5. Powersof the RecruitingAuthority

The powers of the RecruitingAuthority in the matter of awardingany oi lhe


penaltiesspecifiedin Rule9 may be exercisedby an authoritywhich hasbeen shown
in the 5cheduleannexedto theserulesor by any other authorityemPoweredin this
behalfby a specialorder of the Head of the circle or the Head of the ReSionunder

9. Nature of penalties

10. Procedurefor imposing a penalty.-

the RecruitingAuthority or EnquiryOfficer.if any. apPointedin a cate
where a tbrmal enquirYis necessary:
(v) the representation,if any, of the Sevakon the lnquiry Officer'sreport;
(vi) findingsof the Recruiting Authorityin respectof the allegations' with
reasonstherefor;and
(vii.1 the orderimposingthe penalty.

l0-A. Procedurefor imposingpenaltyafterdischarge

(1) The departnentalproceedings underrule 1O'if innitutedwhile a Sevakwas in


serviceshallafter the dischargeof the Sevakon attaininSthe age of sixtyfive
yearsbe deemedto be proceedings underthat rule and shallbe continuedand
concludedby the authorityby which the ProceedinSs were commencedin the
samemanneras if the Sevakhad continuedin serviceand in suchcaJethe
functionof the disciplinaryauthorityshallbe only to reacha findingon the
charges and io submita reportrecordingits findingsto the President and the_
on suchreportshallbe takenin the samemannerasin the caseof
final-decision
review petitionsof the Sevaksaddressed and no departmental

(3) For the purposeof this rule, departmentalproceedings shallbe deemedto be_

Sevakhad beenput off duty' on the date on which he had beenso put off'
