On 08/04/2012, at approximately 0158 hours, , Officer Jason Lopez, was traveling northbound in the #2
northbound lane of Broadway Street, in the City and County of Boulder, State of Colorado, in marked patrol
vehicle #1845, en route to assist Officer Brad Kithcart with a traffic investigation. As approached the intersection
of Broadway Street and Pennsylvania Avenue, was flagged down by the unidentified female driver of an
unidentified yellow school-type bus. The driver of the bus stated she had observed a passenger in a silver sedan
bearing California license plates wave a gun at a vehicle in the lane next to it. Both vehicles were traveling
northbound on Broadway Street and still in view. accelarated and evetentually closed the distance between
myself and the two aforementioned vehicles. n the area of Broadway Street and Canyon Boulevard, obsevered
a silver Audi A6, bearing California license plate 4HBA098, stopped in the #2 northbound lane of Broadway
Street. This vehicle matched the description provided by the bus driver. mmediately abeam the Audi A6, in the
#1 northbound lane of Broadway Street was green BMW X6, bearing Colorado license plate 331CRV.

Narrative
Based on the report of a weapon inside the silver Audi A6, initiated a traffic stop of the vehicle in the area
Broadway Street and Walnut Street by activating the overhead emergency lights of my marked patrol vehicle as
the vehicle began to negotiate a right turn to eastbound Walnut Street. Additionally, simultaneously aired the
information regarding the report of a firearm inside the vehicle and requested an additional officer to assist.
Officer Richard Smith was initially dispatched to assist and responded emergency. The following officers and
sergeants also eventually responded to provide additional assistance and supervision:

The silver Audi A6 came to a stop in an angled parking space on the north side of Walnut Street, just east of
Broadway Street. The green BMW X5 came to a stop in an angled parking space immediately west of the silver
Audi A6. The occupants of both vehicles immediately became verbally antogonistic with Ofc. J. Smyly, R. Smith,
and me. n response to the report of a firearm in the vehicle, Ofcs. J. Smyly, R. Smith and coordinated a felony
hot stop of the vehicle. Using loud verbal commands we directed the occupants of the vehicle to exit in the
following order:
1)Driver - Canty Keenan Anthony (DOB - 10/07/92)
2)Rear left passenger - Jeffery Calvin Thomas (DOB - 02/07/94)
3)Rear center passenger - Moses E. Vigo (DOB - 07/18/94)
4)Rear right passenger - Jermane Darnell Clark (DOB - 07/13/91)
5)Front right passenger - Bell Jared Richmond (DOB - 01/19/92)
Ofc. J. Smyly covered each of the aforementioned occupants at gunpoint as they followed loud verbal commands
to exit the vehicle. As each occupant exited the vehicle, placed them into custody and directed them to Ofcs. A.
Flynn and A. Kunz on the south curb of Walnut Street. While Ofc. A. Flynn was in contact with Clark, she advised
him the reason for the stop and commands for the occupants to exit the vehicle. Ofc. A. Flynn's interview of Clark
went as follows:
Clark: "What's going on?
Ofc. A. Flynn : We received information that there's a gun in the car."
Clark: "Oh."
Ofc. A. Flynn: "s there a gun in the car?"
Clark: "Yeah, but it's a b-b gun."
Ofc. A. Flynn: "Where is it?"
Clark: "On the passenger side on the floor."
Based on this information, conducted a search of the vehicle and located a black AirSoft pistol labeled and
fashioned as a Walther CP99 on floor of the rear right passenger area. This device is CO2 powered pistol
designed to discharge 4.5mm plastic munitions and has the appearance of an authentic Walther P99 firearm.
Once in custody, the occupants of the silver Audi A6 became compliant and cooperative throughout the remainder
of the contact and associated field interviews with Ofcs. J. Moore, A. Flynn and .
However, occupants of the green BMW X5 were verbally antagonistic with Ofcs. J. Smyly, B. Scott and R. Smith.
Specifically, Davaughn Angelo Thornton directed the following statements to Ofc. J. Smyly:
"Go ahead! Shoot me motherfucker!"
"My dad's a sheriff!"
" can go wherever the fuck want!"
"This is Boulder and you have your guns out?!"

All occupants of the silver Audi A6 stated they were friends of and/or related to the occupants of the green BMW
X5, and that they were just playing around as they drove side by side displaying the Walther firearm replica.
All occupants of the BMW X5 confirmed they were friends with and/or related to all the occupants of the silver
Audi A6 and, as such, they never felt threatened by the display of the AirSoft firearm replica.
Ofc. B. Graff made the AirSoft firearm replica safe by partially disassembeling it. placed it into a paper bag and
returned it Clark.
Ofc. R. Smith's patrol vehicle (#3504) was equipped with an in-car video recording system, which documented this
contact from beginning from the time Ofc. R. Smith initiated his emergency response to my location and ending
upon his clearance from the incident.
As a result of this incident, Ofc. B. Kithcart had to wait an additional eight minutes for Officer Matthew Fitzgerald to
arrive, as my replacement, at his location to assist in a DU investigation. While Ofc. B. Kithcart waited for Ofc.
M. Fitzgerald, the vehicle he had stopped was occupied by three subjects, including the driver, who was
subsequently arrrested for suspicion of DU (BPD CR 12-10432).
With the exception of Moses Vigo, all of the occupants of both vehicles are C.U. Boulder athletes (football and
baseball). Sgt. J. Byfield will meet with the C.U. Boulder Athletic Director to discuss the conduct of the athletes
and the impact their behavior had on police services throughout the entire city at the time of the incident.
