Dear Mr.Osterreicher:
‘This is in response to your July 1, 2010 letter wherein you expressed concems
about the recent incident involving individuals taking photographs/video at a Miami-
Dade Transit (MDT) Metrorail Station.
‘The Miami-Dade Code does not prohibit or restrict personal photography, for non«
‘commercial, non-training or non-educational endeavors, at our public transit
facilities. However, Miami-Dade County Code 30(8) does restrict certain audio and
video activities in the MDT system, Specifically, section 30B-5 states:
‘Seo. 30B-6. - Commerciel activities.

No person, uniess authorized in writing by MDTA or the
unty Manager when appropriate under Section 2-11.14 of
this Code, shail take stil, motion, or sound motion pictures or
‘sound recoris or recordings of voices or otherwise for
‘commercial, training or educational purposes, other than news
coverage anywhere In the transit system.
Further, through the authority of MDT’s Offico of Safety and Security, any
photography that would involve any equipment other than a hand-held photo
‘camera or video camera would also require specific, written authorization. This,
‘equipment includes, but may not be limited to, tripods, cabling, etc., oF equipment
that may create a safety hazard.
‘MDT strongly supports the right of the public to photograph in the common areas of
our public facilities. However, given the threats against mass transit systems, both
domestically and abroad, and in order to protect the safety of its transit system, its
customers and its employees, MDT reserves the right to question individuals taking
Photographic images at our stations.
MDT's Office of Safety and Security is in the process of investigating the incident
‘addressed in your letter. Subsequent to its investigation, MDT's Office of Safety
and Security will present its findings to the Miami-Dade Transit Director and, if
warranted, will recommend fo the MDT contracted security's management team
that quick and immediate administrative action be taken , regarding this incident.
Im closing, MDT's Office of Safety and Security staff has reminded our security
‘contractor thet there are no prohibitions against taking photographs for purposes.
not prohibited by Miami-Dade County Code, Chapter 308, other applicable laws,
andior safety issues at our facities. MOT is taking the steps necessary to ensure
that this type of incident does not re-occur on the MDT system.Pe eer eee
