TERMS & CONDITIONS FOR CONTRACT ON HEALTH, SAFETY & ENVIRONMENT . Contractor shall take full responsibility for Heath and safety of his employees 1. during site operations and in accident prevention measures he shall adapt all measures .In case Contractor fails to arrange the same, Engineer In Charge of Tata Power Company Limited shall be entitled to cause them to be provided and recover the cost thereof from the Contractor. Contractor shall follow the following Acts and Rules: a) The Contract Labour (Regulation and Abolition) Act 1970. b) The Building and Other Construction Workers (Regulation of employment and Conditions of service) Act 1996, and its Rules c. c) The Indian Electricity Act 1910 & Rules. d) The Employees State Insurance Act 1884 amended 1985 and Rules. e) The Motor Vehicles Act 1988 f) The Workmans Compensation Act 1923 & Rules. g) The Factories Act 1948 as amended in 1976 & 1987 h) The Industrial Disputes Act 1947 i) The Child labour (Prohibition Regulation) Act 1986 j) The Petroleum Act 1934 & Rules k) The Gas Cylinder Rules 1981 l) Any other Act / Rules applicable to particular place / activity / Operation. Contractor should understand and follow Rules, safe working procedures for waste disposal methods as per OSHAS 18001 and ISO 14 001 Standards. They are also responsible to the observance of these Rules by Sub Contractors.

Prior to start of any construction activity or hazardous operation, Contractor shall submit to the Owner for approval a specific plan for safety precautions covering such operations. ISSUE All accidental occurrence with serious accident potential such as majorR0 equipment failures, contact with high voltage lines, exposure to hazardous materials, slides, cave ins, etc shall be reported.

Contractors are advised that they should understand and follow rules, safe working procedures and waste disposal methods as per OSHAS 18001 AND ISO 14001 standards. In specific, Contractor shall adhere to the Safety Regulations contained in the following ISI Codes

Contractor shall also be responsible for observance / ensuring these terms & conditions by his sub-contractors. 2. Employment Of Skilled Persons:For all activities and operations, Contractor shall employ only trained and skilled persons. Persons holding valid licence, approved by the corresponding law enforcing agency should only perform the following jobs. (a) (b) (c) (d) (e) Blasting. Electrical work on high & low tension lines. LMV & HMV driving. Heavy earth moving equipment operations. Radiography.

Name of employee, age, address, and date of issue of license, validity period of license, issuing agency, length of service with the contractor and years of experience. 3. Pre Employment Medical Check Up:Contractor shall arrange for medical check-up of all his employees before

employment and shall ensure that he employs no person at the site suffering with any of the following diseases. Epilepsy. Colour blindness. Noise induced hearing loss. Deafness / Audiometry test. Chest X-ray and Spirometry test.

Vision and Hearing test of the employees in the following category shall be examined every six months. Crane, winch. other Lifting Machine Operators. LMV / HMV and other transport Vehicle Drivers. Heavy Earth Moving Equipment Operators.

Record of such medical check-up shall be maintained and made available by Contractor for inspection at site. 4. Safety and Safety Organisation Contractor shall inform his employees about the hidden and visible hazards associated with their jobs. Such information shall be passed by toolbox meetings, class room training, notice board display or through writing on Work permit system etc., in a language understood by his employees. Contractor shall also provide regular training to his employees regarding safe working procedures to be followed at site.

