LPD CASE # 05-195140 IN THE NAME AND . iY THE AUTHORITY OF THE STATE OF TEXAS BEFORE ME, the undersigned authority, on this day personally appeared Detective Jamie Jinkinswho after being by me duly sworn on oath deposes and says: that heretofore, to-wit on or about the 17" day of August A.D, 2008 and before the making and filing of this Complaint, in the County of Angelina and State of Texas, Brian Martin Womaek did then and here unlawfully commit the offense of Capital Murder P.C. 19.03 (Capital Felony). I Detective Jamie Jinkins a Peace Officer in the County of Angelina, Texas, do solemnly swear that I have good reason to believe and I do believe that Brian Martin Womack hereinafter called defendant, on or about the 17 day of August A.D. 2008, in Angelina County, Texas did thon and there commit the offense of Capital Murder P.C, 19.03 (Capital Felony) to wit: I, Detective Jamie Jinkins, a certified Peace Officer employed by the Lufkin Police Department, responded te an aggravated robbery call in which it was reported that two victims had been shot, [ responded to the scene along with other Officers to conduct. an investigation. ‘Also participating in the investigation was Ron Stubblefield a Certified Peace Officer employed by the Lufkin Police Department. Detective Stubblefield talked to Katherine Lynn Jeffreys and she related the following information. On August 17, 2008 at approximately 10:30pm Katherine Lynn Jeffreys was completing her shift closing down Catfish King located at 806 S. Medford Dr. Katherine exited the business with Keith Edward Labrozzi II, who was present to pick Katherine up from work. As they walked from the business toward their Chevrolet Tahoe vehicle, Katherine, who was carrying the night deposit from Catfish King, observed a male suspect running towards her from the wood line at the back corner of the property. She heard the suspect yell something, but she did not understand what he said. Katherine saw that the suspect was carrying a handgun in his hand, which he fired at her striking her in ankle. Gunfire was then exchanged between Keith Edward Labrozzi II, a concealed carry license holder, and the suspect. The suspect and the victim, Keith, shot multiple rounds from semi-wuto handguns Keith was struck by multiple shots fired by the suspect. As evident by wet blood located near the suspect's firearm, a shot, or shots, fired by Keith was able to hit the suspect. Shortly after the call was received Officers located a male suspect on Ford Chapel Road between Loop 287 and Renfro Dr. in the ditch, which is the same direction from which the suspect original came. The location where the suspect was found is near that of 806 S, Modford Dr., the address of Catfish King. I would estimate the suspect was laying approximately 170 yards from the scene of the robbery. The suspect had been shot. The male suspect was identified as Brian Martin Womack. Clothing and other items, matching the description given by Katherine Jeffreys of the clothing worn by the suspect, were recovered near where the suspect was laying. A description of the suspect given by Katherine Lynn Jeffreys to Detective Stubblefield matched that of Brian Martin Womack. Keith Edward Labrozzi II was transported to Memorial Hospital where he was pronounced dead at 11:05pm. Hospital Personal related to me he died from gunshot wounds he received in this offense.
