Ltd. acting as ts Registrar and Transfer Agent (hereinafter referred to ‘as "Registiar") offers the faciity of e SBIMF Personal Identification Number (hereinafter referred to as “SBIMF PIN") for the ‘convenience ofits UnitHolders: AND WHEREAS “The UnitHolder has ncicated to the Fund that he/she wishes to avail ofthe PIN eciity offered by the Fund and hasfor this purpose, Indicated to Fund thename of his/her Bank, Brarch Account Number: AND WHEREAS ‘The Fund is wiling toextend the SBIMF PIN facility tothe Unit Holderon the terms and conditions as set out herein: ‘Now THEREFORE, in consideration ofthe mutual understanding as satferth in this Agreement, the partios hereto have agreed to the following terms end concitons: ‘The SBIME PIN granted to the Unit Holder pursuant to this Agreement shall be communicated to the Unit Holder by post and centire'yat the risk of the Unit Heleer 2. The Unit Holder may use the SBIMF PIN facility in order to give telephonic instructions to the Fund regarding redemotion/ ‘switch of units as and when provided bythe Fund, 3. TheUnit Holder may also access the following services through the Internet, using the PIN faci Fund ina phased manner: ‘as and when provide by the ‘© Access to balance information |+ Ability to print Account Statements in a clientindependent standard format + Ability email service requests tothe Transfer Agent 4. In addition to the information and services mentioned above, the Unit Holder may also, as and when such facilty is made ‘valable by the Fund, use the SGIMF PIN in order to give transaction instructions to the Fund through the Internet, by emall regarding purchase (provided there Is payment gate way arrangement) o- redemption of units of change of address, The telephonic instructions and information, services accessed and transaction instructions given through the Internet are hereinafter jointly referred to ac "the Instructions". ‘5. The Fund wil take best efforts to keep the Fund's web site updated on a dally basis so as to provide most current information to Unit Holders. However, the Un Holder agrees that because of communication issues, tis possible that the site may not be current on occasion. The Unit Holder also agrees that the look ond feel of the Web screen and outputs therefrom may differ basedon the nature ofthe software used by the Unit Hoder tobrowsetheske. 6. The Fund agrees to take best efforts to protact security ofthe data placed on the Internat and has for this purpose, required the webservice provider engeges by the Reghstror to signa confidentalty egreement withthe Registrar specifying conicentaity of ‘he date and to restrict external access tothe database on the Internet. ‘The Registrar shall ask the Unit Holder for his/her SBIMF FIN and Folio Number before accepting Instructions on behalf of Fund. The Fund shall not be bound to act on instructions received untl the said fax confimation ‘and.adaitional information is eceivedtrom the Unit Holder. ‘The Unit Holder shall be responsible for safekeeping of the SBIMF PIN and shall net disclose his/her SBIMF PIN to any person {and shail tae al possible care to prevent ciscovery of the SBINF PIN by any person. ‘The Unit Holder shall not use his/her PIN after the disclosure ofthe same to any third party. ‘The Unit Holder shal be fully lable to the Fund for every transection entered into using the SBINF PIN feclity, whether with or without the knowledge ofthe UnitHolder. ‘The Unit Holder hereby releases the Fund and the Registrar from any lablty whstscever against misuse of the SSIMF PIN. Further neither the Fund nor the Registrar shall be lable atal for any misuse if any, of any data placed on the Internet, by third parties hacking” or unauthorizedly accessing theserver. In the event of disclosure ofthe SBIMF PIN to any third party, the Fund may atts absolute discretion sue to the Unit Holder ‘new'S8I NFPINon these terms and conditions or under Such terms and conditions asthe Fung may demi. ‘The Unit Holder shall at all times indemnity the Fund, its officers, employees, successors and assigns from and against all actions, proceedings, claims and demancs whatsoever for or on account of or in elation to any use ofthe SBIMF PIN and from {and against al damages, costs, charges and expenses in respect thereof, unless the same Is caused by gross negligence, bad faith or willfuldefauton thepart of the Fund. ‘The Courts in Mumbaishall nave jurssiction over jdlsputes arising cut of orin respectottnis Agreement.