Nomination Of Safety Supervisor, Safety Stewards & Safety Committee Members:. A Rescue Team shall be constituted at Project level Trained personnel Contractor shall appoint a full time Safety Officer / Supervisor, if contact Value is more than rupees 2 crores or the number of workmen at site, exceeds 500, to ensure that his workmen are working safely. See Article 3 & 3.1 under Technical Specifications, Volume IV of these documents. Safety patroller/ safety steward may also be appointed to help/assist the safety officer if strength of employees is more. Contractor shall ensure that at site, Safety Mass meeting shall be held at least once in a week, preferably in the first day of each week. Names of Safety Committee members & Safety Stewards shall be displayed on general notice boards. Contractor shall also display minutes of Safety Committee meetings on general notice boards. Within a month of Award of work, Contractor shall inform Owner full details of his Safety Organisation that would be fully positioned at site at all times with functions / responsibilities of each member. 5. Employment Of Women & Adolescent:Contractor shall not employ any person below the age of 16 years in any operation, and any adolescent male or women in dangerous and hazardous operations like: Shot blasting. Spray painting with lead based paint. Scraping of surface painting with lead based paint. Working inside the confined spaces. Working at heights. to handle all emergency rescue operations all along the project duration period. This shall consist of duly Qualified and

Contractor shall ensure that his employees do not enter the site /work under influence of any drug /alcohol or other intoxicant. If any such incident will be reported, the person under influence of drug or alcohol or intoxicant shall be immediately removed from the site and Contractor shall be penalised for the same. 7 Personal Protective Equipment ( P P E ):Contractor shall ensure that the following PPE shall be available at all time and shall be used by his employees with no exception whatsoever. a) b) c) All employees at site Workers mixing asphalt , cement , lime / concrete Welders / Grinders Safety helmet & safety shoes with steel toe cap. PPE shall be confirming to BIS/DGMS/DIN specifications, in good condition and shall be comfortable to his employees, when used. Contractor shall arrange all above PPE well in advance with test certificate and maintain a record of distribution with signature of receivers. In case contractor fails to provide the above minimum required PPE, Site Manager shall be entitled to provide the same & recover the cost 1.5 times thereof from contractor, as penalty

House Keeping:i) ii) Contractor shall ensure upkeep and house- keeping at the site and all his work places. All waste material e.g. derbies, packing wood, scrap, earth, muck etc. Shall be removed iii) from and around the work area and disposed off to the designated place at the end of each day before leaving the worksite. Receptacles shall be provided to store different in-coming construction material like sand, gravel etc. Similarly bins shall be provided for different waste and scrape items. iv) v) vi) Spillage of oil /grease /water shall be avoided. In case of any such spillage contractor shall insure immediate cleaning of area to avoid any accident / Fire. Vehicle / Bicycles shall be kept at designated place/s and not in the area of work Safety Slogans / safety Instructions boards and Poster shall be displayed at prominent locations in Hindi, English and Local language.

Lighting & Ventilation:i) For safety of employees and quality of work, contractor should ensure that good lighting arrangements are made at all his work sites and in the area of operations. ii) Emergency lights shall be arranged at appropriate places e.g. electrical panel rooms, staircases, floors, DG rooms etc. for illumination in case of power failure. iii) Good ventilation arrangements shall be made at the places where heat and dust is potential hazard and natural circulation of air is low e.g. pits, sumps and other confined places. Amount of fresh air at each 200 m of tunnel progress shall be checked and also the air tightness of joints and leak of air in ducts of contaminated air. v) If volume of fresh air is not found sufficient or not of required quality, the whole duct system shall be pressure and volume testes in portions not exceeding a few hundred meters. Such stations shall be located not closer than 10 times the duct diameter from any fan or other flow substance within the duct. 10. First Aid:i) ii) iii) iv) v) vi) vii) Contractor shall arrange for necessary firstaid equipment before \ checked for damages and these controlled. Intermediate fans shall be provided a long the main duct line to ensure removal

Stretchers shall be arranged and kept at prominent locations for immediate use in case of an accident All electrical panel rooms and First aid center should have artificial resuscitators to use in emergency. Project Manager will decide regarding the place and time to provide a First Aid center with trained male nurse and ambulance van All contents of first aid box shall be kept in hygienic condition with date of expiry mentioned over it. At-least one in twenty-five of his employees shall be trained in first aid. A list of first aid-trained employees shall be displayed at prominent places of his area of work / office 11. Fire Fighting:i) ii) Contractor shall arrange necessary system for fire fighting as per instructions of Project Manager or his representatives. Portable fire fighting equipment (Extinguishers), adequate in number, s h a l l be kept near electrical panel rooms for Class C fire. ISSUE R0

Extinguisher for class B shall be kept near storage of inflammable materials, auto garage and workshop etc. If contractors activities require in the opinion of Project Manager, Contractor shall arrange for a Fire Tender. Employees of Contractors shall be trained in fire fighting and a list of such trained persons and fire fighting equipment available at site should be displayed at prominent location.

