    Dana Capro, a high school computer teacher, witnessed two students, Thomas Morton and J.D. Morton, attempting to steal a new $1500 computer from the school's computer room on September 15th at 8PM. Mr. Capro saw the two students carrying the computer out of the room looking scared with another student acting as a lookout. The teacher did not give them permission to remove the computer from school grounds, and he believes they would have successfully stolen it if he did not return to lock the computer room that night.

    Dana Capro: I am a high school teacher. Lawyer: Where do you teach? Dana Capro: Mountaintop High School. Lawyer: What subject do you teach, Mr. Capro? Dana Capro: I teach computer classes. Lawyer: Do you teach in a specific room? Dana Capro: Yes, I do, in the computer room. Lawyer: Has this computer room gotten any upgrades lately? Dana Capro: Yes, it did; a Multitech 700 computer was purchased by the school last week for this room. Lawyer: How much did this new computer cost? Dana Capro: $1500 Lawyer: Who did you see carrying this $1500 dollar computer out of the computer room on the night of September 15th at approximately 8PM? Dana Capro: I saw Thomas Morton and J.D. Morton. Lawyer: Are these two people youve just named students who go to Mountaintop? Dana Capro: Yes they are. Lawyer: Did it seem like they were attempting to steal the computer? Dana Capro: Yes it did. Lawyer: What actions of theirs reinforced this thought? Dana Capro: The two of them were carrying out the computer looking all scared and they even had a friend who acted as the lookout. Lawyer: Have they asked for permission to remove this computer off of school premises? Dana Capro: Not that I know of. Lawyer: Would you say that they would have successfully stolen the computer if you didnt go back to lock the room that night? Dana Capro: Yes, they probably would have successfully stolen the computer. Lawyer: Thank you, your honor. I have no further questions.
