Theodore Segerstrom was sued by his ex wife Euna Segerstrom for wrongful death of their child Corinne Segerstrom. The couple was divorced at the time of death. During a visitation, Theodore put the 7-year old chile atop an eight-ton bean thrasher for a photo event. She was apparently left unattended and fell, instantly being crushed by the machine.
In this Court of Appeal ruling, the dissenting opinion stated that had the jury been given the proper negligence per se instructions, the jury would have likely awarded damages against Theodore Segerstrom.
