TO THE HONORABLE MEREDITH A. JURY, UNITED STATES BANKRUPTCY COURT JUDGE, THE OFFICE OF THE UNITED STATES TRUSTEE AND ALL INTERESTED PARTIES: San Bernardino Public Employees Association (SBPEA) is an incorporated labor association, formed and existing under the laws of the State of California, and is the exclusive representative of City of San Bernardino (the City) employees within the Mid-Management Unit for the purpose of bargaining, pursuant to the Meyers-Milias-Brown Act, Government Code 3500, et seq. By and through its undersigned counsel, party-in-interest SBPEA hereby submits this Joinder to the National Public Finance Guarantee Corporations (National) Motion to Permit Discovery of Debtor with Respect to Eligibility, Docket Nos. 148 and 149. For the reasons set forth in the Motion to Permit Discovery of Debtor with Respect to Eligibility, party-in-interest SBPEA urges the Court to direct the City of San Bernardino (City) to: (1) produce the documents requested in Nationals First Request for Production of Documents, attached to its Motion as Exhibit A; and (2) provide testimony pursuant to Nationals Notice of Deposition pursuant to F.R.C.P. 30(b)(6), attached to its Motion as Exhibit B, because such discovery is permissible and necessary to determine whether the City has met the eligibility requirements to file for bankruptcy under chapter 9 of the Bankruptcy Code.