VI)

Fire fighting equipment shall be of the gas, dry powder or other suitable chemical or pumped water type. Number to be decided by Owner.

Traffic Safety: i) It shall be insured by Contractor that for any class of vehicle Operators / Drivers employed by him, are competent, experienced and holding valid driving license under the Motor Vehicle Act, 1988. ii) iii) It shall also be ensured by Contractor that all his vehicles, are complying with the requirements of motor Vehicle act, 1988 and rules made therein Contractor shall produce original copy of following documents before deploying any vehicle at site. a) b) c) d) iv) Driving license issued by Regional Transport Authority to operator. Registration book of vehicle Fitness certificate of vehicle Certificate showing PUC (Pollution under Control).

All LMV, LCV, HMV and Heavy Earth Moving Equipment shall be with reverse horn, headlights, and taillights and back view mirrors. Contractor should ensure that all his vehicles are in sound working condition.

v) vi)

Drivers of Tippers, trucks, trailers and other transport equipment shall manoeuvre the equipment under the direction of helper/ signallers. Roads subject to interference by work shall be kept open or suitable detours shall be provided by Contractor who shall erect and maintain barricades, signal lights, danger signals and flagmen at suitable intervals . He shall obtain all necessary approvals prior commencement of work in such stretches. At locations required, he shall carry out the work during hours as directed by Project Manager. He shall promptly back fill on the pavements and crossings as demanded. It should be insured by contractor that vehicles shall not cross the safe speed limit and comply with all traffic signs. Unauthorized person rides the Tipper, Trucks, and Trailers and transport equipment. Truck and other equipment shall not be loaded beyond their safe carrying capacity declared by the Law Enforcing Agency or Manufacturer. All vehicles shall be got regularly checked as per Law Enforcing Agency of State

Hoist , Lift , Lifting Machines , Lifting Tools & Tackles :i) Contractor s h a l l e nsure that all-lifting machine, tools & tackles (wire

ropes/rope slings, chain slings, D-shackles / pulley blocks) shall be in good working condition. If any lifting machines, tackles or appliances will be found unsafe, poorly maintained or unsuitable for work, contractor will ensure immediate replacement of such equipment. ii) A Competent Person under the factories Act / The Building and Other Construction works Act 1995 shall check all lifting machines, Lifting tackles, hoists and lifts before putting in to use at site and once in every 12 months after that. Certificates of all such inspection / testing shall be maintained by contractor. iii) iv) A competent person shall check all mobile cranes once in six months and issue a certificate with identification no. and Safe Working Load (SWL). A responsible person shall check all lifting machines and Lifting tackles (Wire rope and Wire rope slings, Chain slings, Pulleys, Chain pulley blocks, Dshackles, Cranes, winches etc.) once in a month as per the checklist. v) vi) Any of the crane lifts, lifting machines, lifting tools and tackles shall not be allowed to lift any load more than SWL. Any crane, if so constructed that the safe working load may be varied by raising or lowering of Jib or Boom, shall be provided with automatic safe working load Indicator. vii) Contractor should ensure that no person should ride on a suspended load or on any lifting appliances. Similarly no person shall stand, sit or perform any work under any hoisted load. viii) It is to be ensured that receptacle used for hoisting material is suitably enclosed to prevent the fall of such. 14 Storage Of Goods & Materials :-

Contractor should ensure that no material should be stacked by the sides of walls of stores. A minimum distance of 1 meter from the wall shall be maintained

ii) iii)

