshold triggering the tender, (iii) partially or totally refitted plants (within certain limits set forth under the FER decree), and (iv) repowered plants for which the capacity gap does not exceed the threshold triggering the tender. 13. Quali sono le potenze disponibili per i registri? Which are capacities available for the registration? Quelli indicati nellAllegato 1. Those indicated in Annex 1. 14. Quanto tempo valida la registrazione al fine di ottenere la concessione delle tariffe incentivanti? for hoW long time is the registration valid in order to obtain the tariff confirmation? Fra la data di comunicazione dellesito positivo della registrazione e la data di entrata in esercizio dellimpianto non possono decorre pi di (i) 16 mesi per leolico onshore, (ii) 22 mesi per leolico offshore, (iii) 28 mesi per lidroelettrico, (iv) 28 mesi per il geotermico, (v) da 22 a 28 mesi per biomasse e biogas, (vi) 16 mesi per i bioliquidi sostenibili, (vii) 36 mesi per maree e moto ondoso. E possibile un ritardo di 12 mesi prima di incorrere nella decadenza dalla registrazione, che si paga con una penale

sulla tariffa incentivante dello 0,5% per ogni mese di ritardo. Dopo la decadenza una nuova ammissione sconta in ogni caso una penale del 15% sulla tariffa concedibile. Quali impianti accedono alle tariffe direttamente una volta entrati in esercizio? Which plants can access the tariffs directly upon entry into operation? Le seguenti categorie di impianti: (i) eolici e a fonte oceanica fino a 60 kW, (ii) gli idroelettrici sino a 50 kW, (iii) idroelettrici sino a 250 kW se realizzati su condotte o canali esistenti senza aumento di portata derivata, che utilizzano acque di restituzione o di scarico, che utilizzano il deflusso minimo vitale al netto della risalita, (iv) a biomassa fino a 200 kW, (v) a biogas fino a 100 kW, (vi) potenziamenti che rientrino nei precedenti punti, (vii) rifacimenti che rientrino nei precedenti punti, (viii) impianti realizzati con procedure di evidenza pubblica da pubbliche amministrazioni che rientrino nei precedenti punti, (ix) impianti di riconversione del settore bieticolo-saccarifero e (x) nuove centrali geotermiche a ridotto impatto ambientale che usano i fluidi geotermici a media ed alta entalpia finalizzati alla sperimentazione, con reiniezione del fluido geotermico, con potenza nominale installata non superiore a 5 MW. of dams excluding the climb-up volumes, (iv) biomasses streams with capacity not exceeding 200 kW, (v) biogas streams with capacity not exceeding 100 kW, (vi) repowered plants that fall within the above categories, (vii) re-built plants that fall within the above categories, (viii) plants subject to public tenders called by public entities that plants that fall within the above categories, (ix) plants for the conversion of the sugar industry, and (x) geothermal with medium and high enthalpy with re-injection up to 5 MW, 17. agli impianti gi in esercizio (Qualificati iafr) che sino ad ora ricevono i certificati verdi saranno pagate le nuove tariffe? Sono suddivisi fra (i) integrale ricostruzione (pu essere riutilizzato un limitato numero di infrastrutture ed opere preesistenti), (ii) rifacimento (per mantenere in piena efficienza produttiva limpianto si interviene su alcuni dei principali macchinari ed totale o parziale a seconda della rilevanza dellintervento) e (iii) potenziamento (viene aumentata la potenza dellimpianto). Solo se il sito era inutilizzato da almeno 5 anni, invece, limpianto considerato nuovo. La riattivazione di un impianto la messa in esercizio di un impianto dismesso da oltre 10 anni. They are grouped as follows (i) full re-building (because only a limited number of pre-existing infrastructures and assets can be reused), (ii) refitting (in order to maintain in full generation efficiency the plant, works are conducted on some of the main equipment and can be total or partial depending on how much the works are relevant ones) and (iii) repowering (only the plants capacity gets increased). Only if no plant was present on the relevant site since at least 5 years, the plant can be qualified as a new one. Restarting a plant means commencing the operation of a plant that was abandoned since more than 10 years.

19. Quali sono le potenze disponibili per i rifacimenti? Which are capacities available for the refitted plants? Quelli indicati nellAllegato 1. Those indicated in Annex 1. 20. che tipo di tariffe prevede il decreto fer? the fer decree provides for What type of tariffs? Per impianti con potenza fino a 1 MW si tratta a scelta del produttore di una tariffa onnicomprensiva (viene pagata e lenergia elettrica prodotta ceduta in propriet al GSE) o del regime applicabile agli impianti con maggior potenza. Per impianti con potenza superiore a 1 MW si tratta di una tariffa premiale (viene pagata per lenergia elettrica prodotta, ma questa non ceduta in propriet al GSE). Per gli impianti ricostruiti, oggetto di riattivazione, oggetto di rifacimento o potenziati la tariffa adattata secondo specifiche regole previste dal decreto FER. For plants with capacity up to 1 MW the tariff is a feed-in one (it is paid on the electricity sold to GSE), but the owner of the plant can request the regime of the bigger plants. For plants with capacity exceeding 1 MW the tariff is a premium one (it is paid on the electricity generated which is not to GSE). The FER decree provides for specific rules for the quantification of the tariff for rebuilt, reactivated, refitted and repowered plants. 21. la percezione delle tariffe incentivanti compatibile col ritiro dedicato da parte del gse dellenergia prodotta? can one couple the application of the tariff With the regulated offtake by gse of the produced electricity?
