County District Court ‘THE PEOPLE OF THE STATE OF COLORADO City and County of Denver, Colorado Offense Case No. 10-494972 AFFIDAVIT AND APPLICATION FOR ARREST WARRANT AND THE ARREST WARRANT FOR THE PERSON(S) OF: Mondragon, Brandon (08-21-89) For Careless Driving resulting in Injury, C.R.S, 42-4-1402 (Class 1 Misdemeanor)(2 counts); Accidents involving SBI ~ Duty, CRS. 42-4-1601 (Class 5 Felony}(2 counts); Duty to give Notice, Information and Aid, C.R.S. 42-4-1603 (Misdemeanor Traffic Offense); Duty to Report Accidents, C.R.S. 42-4-1606 (Class 2 Misdemeanor Traffic Offense) 1, Detecive Tilo Voitel 495057, the Ain, state under out thatthe facts Known tothe Aliant which eaablnv probable camo belive ‘hat «criminal offense was committe, and thatthe offense was commited bythe above named person(s), rete following Your Affiant investigated this collision at the scene and determined the following: On 10-03-2010 at about 0200 hours an unknown vehicle was heading towards I-25 on 20" Street (northwest bound) in the #2 lane and hit two pedestrians that were in the east crosswalk of the intersection with Chestnut Street, which isin the City and County of Denver, near the north curb line. According to eye witness Daniel Young the vehicie never slowed down, and was described a darker silver vehicle, possibly an SUV. Glass shards left behind at the scene, combined with the location of the area of impact and Pedestrian trave! to their areas of res, indicated that the vehicle sustained primarily windshield damage on the passenger side. Both pedestrians (~ Vand! ) sustained injuries legally defined as serious bodily injuries according to doctor’s reports from DHIMC. On 10-03-2010 at about 1549 hours Arvada PD Officer Thomton #0021 responded to a call of a suspicious vehicle with a windshield smashed out. Officer Thornton found the vehicle in question parked and unoccupied in the 7700 block of W. 54° Avenue, Officer Thorton believed that the damage was from some type of collision rather than vandalism so she collected fiber evidence and took photos of the vehicle while attempting to contact the registered owner. No contact was made at this time so the vehicle was lef at its current location, parked in the street, Officer Thomnton passed along information about her investigation to the DPD concerning this vehicle after a news story about the collision was aired, several hours after she responded to the call concerning the vehicle. On 10-04-2010 at about 0230 hours Your Affiant went to the 7700 block of W. 54" Avenue to look at the vehicle, but it was no longer at this location. At about 0430 hours the vehicle was located in the 3000 block of W. 92" Avenue, Westininster Colorado, This is the same block that the registered ‘owner resides, DPD Officer Finks #06007 went to that location and verified that it had damage consistent with the damage that your Affient expected to see ftom the collision; including a smashed windshield on the passenger side (with small shards of glass inside the vehicle), and a blue material transfer (that appeared to come from clothing) near the bumper. The vehicle is a silver 2004 Chrysler PT Cruiser (CO 366VMZ), which also roughly matches the description provided by eye witness Daniel ‘Young. The registered owner of the vehicle (Brandon Mondragon) was contacted by phone and when asked about how the damage to his vehicle occurred he staied that he wanted to speak with his attomey prior to answering any questions. Page 2 AFFIDAVIT AND APPLICATION FOR ARREST WARRANT The vehicle was towed on October 4” 2010 from Westminster to the DPD Traffic Investigations Bureau’s secure storage indoor facility, cage #2. The vehicle was followed by Officer Fink to the cage where a Search Warrant was executed on 10-11-2010. Inside the vehicle several documents were located that ell had Brandon Mondragon’s name on them, including insurance Paperwork and a debit A person identified as Charmaine Ortiz had been in the vehicle earlier in the evening but got a ride home with another family member. Detective Kuroda #01062 conducted computer research and located information in Facebook indicating that both Valdez and Ortiz were listed as friends of Mondragon’s, Further research produced a phone number for Ortiz, Your Affiant called Onis end she agreed to give a statement at her home about her knowledge of the collision, Charmaine Oniz stated that she and Desirae Valdez were passengers in Brandon Mondragon’s PT Gite on 10-02-2010 and that Brandon Mondragon drove them all to Club Beta at 19° sed Market at about 2230 hours. Ortiz did nat remember much else about the rest of the evening and official records Hrove that she was not withthe suspect at the time of the collision, n the evening hours of 10-03-21) she spoke with Mondragon by phone and he admitted to driving his ear and hitting something but not Peing sure what it was. Ortiz also spoke with Valdez by phone and she also stated that Mondragon had been driving when they hit something and he kept going because he panicked Afer the interview with Ortiz. was completed Desirae Valdez was contacted at her home.