Pipes, oil barrels, drums shall not be placed one over other. Inflammable material shall not be stored near the place of hot work (e.g. gas cutting / welding area) or in direct sun light.

iv)

Gas cylinders of Acetylene, Oxygen, LPG etc. shall be stored in well ventilated place and direct sun-light shall not be allowed over filled gas cylinders.

v)

Uses of industrial LPG cylinder with BIS approved valves will only be allowed at site.

vi)

Proper care as specified in respective Material Safety Data Sheet shall be taken in storage of corrosive chemical / oxidising substances / radioactive material and other hazardous chemicals.

Safe & Proper Tool / Tackles & Equipment :i) Contractor shall provide and ensure that their employees are using only safe, correct and appropriate tools for the work (e.g. not be used). ii) If work is to carry out in a flammable gas zone, non-sparking tools shall be used. Chisel with mushroomed head, hammers with broken shaft, wrenches / spanner with broken jaw shall

Welding & Gas Cutting :a) b) c) For all welding work at site only Generator sets shall be used instead of AC Transformers. Welding sets shall be got certified from Project Manager once in three months. copy of the certificate should be displayed on respective welding set. Welding cables of good insulation condition and Insulated holders should be only be allowed to use .The length of supply cable should not exceed 8 Meter and the welding set body should be properly earthed. Use of building structure, Pipelines, Railway tracks, steel angles and rounds etc. will not be allowed to use as return path of welding current (Welding earth)

Only qualified welders should be employed by C ontractor to work at site Contractor shall provide ample ventilation, good eye protecting screen, leather hand gloves, safety shoes and apron to all his welders. Cylinder safety caps should be provided at each Gas Cylinder.

g) h)

The KEY to operate the cylinder valve should always be kept on cylinder only. Operators will not be allowed to carry it along with them. Welding and gas cutting inside confined spaces shall be done with great care. Forced ventilation shall be arranged and a competent person shall check the oxygen percentage before entry of employee in confined space.

i) j) k)

Gas cylinders shall always be kept outside the confined spaces. Dissolved Acetylene hoses shall be checked after every 15 days to insure that they are free from any cracks / cuts or leakage. Gas Welder / Cutter should be provided with friction gas lighter to ignite the Cutting/welding Torch. In any circumstance match-stick or smouldering Cotton/ Rope will not be allowed to use for this purpose.

A CO2 type Fire extinguishers should be carried with each welding set. Asbestos blankets / sheets shall be used to catch hot metal particles below welding jobs. Gunny bags shall not be allowed for this purpose.

Operating of Cranes and Piling Equipments Contractor should ensure that a) Cranes, Pile Driving equipment, tripod and winch s h o u l d b e firmly supported on heavy timber sill, concrete bed or other secured foundation. Legs of tripod should be properly spiked in ground to avoid its slipping. b) c) d) Pile Driver, tripod other equipment are away from un-insulated live electrical conductor and other electrical installation. Adequate precautions are taken to prevent overturning of pile drive. All precautions are taken to prevent the hammer from missing the pile.

Competent person should inspect Winch, Pulley, Wire ropes, D- Shackles, Chain Pulley Blocks, Slings, Driving Equipment etc before taken in to use. Failure of pulley due to due to shearing of pin or bolt is common, hence the operator should check all the above equipment daily. A checklist is enclosed as Annexure 18 for the above purpose

f)

Stability of near by Building / Plant / Penstock shall not get affected. If required adjacent structure should be supported by underpinning, shoring, bracing, sheet pilling or any other means.

g) h)

All employees engaged shall use Safety shoe, Helmet, Leather hand gloves, earmuffs and tight fitting clothes while on job. The casing should be kept constantly moving to avoid Jamming. Sometimes, when these casing get jammed and the process of extraction creates extra load on the tripod resulting collapsing of the Tripod.

18.

