HOW CAN I (A FOREIGN NATIONAL) OBTAIN A JUSTICE RECORD/POLICE CLEARANCE/POLICE RECORD FOR THE PERIOD I USED TO LIVE IN VIETNAM?
(The procedure spelled out below is from the Inter-Ministerial Circular 07/1999/TTLT-BTP-BCA issued on 08 February 1999 by the Ministry of Justice and Ministry of Public Security) A foreign national can obtain a Justice Record Certificate by understanding and following the issues and steps detailed below: 1. Who issues the Justice Record/Police Clearance/Police Record? - The Department of Justice of the province in Viet Nam, where the applicant used to live, is the authorized issuing office of a Certificate of Justice Record (also called Police Clearance/Police Record). - A Vietnamese Embassy is not authorized to issue such a Certificate of Justice Record/ Police Clearance/Police Record. - Please note: The Socialist Republic of Viet Nam does not maintain the criminal record of the Republic of South Vietnam which became defunct on 30 April 1975. Therefore, requests for police clearance for periods before April 1975 cannot and will not be met. 2. What to submit? - Completed Application Form (the bilingual application form is attached). - Certified copies of passport and visas. - Certified Power of Attorney (the bilingual form of the Power of Attorney is attached). - Certified copies of Temporary Registration Book or certified copy of Certificate of Temporary Residence issued by the Sub-district Police where the applicant used to reside. - Please note: The applicants are required to submit 2 sets of documents. 3. Who can submit the application? - The person who wants a Certificate of Justice Record must apply in person. - In case of the applicant is a foreign national who has departed Vietnam and entrusting the application to another person, a written Power of Attorney (the bilingual form is attached) must be submitted. The Power of Attorney must be (i) certified by the competent authority of the country where s/he is a citizen of or resides; and (ii) legalized by the Vietnamese Embassy/Consulate in that country. 4. What can the Vietnamese Embassy do to help? The Vietnamese Embassy can: - Certify the photocopies of passports, visas, and other documents; and - Legalize the Power of Attorney after it has been certified by the Department of Foreign Affairs of the country.
