The Maine Republic Free State Alliance Trust

The Maine Republic Free State is an alliance of conscientious patriotic Mainers devoted to working together as a modern day posse comitatus type group. Posse Comitatus means, literally, Power of the County. It means that the primary enforcers of our Constitutionally protected, Sovereign Rights and Immunities should be our elected county officials, including the county sheriff. The term refers to a sheriffs common-law authority to arrange citizens into a posse in order to enforce the laws. The term appeared in English law in the 1400s after a riot that took place. Posse comitatus does not have the same connotation as vigilante or armed mob. The Posse Comitatus Act does not authorize posse comitatus, it simply describes the very limited parameters within which the federal government supposedly with permission from the State Governor may ignore the power of the county to govern its own affairs. While posse comitatus in England referred to the grant of police powers to civilians, posse comitatus in America refers to preventing the military enforcement of civilian laws. This prejudice against the military is rooted in our experience during Colonial times. In the Declaration of Independence, Jefferson expressly cited the use of the British military in America as one of the colonists central grievances: He [the king] has kept among us, in times of peace, standing militaries without the consent of our legislatures. He has affected to render the military independent of and superior to the civil power. Once the United States was formed, Americans were determined to protect themselves from an overbearing federal government. The Constitution mandates civilian control of the military, with the elected president serving as commander-in-chief. Prior to the Posse Comitatus Act, or PCA, soldiers who took on a policing role were usually average citizens, not professional soldiers. Civilian rights were protected by the so-called Mansfield Doctrine, which gave citizens the right to sue or criminally prosecute those who abused their power as members of a posse. Congress approved Lincolns suspension of habeas corpus (after the fact) and barred the Supreme Court from challenging the suspension of the writ. This was done in an effort to keep Confederate rebels from lawfully using the Constitution against the Union. After the Civil War, in the period known as Reconstruction, federal laws were enacted further restricting the rights of the now defeated rebels. The military was sent to the Southern states in order to perform policing duties. The act states, Whoever, except in cases and under such circumstances expressly authorized by the Constitution or by an Act of Congress, willfully uses any part of the Army as a posse comitatus or otherwise to execute laws shall be fined no more that $10,000 or be imprisoned not more than two years, or both. The act was passed in 1878. Other interests of The Maine Republic Free State include the following purposes and goals:

 Land title reform, because we did not actually become the owner of the property when we agreed to pay for the privilege of living on it. We therefore need to become the true owner; Relief for the distressed; Grand Jural activities, functions and considerations; Court support group, because we would never allow a sovereign to be alone when facing a government court. Research and education. A vital part of our interests include locating new members of our society of brother and friends. We seek to build our numbers and influence in our communities until we reach a point where we have community-wide support for

common law juries and courts. What good is the 7th Amendment unless we have common law juries and courts to protect the citizens in our local communities? Becoming part of such a group is merely exercising our right to be secure in our person, property, and papers, to peacefully assemble, and to carry armaments at the same time. Such a group does not meet to promote violence. We meet to promote peace and security in our counties. We are available to our county sheriff to aid him in keeping the peace. The Constitution is a solemn contract between We the People of the united States and the federal government. As a contract, it is enforceable in the courts pursuant to the statutes of fraud.

As a contract, it is to be most liberally construed in favor of a party who is non-signatory to the contract. We did not sign the contract; we are the beneficiaries. Since there are no signers of the Constitution now living, what must make the Constitution effective today are the Oaths taken by our public servants to uphold it. If an elected official refuses to perform the sworn duties of his office, and allows criminal violations of human rights to take place, it is within the duties and power of the citizens of the county to remove that elected office holder from office, and cause him to stand trial in a common law court for felony breach of Oath. Such an action is lawful within American common law, and Biblical social law.