Excavation :Contractor shall take following precautions during excavation work: a) Before starting work ensure with client / appropriate drawings / authorities etc. that no underground live electrical cable, chemical and / water pipelines are passing through the area of excavation. Permit to work for excavation etc.) b) Excavated material /other construction material shall not be kept within 1.5 meter of the edge of trench or half the depth of trench. . All utility services such as electrical lines, chemical, steam, water and air pipelines, telephone connections etc. are disconnected or capped. Safety tags are provided and permit to work is obtained from the owner.

Fragile material (Asbestos roof sheet / Glass panes etc.) are removed. The area is cordoned off, proper warning signs are provided and movements of people and vehicle are redesigned. Suitable catch platform and curtains are provided, if demolition is of an exterior masonry wall or roof of more than 10-meter height. Except designated entry / exit, all other vertical and horizontal opening are blocked off, to avoid danger from falling material. If work is to continue for more than a shift proper illumination is arranged and red warning lights are provided on barricades.

It shall also be ensured that i) ii) Debris, heavy steel structures and other loads shall not be accumulated on any floor or wall as demolition changes the loading designs. When demolishing a structure from the top-down, the structural and load supporting members at the lower level shall not be cut or removed until all the structures above have been demolished and removed. iii) No wall or structure shall be left standing overnight, if its stability is in doubt. In such cases demolition shall continue to the nearest structural cross member or temporary shoring should be erected. iv) Debris / bricks/ scrap should be dropped through chutes, or by collecting in to bags / buckets and lowering them through ropes / hoist. Direct dropping of waste / scrap / debris from height on ground is not approved. v) vi) Openings needed for debris removal shall be blocked, when not in use. Debris shall be transported from the site of demolition to the designated place for disposal as early as possible.

Proper steel staging / scaffold or platform is erected. Proper staircase or ladder is provided to access the height. The erected structure is strong enough to sustain the load of employees along with tools and tackles. Only experienced and physically fit employees are engaged. Protection Against Toxic Chemicals /Gases / Dust : -

i)

Contractor shall take all preventative measures to protect his employees from toxic chemicals/fumes /gases etc. Wrong use of chemical hazardous to health (e.g. Carbon tetra chloride by electricians and use of diesel for hand cleaning by technicians) shall not be permitted. Safe alternatives for such chemicals shall be used.

ii)

Dust should be a l w a y s b e controlled with water. Similarly during dry seasons, water should be sprayed on road and work area for dust control.

Proper respiratory personal equipment should be provided to spray painters, shot blasters, gas cutters / welders to protect from toxic gases, chemicals and dust. 26.

Painting : -

Contractor shall ensure that: -

Men below the age of 18 years and women are not employed do to any spray painting job with lead based paints. Male workers with proper PPE shall only do this job. Scrapping of surfaces coated with lead based paint shall also be done only by audit male workers after wearing proper PPE.

While working /painting on electrical poles, safety belt/safety net and cage shall be used. Before painting on any electrical installation/pole, contractor shall ensure that electrical supply is switched off and proper Permit to Work is taken.

Radiation Hazard : -

Contractor should take permission before organising any radiography test. Only competent persons shall be employed for the use of radioactive source for inspection and testing. Such persons shall use dosimeter and radiation dose/exposure shall be counted.

Medical Aid / Compensation To Injured :

Tata Power Company Limited shall not be held responsible for any accident or damage incurred or claims arising there from during the period of work under your supervision. Contractor shall arrange for all medical help and assistance for his injured employees. Contractor shall arrange for compensation to be paid to the injured / his family members as per the Workmens Compensation Act 1923 or as per the E.S.I. 1948 for temporary, partial permanent disablement or in case of death. 31.

Penalty :-

If Contractor or his sub-contractor breaches stipulated and agreed terms in respect of conditions on health, safety and environment, it shall constitute sufficient cause to penalise /punish under this clause. Site Manager of Tata Power Company Limited shall be entitled in such cases to penalise Contractor with a minimum fine of Rs. 1000/- per violation (contravention).
