making this most recent FOI request, was to receive such information so
that I can inform Council and/or the Fairness Monitor regarding the

factor which helped the company pre-qualify (if that factor can be
ascertained from the public information already released to the Toronto Star).

This is a fairness issue, and the Vellore Village Complex bid is the
most significant bid to pre-date the new City

Hall. I only ask these

questions, because they remain unanswered despite so many requests to

you.

Unfortunately, I have not received the information within the 30 days

following my FOI request. I was told that the City Clerk could not have
answered the FOI request within the 30 days, because of the exceptional

responsibilities in the election. The City is requesting an additional


30 days to answer the question (and hopefully provide the information), but that would place us after a December 18, 2006 Council vote for the award for the new City Hall.

Request for Action from You:

Mr. DeAngelis, can you intervene to insure that what was already deemed
public (in having released the information to the Toronto Star) will be
released to me as well, before Council votes for the award for the new

City Hall.

Also, can you tell me how I can meet directly with the Fairness Monitor
to explain everything herein, and to explain specific concerns I have

have not acknowledged that the company had not completed a $30 million

project. The fact that the company had not completed a $30 million
project by the time it was pre-qualified for the Vellore Village Complex bid, was confirmed to me in an FOI request I made to the City (in the partial documents released to me by the City).

Given that having completed a $30 million project was a significant factor for pre-qualification, I have been (as a follow-up to the previous question) asking you for several months to explain the factor that helped this company pre-qualiff to bid for the Vellore Village

Complex. For example, could a factor have been that a person in a


senior management role at the City, and also in a senior role in bidding in that instance, act as a reference for Maystar and given Maystar a

high score (which, in my opinion, may have been a conflict for a senior
manager to have acted in such a dual role). You have not answered that question.

In the absence of a response from you, I have made a formal FOI request simply to receive what is already public regarding the Vellore Village Complex bid. According to the Information and Privacy Commissioner's
website, the Toronto Star was involved in a2-year case with the City

for that information. According to the website, the City was forced to
release information to the Toronto Star.

I merely asked to receive what the Toronto Star received, on the premise
that the information is already deemed public and on the premise ihat,

having already been noted, the information would be easy for the City to

organize. I clearly stated to you in writing that my intention, in

A Special Committee of the Whole Meeting is scheduled for +l:00 p.m.


Monday December 18, 2006 to deal with the award of the tender for the

New City Hall. Mr. Cory, the Fairness Monitor, will be at that meeting.

Dear Mr. DeAngelis, City Manager:

For more than a year now, on several occasions, I have been asking you to confirm that Maystar General Contractors Inc., which won the contract

forthe Vellore Village Complex, had not completed

a $30 million public

project by the time it was pre-qualified to bid for that contract.

You have not, in a satisfactory way to me, answered that question. You

But you had not addressed the FOI request referred to below.

It is very important for me to receive the FOI request before Monday's meeting, so that I can share with Mr. Cory what I presume to be there (in determining a major factor, or the factor itself, that helped a company which had not completed a $30 million project pre-qualify for the Vellore Village Complex bid).

I will be visiting the Clerk's Office tomorrow (Friday, December 15,2006) between 4 4:30 pm, or Monday (December 18, 2006) between 9 9:30 am, to receive my copy of what is already public, pursuant to my FOI request. It is difficult to believe that the City could not comply by tomorrow afternoon, to provide me a copy of what it has on record in providing another parly.

By the way, have you told the Mayor and members of Council the name of the person who is alleged, under
oath by a person in the City's management, to have used duress or the equivalent to get that person under oath to alter Fleet Department invoices, and have you told the Mayor and members of Council whether this same person (who is alleged to have used duress or its equivalent) had a significant role in the City Hall

s copy of the accident report was given to Clayton Harris so that he could fill out the required information. The vehicle was taken to the Body Shop at Woodland Chev Olds, 2 Auto Park Circle, Woodbridge, 905-8501000, Attention: Derek I will inquire if Clayton has a copy of the police report. At the moment Clayton has the use of a 2003 Chevrolet Cavalier, at no charge to the City, however he has inquired about the availabiltiy of the Buick LeSabre. Please advise.

I have a copy of the estimate from Woodlands, would you like me to fax you a copy?
