This is my answer to that question given by our professor in criminal procedure when i was in

second year. i got a ten for this answer.

"As distinguished from a criminal information, a criminal complaint is subscribed by a private party
who may either be the offended party or other persons. The accusation in the complaint is made
under oath. Also, the complaint need not be filed in court. As defined by the Rules of Court, a
complaint is a sworn written statement charging a person with an offense, subscribed by the
offended party, or any peace office, or other public officer charged with the enforcement of the
law violated.

"An information, on the other hand, is defined as an accusation in writing charging a person with
an offense, subscribed by the prosecutor and filed with the court. It is always filed in court,
otherwise, it is not an information. Aside from that, it does not include the signature of the
private complainant. Only the prosecutor subscribes in the information."

That's it. I don't know how correct it is but Judge Leopoldo Legazpi gave me a perfect ten! He is
always a generous professor... once said that what he wants to know is how much we know and
not how much we don't know.
